Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Te Marua rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

As of 1st July 2021, when a brand new, renewed or varied Tenancy is signed for the Te Marua rental property, all Healthy Homes compliance work must be done inside of 90 days.

Te Marua Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is required in all Te Marua and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to all Healthy Homes Standard that apply or will be applicable throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Te Marua

Rental properties in Te Marua must have a fixed source of heat that can warm the largest or main living area to at minimum 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs to remain fixed (i.e. not portable) and at least 1.5 kW of heating capacity and have the minimum heating capacity needed in the living area. A Heating Assessment Tool can be used to determine if your current fixed heater(s) are adequate or whether you will need to ‘top up’ with a new heater. Unflued combustion and open fire heaters such as small portable LPG bottle heaters are not considered to be safe heating options for The Healthy Homes Standard.

If the heating that you provide is an electric heater (or heat pump), it should have the thermostat. This makes your heating more consistent and efficient. For most properties, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in some cases like small apartment buildings, a smaller fixed electric heater might be enough.

If your living space is already equipped with a fixed heating source, such as a heat pump, then it might just require an upgrade to meet the standards. Certain kinds of heaters aren’t able to be utilised to meet the standard as they are either not efficient, cost prohibitive to operate or unsafe to operate.
