Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed contract is signed on a Paremata rental property, all Healthy Homes compliance items must be completed inside of 90 days.

Since the 1st July of 2021, if a new, renewed or varied lease is entered into on a Paremata rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy contract, it could result in an additional fine or violation fee.

Paremata Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory throughout Paremata and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove conformance with each Healthy Homes Standard that apply or will apply to their rental properties.

Starting 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any new, renewed or varied lease.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Draughts increase the likelihood of dropping temperatures within homes. A cold house costs more to heat, which results in wasting energy and increased bills.

If a draught is felt through gaps that are too large or holes, it needs to be closed.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or an unobstructed draught coming from a hole or gap or crack, then it is likely a crack or hole which needs sealing in any way. Cracks or gaps with large gaps must be fixed permanently. Any gaps greater than 3mm that allow air to enter or exit from the home need to be sealed. For instance, if an open fireplace is not in use, it could cause draughts, and should be sealed from. Property managers and landlords are responsible for making sure that these draughts are stopped as much as possible.

You don’t require to block up intentional gaps or holes that are part of the construction. For instance, small gaps around windows and doors might be necessary to allow movement of the structure when the household warms and cools to allow them to be closed and opened rather than sticking. Adequate heaters are important for healthy houses

Heating Paremata

Rental properties in Paremata need to have a stable source of heating that is able to heat the largest or main living space to at least 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements that it be permanently fixed (i.e. not portable), at least 1.5 kW in heating capacity, and must meet the minimum requirement for heat capacity to heat the living space in general. Open fires and unflued combustion heaters, such as mobile LPG bottle heaters aren’t considered to be safe heating options in those following the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, then it must be equipped with the thermostat. This makes the heating more reliable and effective. In most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In certain situations, such as small apartments an electric, fixed heater may be sufficient.

If the main living room is already equipped with a fixed heating source, such as an air conditioner, it may require some additional energy to be able to meet the standards. Certain types of heaters cannot be utilised to meet the quality because they’re costly, not cost-effective to run, or unsafe to operate.

Ventilation Paremata

Insulation Paremata

Underfloor and ceiling insulation is a requirement for all rent houses from 1 July 2019. Property managers and landlords must make sure that the insulation meets current quality. In some instances, current ceiling insulation, or the insulation of the sub floor space may need to be topped up or replaced.

A properly insulated home will reduce the risk of condensation and lower the chance of mould and dampness, and it will make more easy to allow the home to keep the heat.
