Did you be aware that the Healthy Homes Standards came into effective on July 1st, 2021? The landlords are now required to ensure their Te Marua rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy and all private rental properties are required to be completely certified by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Te Marua rental property, all Healthy Homes compliance work must be taken care of within 90 days.

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on the Te Marua rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to any of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy contract, it could result in additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to supply the necessary information within 21 days from being informed of the request, they could receive an infringement notification and be fined upto $750.

Furthermore, there’s also a penalty approximately $900 for landlords or property managers providing a false or false Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is identified on the tenancy contract as the person leasing the property out and it could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is executed, and it must be updated through the tenancy period as associated work has been completed.

It’s also crucial to keep in mind that landlords who have multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are reserved only for serious breaches, and landlords with at least six rental properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.

Te Marua Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is mandatory in all Te Marua and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the compliance with the Healthy Homes Standards that apply or will be applied to their rental properties.

From July 1st 2021

  • Property managers and private landlords are required to ensure their rental properties conform with the Healthy Homes Standards within 90 days of a new, renewed or varied tenant.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Te Marua

Rental properties in Te Marua need to have a stable heating source that is able to heat the largest or main living space to at least 18degC, even on the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements for it to be permanent (i.e. not portable) and at minimum 1.5 kW of heating capacity, and must meet the minimum capacity for heating required in the living area. If the heating system you offer is electric heating or heat source, it requirements to include an thermostat. This will make your heating more consistent and efficient. In most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In certain situations, like small apartments an electric, fixed heater may suffice.

If the main living room already has a permanent heating source, such as heat pumps, it could need an upgrade to be able to meet the standards. Insulation Te Marua

Insulation for underfloor and ceilings is required on all rental houses since July 1, 2019. Property managers and landlords should make sure that the insulation is in line with this new quality. In some instances, existing ceiling insulation or insulation in the sub floor space might need to be added or replaced.
