Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed for a Paremata rental property, all Healthy Homes compliance tasks have to be taken care of within 90 days.

In addition, there is an additional fine of approximately $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Compliance Statement or other information. The person responsible for this fine is whoever is listed on the tenancy agreement as the one who is letting the property out and it could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be up-to-date before the tenancy agreement can be signed. It is updated during the entire tenancy, as associated work has been completed.

It is also important to remember that landlords with multiple rental properties may face more severe penalties for not complying. The highest penalties are reserved for severe violations, and landlords who own six or more properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement throughout Paremata and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or altered tenancy contract.
