Fines for Failing to Comply
As of 1st July 2021, when a brand new or renewed tenancy is signed on a Paremata rental property, all Healthy Homes compliance tasks need to be done inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or amended tenancy agreement there may be an additional fine or infringement fee.
Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager is unable to supply the required information within 21 days from receiving the request, they may receive an infringement letter and be fined up to $750.
Additionally, there is an additional fine of up to $900 for landlords or property managers that provide false or false Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the person who is named on the lease agreement as being the person leasing the property out, so it could be the name of the landlord as well as the property management company.
All information in the Compliance Statement requirements to be correct when the tenancy agreement is executed, and it must be updated throughout the duration of the tenancy when any necessary work related to it is finished.
It is also important to keep in mind that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are given for the most serious violations. Those who have at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in hearing claims.
