Fines for Failing to Comply
As of 1st July 2021, if a new, renewed or varied contract is signed on a Takapuwahia rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.
Beginning on July 1st, 2021, when a new, renewed or varied lease is entered into on the Takapuwahia rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Failure to meet one of the Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement, it could result in an additional fine or infringement fee.
Anyone can request information regarding the Healthy Homes Standard and how they relate to the building they are living in. If the property manager is unable to supply the information requested within 21 days of receiving the request, they can receive an infringement notification and could be fined up to $750.
Additionally, there is also a penalty of approximately $900 for landlords or property managers who offer a false or misleading Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is the one who is listed on the tenancy agreement as the person who is renting the property which could be the name of the landlord, or the company that manages the property.
All information in the Compliance Statement needs to be current when the tenancy contract is signed, and ideally it should be kept updated throughout the duration of the tenancy when any necessary work related to it’s finished.
It’s important to remember that a landlord who own several rental properties can face more severe penalties for not complying. The most severe penalties are reserved for the most serious violations, and landlords who own more than six properties could be fined up to $50,000, and as much as $100,000 in the case of hearing claims.
