Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed for a Riverstone Terraces rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

The person who is liable for this fine is the one who is named on the lease contract as the person letting the property out, so it could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement requirements to be current when the tenancy contract is completed, and is updated throughout the duration of the tenancy when any relevant work gets completed.

It’s crucial to remember that landlords who manage multiple rental properties could face additional fines for non-compliance. The most severe penalties are handed down for the most serious violations. Those who have more than six properties could be penalised up to $50,000, and as much as $100,000 for hearing claims.

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement for all Riverstone Terraces and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate compliance with each Healthy Homes Standards that apply or will be in force during the tenancy of their rental properties.

From 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a new, renewed or varied tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Heating Riverstone Terraces
