Healthy Homes Assessment Services

Did you know that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords now have to make sure that their Paremata rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any renewed or new tenancy and all private rentals must be fully in compliance by July 1st 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed for a Paremata rental property, all Healthy Homes compliance items must be taken care of within 90 days.

From the 1st of July in 2021, if a new or renewed lease is entered into on a Paremata rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet each of Healthy Homes Standards inside of the expected timeframe can result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or amended tenancy agreement there may be an additional fine or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager fails to supply the required information within 21 days of receiving the request, they will receive an infringement notice and be fined up to $750.

Furthermore, there’s also a fine of approximately $900 for landlords or property managers who have provided a false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the one who is named on the tenancy agreement as the one who is letting the property out and it could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be accurate before the tenancy agreement can be completed, and is updated throughout the tenancy as any associated work has been completed.

It is also important to keep in mind that a landlord who have multiple rental properties may receive additional fines for non-compliance. The highest penalties are reserved for the most serious breaches, and landlords with at least six rental properties could be fined as high as $50,000, or as high as $100,000 in hearings.

Paremata Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory in all Paremata and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with any Healthy Homes Standards that apply or will be applicable during the tenancy of an apartment rental.

From 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform to the Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.

What are unjustifiable gaps or holes?

If you can feel external air entering or the sound of a clear draught emanating from a crack or a gap that is, it is probably a gap or an opening that requirements sealing in the way you can. Adequate heaters are important to ensure well-being houses

Heating Paremata

Rental properties in Paremata must have a fixed source of heating that is able to heat the principal or the biggest living area to at minimum 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat needs to be fixed (i.e. not portable) with at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity for the main living space. A Heating Assessment Tool may be used to determine if the current fix heater(s) are sufficient or whether you will require to ‘top up’ by adding a second heater. Open fires and unflued combustion heaters such as small portable LPG bottle heaters aren’t considered acceptable heating options under those following the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, it should include a thermostat. This will make the heating more reliable and efficient. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in some cases like small apartments an electric, fixed heater could be enough.

If the main living room already has a permanent heating source, such as the heat pump, it might need an upgrade in order to comply with the standards. Certain types of heaters cannot be utilised to meet the quality as they are either expensive, inefficient or are unsafe to operate.

Ventilation Paremata

Every living space of a rental property must have at least one opening windows or an exterior door to provide natural airflow. In addition, humid spaces like kitchens and bathrooms should be equipped with an externally vented extractor fan to get rid of moisture.

Insulation Paremata

Insulation for underfloor and ceilings has been compulsory in all rental homes from 1 July 2019. All landlords and property managers are required to ensure that the insulation meets current quality. In some cases, old ceiling insulation as well as insulation within the subfloor space may need to be filled with or replaced.

A well-insulated property can help control condensation, and decrease the risk of dampness and mould, and will also make much easier to allow the house to keep the heat.
