Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for a Te Marua rental property, all Healthy Homes compliance items must be completed within 90 days.

As of 1st July 2021, when a new or renewed contract is signed on a Te Marua rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet all of the Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy contract, there may be additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or the property manager doesn’t supply the information requested within 21 days of having received the inquiry, they can receive an infringement notice and be fined up to $750.

Furthermore, there’s also a fine of approximately $900 for property owners or property managers providing a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is listed on the tenancy agreement as the person who is renting the property It could also be the landlord’s name or the property management company.

The information contained in the Compliance Statement requirements to be up-to-date before the tenancy agreement can be signed, and ideally it should be kept updated throughout the tenancy as any necessary work related to it’s finished.

It is also crucial to remember that landlords who manage multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for the most serious violations, and landlords who own at least six rental properties could be penalised up to $50,000, or as high as $100,000 in hearings.

Te Marua Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement for all Te Marua and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate conformance with each Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenant.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Te Marua

Draughts increase the likelihood of low temperatures inside houses. A humid home will cost more to heat, which results in wasting energy and resulting in higher bills.

Heating Te Marua

Rental properties in Te Marua need to have a stable heating source that can warm the main or largest living space to at least 18degC even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs to be fixed (i.e. not portable) that is, at minimum 1.5 kW in heating capacity and have the minimum capacity for heating required to heat the living space in general. A Heating Assessment Tool could be used to determine if the fixed heater(s) are adequate or whether you will require to "top up" with an additional heater. Unflued combustion and open fire heaters like small portable LPG bottle heaters are not considered acceptable heating options under the Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump it must have a thermostat. This will help make the heating more reliable and effective. For most properties, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in certain instances like small apartments the smaller fixed electric heater may suffice.

If the living area already has a central heating source like an air conditioner, it may need some additional energy to make sure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the standard since they’re either costly, not affordable to run, or unsafe to operate.

Ventilation Te Marua

Insulation Te Marua

Insulation for underfloor and ceilings is a requirement for all rent homes since 1 July 2019. All landlords and property managers must ensure that the insulation meets the new quality. In some cases, an existing insulation on the ceiling or in the sub floor space may need to be added or replaced.

A well-insulated house will reduce the risk of condensation and lower the chance of mould and damp, as well as making much easier to the house to keep heat.

Te Marua Moisture Ingress & Drainage
