Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Te Marua rental property, all Healthy Homes compliance work need to be completed within 90 days.

Since the 1st July of 2021, once a new or renewed Tenancy is signed for the Te Marua rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if a existing Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy agreement there may be an additional fine or violation fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the property manager does not provide the required information within 21 days from receiving the request, they could be issued an infringement notice and could be fined up to $750.

When do I require to be in compliance with requirements of the Healthy Homes Standards?

Te Marua Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement throughout Te Marua and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with each Healthy Homes Standards that apply or will be applicable to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

  • All houses let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

What are unreasonable gaps or holes?

If you can feel external air flowing in or an unobstructed draught coming out of a hole or gap or crack, then it’s likely to be a gap or hole that requirements sealing in somehow. Cracks or gaps with large gaps must be sealed permanently. Any gaps greater than 3mm that allow air to enter or exit within your house need sealing. For instance, if an open fireplace is not in use, it could cause draughts, and should be blocked from. Landlords and property managers are responsible for ensuring such draughts are eliminated in the maximum extent imaginable.

You don’t need to block up intentional holes or gaps which are part of the building. For instance, small gaps around windows and doors could be necessary to allow for movement within the building when the house gets warmer and cooler, so that they can still be opened and closed rather than sticking. Heating Te Marua

Rental properties in Te Marua require a reliable source of heating that can warm the living space to at least 18degC, even on the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs to be fixed (i.e., not portable) that is, at minimum 1.5 horsepower in capacity and have the minimum required heating capacity for the main living space. A Heating Assessment Tool can be used to check if the current installed heater(s) are adequate or if you’ll need to top up by adding a second heater. Fires that are open and unflued heaters such as portable LPG bottle heaters aren’t considered to be acceptable heating options for those following the Healthy Homes Standard.

If the heating you offer is electric heating (or heat pump), it must be equipped with a thermostat. This makes your heating more consistent and effective. For most properties, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in some cases like apartments with small spaces the smaller fixed electric heater might be enough.

If the living area already has a fixed heating source, like the heat pump, it could require an update to meet the standards. Some types of heaters can’t be used to comply with the standard since they’re either costly, not cost-effective to run, and/or unhealthy to run.

Ventilation Te Marua
