Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Porirua rental property, all Healthy Homes compliance tasks have to be taken care of inside of 90 days.

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on the Porirua rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with one of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement it could result in an additional fine or violation fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they are living in. If the property manager fails to provide the required information within 21 days from getting the notice, the tenant may receive an infringement notice and could be fined up to $750.

Furthermore, there’s also a penalty up to $900 for landlords or property managers providing a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the one who is named on the lease agreement as the person who is letting the property out, so it could be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed. It must be updated during the entire tenancy, as relevant work gets completed.

It is important to note that landlords who own multiple rental properties may face more severe penalties for not complying. The highest penalties are handed down only for serious violations, and landlords who own six or more properties can be fined up to $50,000 and as high as $100,000 in hearings.

In the end, a failure to meet compliance with Healthy Homes requirements can hit your pocket and result in significant fines and still having to meet compliance. Unreasonable Gaps & Holes

Draught Stopping Porirua

Draughts are a major cause of lower temperatures in homes. A humid house will cost more to heat, resulting in wasted money and energy.

If a draught could be felt through gaps that are too large or holes that it requirements to be sealed.

What are unreasonable gaps and holes?

If you are able to feel external air flowing in or a clear draught from a gap or hole that is, it’s likely a crack or crack that requirements sealing in some way. Cracks or gaps with large gaps must be fixed permanently. Any gaps greater than 3mm that allow air to enter or exit of your home need the sealing. In the case of an open fireplace isn’t used it may cause draughts and should be shut from. Property managers and landlords are responsible for ensuring that such draughts are squelched whenever imaginable.

You don’t require to cover up holes or gaps which are part of the building. For instance, small gaps around doors and windows might be necessary to allow for movement of the structure as the house is heated and cools in order to let them be opened and closed rather instead of being stuck. We will inspect the windows and doors during our Healthy Homes assessment of your rental property.

Adequate heaters are crucial to ensure healthy houses

Heating Porirua

Porirua rental properties should have a permanent source of heat which can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements to remain fixed (i.e., not portable) and at least 1.5 Kilowatts in heating capacity, and it must have the minimum capacity for heating required for the main living space. A Heating Assessment Tool may be used to determine if the installed heater(s) are adequate or whether you will require to "top up" with an additional heater. Unflued combustion and open fire heaters, such as mobile LPG bottle heaters aren’t considered to be suitable heating options for the Healthy Homes Standard.

If the heating that you offer is electric heating or heat pump, it should be equipped with an thermostat. This will help make your heating more consistent and effective. In most houses, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances like small apartments an electric, fixed heater may be sufficient.

If the living area is already equipped with a fixed heating source such as an air conditioner, it may require a top up to meet the standards. Certain kinds of heaters cannot be utilised to meet the quality because they’re not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Porirua

Each living space within a rental property has to have at least one openable door or window to provide natural ventilation. Furthermore, moist areas such as kitchens and bathrooms should have an externally vented extractor fan that can eliminate moisture.

This ventilation standard is all about recognising that dried air can be easier to heat and a property that is well ventilated is less likely to be a victim of mould and damp.

Bedrooms, living rooms dining rooms, and kitchens are all considered living spaces. Connecting spaces such as the hallway aren’t considered liveable and therefore are not require an opening window or door.

Each window, door or Skylight requirements at least of opening to the outside and remain closed to allow for fresh air circulation and ventilation.

Bathrooms, kitchens, and any other room in your property with shower, bath and cooktop or another moisture-producing item will require suitable extractor fans which are vented to the outdoors. Our Healthy Homes Assessment service will ensure that there is sufficient air circulation in every living space that includes extractor fans that are suitable in areas with high moisture.

Insulation Porirua

Ceiling and underfloor insulation is mandatory for all rent houses since July 1, 2019. Property managers and landlords must make sure that the insulation is up to current quality. In some cases, old ceiling insulation as well as insulation within the subfloor space may require to be added or replaced.

A properly insulated home can help control condensation and lessen the likelihood of mould and damp, and will also make more easy to allow the house to hold warmth.

Insulation needs to be in compliance with the R-values for your area

The "R" is a symbol for thermal resistance and it is a measurement of how well insulation withstands heat flow. The more high the R-value, more effective the insulation.

  • Zone 1 Zone 1 Auckland & Northland - ceiling R 2.9 Underfloor R 1.3
  • Zone 2 – all area of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3, underfloor R 1.3

Porirua Moisture Ingress & Drainage

The security of your rental home from moisture isn’t just about the inside of the building it is also about the outside. You must make sure there is somewhere for rain, surface or ground water, and to prevent it from getting inside. When it comes to moisture and damp it’s often what you don’t see that can become a big problem and cause damage to your investment and affecting your tenant’s well-being.

Properties that are rented must be equipped with efficient drainage to remove rainwater, storm water and ground water. This includes an appropriate outfall or runoff. Making sure the water is able to go, and it can’t linger underneath the structures is a crucial aspect of keeping your property dry.

In addition to a drainage system to avoid moisture from entering, if your rental has an enclosed gap between your flooring and soil, a ground-water barrier must be put in place when it is reasonably practicable to install it.

A ground moisture barrier is typically made of polythene and is laid on top of the ground, to block any moisture from the ground from rising into the building. It also helps prevent moisture damage to the underfloor insulation.
