Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Riverstone Terraces rental property, all Healthy Homes compliance work have to be done inside of 90 days.

The person who is responsible for this fine is the person who is identified on the tenancy agreement as being the person leasing the property out and it could be the name of the landlord, or the property management company.

All the information on the Statement of Compliance needs to be current when the tenancy agreement is completed, and must be updated during the entire tenancy, as necessary work related to it is finished.

It’s important to remember that a landlord with several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved for serious breaches, and landlords with six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Tenancies commenced from 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is required in all Riverstone Terraces and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the compliance with the Healthy Homes Standard that apply or will apply during the tenancy of an apartment rental.

Beginning 1 July 2021

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Riverstone Terraces

Riverstone Terraces rental properties should have a permanent source of heat that is able to heat the largest or main living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year.
