Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Papakowhai rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

As of 1st July 2021, if a new, renewed or varied contract is signed on a Papakowhai rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with each of Healthy Homes Standards within the deadlines can result in an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy agreement, there could be an additional fine or violation fee.

Papakowhai Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is mandatory in all Papakowhai and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records of their the conformance to all Healthy Homes Standards that apply or will apply throughout the tenancy period of the rental property.

From July 1st 2021

  • Property managers and private landlords must make sure their rental properties conform with the Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy began.

Rental properties in Papakowhai should have a permanent source of heat that is able to heat the living space to at least 18degC, even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.
