Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Paremata rental property, all Healthy Homes compliance work need to be done within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on the Paremata rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to any of the Healthy Homes Standards within the anticipated timeframe could result in a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy agreement it could result in an additional fine or violation fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager does not provide the information requested within 21 days of being informed of the request, they may receive an infringement notification and could be fined up to $750.

In addition, there’s also a penalty of approximately $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the one who is identified on the tenancy agreement as being the person who is letting the property and it could be the name of the landlord or the company that manages the property.

The information contained in the Statement of Compliance requirements to be current when the tenancy contract is signed, and ideally it should be maintained throughout the duration of the tenancy when any related work is completed.

It’s crucial to be aware that a landlord who have multiple rental properties could face greater penalties for non-compliance. The highest penalties are handed down for severe breaches. Landlords with six or more properties can be fined as high as $50,000 and as high as $100,000 in hearings.

Paremata Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement throughout Paremata and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the conformance to the Healthy Homes Standard that apply or will be in force throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must adhere to the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Paremata

Draughts are a major cause of dropping temperatures within houses. A humid home will cost more to heat, which results in wasting money and energy.

Adequate heaters are crucial to ensure well-being houses

Heating Paremata

Paremata rental properties need to have a stable source of heat that can heat the main or largest living room to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source requirements for it to be permanent (i.e., not portable) that is, at least 1.5 Kilowatts in heating capacity, and meet the minimum heating capacity needed for the main living room. A Heating Assessment Tool could be used to determine whether the current fix heater(s) are adequate or whether you will require to ‘top up’ with an additional heater. Open fires and unflued combustion heaters like the portable LPG bottle heaters are not considered acceptable heating options under The Healthy Homes Standard.

If the heating you provide is an electric heater (or heat pump), it should be equipped with the thermostat. This makes the heating more reliable and effective. In most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, like apartments with small spaces an electric, fixed heater may be sufficient.

If your main living space already has a permanent heating source, like heat pumps, it could require an upgrade to be able to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the standard because they’re not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Paremata

Insulation Paremata

Underfloor and ceiling insulation has been compulsory for all rent homes as of July 1st, 2019. All landlords and property managers must ensure the insulation meets the new quality. In some cases, old ceiling insulation as well as insulation within the subfloor space might need to be topped up or replaced.
