Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Te Marua rental property, all Healthy Homes compliance work have to be finished inside of 90 days.

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Te Marua rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the deadlines can result in an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy contract, there could be an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or the property manager doesn’t supply the information requested within 21 days from receiving the request, they will receive an infringement letter and be fined as high as $750.

In addition, there is an additional fine of as much as $900 for landlords or property managers providing a false or misleading Healthy Homes Compliance Statement or other information. The person liable for this fine is the one who is named on the lease agreement as the person who is renting the property It could also be the landlord’s name or the company that manages the property.

All the information on the Statement of Compliance needs to be current before the tenancy agreement can be signed. It is updated throughout the tenancy as any associated work has been completed.

It’s important to remember that a landlord who manage several rental properties can face even higher fines for non-compliance. The highest penalties are handed down for severe violations, and landlords who own at least six rental properties could be fined as high as $50,000, or as high as $100,000 in hearings.

Te Marua Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory for all Te Marua and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records of their the conformance to each Healthy Homes Standard that apply or will be applicable to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties conform according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Te Marua

Draughts can lead to low temperatures inside households. A cold house costs more to heat, meaning wasting energy and increased bills.

If a draft can be noticed from gaps that are not adequate or holes that it requirements to be closed.

What are the most unreasonable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a hole or gap or crack, then it’s likely a crack or hole that requirements sealing in somehow. Cracks and gaps that are large should be sealed permanently. Gaps greater than 3mm that allow air in or out from your house require sealing. In the case of an open fireplace is not in use, it can cause draughts and must be sealed off. Landlords and property managers are accountable for making sure that these draughts are stopped in the maximum extent imaginable.

There is no need to block gaps or holes in the construction. For example, tiny gaps around windows and doors could be necessary to allow for the movement of the structure as the home heats and cools, so that they can still be opened and closed rather instead of being stuck. Heating Te Marua

Rental properties in Te Marua must have a fixed heating source that can warm the living space to at least 18degC, even during the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source requirements that it be permanently fixed (i.e. not portable) with at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed for the main living room. The Heating Assessment Tool can be used to check if the current fixed heater(s) are adequate or whether you will require to "top up" with a new heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters aren’t considered to be suitable heating options in the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump then it must include a thermostat. This will help make your heating more consistent and efficient. For most houses, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are required. In some instances, like apartments with small spaces small apartments, a smaller electric fixed heater might be enough.

If the living area already has a permanent heating source such as the heat pump, it might just require an update to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the standard since they’re either costly, not cost-effective to run, and/or unhealthy to run.

Insulation Te Marua

Ceiling and underfloor insulation is a requirement to all rental homes since July 1, 2019. All landlords and property managers are required to ensure that the insulation is in line with this new quality. In some instances, existing ceiling insulation or insulation in the subfloor space might require to be replaced or replaced.
