Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords are now required to ensure their Wilton rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rental properties must be completely conforming by the 1st July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on a Wilton rental property, all Healthy Homes compliance tasks need to be taken care of inside of 90 days.

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on the Wilton rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy contract, there could be an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager fails to supply the necessary information within 21 days from receiving the request, they may receive an infringement letter and be fined upto $750.

Additionally, there is also a fine of as much as $900 for landlords or property managers that provide false or incorrect Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is named on the lease agreement as being the person leasing the property out, so it could be the name of the landlord or the property management company.

The information contained in the Compliance Statement requirements to be correct before the tenancy agreement can be completed, and should be kept updated through the tenancy period as related work is completed.

It is important to note that a landlord who own multiple rental properties could face even higher fines for non-compliance. The highest penalties are handed down for the most serious violations, and landlords who own six or more properties could be fined as high as $50,000, and as much as $100,000 for hearing claims.

Wilton Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement throughout Wilton and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with any Healthy Homes Standard that apply or will apply during the tenure of an apartment rental.

From July 1st 2021

  • Property managers and private landlords have to make sure their rental properties comply to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Wilton

Draughts are a major cause of low temperatures inside households. A damp house will cost more to heat, resulting in wasted money and energy.

If a draught is noticed from gaps that are not adequate or holes, it needs to be sealed.

What are unreasonable gaps or holes?

A good heating system is important to ensure healthy homes

Heating Wilton

Wilton rental properties should have a permanent heating source that is able to heat the living area to at minimum 18degC, even during the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs for it to be permanent (i.e., not portable) with at least 1.5 kW in heating capacity, and meet the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool could be used to check if the current fix heater(s) are sufficient or whether you will require to ‘top up’ with a new heater. Open fires as well as unflued combustion heaters, such as the portable LPG bottle heaters aren’t considered acceptable heating options for The Healthy Homes Standard.

If the heating that you offer is electric heating (or heat pump), then it must include a thermostat. This will help make your heating more consistent and effective. For the majority of homes, bigger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in some cases such as small apartments small apartments, a smaller electric fixed heater might be enough.

If the living area already has a fixed heating source, like an air conditioner, it may require an update to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the quality as they are either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Wilton

Each window, door or Skylight requirements at least to open up to the outside while remaining fixed in an open position in order to allow for fresh air circulation and air flow.

The bathrooms in all kitchens and any other area in your home that has shower, bath and cooktop or another water-generating appliance will need adequate extractor fans that can be vented to the outside. Insulation Wilton

The insulation of the ceiling and underfloor has been compulsory in all rental homes since 1 July 2019. All landlords and property managers must ensure that the insulation is in line with this new quality. In some cases, an existing insulation on the ceiling or in the subfloor space may need to be filled with or replaced.

A house that is well-insulated will help to control condensation and lessen the likelihood of mould and dampness, and also makes an easier task to allow the home to retain warmth.
