Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Pauatahanui rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Pauatahanui rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with any of the Healthy Homes Standards within the period of time expected can lead to an amount of $7200. The person who is responsible for this fine is whoever is named on the lease contract as the person who is letting the property and it could be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance needs to be correct when the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s also crucial to remember that a landlord with several rental properties can face additional fines for non-compliance. The harshest penalties are given for severe violations, and landlords who own more than six properties could be fined up to $50,000, or as high as $100,000 in hearings.

Pauatahanui Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory in all Pauatahanui and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate the compliance with the Healthy Homes Standards that apply or will be in force during the tenancy of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords have to make sure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed , or altered tenant.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All households let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.
