Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Silverstream rental property, all Healthy Homes compliance work need to be done within 90 days.

Beginning on July 1st, 2021, once a new or renewed lease is entered into on a Silverstream rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

It is important to be aware that landlords with multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved for severe violations, and landlords who own six or more properties can be fined as high as $50,000 and as high as $100,000 in hearing claims.

When will I need to be in compliance with The Healthy Homes Standards?

Silverstream Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Silverstream and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records of their compliance with each Healthy Homes Standards that apply or will be in force throughout the tenancy period of an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords must make sure their rental properties comply according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.

If your main living space already has a fixed heating source, like a heat pump, then it could need an update to meet the standards. Some types of heaters can’t be used to meet the standard because they’re costly, not cost-effective to run, and/or unsafe to run.
