Did you be aware that the Healthy Homes Standards came into effective on July 1st, 2021? Landlords are now required to ensure that their Paremata rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy, and all private rentals must be fully in compliance by July 1st 2024.

Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed for a Paremata rental property, all Healthy Homes compliance work must be finished inside of 90 days.

From the 1st of July in 2021, if a new or renewed contract is signed on the Paremata rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy agreement, there may be an additional penalty or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or the property manager doesn’t provide the required information within 21 days from receiving the request, they will receive an infringement notice and be fined up to $750.

Additionally, there is also a penalty of up to $900 for landlords and property managers providing a false or misleading Healthy Homes Compliance Statement or other information. The person liable for this fine is the one who is named on the lease contract as the person renting the property and it could be the name of the landlord, or the company that manages the property.

All the information on the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be executed, and it must be updated during the entire tenancy, as associated work has been completed.

It’s also important to be aware that a landlord with multiple rental properties could face even higher fines for non-compliance. The most severe penalties are given only for serious breaches, and landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory in all Paremata and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate conformance with the Healthy Homes Standard that apply or will apply to your rental home.

From 1 July 2021

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Draughts are a major cause of less temperature in households. A humid house is more expensive to heat, meaning wasting energy and resulting in higher bills.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or a clear draught from a gap or hole and you are able to feel it, it is most likely a gap or hole that requirements sealing in the way you can. Large cracks and gaps should be sealed permanently. The gaps that exceed 3mm that allow air in or out within the house need sealing. For instance, if an open fireplace isn’t in use it can create draughts. This should be blocked off. For instance, small gaps around windows and doors could be required to allow for movement of the building as the household warms and cools in order to let them be closed and opened instead of than being stuck. Heating Paremata

Rental properties in Paremata require a reliable source of heat which can warm the principal or the biggest living space to at least 18degC, even during the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental well-being.

The heating source requirements to remain fixed (i.e., not portable), at least 1.5 kW of heating capacity, and must meet the minimum required heating capacity for the main living room. For most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases such as small apartments, a smaller fixed electric heater might be enough.

If your living space already has a central heating source like an air conditioner, it could require an upgrade to meet the standards. Some types of heaters can’t be utilised to meet the standard since they’re either expensive, inefficient or unsafe to operate.

In certain situations, the current ceiling insulation, or the insulation of the subfloor space may need to be added or replaced.
