Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed contract is signed on a Pauatahanui rental property, all Healthy Homes compliance items have to be done by the end of 90 days.

Since the 1st July of 2021, when a brand new or renewed lease is entered into on the Pauatahanui rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement there may be an additional fine or violation fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to supply the required information within 21 days from receiving the request, they could receive an infringement letter and be fined up to $750.

In addition, there’s also a penalty of as much as $900 for landlords or property managers providing a false or false Healthy Homes Compliance Statement or information. The person who is liable to pay this fine is the one who is listed on the tenancy agreement as the one who is renting the property which could be the name of the landlord or the property management company.

It is also crucial to note that a landlord who have multiple rental properties may face more severe penalties for not complying. The harshest penalties are given for severe breaches, and landlords with at least six rental properties could be penalised up to $50,000 and as high as $100,000 in hearing claims.

Unreasonable Gaps & Holes

Draught Stopping Pauatahanui

Draughts increase the likelihood of less temperature in households. A damp house is more expensive to heat, which results in wasting money and energy.

If a draft can be perceived as a result of gaps or holes, it needs to be sealed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a hole or gap and you can feel it, it’s probably a gap or crack that requirements sealing in some way. Large gaps and cracks should be stopped permanently. Gaps greater than 3mm that allow air in or out within the home require the sealing. For instance, if an open fireplace is not in use, it can cause draughts and must be sealed from. Property managers and landlords are responsible for ensuring that such draughts are squelched whenever imaginable.

There is no need to block gaps or holes that are part of the construction. For example, tiny gaps around windows and doors may be required to allow for the movement of the structure when the house heats and cools, to allow them to be opened and closed rather than being stuck. We will inspect the windows and doors in an Healthy Homes assessment of your rental property.

The proper heating equipment is crucial for healthy homes

Heating Pauatahanui

Pauatahanui rental properties must have a fixed heating source that can warm the main or largest living space to at least 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs to be fixed (i.e., not portable) with at least 1.5 kW of heating capacity, and meet the minimum required heating capacity for the main living room. A Heating Assessment Tool may be used to determine if the permanent heater(s) are adequate or if you’ll need to top up by adding a second heater. Open fires and unflued combustion heaters like the portable LPG bottle heaters are not considered acceptable heating options for The Healthy Homes Standard.

If the heating that you provide is electric heating (or heat pump), then it must be equipped with an thermostat. This will help make the heating more consistent and effective. In most homes, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. However, in certain instances like small apartment buildings small apartments, a smaller electric fixed heater might be enough.

If the living area already has a fixed heating source, such as the heat pump, it may require an upgrade to ensure it meets the requirements. Some types of heaters can’t be used to comply with the standard as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Pauatahanui

Every living space of a rental home must include at least one open windows or an exterior door to provide natural airflow. Furthermore, moist spaces like kitchens and bathrooms should be equipped with an externally vented extractor to take moisture away.

This ventilation quality is all about recognising that dried air can be much easier to heat, and that a well ventilated rental property is less likely to develop mould and damp.

Bedrooms, living rooms, kitchens and dining rooms are considered liveable areas. Connecting spaces such as the hallway aren’t considered living spaces and therefore don’t need an opening door or window.

Every window, door or Skylight requirements to have the ability open to the outside, but remain closed to allow ventilation and fresh air ventilation.

Bathrooms, kitchens, as well as any other space in your home with a bath, shower cooker or any other moisture generating item will need adequate extractor fans which are vented towards the outside. Our Healthy Homes Assessment service will ensure that there is sufficient ventilation in every living space that includes extractor fans that are suitable for areas that are high in moisture.

Insulation Pauatahanui

Ceiling and underfloor insulation has been compulsory for all rent houses since 1 July 2019. All landlords and property managers have to make sure that the insulation is up to the new quality. In some instances, existing ceiling insulation or insulation in the subfloor space may need to be topped up or replaced.

A house that is well-insulated will help to control condensation and lessen the likelihood of mould and dampness, and it will make an easier task to allow the household to keep the heat.

Insulation needs to be in compliance with the R-values that are appropriate for your region.

The "R" is a symbol for thermal resistance and is a gauge of how well the insulation resists heat flow. The higher the R-value, the better the insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 Underfloor R 1.3
  • Zone 2 – the rest of the North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3, underfloor R 1.3

Pauatahanui Moisture Ingress & Drainage

Making sure your rental property is protected from moisture isn’t just about the inside of the building it’s also about the outside. You must make sure there is somewhere for surface as well as groundwater to move, and to prevent it from getting inside. When it is about damp and water, it is typically not apparent that it can become a big problem and end up causing the property to suffer and affecting the tenant’s health.

Properties that are rented must have effective drainage to get rid of floodwaters, surface water and groundwater, with an appropriate runoff or outfall. Making sure that water has a location to go, and that it doesn’t get sucked into structures is a crucial aspect of maintaining your property’s dry.

Alongside a drainage system to avoid moisture ingress, if your apartment has an enclosed gap between floorboards and ground, a ground moisture barrier must be put in place when it’s reasonably practicable to do so.

The ground-moisture barrier usually an insulating sheet of polythene laid over the ground to stop any moisture that is present in the ground from entering the building. It also helps to prevent moisture damage to the underfloor insulation.
