Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Riverstone Terraces rental property, all Healthy Homes compliance work need to be finished by the end of 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on the Riverstone Terraces rental property, all Healthy Homes compliance work must be done inside of 90 days.

The harshest penalties are handed down only for serious violations, and landlords who own at least six rental properties could be penalised up to $50,000 and as high as $100,000 for hearing claims.

Riverstone Terraces Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory to all Riverstone Terraces and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the compliance with each Healthy Homes Standard that apply or will be in force during the tenancy of the rental property.

Starting 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply with the Healthy Homes Standard within 90 days of any new, renewed or varied tenant.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Riverstone Terraces

Rental properties in Riverstone Terraces should have a permanent source of heating that is able to heat the principal or the biggest living room to at least 18degC, even during the most coldest days of the year. For most properties, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances like small apartment buildings, a smaller fixed electric heater might be enough.

If your main living space already has a fixed heating source, such as the heat pump, it might require a top up to meet the standards. Certain kinds of heaters cannot be used to achieve the standard as they are either costly, not cost-effective to run, and/or unhealthy to run.
