Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed for a Pukerua Bay rental property, all Healthy Homes compliance items have to be finished within 90 days.

The person who is responsible for this fine is the person who is named on the lease contract as the person who is letting the property It could also be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance requirements to be correct when the tenancy agreement is signed. It is updated throughout the tenancy as any necessary work related to it’s finished.

It is also important to remember that landlords with multiple rental properties could face greater penalties for non-compliance. The most severe penalties are given for the most serious breaches, and landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required to all Pukerua Bay and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records to demonstrate compliance with any Healthy Homes Standards that apply or will be applicable throughout the tenancy period of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any new, renewed , or altered tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Pukerua Bay

Rental properties in Pukerua Bay require a reliable heating source that can heat the largest or main living space to at least 18degC, even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to be fixed (i.e., not portable), at least 1.5 Kilowatts in heating capacity, and meet the minimum heating capacity needed to heat the living space in general. However, in some cases like small apartments an electric, fixed heater may suffice.
