Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on a Vogeltown rental property, all Healthy Homes compliance tasks have to be done within 90 days.

From the 1st of July in 2021, when a brand new or renewed Tenancy is signed for a Vogeltown rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to adhere to one of the Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. It’s crucial to be aware that landlords who own multiple rental properties may receive greater penalties for non-compliance. The highest penalties are reserved for serious violations, and landlords who own at least six rental properties could be fined up to $50,000, or as high as $100,000 for hearing claims.

Vogeltown Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required for all Vogeltown and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with any Healthy Homes Standard that apply or will be in force during the tenure of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers are required to make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Heating Vogeltown

Rental properties in Vogeltown must have a fixed source of heat that is able to heat the living space to a minimum of 18degC even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to be fixed (i.e., not portable), at least 1.5 Kilowatts in heating capacity, and meet the minimum capacity for heating required for the main living space. In some instances, like small apartment buildings, a smaller fixed electric heater may suffice.

If your living space is already equipped with a fixed heating source like a heat pump, then it may require an update to meet the standards. Certain kinds of heaters aren’t able to be used to achieve the standard as they are either costly, not cost-effective to run, and/or unsafe to run.
