Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed contract is signed on a Paremata rental property, all Healthy Homes compliance work must be finished inside of 90 days.

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Paremata rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet all of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement it could result in an additional fine or violation fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager is unable to supply the information requested within 21 days from receiving the request, they will receive an infringement notice and be fined upto $750.

In addition, there’s also a penalty as much as $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or other information. The person responsible for this fine is whoever is identified on the tenancy contract as the person letting the property out It could also be the name of the landlord, or the property management company.

Paremata Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is required to all Paremata and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records of their the compliance with any Healthy Homes Standard that apply or will apply throughout the tenancy period of the rental property.

From July 1st 2021

  • Property managers and private landlords are required to make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Paremata

Draughts increase the likelihood of less temperature in households. A cold home is more expensive to heat, which means wasting money and energy.

What are unreasonable gaps and holes?

If you are able to feel external air entering or a clear draught from a hole or gap and you are able to feel it, it is likely a crack or hole that requirements sealing in some way. Cracks or gaps with large gaps must be fixed permanently. Any gaps greater than 3mm that let air into or out of your house require to be sealed. For example, if the open fireplace is not in use, it may cause draughts and should be sealed from. There is no need to block holes or gaps that are part of the building. For example, tiny gaps around doors and windows may be required to allow for movement within the building when the home gets warmer and cooler, so that they can still be opened and closed rather than sticking. Heating Paremata

Paremata rental properties require a reliable source of heating that is able to heat the main or largest living space to at least 18degC, even during the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs that it be permanently fixed (i.e. not portable) that is, at minimum 1.5 kW in heating capacity, and it must have the minimum capacity for heating required for the main living room. A Heating Assessment Tool could be used to check if the existing fixed heater(s) are sufficient or if you’ll need to top up by adding a second heater. Open fires and unflued combustion heaters, such as the portable LPG bottle heaters aren’t considered to be suitable heating options for The Healthy Homes Standard.

If the heating you provide is an electric heater or heat source, then it must be equipped with a thermostat. This will help make the heating more uniform and effective. For most properties, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances like apartments with small spaces the smaller fixed electric heater may suffice.

If your living space already has a fixed heating source like the heat pump, it might need some additional energy to be able to meet the standards. Certain kinds of heaters aren’t able to be utilised to meet the standard as they are either expensive, inefficient or are unsafe to operate.

Ventilation Paremata

Property managers and landlords should make sure that the insulation is up to standards that are in line with the latest standard.
