Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed for a Wadestown rental property, all Healthy Homes compliance items have to be completed within 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on the Wadestown rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement there could be additional penalties or an infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager is unable to provide the information requested within 21 days of receiving the request, they may receive an infringement notice and be fined as high as $750.

Furthermore, there’s also a penalty of as much as $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or information. The person liable for this fine is the one who is named on the tenancy agreement as the person who is leasing the property out, so it could be the name of the landlord as well as the company that manages the property.

The information contained in the Statement of Compliance requirements to be accurate before the tenancy agreement can be executed, and it should be kept updated during the entire tenancy, as relevant work gets completed.

It is also crucial to be aware that landlords who have multiple rental properties may receive more severe penalties for not complying. The harshest penalties are reserved for the most serious violations. Those who have six or more properties can be fined as high as $50,000 and as high as $100,000 in hearings.

Wadestown Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory in all Wadestown and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to each Healthy Homes Standard that apply or will apply during the tenancy of your rental home.

From July 1st 2021

  • Property managers and private landlords are required to make sure their rental properties comply according to Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts are a major cause of dropping temperatures within houses. A damp home is more expensive to heat, meaning wasting money and energy.

Heating Wadestown

Wadestown rental properties must have a fixed source of heat that can warm the principal or the biggest living space to at least 18degC, even on the most coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat needs for it to be permanent (i.e. not portable), at minimum 1.5 kW in heating capacity, and it must have the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to determine if the existing permanent heater(s) are adequate or whether you will require to "top up" with an additional heater. Open fires and unflued combustion heaters, such as mobile LPG bottle heaters are not considered to be acceptable heating options for those following the Healthy Homes Standard.

If the heating you offer is an electric heater (or heat pump), it needs to have the thermostat. This will help make the heating more uniform and efficient. For most properties, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In certain situations, like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

If the living area already has a central heating source like heat pumps, it could require an update in order to comply with the standards. Certain kinds of heaters aren’t able to be utilised to meet the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Wadestown

Insulation Wadestown

Ceiling and underfloor insulation is required for all rent houses from 1 July 2019. All landlords and property managers have to make sure that the insulation is in line with this new quality.
