Fines for Failing to Comply
As of 1st July 2021, once a new or renewed tenancy is signed for a Wilton rental property, all Healthy Homes compliance tasks have to be finished inside of 90 days.
From the 1st of July in 2021, when a brand new or renewed Tenancy is signed for a Wilton rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Failure to adhere to each of Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy agreement there may be an additional fine or violation fee.
Any tenant may request information regarding the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager does not supply the necessary information within 21 days from being informed of the request, they could receive an infringement notice and be fined upto $750.
Furthermore, there’s an additional fine of up to $900 for landlords and property managers who have provided a false or misleading Healthy Homes Compliance Statement or information. The person responsible for this fine is the person who is named on the lease agreement as the person who is renting the property It could also be the name of the landlord or the property management company.
The information contained in the Statement of Compliance requirements to be correct before the tenancy agreement can be signed, and ideally it must be updated during the entire tenancy, as associated work has been completed.
It is important to keep in mind that a landlord who have several rental properties can face additional fines for non-compliance. The most severe penalties are given for the most serious breaches, and landlords with six or more properties could be penalised up to $50,000, and as much as $100,000 in hearings.
