Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Roseneath rental property, all Healthy Homes compliance items have to be taken care of by the end of 90 days.

As of 1st July 2021, when a new, renewed or varied Tenancy is signed for the Roseneath rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy agreement it could result in additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the property manager is unable to provide the necessary information within 21 days from being informed of the request, they can receive an infringement notice and could be fined up to $750.

In addition, there is also a fine of approximately $900 for property owners or property managers who offer a false or inaccurate Healthy Homes Statement of Compliance or information. The person liable for this fine is whoever is named on the tenancy agreement as the one who is who is letting the property and it could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be signed, and ideally it should be kept updated throughout the duration of the tenancy when any related work is completed.

It is also important to keep in mind that a landlord who manage multiple rental properties may face even higher fines for non-compliance. The most severe penalties are reserved only for serious breaches. Landlords with six or more properties can be fined as high as $50,000 and as high as $100,000 for hearing claims.

Roseneath Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory for all Roseneath and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records that prove compliance with all Healthy Homes Standards that apply or will apply throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

What are unjustifiable gaps or holes?

If you are able to feel external air getting in, or see a clear draught out of a hole or gap, then it is probably a gap or an opening that needs sealing in somehow. Large gaps and cracks should be fixed permanently. The gaps that exceed 3mm that allow air to enter or exit of your house require seals. For example, if an open fireplace is not in use, it may cause draughts and should be shut from. Property managers and landlords are responsible for ensuring that these draughts are stopped whenever imaginable.

You don’t need to cover up gaps or holes in the building. For example, tiny gaps around doors and windows could be required to allow movement of the structure when the household heats and cools, so that they are able to be shut and opened, rather than being stuck. Heating Roseneath

Roseneath rental properties require a reliable source of heating that can heat the largest or main living space to at least 18degC even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements to remain fixed (i.e., not portable) that is, at least 1.5 kW of heating capacity and have the minimum required heating capacity for the main living room. A Heating Assessment Tool can be used to determine if your current permanent heater(s) are sufficient or if you’ll need to top up by adding a second heater. Unflued combustion and open fire heaters like the portable LPG bottle heaters are not considered to be acceptable heating options under The Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump it requirements to have an thermostat. This makes the heating more consistent and efficient. For the majority of houses, bigger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances like small apartments, a smaller fixed electric heater may suffice.

If the main living room already has a permanent heating source such as heat pumps, it may need an upgrade in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the standard since they’re either expensive, inefficient and/or unhealthy to run.

Ventilation Roseneath
