Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed tenancy is signed on a Wadestown rental property, all Healthy Homes compliance items need to be done within 90 days.

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on the Wadestown rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet one of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy contract, it could result in additional penalties or an infringement fee.

The person liable for this fine is whoever is listed on the tenancy contract as the person who is letting the property It could also be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy contract is executed, and it should be kept updated throughout the tenancy as any relevant work gets completed.

It’s crucial to note that a landlord who manage multiple rental properties may receive additional fines for non-compliance. The harshest penalties are reserved only for serious violations, and landlords who own six or more properties could be fined up to $50,000, or as high as $100,000 in hearings.

Wadestown Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory for all Wadestown and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with any Healthy Homes Standard that apply or will be in force during the tenure of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords have to make sure their rental properties conform according to Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Adequate heaters are crucial for healthy homes

Heating Wadestown

Rental properties in Wadestown need to have a stable source of heat that is able to heat the largest or main living area to at minimum 18degC, even during the winter coldest days.
