Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Te Marua rental property, all Healthy Homes compliance items have to be taken care of by the end of 90 days.

Te Marua Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory to all Te Marua and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the compliance with each Healthy Homes Standards that apply or will be applied to your rental home.

Beginning 1 July 2021

Heating Te Marua

Te Marua rental properties need to have a stable heating source which can warm the largest or main living space to at least 18degC even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat needs to remain fixed (i.e., not portable) with at minimum 1.5 kW in heating capacity and have the minimum heating capacity needed for the main living room. A Heating Assessment Tool could be used to determine whether the permanent heater(s) are sufficient or if you’ll need to top up with a new heater. If the heating that you provide is an electric heater or heat pump, it needs to include a thermostat. This will help make the heating more consistent and efficient. In most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in some cases like apartments with small spaces an electric, fixed heater may suffice.

If the main living room already has a fixed heating source, such as an air conditioner, it could require an update in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the quality since they’re either expensive, inefficient or are unsafe to operate.

Ceiling and underfloor insulation is required in all rental homes as of July 1st, 2019. All landlords and property managers are required to ensure that the insulation meets this new quality. In some instances, existing ceiling insulation or insulation in the sub floor space may need to be topped up or replaced.
