Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied contract is signed on a Paremata rental property, all Healthy Homes compliance tasks need to be taken care of inside of 90 days.

From the 1st of July in 2021, if a new or renewed Tenancy is signed for the Paremata rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

In addition, if the present Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy agreement, it could result in additional penalties or an infringement fee.

Paremata Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory for all Paremata and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records of their compliance with each Healthy Homes Standard that apply or will be in force during the tenure of their rental properties.

From 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Paremata

Paremata rental properties must have a fixed source of heating which can warm the largest or main living space to a minimum of 18degC, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health as well as their mental health.
