Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed for a Paremata rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

From the 1st of July in 2021, when a new or renewed contract is signed on the Paremata rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to one of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or the property manager doesn’t provide the necessary information within 21 days of getting the notice, the tenant will be issued an infringement notice and be fined up to $750.

In addition, there is an additional fine of up to $900 for property owners or property managers that provide false or misleading Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is listed on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord as well as the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy contract is signed, and ideally it must be updated during the entire tenancy, as related work is completed.

It’s also important to remember that landlords with multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for the most serious breaches. Landlords with more than six properties could be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is required for all Paremata and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate compliance with all Healthy Homes Standards that apply or will apply to their rental properties.

Starting 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply according to Healthy Homes Standard within 90 days of a renewal, new or a change in lease.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Paremata

Draughts increase the likelihood of low temperatures inside houses. A draughty house will cost more to heat, meaning wasting money and energy.

If a draught can be felt through gaps that are too large or holes, it needs to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air coming in or a clear draught from a crack or a gap and you can feel it, it’s likely a crack or hole which requirements sealing in any way. Large cracks and gaps should be sealed permanently. Cracks that are greater than 3mm and let air into or out of the house require the sealing. In the case of an open fireplace isn’t used it may cause draughts and should be sealed from. Property managers and landlords are responsible for making sure that draughts from the fireplace are removed whenever imaginable.

You don’t need to block gaps or holes which are part of the building. For example, tiny gaps around doors and windows could be necessary to allow movement of the building as the house heats and cools, to allow them to be closed and opened rather instead of being stuck. Heating Paremata

Rental properties in Paremata should have a permanent heating source that can warm the main or largest living space to a minimum of 18degC even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs to remain fixed (i.e. not portable) and at least 1.5 horsepower in capacity, and meet the minimum required heating capacity for the main living space. A Heating Assessment Tool can be used to check if the existing installed heater(s) are adequate or if you’ll need to ‘top up’ by adding a second heater. Fires that are open and unflued heaters like mobile LPG bottle heaters aren’t considered to be acceptable heating options under The Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), it needs to be equipped with a thermostat. This makes the heating more reliable and effective. For the majority of homes, bigger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In some instances, like apartments with small spaces small apartments, a smaller electric fixed heater could be enough.

If the main living room is already equipped with a fixed heating source, like a heat pump, then it might just need an upgrade to be able to meet the standards. Certain kinds of heaters cannot be used to meet the quality because they’re expensive, inefficient and/or unsafe to run.

Ventilation Paremata

Every living space in a rental property must have at least one openable door or window to provide natural airflow. In addition, high moisture areas such as kitchens and bathrooms should be equipped with an externally vented extractor fan that can take moisture away.

Insulation Paremata

The insulation of the ceiling and underfloor is required on all rental homes from 1 July 2019. All landlords and property managers are required to make sure that the insulation meets the new standard. In certain situations, the existing ceiling insulation or insulation in the sub floor space may need to be replaced or replaced.

A well-insulated property will reduce the risk of condensation and lower the chance of mould and damp, and it will make more easy to allow the household to hold the heat.
