Fines for Failing to Comply
Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Porirua rental property, all Healthy Homes compliance work need to be taken care of by the end of 90 days.
Since the 1st July of 2021, if a new, renewed or varied lease is entered into on a Porirua rental property, all Healthy Homes compliance work must be completed by the end of 90 days.
Failure to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included in the new, renewed or amended tenancy agreement there may be an additional fine or infringement fee.
Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the property manager fails to supply the necessary information within 21 days of receiving the request, they could receive an infringement letter and be fined up to $750.
In addition, there is also a penalty of approximately $900 for property owners or property managers that provide false or inaccurate Healthy Homes Compliance Statement or any other information. The person responsible to pay this fine is the one who is listed on the tenancy agreement as the one who is renting the property and it could be the name of the landlord as well as the company that manages the property.
All information in the Compliance Statement requirements to be correct before the tenancy agreement can be executed, and it should be maintained throughout the duration of the tenancy when any associated work has been completed.
It is also crucial to remember that landlords with multiple rental properties may receive more severe penalties for not complying. The most severe penalties are handed down only for serious breaches. Landlords with six or more properties could be fined up to $50,000 and as high as $100,000 in the case of hearing claims.
