Fines for Failing to Comply

Tenancies signed between 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is required in all Silverstream and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with all Healthy Homes Standards that apply or will apply during the tenure of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
