Fines for Failing to Comply

As of 1st July 2021, once a new or renewed contract is signed on a Roseneath rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

As of 1st July 2021, when a new, renewed or varied lease is entered into on the Roseneath rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet any of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. All the information on the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is signed, and ideally it should be kept updated throughout the tenancy as any associated work has been completed.

It is crucial to remember that landlords who have multiple rental properties may face more severe penalties for not complying. The highest penalties are given only for serious violations. Those who have at least six rental properties could be fined as high as $50,000, and as much as $100,000 in hearings.

Tenancies established from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is a requirement throughout Roseneath and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records that prove compliance with each Healthy Homes Standard that apply or will be applicable during the tenancy of the rental property.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All households let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Heating Roseneath

Roseneath rental properties require a reliable heating source that can heat the principal or the biggest living room to at least 18degC, even during the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs to remain fixed (i.e., not portable) and at least 1.5 kW in heating capacity, and it must have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to determine whether the current installed heater(s) are adequate or if you’ll need to "top-up" with a new heater. Open fires and unflued combustion heaters such as mobile LPG bottle heaters aren’t considered to be acceptable heating options under The Healthy Homes Standard.

If the heating system you provide is electric heating (or heat pump), it requirements to include the thermostat. This will make the heating more uniform and efficient. For the majority of homes, bigger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in certain instances such as small apartments, a smaller fixed electric heater might be enough.

If the living area is already equipped with a fixed heating source like heat pumps, it could require an update to meet the standards. Some types of heaters can’t be used to achieve the standard since they’re either expensive, inefficient or are unsafe to operate.
