Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed for a Wilton rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

From the 1st of July in 2021, when a brand new or renewed lease is entered into on the Wilton rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet each of Healthy Homes Standards inside of the deadlines can result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy contract, it could result in an additional penalty or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager is unable to supply the information requested within 21 days from getting the notice, the tenant may receive an infringement notice and be fined up to $750.

In addition, there is also a penalty of approximately $900 for landlords or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the one who is named on the lease contract as the person leasing the property out and it could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement requirements to be up-to-date at the time that the tenancy agreement is signed. It is updated during the entire tenancy, as relevant work gets completed.

It’s also important to note that a landlord with several rental properties can face more severe penalties for not complying. The highest penalties are reserved for serious violations, and landlords who own more than six properties could be fined up to $50,000 and as high as $100,000 in the case of hearing claims.

In the end, a failure to adhere to the Healthy Homes requirements can hit your bank account with significant fines and still being required to adhere to the regulations. Healthy homes are important

Why is Healthy Homes Compliance important?

About 1 in 3 households rent from New Zealand and Wilton, and research indicates that rental houses are likely to be older, colder, have less efficient heating, and generally have lower quality than houses that are owned by the owner.

Moldy, damp and cold houses are associated with negative health outcomes, particularly for illnesses like colds, flu, asthma and cardiovascular conditions. Furthermore, people who have reported at least four key house quality problems often experience less satisfaction in their lives and lower well-being.

Improving the standard of Wilton rental property can allow tenants to experience better mental and physical health as well as lessen disruptions to their work, education and living due to health issues. Your investment will be safeguarded from mildew, mould and damp damage, meaning less costs of maintenance over the long term.

The Healthy Homes Standard is a list of specific and minimum standards for Heating, Insulation Ventilation and Ventilation and Drainage, and Draught Stopping on Wilton rental properties.

Unreasonable Gaps & Holes

Draught Stopping Wilton

Draughts can lead to low temperatures inside houses. A cold home costs more to heat, which means wasting energy and incurring higher costs.

If a draught could be noticed from gaps that are not adequate or holes, it requirements to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air getting in, or see the air is clear from a hole or gap and you are able to feel it, it’s likely to be a gap or crack that needs sealing in the way you can. Large gaps and cracks should be fixed permanently. Gaps greater than 3mm that let air in or out into your home need seals. For instance, if an open fireplace isn’t being used, it may cause draughts and must be sealed off. Property managers and landlords are responsible for making sure that such draughts are squelched whenever possible.

You don’t require to block gaps or holes which are part of the building. For instance, small gaps around windows and doors could be required to allow movement of the building as the house is heated and cools in order to let them be opened and closed rather instead of being stuck. We will test the windows and doors in the Healthy Homes assessment of your rental property.

Adequate heaters are important for healthy houses

Heating Wilton

Wilton rental properties require a reliable source of heating which can warm the principal or the biggest living room to at least 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat requirements for it to be permanent (i.e., not portable), at minimum 1.5 kW of heating capacity and have the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool may be used to determine if the current permanent heater(s) are sufficient or if you’ll require to ‘top up’ by adding a second heater. Open fires and unflued combustion heaters such as the portable LPG bottle heaters are not considered to be safe heating options for Healthy Homes Standard. Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump, it should be equipped with an thermostat. This makes your heating more consistent and efficient. For most properties, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are needed. In some instances, like small apartment buildings the smaller fixed electric heater may suffice.

If the main living room is already equipped with a fixed heating source, such as heat pumps, it might just need a top up to ensure it meets the requirements. Certain types of heaters cannot be utilised to meet the standard as they are either expensive, inefficient and/or unsafe to run.

Wilton Moisture Ingress & Drainage

Keeping your rental property safe from moisture isn’t just about the inside it’s also about the outside. You must ensure there is somewhere for surface, rain or ground water, and prevent it from getting into the building. When it is damp and moisture, it’s frequently the concerns you don’t notice that can become a big problem, causing damage to your investment as well as harming the tenant’s health.

Rental properties must have effective drainage for the removal of rainwater, storm water, and ground water. This includes the proper outfall or runoff. Making sure the water has a proper place to go, and it doesn’t sit beneath structures is a crucial aspect of maintaining your property’s dry.

In addition to a drainage system to avoid moisture from entering, if your property has an enclosed space between your floor and the soil, a ground-water barrier must be constructed if it’s reasonably practicable to install it.

A ground moisture barrier is typically made of polythene and is laid on top of the ground, in order to block any moisture from the ground from rising into the structure. It also helps in preventing moisture damage to the underfloor insulation.
