Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed for a Silverstream rental property, all Healthy Homes compliance work must be completed within 90 days.

Anyone can request information about the Healthy Homes Standard and how they relate to the home they live in. If the property manager fails to provide the information requested within 21 days of being informed of the request, they could receive an infringement notice and be fined up to $750.

Additionally, there is also a penalty up to $900 for landlords or property managers providing a false or incorrect Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is named on the lease contract as the person letting the property out which could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be correct at the time that the tenancy agreement is completed, and should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It’s also important to remember that a landlord with multiple rental properties could face even higher fines for non-compliance. The highest penalties are handed down for serious breaches, and landlords with six or more properties can be fined as high as $50,000, and as much as $100,000 in hearings.

Tenancies established from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory throughout Silverstream and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to any Healthy Homes Standard that apply or will be applied during the tenure of an apartment rental.

From July 1st 2021

  • Property managers and private landlords must make sure their rental properties conform according to Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All houses let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Silverstream
