Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed on a Riverstone Terraces rental property, all Healthy Homes compliance tasks need to be completed by the end of 90 days.

As of 1st July 2021, if a new or renewed tenancy is signed on a Riverstone Terraces rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

In addition, there is also a penalty of approximately $900 for property owners or property managers providing a false or incorrect Healthy Homes Statement of Compliance or other information. The person liable to pay this fine is the one who is named on the lease agreement as the person who is letting the property out, so it could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance needs to be correct when the tenancy agreement is completed, and should be maintained throughout the tenancy as any related work is completed.

It’s also crucial to keep in mind that a landlord who manage multiple rental properties may receive additional fines for non-compliance. The highest penalties are reserved only for serious violations. Those who have at least six rental properties could be fined as high as $50,000, and as much as $100,000 in hearings.

When do I need to be in compliance with The Healthy Homes Standards?

Riverstone Terraces Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement for all Riverstone Terraces and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to each Healthy Homes Standards that apply or will be applied throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords should make sure their rental properties comply with the Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.
