Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed for a Wilton rental property, all Healthy Homes compliance work need to be taken care of within 90 days.

Since the 1st July of 2021, when a new or renewed tenancy is signed on a Wilton rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included within the renewal, new or amended tenancy agreement there could be an additional penalty or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the building they are living in. If the the property manager doesn’t provide the required information within 21 days from receiving the request, they may receive an infringement notification and be fined as high as $750.

Additionally, there is also a penalty up to $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or other information. The person liable to pay this fine is the one who is named on the lease contract as the person renting the property and it could be the name of the landlord as well as the company that manages the property.

All the information on the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is completed, and is updated throughout the duration of the tenancy when any necessary work related to it is finished.

It’s important to keep in mind that landlords who have multiple rental properties may face greater penalties for non-compliance. The most severe penalties are reserved for serious breaches. Landlords with six or more properties can be penalised up to $50,000, and as much as $100,000 in hearings.

Wilton Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory for all Wilton and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to any Healthy Homes Standard that apply or will apply during the tenure of their rental properties.

From 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Wilton

Rental properties in Wilton need to have a stable heating source that can heat the largest or main living space to at least 18degC even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

In most houses, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters will be required. In certain situations, like apartments with small spaces the smaller fixed electric heater could be enough.

If the main living room is already equipped with a fixed heating source, such as an air conditioner, it might just need some additional energy in order to comply with the standards. Some types of heaters can’t be used to achieve the standard because they’re expensive, inefficient and/or unhealthy to run.

Ventilation Wilton

Each liveable space in a rental property must contain at minimum one open door or window to offer natural airflow. In addition, humid areas such as kitchens and bathrooms must have a suitable externally vented extractor fan that can get rid of moisture.

This ventilation standard is about recognising that dried air can be easier to heat and that an apartment that is well-ventilated is less likely to grow damp and mould.

Bedrooms, living rooms kitchens, and dining rooms are considered liveable spaces. Spaces that connect, such as the hallways are not liveable , and thus are not need an opening door or window.
