Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed on a Plimmerton rental property, all Healthy Homes compliance work have to be done within 90 days.

Failure to comply with all of the Healthy Homes Standards within the period of time expected can lead to an amount of $7200. In addition, if the present Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy contract, it could result in an additional fine or violation fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager is unable to supply the required information within 21 days from being informed of the request, they could receive an infringement notice and be fined up to $750.

Furthermore, there’s also a fine of approximately $900 for landlords and property managers providing a false or inaccurate Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the person who is named on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance requirements to be correct at the time that the tenancy agreement is executed, and it must be updated during the entire tenancy, as associated work has been completed.

It’s important to be aware that landlords who own multiple rental properties may receive additional fines for non-compliance. The harshest penalties are handed down only for serious violations. Those who have six or more properties can receive fines of up to $50,000, and even as high as $100,000 in hearings.

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement throughout Plimmerton and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that prove conformance with the Healthy Homes Standard that apply or will be applicable during the tenancy of your rental home.

Heating Plimmerton

Plimmerton rental properties must have a fixed heating source that can warm the living space to a minimum of 18degC, even during the most coldest days of the year. Ventilation Plimmerton
