Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Pinehaven rental property, all Healthy Homes compliance items must be completed within 90 days.

If the property manager is unable to provide the necessary information within 21 days from getting the notice, the tenant can receive an infringement notification and be fined up to $750.

In addition, there is also a fine of approximately $900 for property owners or property managers that provide false or false Healthy Homes Statement of Compliance or information. The person who is liable to pay this fine is the one who is listed on the tenancy agreement as the one who is leasing the property out which could be the name of the landlord or the company that manages the property.

Pinehaven Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is required throughout Pinehaven and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with all Healthy Homes Standard that apply or will be applicable during the tenancy of an apartment rental.

From 1 July 2021
