Fines for Failing to Comply

All information in the Compliance Statement requirements to be up-to-date when the tenancy agreement is executed, and it should be kept updated throughout the tenancy as any necessary work related to it is finished.

It is important to remember that landlords who manage multiple rental properties may face more severe penalties for not complying. The most severe penalties are handed down for serious violations, and landlords who own six or more properties could be penalised up to $50,000, or as high as $100,000 for hearing claims.

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory for all Plimmerton and New Zealand rental houses where it is reasonably practicable to install.

  • All boarder homes (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

  • All houses let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.
