Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed contract is signed on a Riverstone Terraces rental property, all Healthy Homes compliance work must be done inside of 90 days.

As of 1st July 2021, if a new or renewed Tenancy is signed for the Riverstone Terraces rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy contract, it could result in an additional fine or infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they are related to the house they are living in. If the the property manager doesn’t provide the information requested within 21 days from getting the notice, the tenant can receive an infringement notice and could be fined up to $750.

Furthermore, there’s also a fine of as much as $900 for landlords and property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is named on the lease agreement as the person who is renting the property, so it could be the landlord’s name or the property management company.

The information contained in the Compliance Statement needs to be correct at the time that the tenancy agreement is signed, and ideally it must be updated during the entire tenancy, as necessary work related to it is finished.

It is important to keep in mind that a landlord with multiple rental properties could face more severe penalties for not complying. The most severe penalties are reserved for serious breaches, and landlords with at least six rental properties could be penalised up to $50,000 and as high as $100,000 in hearing claims.

Tenancies commenced beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is compulsory for all Riverstone Terraces and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the conformance to each Healthy Homes Standard that apply or will be applicable to the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must make sure their rental properties conform with the Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Riverstone Terraces

Riverstone Terraces rental properties should have a permanent source of heat that can heat the main or largest living area to at minimum 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source requirements to be fixed (i.e., not portable), at minimum 1.5 kW of heating capacity and have the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to determine whether the existing permanent heater(s) are sufficient or if you’ll need to "top-up" by adding a second heater. Open fires and unflued combustion heaters like mobile LPG bottle heaters are not considered to be acceptable heating options under the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, then it must have a thermostat. This will help make the heating more uniform and efficient. In most houses, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances like small apartment buildings the smaller fixed electric heater could be enough.

If the main living room already has a central heating source, like a heat pump, then it could require a top up in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the quality since they’re either expensive, inefficient and/or unhealthy to run.

Ventilation Riverstone Terraces
