As of 1st July 2021, when a new, renewed or varied contract is signed on the Grenada North rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Failure to comply with each of Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or amended tenancy agreement there may be additional penalties or an infringement fee.
Any tenant may request details about the Healthy Homes Standard and how they relate to the property they live in. If the property manager does not supply the required information within 21 days of getting the notice, the tenant will receive an infringement notification and be fined upto $750.
Furthermore, there’s an additional fine of approximately $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the person who is listed on the tenancy agreement as the one who is leasing the property out, so it could be the name of the landlord as well as the company that manages the property.
All the information on the Statement of Compliance needs to be accurate at the time that the tenancy agreement is completed, and is updated throughout the tenancy as any necessary work related to it is finished.
It’s crucial to keep in mind that landlords who have multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved for the most serious breaches, and landlords with six or more properties could be fined as high as $50,000, and as much as $100,000 in hearings.
