Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed contract is signed on a Roseneath rental property, all Healthy Homes compliance work have to be taken care of within 90 days.

From the 1st of July in 2021, when a new or renewed tenancy is signed on the Roseneath rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with each of Healthy Homes Standards within the period of time expected can lead to an amount of $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not included in a new, renewed or amended tenancy agreement it could result in additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager does not provide the required information within 21 days of being informed of the request, they may receive an infringement notice and be fined as high as $750.

Additionally, there is also a penalty of as much as $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is named on the tenancy agreement as being the person letting the property out It could also be the name of the landlord or the property management company.

The information contained in the Compliance Statement requirements to be correct when the tenancy contract is executed, and it must be updated during the entire tenancy, as necessary work related to it’s finished.

It’s important to remember that a landlord who manage several rental properties can face additional fines for non-compliance. The most severe penalties are given for serious breaches. Landlords with at least six rental properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Roseneath Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory throughout Roseneath and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records to demonstrate the conformance to all Healthy Homes Standards that apply or will be applied during the tenancy of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers have to make sure their rental properties conform with the Healthy Homes Standard within 90 days of a new, renewed , or altered tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Roseneath

Roseneath rental properties must have a fixed heating source which can warm the living room to at least 18degC, even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

If the heating you offer is electric heating or heat pump then it must include the thermostat. This makes your heating more consistent and efficient. For the majority of houses, bigger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in some cases like apartments with small spaces an electric, fixed heater could be enough.

If your living space is already equipped with a fixed heating source, such as an air conditioner, it might just require some additional energy to be able to meet the standards. Certain types of heaters cannot be used to comply with the quality as they are either not effective, cost prohibitive to operate and/or unsafe to run.

Ceiling and underfloor insulation is required on all rental homes from 1 July 2019. All landlords and property managers are required to ensure the insulation meets standards that are in line with the latest quality. In some instances, an existing insulation on the ceiling or in the sub floor space may require to be added or replaced.

A well-insulated house will reduce the risk of condensation and lower the chance of dampness and mould, and also makes an easier task for the home to hold the heat.
