Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Pauatahanui rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

Since the 1st July of 2021, when a new, renewed or varied Tenancy is signed for a Pauatahanui rental property, all Healthy Homes compliance work must be done inside of 90 days.

Furthermore, there’s an additional fine of as much as $900 for landlords and property managers who have provided a false or misleading Healthy Homes Compliance Statement or other information. The person responsible for this fine is whoever is named on the lease agreement as the one who is who is letting the property It could also be the name of the landlord or the company that manages the property.

It is also important to remember that a landlord who have several rental properties can face more severe penalties for not complying. The most severe penalties are given only for serious violations. Those who have more than six properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Pauatahanui Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement for all Pauatahanui and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records that prove the compliance with the Healthy Homes Standards that apply or will be applied during the tenancy of your rental home.

From 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a renewal, new or a change in tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy began.

Heating Pauatahanui

Pauatahanui rental properties require a reliable source of heating that is able to heat the main or largest living space to at least 18degC, even on the coldest days of the year.
