Fines for Failing to Comply
As of 1st July 2021, when a new or renewed tenancy is signed on a Plimmerton rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or amended tenancy agreement there may be an additional penalty or infringement fee.
Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager fails to supply the information requested within 21 days from having received the inquiry, they may receive an infringement notification and could be fined up to $750.
Furthermore, there’s also a penalty of approximately $900 for property owners or property managers who offer a false or inaccurate Healthy Homes Compliance Statement or any other information. The person responsible for this fine is whoever is listed on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord, or the property management company.
All information in the Statement of Compliance requirements to be accurate when the tenancy contract is completed, and should be kept updated throughout the duration of the tenancy when any relevant work gets completed.
It’s crucial to keep in mind that landlords who own multiple rental properties may face additional fines for non-compliance. The harshest penalties are handed down only for serious violations, and landlords who own six or more properties could be fined up to $50,000, and even as high as $100,000 in hearings.
