Since the 1st July of 2021, once a new, renewed or varied lease is entered into on a Roseneath rental property, all Healthy Homes compliance work must be done within 90 days.
Inability to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement, there may be additional penalties or an infringement fee.
Anyone can request information about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or the property manager doesn’t provide the necessary information within 21 days of receiving the request, they can receive an infringement notification and be fined upto $750.
Additionally, there is also a fine of approximately $900 for property owners or property managers providing a false or false Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the one who is identified on the tenancy agreement as being the person who is letting the property which could be the name of the landlord or the property management company.
All the information on the Statement of Compliance needs to be correct when the tenancy contract is executed, and it should be maintained during the entire tenancy, as necessary work related to it’s finished.
It’s also crucial to remember that a landlord who own multiple rental properties may face greater penalties for non-compliance. The harshest penalties are reserved for severe violations. Those who have six or more properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.
