Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Silverstream rental property, all Healthy Homes compliance tasks need to be done inside of 90 days.

The information contained in the Compliance Statement needs to be accurate at the time that the tenancy agreement is completed, and should be kept updated throughout the tenancy as any relevant work gets completed.

It is crucial to keep in mind that a landlord who own multiple rental properties could face additional fines for non-compliance. The harshest penalties are reserved only for serious violations, and landlords who own six or more properties can receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.

Silverstream Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is required to all Silverstream and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records that prove compliance with the Healthy Homes Standard that apply or will be applied to an apartment rental.

From 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy first began.
