Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Paremata rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on the Paremata rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy contract, there may be additional penalties or an infringement fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not supply the information requested within 21 days of receiving the request, they can receive an infringement notice and be fined up to $750.

In addition, there’s also a penalty of up to $900 for property owners or property managers that provide false or incorrect Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the one who is named on the lease contract as the person leasing the property out which could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement requirements to be accurate before the tenancy agreement can be signed, and ideally it should be kept updated throughout the tenancy as any associated work has been completed.

It’s also crucial to remember that a landlord who manage multiple rental properties may receive additional fines for non-compliance. The most severe penalties are handed down for the most serious violations, and landlords who own six or more properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory throughout Paremata and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records that prove compliance with all Healthy Homes Standard that apply or will be applied throughout the tenancy period of your rental home.

From July 1st 2021

  • Private landlords and property managers have to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts may lead to less temperature in houses. A damp house costs more to heat, which means wasting money and energy.

Heating Paremata

Rental properties in Paremata require a reliable source of heating which can warm the main or largest living space to a minimum of 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs for it to be permanent (i.e. not portable) with at least 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity to heat the living space in general. For most properties, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are required. If your main living space already has a permanent heating source, like an air conditioner, it may require a top up to make sure it meets the requirements. Certain types of heaters cannot be used to achieve the quality as they are either inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Paremata

Every living space in a rental home must have at least one openable windows or an exterior door to offer natural ventilation. Additionally, areas with high moisture areas such as kitchens and bathrooms must have a suitable venting fan outside to remove moisture.

Insulation for underfloor and ceilings has been compulsory on all rental houses since 1 July 2019. All landlords and property managers are required to make sure that the insulation is in line with current standard.
