Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed for a Te Marua rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

As of 1st July 2021, once a new or renewed tenancy is signed on the Te Marua rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with any of the Healthy Homes Standards inside of the period of time expected can lead to an amount of $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not incorporated in a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager is unable to provide the information requested within 21 days from having received the inquiry, they can receive an infringement notice and be fined upto $750.

In addition, there’s also a penalty of approximately $900 for landlords or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person responsible for this fine is the person who is identified on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord as well as the property management company.

All information in the Statement of Compliance needs to be current when the tenancy agreement is signed, and ideally it should be maintained throughout the tenancy as any relevant work gets completed.

It’s also important to be aware that landlords who manage several rental properties can face even higher fines for non-compliance. The highest penalties are given for serious violations, and landlords who own at least six rental properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Te Marua Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is required to all Te Marua and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records that prove the compliance with each Healthy Homes Standards that apply or will be applicable during the tenure of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply to the Healthy Homes Standards within 90 days of any renewal, new or a change in tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts are a major cause of lower temperatures in houses. A cold house will cost more to heat, meaning wasting energy and incurring higher costs.

If a draught is felt through gaps that are too large or holes, it needs to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or an unobstructed draught coming out of a hole or gap and you are able to feel it, it is likely a crack or an opening that requirements sealing in somehow. Large gaps and cracks should be fixed permanently. The gaps that exceed 3mm that allow air in or out into your home require sealing. For instance, if an open fireplace isn’t used it may cause draughts and should be sealed from. Landlords and property managers are responsible for making sure that such draughts are squelched as far as possible.

You don’t require to block up intentional holes or gaps which are part of the construction. For example, tiny gaps around windows and doors might be necessary to allow for movement of the structure when the home is heated and cools so that they can still be opened and closed rather than sticking. Heating Te Marua

Te Marua rental properties need to have a stable source of heat which can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs to be fixed (i.e., not portable) that is, at least 1.5 kW of heating capacity, and meet the minimum capacity for heating required for the main living space.
