Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed on a Silverstream rental property, all Healthy Homes compliance items have to be finished inside of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied Tenancy is signed for a Silverstream rental property, all Healthy Homes compliance work must be finished inside of 90 days.

All information in the Statement of Compliance needs to be correct before the tenancy agreement can be executed, and it is updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It is also important to remember that landlords who own several rental properties can face even higher fines for non-compliance. The highest penalties are reserved for the most serious violations, and landlords who own six or more properties could receive fines of up to $50,000 and as high as $100,000 for hearing claims.

Silverstream Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory for all Silverstream and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standard that apply or will be applied to their rental properties.

From 1 July 2021

  • Private landlords and property managers are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

You don’t need to block up intentional gaps or holes in the building. For example, tiny gaps around doors and windows may be required to allow for the movement of the structure as the house gets warmer and cooler, in order to let them be opened and closed rather instead of being stuck. A good heating system is important for healthy homes

Heating Silverstream

Silverstream rental properties need to have a stable source of heat that can heat the main or largest living space to a minimum of 18degC, even during the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements to remain fixed (i.e. not portable), at least 1.5 kW of heating capacity, and must meet the minimum required heating capacity for the main living room. A Heating Assessment Tool could be used to check if the fix heater(s) are sufficient or whether you will require to "top up" with an additional heater. If the heating that you provide is an electric heater or heat source, it must have a thermostat. This will help make the heating more consistent and efficient. For most properties, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In some instances, like small apartments small apartments, a smaller electric fixed heater may be sufficient.

If your living space is already equipped with a fixed heating source like heat pumps, it might just need an update to ensure it meets the requirements. Certain types of heaters cannot be used to comply with the standard as they are either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Silverstream

Each living space within the rental property should contain at minimum one open windows or an exterior door to provide natural ventilation. In addition, humid areas such as kitchens and bathrooms should be equipped with an externally vented extractor fan to get rid of moisture.
