Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed on a Te Marua rental property, all Healthy Homes compliance items need to be completed within 90 days.

Since the 1st July of 2021, once a new, renewed or varied contract is signed on the Te Marua rental property, all Healthy Homes compliance work must be done within 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t included within the renewal, new or amended tenancy agreement there may be an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager is unable to provide the necessary information within 21 days from having received the inquiry, they can receive an infringement notice and could be fined up to $750.

Furthermore, there’s an additional fine of approximately $900 for landlords and property managers providing a false or false Healthy Homes Compliance Statement or other information. The person liable to pay this fine is the one who is named on the tenancy contract as the person renting the property which could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance requirements to be current when the tenancy contract is signed, and ideally it should be maintained through the tenancy period as related work is completed.

It’s also important to keep in mind that a landlord who have multiple rental properties could face even higher fines for non-compliance. The most severe penalties are reserved only for serious violations. Those who have at least six rental properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

When Do I require to be in compliance with The Healthy Homes Standards?

Te Marua Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is compulsory for all Te Marua and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records of their the conformance to any Healthy Homes Standards that apply or will be applicable during the tenure of your rental home.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform with the Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Te Marua

Draughts can lead to dropping temperatures within households. A humid house will cost more to heat, which results in wasting money and energy.

A good heating system is important to ensure healthy houses

Heating Te Marua

Rental properties in Te Marua must have a fixed source of heat which can warm the living space to at least 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating requirements to be fixed (i.e. not portable) and at least 1.5 kW in heating capacity, and meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool could be used to check if your current permanent heater(s) are sufficient or if you’ll require to ‘top up’ with a new heater. Open fires as well as unflued combustion heaters, such as mobile LPG bottle heaters are not considered acceptable heating options in those following the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump, it needs to be equipped with a thermostat. This makes the heating more reliable and effective. For most properties, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In some instances, such as small apartments the smaller fixed electric heater may be sufficient.

If your living space already has a central heating source such as the heat pump, it may require an upgrade in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the quality as they are either expensive, inefficient and/or unsafe to run.

Ventilation Te Marua

Each living space within the rental property should have at least one opening doors or windows to offer natural airflow. In addition, high moisture areas like kitchens and bathrooms need to have an venting fan outside to get rid of moisture.

The ventilation quality is about recognising how dry air is less difficult to heat, and that a property that is well ventilated is less likely to be a victim of mould and damp.

Bedrooms, living spaces, dining rooms, and kitchens are considered to be liveable spaces. Connecting spaces like the hallway are not considered living spaces and therefore do not need an opening window or door.

Each window, door or the skylight requirements to be able to open up to the outside, but remain fixed in an open position, allowing ventilation and fresh air air flow.

The bathrooms in all kitchens and any other area in your home with a bath, shower, cooktop or other high humidity-generating items will require adequate extractor fans that vent to the outside. Insulation Te Marua

Ceiling and underfloor insulation is a requirement for all rent homes as of July 1st, 2019. Property managers and landlords must make sure that the insulation meets standards that are in line with the latest standard. In some instances, an existing insulation on the ceiling or in the subfloor space may require to be added or replaced.

A house that is well-insulated will help to control condensation and lower the chance of mould and dampness, and it will make it easier for the home to hold warmth.

Te Marua Moisture Ingress & Drainage
