Fines for Failing to Comply

It’s crucial to note that a landlord who own multiple rental properties may face even higher fines for non-compliance. The most severe penalties are given only for serious breaches, and landlords with six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearings.

Tenancies signed between 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory in all Takapuwahia and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with all Healthy Homes Standard that apply or will be applied throughout the tenancy period of your rental home.

From July 1st 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.
