Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Wadestown rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

As of 1st July 2021, when a brand new, renewed or varied lease is entered into on the Wadestown rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to adhere to one of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included in an updated, renewed, or amended tenancy agreement there could be an additional fine or violation fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager is unable to supply the necessary information within 21 days of being informed of the request, they could receive an infringement letter and be fined upto $750.

Additionally, there is also a penalty of as much as $900 for property owners or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the one who is named on the tenancy agreement as being the person renting the property and it could be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance needs to be current at the time that the tenancy agreement is completed, and should be kept updated during the entire tenancy, as necessary work related to it’s finished.

It’s also important to remember that landlords who manage multiple rental properties may face greater penalties for non-compliance. The highest penalties are reserved only for serious breaches, and landlords with six or more properties could be penalised up to $50,000 and as high as $100,000 in hearing claims.

Unreasonable Gaps & Holes

Draught Stopping Wadestown

Draughts increase the likelihood of dropping temperatures within houses. A humid house is more expensive to heat, which means wasting energy and increased bills.

If a draft can be felt from unreasonable gaps or holes the area requirements to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air coming in or an unobstructed draught coming from a crack or a gap or crack, then it is likely a crack or hole which needs sealing in the way you can. Cracks or gaps with large gaps must be permanently stopped. The gaps that exceed 3mm that allow air in or out into your home require seals. For example, if an open fireplace isn’t in use it can create draughts. This must be sealed from. Property managers and landlords are accountable for ensuring that these draughts are stopped in the maximum extent possible.

There is no need to cover up holes or gaps which are part of the construction. For example, tiny gaps around windows and doors could be necessary to allow for movement of the structure when the household is heated and cools to allow them to be closed and opened rather than securing. We will inspect every window and door as part of your Healthy Homes assessment of your rental property.

Proper heating is important for well-being houses

Heating Wadestown

Rental properties in Wadestown should have a permanent source of heat that can heat the largest or main living space to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs to remain fixed (i.e., not portable), at least 1.5 Kilowatts in heating capacity, and it must have the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool could be used to determine whether your current fixed heater(s) are adequate or whether you will need to "top up" with a new heater. Fires that are open and unflued heaters, such as mobile LPG bottle heaters aren’t considered acceptable heating options for The Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump, it needs to include a thermostat. This will make the heating more reliable and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are needed. In some instances, like small apartment buildings an electric, fixed heater might be enough.

If the main living room is already equipped with a fixed heating source like an air conditioner, it might just need an upgrade to meet the standards. Certain kinds of heaters aren’t able to be used to achieve the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Wadestown

Every living space of the rental property should have at least one opening windows or an exterior door to provide natural airflow. In addition, humid areas like kitchens and bathrooms need to have an externally vented extractor fan to eliminate moisture.

This ventilation quality is all about acknowledging that dry air is less difficult to heat and an apartment that is well-ventilated is less likely to be a victim of damp and mould.

Bedrooms, living rooms kitchens, and dining rooms are considered to be liveable spaces. Connecting spaces such as the hallways are not living spaces and therefore are not need an opening door or window.

Every window, door or Skylight needs at least to open to the outside and remain fixed in an open position in order to allow the circulation of fresh air and air flow.

Bathrooms, kitchens, as well as any other space in your home that has a bath, shower or cooktop, or any other moisture-producing item will require adequate extractor fans which are vented out to the outside. Our Healthy Homes Assessment service will make sure there is sufficient ventilation throughout the living spaces, including suitable extractor fans in areas with high moisture.

Insulation Wadestown

Insulation for underfloor and ceilings is a requirement for all rent houses since July 1, 2019. Property managers and landlords have to make sure that the insulation is up to this new quality. In some instances, an existing insulation on the ceiling or in the sub floor space may require to be added or replaced.

A well-insulated house can reduce condensation, and decrease the risk of mould and damp, and will also make an easier task to the house to retain the heat.

Insulation needs to meet the R-values for your area

The "R" stands for thermal resistance, and is a measure of how well insulation can withstand heat flow. The more R-value is higher, the higher the standard of insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9 in the underfloor, 1.3
  • Zone 2 – the remainder part of North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 (underfloor R 1.3

Wadestown Moisture Ingress & Drainage

The security of your rental home from water damage isn’t only about the inside of the building but you must make sure there is somewhere for rain, surface as well as groundwater to move, and stop it from coming into the building. When it is about damp and water, it’s frequently those concerns that you aren’t aware of that can cause a lot of trouble that can cause the property to suffer and harming the tenant’s well-being.

Rental properties should have efficient drainage for the removal of rainwater, storm water, and ground water. This includes an appropriate outfall or runoff. Making sure the water has a place to go, and it doesn’t get sucked into buildings is a vital aspect of keeping your property dry.

In addition to the drainage system that will prevent the ingress of moisture, if your apartment has an enclosed gap between your floor and soil, a ground-water barrier must be installed if it is reasonably practicable to install it.

Ground moisture barriers are usually an insulating sheet of polythene laid over the ground, to block any moisture from the ground from entering the building. It also assists in preventing any damage to your underfloor insulation.
