Fines for Failing to Comply

All information in the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed, and ideally it must be updated through the tenancy period as relevant work gets completed.

It is also crucial to keep in mind that landlords with multiple rental properties may face additional fines for non-compliance. The most severe penalties are handed down for serious breaches, and landlords with six or more properties can be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory for all Wilton and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewed, new or varied tenancy agreement.

From 1 July 2021

If your living space is already equipped with a fixed heating source like a heat pump, then it could require an upgrade to make sure it meets the requirements. Some types of heaters can’t be utilised to meet the standard since they’re either not effective, cost prohibitive to operate or unsafe to operate.
