Did you not know that Healthy Homes Standards came into in force on July 1, 2021? The landlords are now required to ensure that their Wilton rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy, and all private rental properties are required to be fully compliant by 1 July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed for a Wilton rental property, all Healthy Homes compliance work have to be completed within 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Wilton rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet each of Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Anyone can request details regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or the property manager doesn’t supply the required information within 21 days from being informed of the request, they may receive an infringement notice and could be fined up to $750.

Additionally, there is also a penalty of up to $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is listed on the tenancy agreement as being the person letting the property out and it could be the name of the landlord as well as the property management company.

All the information on the Compliance Statement needs to be accurate when the tenancy contract is signed, and ideally it is updated throughout the duration of the tenancy when any relevant work gets completed.

It’s also crucial to keep in mind that a landlord who have multiple rental properties may receive additional fines for non-compliance. The most severe penalties are given for the most serious breaches, and landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearing claims.

When Do I need to meet The Healthy Homes Standards?

Wilton Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory in all Wilton and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records that prove conformance with each Healthy Homes Standard that apply or will apply during the tenure of your rental home.

From July 1st 2021

  • Private landlords and property managers should make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Wilton

Draughts may lead to low temperatures inside homes. A cold house will cost more to heat, which completed jobs in wasting energy and increased bills.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or a clear draught from a hole or gap and you are able to feel it, it is most likely a gap or crack that requirements sealing in any way. Cracks and gaps that are large should be sealed permanently. Gaps greater than 3mm that let air into or out into your home need the sealing. In the case of an open fireplace isn’t in use it can create draughts. This should be shut off. Landlords and property managers are responsible for ensuring such draughts are eliminated in the maximum extent possible.

You don’t need to block off holes or gaps which are part of the construction. For instance, small gaps around windows and doors might be necessary to allow movement of the structure when the household gets warmer and cooler, so that they can still be opened and closed rather than securing. The proper heating equipment is important for healthy houses

Heating Wilton

Wilton rental properties require a reliable source of heat that can heat the main or largest living space to a minimum of 18degC, even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating requirements to be fixed (i.e. not portable), at least 1.5 Kilowatts in heating capacity, and meet the minimum heating capacity needed for the main living space. A Heating Assessment Tool could be used to check if your current permanent heater(s) are sufficient or whether you will need to "top up" by adding a second heater. Fires that are open and unflued heaters like small portable LPG bottle heaters are not considered to be safe heating options under those following the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump, it must have the thermostat. This will help make the heating more consistent and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are needed. In some instances, like small apartments the smaller fixed electric heater might be enough.

If the main living room already has a permanent heating source such as a heat pump, then it may require some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to meet the standard since they’re either costly, not affordable to run, and/or unhealthy to run.

Ventilation Wilton

Each liveable space in a rental property must have at least one opening door or window to provide natural ventilation. In addition, high moisture areas such as kitchens and bathrooms need to have an venting fan outside to eliminate moisture.

All bathrooms and kitchens and every other room of your property with shower, bath or cooktop, or any other water-generating appliance will require appropriate extractor fans that can be vented to the outdoors. Insulation Wilton

Ceiling and underfloor insulation is a requirement on all rental homes from 1 July 2019. Property managers and landlords should make sure that the insulation is up to standards that are in line with the latest standard. In some cases, an existing insulation on the ceiling or in the subfloor space might require to be filled with or replaced.
