Fines for Failing to Comply
Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Silverstream rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated in the renewal, new or revised tenancy agreement it could result in additional penalties or an infringement fee.
Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not provide the required information within 21 days of having received the inquiry, they could receive an infringement letter and be fined up to $750.
In addition, there is also a penalty of as much as $900 for property owners or property managers who offer a false or incorrect Healthy Homes Statement of Compliance or any other information. The person liable to pay this fine is the one who is named on the lease agreement as being the person leasing the property out which could be the landlord’s name or the property management company.
The information contained in the Compliance Statement needs to be current at the time that the tenancy agreement is completed, and must be updated during the entire tenancy, as associated work has been completed.
It’s important to keep in mind that landlords who have multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are given for the most serious violations, and landlords who own six or more properties could be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.
