Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on a Plimmerton rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.

If the the property manager doesn’t provide the required information within 21 days from getting the notice, the tenant will receive an infringement notification and could be fined up to $750.

Furthermore, there’s an additional fine of as much as $900 for landlords and property managers who offer a false or false Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the person who is named on the tenancy contract as the person leasing the property out It could also be the name of the landlord or the property management company.

The information contained in the Statement of Compliance needs to be up-to-date when the tenancy agreement is signed. It should be kept updated throughout the duration of the tenancy when any associated work has been completed.

It’s also important to be aware that a landlord who manage multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for severe breaches, and landlords with six or more properties could be penalised up to $50,000, and as much as $100,000 in hearings.

Plimmerton Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory throughout Plimmerton and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be applied during the tenancy of the rental property.

Starting 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties comply to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Heating Plimmerton

Rental properties in Plimmerton require a reliable source of heat that can heat the principal or the biggest living area to at minimum 18degC even on the most coldest days of the year. In some instances, like small apartment buildings an electric, fixed heater could be enough.

If the living area already has a permanent heating source like an air conditioner, it may require some additional energy to meet the standards. Certain kinds of heaters aren’t able to be used to meet the quality as they are either not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Plimmerton
