Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Grenada North rental property, all Healthy Homes compliance tasks must be finished inside of 90 days.

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Grenada North rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy agreement, there could be an additional penalty or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager does not provide the required information within 21 days from getting the notice, the tenant could receive an infringement letter and be fined upto $750.

It is also crucial to note that a landlord who manage multiple rental properties may receive more severe penalties for not complying. The most severe penalties are given only for serious breaches, and landlords with more than six properties could be penalised up to $50,000, and as much as $100,000 for hearing claims.

Grenada North Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory throughout Grenada North and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or altered tenancy contract.

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Grenada North

Grenada North rental properties must have a fixed source of heat which can warm the largest or main living space to at least 18degC even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs for it to be permanent (i.e., not portable) with at least 1.5 kW in heating capacity, and it must have the minimum required heating capacity in the living area. The Heating Assessment Tool can be used to determine if the fixed heater(s) are sufficient or if you’ll need to top up by adding a second heater. Open fires and unflued combustion heaters such as the portable LPG bottle heaters are not considered acceptable heating options under those following the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump, it should include the thermostat. This will help make the heating more uniform and effective. In most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In certain situations, like small apartments, a smaller fixed electric heater may suffice.

If the living area is already equipped with a fixed heating source, like the heat pump, it might just need a top up in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the quality as they are either not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Grenada North
