Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed contract is signed on a Wilton rental property, all Healthy Homes compliance items need to be finished within 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied Tenancy is signed for the Wilton rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy contract, there may be additional penalties or an infringement fee.

If the landlord or property manager is unable to supply the required information within 21 days of having received the inquiry, they could be issued an infringement notice and could be fined up to $750.

Additionally, there is also a fine of up to $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is whoever is listed on the tenancy contract as the person letting the property out and it could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be correct at the time that the tenancy agreement is executed, and it should be maintained during the entire tenancy, as associated work has been completed.

It’s crucial to keep in mind that landlords who have multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are reserved for serious breaches. Landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required to all Wilton and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with each Healthy Homes Standards that apply or will be in force to an apartment rental.

From 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Adequate heaters are crucial for healthy houses

Heating Wilton

Rental properties in Wilton must have a fixed heating source which can warm the principal or the biggest living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating requirements for it to be permanent (i.e. not portable) and at minimum 1.5 horsepower in capacity and have the minimum required heating capacity for the main living space. Fires that are open and unflued heaters, such as portable LPG bottle heaters are not considered to be acceptable heating options in those following the Healthy Homes Standard.

If the heating you offer is electric heating (or heat pump), it should have the thermostat. This will help make your heating more consistent and efficient. For the majority of homes, bigger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in certain instances like small apartments, a smaller fixed electric heater might be enough.

If the living area is already equipped with a fixed heating source, such as heat pumps, it may need a top up to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the quality because they’re expensive, inefficient or unsafe to operate.

Insulation Wilton

Ceiling and underfloor insulation is a requirement for all rent houses from 1 July 2019. All landlords and property managers have to make sure the insulation meets the new quality. In some instances, current ceiling insulation, or the insulation of the subfloor space may require to be topped up or replaced.

A well-insulated house can reduce condensation and reduce the chances of mould and dampness and also makes much easier for the house to hold the heat.

  • Zone 3 - North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 below floor R 1.3
