Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Te Marua rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

From the 1st of July in 2021, when a brand new or renewed Tenancy is signed for the Te Marua rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet any of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager fails to provide the information requested within 21 days of having received the inquiry, they could receive an infringement notice and be fined up to $750.

In addition, there’s also a fine of up to $900 for landlords and property managers that provide false or inaccurate Healthy Homes Compliance Statement or other information. The person who is responsible to pay this fine is the one who is listed on the tenancy contract as the person leasing the property out, so it could be the name of the landlord or the property management company.

All information in the Statement of Compliance requirements to be current before the tenancy agreement can be signed, and ideally it should be maintained throughout the duration of the tenancy when any necessary work related to it’s finished.

It’s crucial to remember that a landlord who have multiple rental properties may face even higher fines for non-compliance. The most severe penalties are given for serious breaches, and landlords with at least six rental properties could be fined up to $50,000, or as high as $100,000 for hearing claims.

When should I need to be in compliance with The Healthy Homes Standards?

Te Marua Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory throughout Te Marua and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their compliance with all Healthy Homes Standard that apply or will be applicable during the tenancy of an apartment rental.

From July 1st 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a new, renewed , or altered Tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts increase the likelihood of less temperature in homes. A cold home costs more to heat, which means wasting energy and increased bills.

What are unjustifiable gaps or holes?

If you are able to feel external air getting in, or see an unobstructed draught coming from a gap or hole or crack, then it is likely a crack or crack that requirements sealing in some way. Cracks or gaps with large gaps must be fixed permanently. Any gaps greater than 3mm that let air into or out from the house need the sealing. Heating Te Marua

Te Marua rental properties should have a permanent source of heating that can warm the living room to at least 18degC even on the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source requirements to remain fixed (i.e. not portable) and at minimum 1.5 Kilowatts in heating capacity, and meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool may be used to determine whether the fix heater(s) are sufficient or if you’ll need to ‘top up’ with an additional heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters aren’t considered to be acceptable heating options in those following the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, then it must be equipped with a thermostat. This will help make the heating more reliable and efficient. For most houses, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in some cases like small apartments the smaller fixed electric heater may be sufficient.

If the main living room already has a fixed heating source such as heat pumps, it might just need a top up to meet the standards. Certain types of heaters cannot be used to comply with the standard as they are either costly, not affordable to run, or unsafe to operate.

Ventilation Te Marua

Each liveable space in a rental property has to contain at minimum one open door or window to provide natural ventilation. Furthermore, moist areas such as kitchens and bathrooms need to have an externally vented extractor fan to get rid of moisture.

Insulation Te Marua

Ceiling and underfloor insulation is required to all rental houses since 1 July 2019. Property managers and landlords must make sure that the insulation is up to the new standard. In some cases, an existing insulation on the ceiling or in the sub floor space may require to be replaced or replaced.
