Rental Property Healthy Homes Fines
Fines for Failing to Comply
From the 1st of July in 2021, when a brand new or renewed contract is signed on a Te Marua rental property, all Healthy Homes compliance items have to be finished inside of 90 days.
Beginning on July 1st, 2021, if a new or renewed lease is entered into on a Te Marua rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Inability to adhere to one of the Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy agreement, there could be an additional penalty or infringement fee.
Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager does not provide the necessary information within 21 days of getting the notice, the tenant will receive an infringement notification and be fined as high as $750.
Furthermore, there’s also a fine of up to $900 for landlords or property managers providing a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the person who is named on the tenancy agreement as the one who is leasing the property out and it could be the landlord’s name or the company that manages the property.
All the information on the Statement of Compliance requirements to be up-to-date when the tenancy contract is signed. It is updated through the tenancy period as associated work has been completed.
It’s also crucial to remember that a landlord with multiple rental properties could face even higher fines for non-compliance. The most severe penalties are handed down only for serious violations, and landlords who own six or more properties can receive fines of up to $50,000, and even as high as $100,000 in hearing claims.
In the end, a failure to meet your Healthy Homes requirements can hit your pocket and result in huge fines, in addition to still being required to adhere to the regulations. Don’t risk your rental property, contact us today and ask us to conduct an home evaluation performed on your rental property.
