Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed on a Riverstone Terraces rental property, all Healthy Homes compliance items need to be finished within 90 days.

Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Riverstone Terraces rental property, all Healthy Homes compliance work must be taken care of within 90 days.

The person liable for this fine is whoever is listed on the tenancy agreement as the person who is leasing the property out which could be the landlord’s name or the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy contract is signed, and ideally it should be kept updated through the tenancy period as related work is completed.

It’s important to remember that a landlord with multiple rental properties may face greater penalties for non-compliance. The harshest penalties are given only for serious breaches. Landlords with more than six properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

Riverstone Terraces Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement throughout Riverstone Terraces and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records of their conformance with all Healthy Homes Standards that apply or will be applicable during the tenancy of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy began.

For instance, if an open fireplace isn’t being used, it can cause draughts and should be shut from. Property managers and landlords are responsible for making sure that these draughts are stopped whenever possible.

You don’t need to block off holes or gaps in the construction. For example, tiny gaps around doors and windows could be necessary to allow for the movement of the building as the house is heated and cools so that they are able to be shut and opened, rather instead of being stuck. Heating Riverstone Terraces

Rental properties in Riverstone Terraces must have a fixed heating source that can warm the principal or the biggest living area to at minimum 18degC, even during the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements to remain fixed (i.e., not portable) that is, at least 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed in the living area. A Heating Assessment Tool can be used to check if the current fixed heater(s) are adequate or whether you will need to "top-up" by adding a second heater. Open fires as well as unflued combustion heaters, such as portable LPG bottle heaters aren’t considered to be suitable heating options for those following the Healthy Homes Standard.

If the heating system you provide is an electric heater or heat pump, then it must be equipped with a thermostat. This will help make the heating more uniform and efficient. For most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in certain instances like small apartments the smaller fixed electric heater may suffice.

If your living space already has a fixed heating source like heat pumps, it might just require some additional energy to be able to meet the standards. Certain types of heaters cannot be used to meet the standard as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Riverstone Terraces
