Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for a Papakowhai rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

In addition, there is also a fine of approximately $900 for landlords or property managers providing a false or false Healthy Homes Statement of Compliance or information. The person responsible to pay this fine is the one who is listed on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord as well as the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date when the tenancy contract is completed, and must be updated during the entire tenancy, as related work is completed.

It’s also crucial to be aware that a landlord with multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are reserved only for serious violations. Those who have six or more properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Papakowhai Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory in all Papakowhai and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records of their conformance with each Healthy Homes Standards that apply or will be applicable during the tenancy of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords should ensure their rental properties conform according to Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy began.

Draughts are a major cause of lower temperatures in houses. A humid home will cost more to heat, resulting in wasted energy and incurring higher costs.

If a draught is felt from unreasonable gaps or holes, it needs to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or the sound of a clear draught emanating from a gap or hole that is, it’s likely a crack or hole that requirements sealing in the way you can. Cracks and gaps that are large should be permanently stopped. Cracks that are greater than 3mm and allow air in or out from the house need seals. For example, if an open fireplace isn’t being used, it could cause draughts, and should be shut off. Landlords and property managers are responsible for ensuring that draughts from the fireplace are removed in the maximum extent imaginable.

You don’t need to block holes or gaps which are part of the building. For example, tiny gaps around windows and doors may be required to allow for the movement of the structure as the house warms and cools so that they are able to be closed and opened instead of instead of being stuck. Adequate heaters are crucial to ensure healthy houses

Heating Papakowhai

Papakowhai rental properties must have a fixed source of heating which can warm the largest or main living space to at least 18degC, even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements that it be permanently fixed (i.e. not portable) with at minimum 1.5 kW in heating capacity and have the minimum capacity for heating required in the living area. If the heating system you offer is electric heating or heat pump it must be equipped with an thermostat. This makes the heating more uniform and efficient. For the majority of homes, bigger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are required. In some instances, like apartments with small spaces the smaller fixed electric heater may suffice.

If your living space already has a central heating source, such as the heat pump, it could need a top up to be able to meet the standards. Some types of heaters can’t be used to achieve the quality as they are either costly, not cost-effective to run, and/or unsafe to run.
