Fines for Failing to Comply

As of 1st July 2021, if a new or renewed contract is signed on a Paremata rental property, all Healthy Homes compliance items need to be finished by the end of 90 days.

It is crucial to remember that landlords with multiple rental properties may receive more severe penalties for not complying. The most severe penalties are reserved for severe breaches, and landlords with six or more properties can be fined as high as $50,000, or as high as $100,000 in hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory throughout Paremata and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate the conformance to any Healthy Homes Standards that apply or will be applied during the tenure of your rental home.

Starting 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties conform according to Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.

Heating Paremata

Rental properties in Paremata require a reliable heating source that can warm the largest or main living room to at least 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source requirements for it to be permanent (i.e., not portable) that is, at minimum 1.5 kW in heating capacity, and must meet the minimum heating capacity needed for the main living space. A Heating Assessment Tool may be used to determine if the fixed heater(s) are adequate or if you’ll need to "top-up" with a new heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters aren’t considered to be safe heating options in the Healthy Homes Standard.

If the heating you offer is an electric heater (or heat pump), then it must include the thermostat. This makes the heating more uniform and effective. For most properties, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In some instances, like small apartment buildings small apartments, a smaller electric fixed heater might be enough.

If your living space already has a fixed heating source like the heat pump, it could require some additional energy to meet the standards. Certain kinds of heaters cannot be utilised to meet the quality because they’re expensive, inefficient or unsafe to operate.

Underfloor and ceiling insulation is a requirement in all rental houses as of July 1st, 2019. Property managers and landlords must ensure the insulation meets this new standard. In some instances, an existing insulation on the ceiling or in the sub floor space might need to be added or replaced.
