Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Paremata rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Paremata rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with any of the Healthy Homes Standards inside of the anticipated timeframe could result in penalties of up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy contract, there could be an additional penalty or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the home they are living in. If the property manager is unable to supply the necessary information within 21 days of receiving the request, they can receive an infringement notice and be fined up to $750.

It’s also important to be aware that landlords who have multiple rental properties could face additional fines for non-compliance. The highest penalties are reserved for serious breaches, and landlords with more than six properties could receive fines of up to $50,000, or as high as $100,000 in hearings.

When Do I require to be in compliance with the Healthy Homes Standards?

Paremata Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory in all Paremata and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with any Healthy Homes Standards that apply or will be applied throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords must make sure their rental properties conform with the Healthy Homes Standards within 90 days of a new, renewed , or altered lease.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Paremata

Draughts are a major cause of low temperatures inside homes. A humid house is more expensive to heat, which completed jobs in wasting energy and resulting in higher bills.

If a draught can be felt through gaps that are too large or holes, it needs to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air getting in, or see the sound of a clear draught emanating from a hole or gap or crack, then it is probably a gap or hole that requirements sealing in any way. Large cracks and gaps should be permanently stopped. The gaps that exceed 3mm that let air in or out of the home require to be sealed. For instance, if an open fireplace isn’t in use it can create draughts. This should be blocked off. Property managers and landlords are responsible for making sure that draughts from the fireplace are removed in the maximum extent possible.

You don’t require to block off gaps or holes which are part of the construction. Heating Paremata

Paremata rental properties need to have a stable source of heating that is able to heat the living space to a minimum of 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heating requirements that it be permanently fixed (i.e., not portable) with at minimum 1.5 kW of heating capacity, and must meet the minimum required heating capacity for the main living space. The Heating Assessment Tool can be used to check if the current fix heater(s) are sufficient or whether you will require to "top-up" with an additional heater. If the heating system you provide is an electric heater or heat pump it should include a thermostat. This makes the heating more consistent and effective. In most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in certain instances like small apartment buildings an electric, fixed heater could be enough.

If your living space already has a permanent heating source, like a heat pump, then it might require an update in order to comply with the standards. Certain kinds of heaters cannot be used to comply with the standard since they’re either costly, not affordable to run, or unsafe to operate.

Ventilation Paremata

Insulation Paremata

Ceiling and underfloor insulation is required on all rental houses since July 1, 2019. All landlords and property managers must ensure that the insulation meets the new quality. In some cases, current ceiling insulation, or the insulation of the subfloor space may need to be added or replaced.

A well-insulated house can reduce condensation and lower the chance of mould and dampness, and will also make much easier to allow the household to keep heat.

The "R" refers to thermal resistance, and is a gauge of how well insulation can withstand heat flow. The more high the R-value, more efficient the insulation.
