Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords now have to ensure that their Wilton rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy, and all private rental properties are required to be fully in compliance by July 1st 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Wilton rental property, all Healthy Homes compliance items need to be done by the end of 90 days.

Since the 1st July of 2021, once a new or renewed lease is entered into on the Wilton rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with any of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy agreement there could be additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager is unable to provide the required information within 21 days of having received the inquiry, they can receive an infringement notice and could be fined up to $750.

Additionally, there is also a fine of approximately $900 for landlords and property managers that provide false or false Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the one who is named on the tenancy contract as the person letting the property out which could be the landlord’s name or the company that manages the property.

All information in the Compliance Statement requirements to be accurate at the time that the tenancy agreement is executed, and it should be kept updated throughout the tenancy as any necessary work related to it is finished.

It is crucial to remember that landlords who have several rental properties can face additional fines for non-compliance. The highest penalties are reserved for serious violations. Those who have more than six properties could be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Wilton and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate conformance with the Healthy Homes Standards that apply or will be applied throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Heating Wilton

Wilton rental properties must have a fixed source of heating that can heat the living space to at least 18degC, even during the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements to be fixed (i.e. not portable), at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum required heating capacity to heat the living space in general. For most homes, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in certain instances like small apartments an electric, fixed heater may be sufficient.

If the living area is already equipped with a fixed heating source, like a heat pump, then it may require a top up to be able to meet the standards. Certain types of heaters cannot be used to comply with the quality since they’re either costly, not cost-effective to run, and/or unhealthy to run.

Insulation Wilton

The insulation of the ceiling and underfloor is mandatory on all rental homes as of July 1st, 2019. All landlords and property managers have to ensure the insulation meets the new standard. In some instances, existing ceiling insulation or insulation in the sub floor space may need to be filled with or replaced.

A well-insulated property can help control condensation and lessen the likelihood of dampness and mould, and will also make it easier to the home to hold warmth.
