Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Porirua rental property, all Healthy Homes compliance work must be finished within 90 days.

From the 1st of July in 2021, when a brand new or renewed lease is entered into on the Porirua rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Any tenant may request details about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager is unable to supply the required information within 21 days of being informed of the request, they will receive an infringement letter and be fined upto $750.

In addition, there’s an additional fine of up to $900 for landlords or property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the one who is listed on the tenancy agreement as being the person letting the property out It could also be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance requirements to be correct before the tenancy agreement can be executed, and it is updated throughout the duration of the tenancy when any related work is completed.

It is also crucial to remember that landlords who manage multiple rental properties could face greater penalties for non-compliance. The most severe penalties are reserved only for serious breaches, and landlords with six or more properties could be fined up to $50,000, or as high as $100,000 in hearings.

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement for all Porirua and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the conformance to all Healthy Homes Standards that apply or will apply during the tenure of your rental home.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform with the Healthy Homes Standards within 90 days of a renewal, new or a change in Tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Heating Porirua

Porirua rental properties need to have a stable source of heat which can warm the largest or main living space to at least 18degC even on the coldest winter days.
