Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Te Marua rental property, all Healthy Homes compliance items must be done by the end of 90 days.

Since the 1st July of 2021, when a new or renewed Tenancy is signed for a Te Marua rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet all of the Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy agreement there may be an additional fine or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they live in. If the property manager is unable to supply the required information within 21 days from having received the inquiry, they can receive an infringement notification and be fined as high as $750.

Additionally, there is also a penalty approximately $900 for landlords and property managers providing a false or misleading Healthy Homes Compliance Statement or any other information. The person liable to pay this fine is the one who is named on the tenancy agreement as being the person renting the property, so it could be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance needs to be correct at the time that the tenancy agreement is completed, and is updated during the entire tenancy, as relevant work gets completed.

It is also crucial to remember that landlords who have multiple rental properties may face additional fines for non-compliance. The highest penalties are given for the most serious violations, and landlords who own at least six rental properties could be fined up to $50,000 and as high as $100,000 in hearings.

Te Marua Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory throughout Te Marua and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate compliance with the Healthy Homes Standard that apply or will apply to an apartment rental.

From 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.

Draught Stopping Te Marua

Draughts can lead to lower temperatures in households. A humid home costs more to heat, meaning wasting energy and incurring higher costs.

If a draught is felt through gaps that are too large or holes that it requirements to be closed.

What are unreasonable gaps and holes?

If you are able to feel external air getting in, or see a clear draught from a gap or hole, then it’s most likely a gap or an opening that needs sealing in some way. Cracks or gaps with large gaps must be permanently stopped. Any gaps greater than 3mm that allow air to enter or exit within the home require sealing. For instance, if an open fireplace is not in use, it may cause draughts and should be shut from. Property managers and landlords are responsible for ensuring that such draughts are squelched whenever imaginable.

There is no need to block up intentional holes or gaps which are part of the construction. For instance, small gaps around windows and doors could be required to allow for movement of the structure as the house warms and cools so that they are able to be closed and opened instead of than being stuck. Heating Te Marua

Rental properties in Te Marua need to have a stable heating source that can warm the main or largest living area to at minimum 18degC even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source requirements that it be permanently fixed (i.e., not portable), at minimum 1.5 horsepower in capacity and have the minimum requirement for heat capacity for the main living room. The Heating Assessment Tool can be used to check if your current installed heater(s) are sufficient or if you’ll require to "top up" with an additional heater. Open fires as well as unflued combustion heaters such as mobile LPG bottle heaters are not considered to be suitable heating options for the Healthy Homes Standard.

If the heating you provide is an electric heater (or heat pump), it needs to have the thermostat. This makes your heating more consistent and efficient. For most properties, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in certain instances like small apartment buildings an electric, fixed heater could be enough.

Certain kinds of heaters cannot be used to comply with the quality as they are either not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Te Marua

Every living space in a rental property has to have at least one openable door or window to offer natural airflow. In addition, high moisture areas such as kitchens and bathrooms should have an externally vented extractor to eliminate moisture.

Insulation Te Marua

Ceiling and underfloor insulation is mandatory to all rental houses since 1 July 2019. Property managers and landlords have to make sure the insulation meets this new quality.
