Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied contract is signed on a Pukerua Bay rental property, all Healthy Homes compliance work have to be done within 90 days.

From the 1st of July in 2021, when a new or renewed lease is entered into on the Pukerua Bay rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to adhere to any of the Healthy Homes Standards within the deadlines can result in the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement, there could be an additional fine or infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager does not supply the necessary information within 21 days of receiving the request, they could receive an infringement notice and be fined upto $750.

In addition, there’s also a fine of approximately $900 for landlords and property managers that provide false or false Healthy Homes Statement of Compliance or information. The person liable for this fine is the person who is named on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be current before the tenancy agreement can be signed. It should be kept updated during the entire tenancy, as relevant work gets completed.

It’s crucial to be aware that a landlord who manage several rental properties can face more severe penalties for not complying. The most severe penalties are handed down only for serious breaches. Landlords with six or more properties can be fined as high as $50,000 and as high as $100,000 in hearings.

Healthy homes matter

What is the reason Healthy Homes Compliance important?

One in three households rent from New Zealand and Pukerua Bay, and research indicates that rental homes are more likely to be colder, older, are not as effective heating and tend to be lower standard than those owned by owners.

The damp, cold and mouldy homes are associated with negative well-being results, specifically for ailments like colds and influenza, asthma, and heart diseases. Furthermore, people who reported four or more major home quality issues often suffer from less satisfaction in their lives and lower well-being.

The improvement in the standard of Pukerua Bay rental property can allow tenants to experience better physical and mental health as well as lessen disruptions to their work, education and living due to health issues. Your investment is also better protected from mould, mildew and damp damage, meaning less maintenance costs in the long-term.

The Healthy Homes Standard is a list of specific and minimum standards for Heating, Insulation Ventilation and Ventilation and Drainage, and Draught Stopping for Pukerua Bay rental properties.

Unreasonable Gaps & Holes

Draught Stopping Pukerua Bay

Draughts may lead to less temperature in homes. A draughty home is more expensive to heat, which means wasting energy and resulting in higher bills.

If a draught could be perceived as a result of gaps or holes the area requirements to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or an unobstructed draught coming from a gap or hole that is, it is probably a gap or an opening that needs sealing in somehow. Large gaps and cracks should be fixed permanently. Any gaps greater than 3mm that let air in or out within your house need seals. For instance, if an open fireplace isn’t used it can cause draughts and should be blocked off. Property managers and landlords are accountable for ensuring that such draughts are squelched as much as possible.

You don’t need to block gaps or holes that are part of the building. For instance, small gaps around windows and doors might be necessary to allow movement of the building as the household is heated and cools so that they can still be closed and opened instead of instead of being stuck. We will test all windows and doors during an Healthy Homes assessment of your rental property.

The proper heating equipment is crucial for healthy houses

Heating Pukerua Bay

Rental properties in Pukerua Bay require a reliable source of heating that can heat the living space to a minimum of 18degC, even on the coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source needs to be fixed (i.e. not portable), at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool can be used to check if the existing fix heater(s) are sufficient or whether you will need to top up with an additional heater. Fires that are open and unflued heaters such as small portable LPG bottle heaters aren’t considered to be suitable heating options for those following the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump, it should have the thermostat. This will make the heating more reliable and effective. For most homes, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases such as small apartments, a smaller fixed electric heater may be sufficient.

If your living space already has a fixed heating source such as an air conditioner, it might just need an upgrade to ensure it meets the requirements. Certain types of heaters cannot be used to comply with the quality since they’re either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Pukerua Bay

Every living space in a rental property has to have at least one opening door or window to offer natural airflow. Additionally, areas with high moisture areas like kitchens and bathrooms should have an externally vented extractor fan that can eliminate moisture.

The ventilation quality is about recognising how dry air is much easier to heat and a property that is well ventilated is less likely to develop damp and mould.

Living rooms, bedrooms, kitchens and dining rooms are all considered living spaces. Connecting spaces such as the hallway aren’t liveable and don’t need an opening window or door.

Each door, window or skylight needs for them to be in a position to open up to the outside, and stay at an open angle, allowing ventilation and fresh air air flow.

Bathrooms, kitchens, and any other room in your house that houses a bath, shower and cooktop or another moisture-producing item will need appropriate extractor fans that are vented to the outdoors. We offer a Healthy Homes Assessment service will verify that there is enough ventilation throughout the living spaces with the right extractor fan in areas with high moisture.

Insulation Pukerua Bay

Underfloor and ceiling insulation is mandatory in all rental houses as of July 1st, 2019. Property managers and landlords have to ensure the insulation meets this new quality. In certain situations, the an existing insulation on the ceiling or in the sub floor space may need to be added or replaced.

A house that is well-insulated will help to control condensation and reduce the chances of mould and dampness and it will make more easy to the home to hold warmth.

Insulation requirements to meet the R-values of your area.

The "R" stands for thermal resistance, and is a gauge of how well insulation withstands heat flow. The greater the R-value, the more effective the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9 in the underfloor, 1.3
  • Zone 2 – all area of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 and underfloor R 1.3

Pukerua Bay Moisture Ingress & Drainage

Protecting your rental property from moisture isn’t just about the interior of the building it’s also about the outside. You must make sure there is somewhere for surface and underground water to flow and also stop it from getting inside. When it comes to moisture and damp it is frequently those concerns that you aren’t aware of that can cause a lot of trouble that can cause damage to your investment as well as harming the tenant’s well-being.

Properties that are rented must have effective drainage to get rid of rainwater, storm water, and ground water, which includes an appropriate runoff or outfall. Making sure that water is able to go and that it doesn’t sit beneath structures is an crucial aspect of keeping your property dry.

In addition to an irrigation system to stop the ingress of moisture, if your rental is enclosed between your floor and surface, a ground moisture barrier must be put in place when it’s reasonably practicable to do so.

A ground moisture barrier is generally a sheet of polythene that is placed over the ground, in order to block any moisture in the ground from rising into the home. It also helps prevent from causing damage to the flooring insulation.
