Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on a Strathmore Park rental property, all Healthy Homes compliance items have to be taken care of by the end of 90 days.

As of 1st July 2021, when a brand new, renewed or varied contract is signed on the Strathmore Park rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet one of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement, there may be an additional fine or violation fee.

Any tenant can ask for details about the Healthy Homes Standard and how they are related to the house they reside in. If the property manager is unable to supply the information requested within 21 days from receiving the request, they can receive an infringement notification and be fined up to $750.

In addition, there’s an additional fine of up to $900 for landlords and property managers that provide false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is whoever is named on the lease agreement as the one who is leasing the property out and it could be the name of the landlord or the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is executed, and it should be maintained through the tenancy period as related work is completed.

It’s also crucial to note that landlords who manage multiple rental properties could face even higher fines for non-compliance. The harshest penalties are handed down for severe breaches. Landlords with more than six properties could receive fines of up to $50,000, and even as high as $100,000 in hearing claims.

Clearly, failure to comply with the Healthy Homes requirements can hit your bank account resulting in significant fines and still having to meet compliance. Don’t risk your rental property, contact us today and request an home assessment done for your rental property.

Unreasonable Gaps & Holes

Draught Stopping Strathmore Park

Draughts are a major cause of less temperature in households. A cold home costs more to heat, which means wasting energy and incurring higher costs.

If a draught could be perceived as a result of gaps or holes, it needs to be sealed.

What are unreasonable gaps and holes?

If you are able to feel external air entering or the sound of a clear draught emanating from a crack or a gap or crack, then it is probably a gap or hole that needs sealing in the way you can. Cracks or gaps with large gaps must be permanently stopped. The gaps that exceed 3mm that allow air to enter or exit within the house require sealing. For example, if the open fireplace isn’t being used, it may cause draughts and should be sealed off. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed whenever possible.

There is no need to cover up holes or gaps in the building. For instance, small gaps around doors and windows could be necessary to allow for the movement of the structure when the home heats and cools, to allow them to be opened and closed rather than sticking. We will check all windows and doors during the Healthy Homes assessment of your rental property.

A good heating system is crucial to ensure healthy homes

Heating Strathmore Park

Strathmore Park rental properties need to have a stable source of heat that is able to heat the main or largest living space to a minimum of 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source requirements that it be permanently fixed (i.e., not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed for the main living space. A Heating Assessment Tool can be used to check if the existing fixed heater(s) are sufficient or whether you will require to top up by adding a second heater. Open fires as well as unflued combustion heaters like mobile LPG bottle heaters aren’t considered to be suitable heating options for The Healthy Homes Standard.

If the heating you provide is an electric heater (or heat pump), it should have a thermostat. This will help make the heating more consistent and effective. In most homes, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in some cases like apartments with small spaces, a smaller fixed electric heater may be sufficient.

If your main living space is already equipped with a fixed heating source like a heat pump, then it might need a top up to be able to meet the standards. Some types of heaters can’t be utilised to meet the standard as they are either not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Strathmore Park

Every living space in a rental property has to have at least one opening doors or windows to provide natural airflow. Additionally, areas with high moisture spaces like kitchens and bathrooms must have a suitable externally vented extractor to eliminate moisture.

This ventilation quality is all about recognising that the dry atmosphere is less difficult to heat and a property that is well ventilated is less likely to develop damp and mould.

Living rooms, bedrooms, dining rooms, and kitchens are considered liveable spaces. Connecting spaces such as the hallway aren’t liveable and are not require an opening window or door.

Every window, door or the skylight requirements at least to open to the outside and remain closed to allow the circulation of fresh air and air flow.

All bathrooms and kitchens and every other room of your home that has a bath, shower or cooktop, or any other moisture-producing item will need proper extractor fan systems that are vented out to the outside. This Healthy Homes Assessment service will check that there is adequate ventilation in every living space that includes extractor fans that are suitable in areas of high moisture.

Insulation Strathmore Park

Insulation for underfloor and ceilings is required in all rental houses as of July 1st, 2019. Property managers and landlords should ensure that the insulation is in line with standards that are in line with the latest standard. In some instances, an existing insulation on the ceiling or in the sub floor space might need to be added or replaced.

A well-insulated property will help to control condensation and reduce the chances of mould and dampness as well as making more easy to allow the house to hold heat.

Insulation needs to meet the R-values for your area

The "R" refers to thermal resistance and it is a measurement of how well the insulation resists heat flow. The higher the R-value, the more effective the insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – all of North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 (underfloor R 1.3

Strathmore Park Moisture Ingress & Drainage

Protecting your rental property from water damage isn’t only about the inside; you have to make sure there is somewhere for surface as well as groundwater to move and stop it from coming into the building. When it is about damp and water, it is frequently what you don’t see that can cause a lot of trouble, causing damage to your investment and harming your tenant’s health.

Rental properties require to be equipped with efficient drainage to remove floodwaters, surface water and ground water, which includes an appropriate runoff or outfall. Making sure that the water has a place to go, and it doesn’t get sucked into structures is an crucial aspect of maintaining your property’s dry.

Alongside a drainage system to prevent the ingress of moisture, if your rental is enclosed between the floor and ground, a ground moisture barrier must be constructed if it’s reasonably practicable to install it.

The ground-moisture barrier typically made of polythene and is laid on top of the ground to prevent any moisture in the ground from accumulating into the structure. It also assists in preventing water damage to the floor insulation.
