Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on a Riverstone Terraces rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

It is important to note that landlords who manage multiple rental properties could face greater penalties for non-compliance. The most severe penalties are handed down for severe violations, and landlords who own six or more properties can be fined up to $50,000, and even as high as $100,000 in hearings.

Riverstone Terraces Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement for all Riverstone Terraces and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate conformance with any Healthy Homes Standards that apply or will be applicable during the tenancy of their rental properties.

From 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply with the Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
