Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed contract is signed on a Roseneath rental property, all Healthy Homes compliance work have to be completed inside of 90 days.

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Roseneath rental property, all Healthy Homes compliance work must be done within 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the deadlines can result in an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy contract, there could be an additional fine or violation fee.

The information contained in the Statement of Compliance needs to be current at the time that the tenancy agreement is completed, and is updated throughout the duration of the tenancy when any necessary work related to it is finished.

It’s crucial to keep in mind that landlords who own several rental properties can face additional fines for non-compliance. The most severe penalties are given for serious violations, and landlords who own six or more properties can be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

Tenancies established between 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is a requirement to all Roseneath and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be applicable to an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Property managers and landlords are responsible for making sure that draughts from the fireplace are removed in the maximum extent possible.

There is no need to block off holes or gaps which are part of the construction. For instance, small gaps around windows and doors might be necessary to allow movement of the building as the home is heated and cools in order to let them be closed and opened rather than sticking.
