Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed on a Takapuwahia rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

From the 1st of July in 2021, once a new or renewed lease is entered into on a Takapuwahia rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the property they are living in. If the the property manager doesn’t provide the necessary information within 21 days from having received the inquiry, they could receive an infringement notification and be fined up to $750.

Additionally, there is an additional fine of up to $900 for landlords or property managers who provide a false or incorrect Healthy Homes Statement of Compliance or other information. The person liable to pay this fine is the one who is named on the tenancy agreement as the one who is leasing the property out, so it could be the landlord’s name or the company that manages the property.

All information in the Statement of Compliance requirements to be current at the time that the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It is crucial to note that a landlord who have multiple rental properties could face additional fines for non-compliance. The most severe penalties are given for severe breaches, and landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Takapuwahia Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory to all Takapuwahia and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove the conformance to all Healthy Homes Standard that apply or will be in force during the tenancy of an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords have to ensure their rental properties comply with the Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts can lead to low temperatures inside houses. A damp home is more expensive to heat, meaning wasting money and energy.

If a draft can be felt from unreasonable gaps or holes, it needs to be sealed.

What are unjustifiable gaps or holes?

If you can feel external air entering or an unobstructed draught coming from a crack or a gap and you are able to feel it, it is probably a gap or an opening that requirements sealing in somehow. Large cracks and gaps should be sealed permanently. Gaps greater than 3mm that allow air in or out into the house require the sealing. For example, if an open fireplace isn’t used it can cause draughts and should be sealed from. Landlords and property managers are responsible for ensuring that draughts from the fireplace are removed as much as possible.

There is no need to block up intentional holes or gaps that are part of the building. For example, tiny gaps around doors and windows could be required to allow for the movement of the building as the house is heated and cools so that they can still be shut and opened, rather instead of being stuck. Heating Takapuwahia

Takapuwahia rental properties should have a permanent heating source that can warm the largest or main living room to at least 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs for it to be permanent (i.e., not portable) and at minimum 1.5 horsepower in capacity, and it must have the minimum capacity for heating required in the living area. If the heating that you offer is electric heating (or heat pump), it must include a thermostat. This will make the heating more consistent and efficient. For most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in certain instances like small apartment buildings an electric, fixed heater may suffice.

If your living space already has a permanent heating source such as a heat pump, then it may need a top up to make sure it meets the requirements. Certain types of heaters cannot be used to achieve the quality as they are either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Takapuwahia

Every living space of a rental property must include at least one open window or exterior door to provide natural airflow. In addition, humid areas like kitchens and bathrooms must have a suitable venting fan outside to remove moisture.
