Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed for a Paremata rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Paremata rental property, all Healthy Homes compliance work must be done within 90 days.

Inability to adhere to one of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or amended tenancy agreement there could be additional penalties or an infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager fails to provide the information requested within 21 days from receiving the request, they could be issued an infringement notice and be fined upto $750.

In addition, there is an additional fine of as much as $900 for landlords or property managers who offer a false or incorrect Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the person who is listed on the tenancy contract as the person letting the property out and it could be the landlord’s name or the property management company.

It’s also crucial to keep in mind that a landlord who own several rental properties can face even higher fines for non-compliance. The harshest penalties are handed down for severe breaches. Landlords with six or more properties can be fined up to $50,000 and as high as $100,000 in the case of hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory in all Paremata and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with the Healthy Homes Standard that apply or will be in force during the tenancy of the rental property.

From 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a new, renewed , or altered tenant.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Adequate heaters are important to ensure well-being houses

Heating Paremata

Paremata rental properties must have a fixed source of heating that can warm the largest or main living room to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating needs that it be permanently fixed (i.e., not portable) that is, at minimum 1.5 horsepower in capacity and have the minimum required heating capacity for the main living space. Ventilation Paremata

The insulation of the ceiling and underfloor is mandatory to all rental homes from 1 July 2019. Property managers and landlords must make sure that the insulation meets the new standard.
