Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed on a Wilton rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy contract, it could result in an additional fine or violation fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the property they are living in. If the the property manager doesn’t provide the necessary information within 21 days of having received the inquiry, they could receive an infringement notification and be fined as high as $750.

In addition, there’s an additional fine of as much as $900 for landlords or property managers providing a false or false Healthy Homes Compliance Statement or other information. The person who is responsible to pay this fine is the one who is named on the tenancy contract as the person leasing the property out which could be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement requirements to be current before the tenancy agreement can be signed, and ideally it must be updated during the entire tenancy, as associated work has been completed.

It’s also crucial to remember that landlords who have multiple rental properties may receive additional fines for non-compliance. The harshest penalties are handed down only for serious breaches, and landlords with six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearing claims.

When will I need to be in compliance with The Healthy Homes Standards?

Wilton Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory for all Wilton and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records of their the compliance with all Healthy Homes Standard that apply or will apply during the tenure of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a new, renewed , or altered tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

What are unreasonable gaps or holes?

If you can feel external air coming in or a clear draught from a gap or hole, then it’s probably a gap or an opening that requirements sealing in any way. Large gaps and cracks should be permanently stopped. Gaps greater than 3mm that let air into or out within the home need to be sealed. In the case of an open fireplace isn’t being used, it can create draughts. This should be shut from. Landlords and property managers are responsible for ensuring that such draughts are squelched as much as possible.

You don’t need to cover up holes or gaps which are part of the construction. For example, tiny gaps around windows and doors could be necessary to allow for movement within the structure as the house gets warmer and cooler, so that they are able to be shut and opened, rather than sticking. Proper heating is important to ensure well-being homes

Heating Wilton

Rental properties in Wilton need to have a stable heating source that can heat the living room to at least 18degC, even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source requirements to remain fixed (i.e. not portable) and at minimum 1.5 horsepower in capacity, and meet the minimum capacity for heating required in the living area. A Heating Assessment Tool may be used to determine whether your current permanent heater(s) are adequate or whether you will need to top up with a new heater. Unflued combustion and open fire heaters such as portable LPG bottle heaters are not considered to be suitable heating options for those following the Healthy Homes Standard.

If the heating system you provide is an electric heater or heat source, it should have an thermostat. This makes your heating more consistent and effective. For most properties, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In certain situations, like small apartments, a smaller fixed electric heater may suffice.

If your main living space already has a central heating source such as the heat pump, it might just need a top up to be able to meet the standards. Some types of heaters can’t be used to comply with the standard because they’re inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Wilton

Insulation Wilton

The insulation of the ceiling and underfloor has been compulsory on all rental homes since 1 July 2019. Property managers and landlords have to ensure that the insulation is in line with current standard. In certain situations, the current ceiling insulation, or the insulation of the sub floor space might need to be topped up or replaced.

A properly insulated home can reduce condensation, and decrease the risk of mould and dampness, and also makes more easy to allow the household to retain warmth.
