Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for a Vogeltown rental property, all Healthy Homes compliance tasks have to be finished inside of 90 days.

As of 1st July 2021, once a new or renewed Tenancy is signed for the Vogeltown rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. Anyone can request details about the Healthy Homes Standard and how they relate to the home they live in. If the property manager fails to provide the information requested within 21 days from having received the inquiry, they may receive an infringement letter and be fined as high as $750.

In addition, there’s also a fine of approximately $900 for property owners or property managers who have provided a false or false Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is named on the tenancy agreement as the person who is renting the property, so it could be the name of the landlord, or the company that manages the property.

It is also crucial to be aware that landlords with multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for the most serious violations. Those who have six or more properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Clearly, failure to meet compliance with Healthy Homes requirements can hit your pocket and result in massive fines as well as still having to meet compliance. Don’t take a chance with your rental property, contact us today and make arrangements to have a house assessment done for your rental property.

If a draught is felt from unreasonable gaps or holes or holes, it requirements to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air coming in or a clear draught from a gap or hole and you are able to feel it, it’s likely a crack or an opening that requirements sealing in some way. Cracks and gaps that are large should be permanently stopped. Gaps greater than 3mm that allow air in or out from the home need seals. For example, if an open fireplace isn’t in use it can cause draughts and should be sealed from. Property managers and landlords are accountable for making sure that such draughts are squelched as much as possible.

You don’t need to block holes or gaps which are part of the construction. Proper heating is important for healthy homes

Heating Vogeltown

Rental properties in Vogeltown need to have a stable heating source that can heat the largest or main living room to at least 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs to remain fixed (i.e., not portable) and at least 1.5 kW of heating capacity, and must meet the minimum heating capacity needed for the main living space. The Heating Assessment Tool can be used to check if the existing permanent heater(s) are adequate or whether you will need to "top up" by adding a second heater. Unflued combustion and open fire heaters such as small portable LPG bottle heaters aren’t considered acceptable heating options under the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump, then it must have a thermostat. This will make the heating more uniform and efficient. For the majority of houses, bigger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in certain instances such as small apartments small apartments, a smaller electric fixed heater could be enough.

If your living space already has a central heating source such as the heat pump, it might require some additional energy to ensure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the standard as they are either not efficient, cost prohibitive to operate or unsafe to operate.

We offer a Healthy Homes Assessment service will ensure that there is sufficient ventilation in each livable space with the right extractor fan in areas of high moisture.

Vogeltown Moisture Ingress & Drainage

The security of your rental home from water damage isn’t only about the inside; you have to ensure there is somewhere for rain, surface as well as groundwater to move, and also stop it from getting inside. When it is damp and moisture, it is frequently those concerns that you aren’t aware of that can cause a lot of trouble, causing damage to your investment and harming the tenant’s well-being.

Rental properties should be equipped with efficient drainage to eliminate storm water, surface water and ground water. This includes an appropriate outfall or runoff. Making sure that water has a place to go, and also that it doesn’t get sucked into buildings is an essential part of keeping your property dry.

Alongside an irrigation system to stop water ingress, if the rental is enclosed between floorboards and the surface, a ground moisture barrier must be installed if it’s reasonably practicable to do so.

A ground moisture barrier is typically a sheet of polythene that is placed over the ground, to block any moisture that is present in the ground from entering the structure. It also helps prevent any damage to your underfloor insulation.
