Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on a Papakowhai rental property, all Healthy Homes compliance items have to be done inside of 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on a Papakowhai rental property, all Healthy Homes compliance work must be taken care of within 90 days.

The person responsible for this fine is the one who is listed on the tenancy agreement as the one who is leasing the property out which could be the name of the landlord, or the property management company.

Papakowhai Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory throughout Papakowhai and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with all Healthy Homes Standards that apply or will apply throughout the tenancy period of their rental properties.

From July 1st 2021

  • Property managers and private landlords are required to ensure their rental properties conform to the Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy began.
