Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Silverstream rental property, all Healthy Homes compliance work need to be done inside of 90 days.

The person who is liable to pay this fine is the one who is named on the lease agreement as the one who is letting the property out which could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be accurate when the tenancy agreement is completed, and should be kept updated through the tenancy period as necessary work related to it is finished.

It’s important to keep in mind that a landlord with multiple rental properties may face even higher fines for non-compliance. The most severe penalties are given only for serious breaches, and landlords with at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Silverstream Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory throughout Silverstream and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the conformance to any Healthy Homes Standard that apply or will be applied during the tenure of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords should make sure their rental properties comply with the Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.

Adequate heaters are crucial for healthy homes

Heating Silverstream

Silverstream rental properties must have a fixed heating source that is able to heat the principal or the biggest living room to at least 18degC, even on the winter coldest days. For the majority of houses, bigger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. However, in certain instances such as small apartments an electric, fixed heater may be sufficient.

If your living space already has a fixed heating source like heat pumps, it could need an update in order to comply with the standards. Certain types of heaters cannot be used to achieve the quality as they are either inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Silverstream

Each living space within the rental property should have at least one openable door or window to provide natural airflow. Furthermore, moist areas such as kitchens and bathrooms need to have an externally vented extractor fan to get rid of moisture.
