Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Wilton rental property, all Healthy Homes compliance tasks need to be completed by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed contract is signed on a Wilton rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to one of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement it could result in an additional penalty or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the property manager fails to supply the required information within 21 days of having received the inquiry, they may receive an infringement notification and be fined up to $750.

Furthermore, there’s also a fine of approximately $900 for property owners or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the person who is named on the lease agreement as the one who is letting the property out It could also be the name of the landlord or the property management company.

The information contained in the Compliance Statement requirements to be up-to-date when the tenancy contract is completed, and should be maintained through the tenancy period as related work is completed.

It is also crucial to be aware that a landlord who have several rental properties can face additional fines for non-compliance. The highest penalties are given for serious violations. Those who have at least six rental properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement in all Wilton and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be applicable during the tenancy of the rental property.

From July 1st 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

Draughts can lead to less temperature in households. A cold home costs more to heat, resulting in wasted energy and incurring higher costs.

If a draught could be felt through gaps that are too large or holes, it needs to be closed.

What are unreasonable gaps and holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a hole or gap that is, it is likely a crack or hole that needs sealing in somehow. Large gaps and cracks should be fixed permanently. Cracks that are greater than 3mm and let air into or out within your house need the sealing. For instance, if an open fireplace is not in use, it can create draughts. This must be sealed off. Landlords and property managers are accountable for making sure such draughts are eliminated in the maximum extent imaginable.

There is no need to cover up gaps or holes in the building. For example, tiny gaps around doors and windows could be necessary to allow for movement within the building as the house gets warmer and cooler, in order to let them be opened and closed rather than sticking. Heating Wilton

Wilton rental properties need to have a stable source of heating which can warm the largest or main living space to a minimum of 18degC, even during the coldest winter days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements for it to be permanent (i.e. not portable), at minimum 1.5 Kilowatts in heating capacity and have the minimum heating capacity needed to heat the living space in general. However, in certain instances like small apartments, a smaller fixed electric heater may be sufficient.

If the main living room already has a permanent heating source such as a heat pump, then it might need an upgrade to meet the standards. Certain kinds of heaters cannot be used to achieve the standard since they’re either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Wilton

Insulation Wilton

Ceiling and underfloor insulation is a requirement for all rent homes from 1 July 2019. Property managers and landlords are required to ensure that the insulation is up to the new standard. In some cases, existing ceiling insulation or insulation in the sub floor space might require to be added or replaced.
