Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed contract is signed on a Te Marua rental property, all Healthy Homes compliance items have to be completed by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on the Te Marua rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement there could be an additional fine or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the the property manager doesn’t provide the information requested within 21 days from getting the notice, the tenant could be issued an infringement notice and be fined as high as $750.

Additionally, there is an additional fine of approximately $900 for property owners or property managers that provide false or false Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the one who is named on the tenancy agreement as being the person leasing the property out which could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be current when the tenancy contract is signed. It is updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It’s crucial to keep in mind that landlords who own multiple rental properties may face even higher fines for non-compliance. The harshest penalties are reserved for severe violations, and landlords who own at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

Te Marua Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory throughout Te Marua and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with each Healthy Homes Standard that apply or will be in force to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform with the Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Te Marua

Draughts can lead to lower temperatures in homes. A cold home costs more to heat, which means wasting energy and resulting in higher bills.

If a draft can be felt from unreasonable gaps or holes, it needs to be sealed.

What are unreasonable gaps and holes?

If you can feel external air getting in, or see an unobstructed draught coming out of a hole or gap that is, it is likely a crack or hole that requirements sealing in any way. Large gaps and cracks should be stopped permanently. The gaps that exceed 3mm that allow air to enter or exit into your house need to be sealed. For instance, if an open fireplace isn’t being used, it can cause draughts and must be sealed from. Property managers and landlords are accountable for ensuring such draughts are eliminated as much as possible.

You don’t need to block off gaps or holes which are part of the construction. For instance, small gaps around windows and doors may be required to allow for movement within the structure when the household warms and cools so that they are able to be opened and closed rather than securing. A good heating system is crucial for healthy homes

Heating Te Marua

Rental properties in Te Marua need to have a stable source of heating that can warm the principal or the biggest living space to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source needs that it be permanently fixed (i.e., not portable), at least 1.5 kW in heating capacity, and must meet the minimum capacity for heating required to heat the living space in general. Ventilation Te Marua
