Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Papakowhai rental property, all Healthy Homes compliance tasks need to be completed by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on the Papakowhai rental property, all Healthy Homes compliance work must be completed within 90 days.

It’s also crucial to note that landlords who manage multiple rental properties could face even higher fines for non-compliance. The most severe penalties are handed down for severe breaches. Landlords with six or more properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

When should I need to be in compliance with The Healthy Homes Standards?

Papakowhai Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement throughout Papakowhai and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the compliance with the Healthy Homes Standard that apply or will be applicable during the tenancy of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers should make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of when the tenancy began.

Papakowhai rental properties need to have a stable heating source that can warm the main or largest living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs for it to be permanent (i.e., not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum heating capacity needed for the main living room. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in some cases like small apartment buildings small apartments, a smaller electric fixed heater may suffice.
