Did you be aware that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords now have to make sure their Papakowhai rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any renewal or new tenancy and all private rentals are required to be fully compliant by 1 July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Papakowhai rental property, all Healthy Homes compliance items have to be completed by the end of 90 days.

From the 1st of July in 2021, if a new, renewed or varied Tenancy is signed for the Papakowhai rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or amended tenancy agreement there may be an additional fine or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or the property manager doesn’t supply the necessary information within 21 days from having received the inquiry, they can be issued an infringement notice and be fined as high as $750.

Additionally, there is an additional fine of up to $900 for landlords or property managers who offer a false or incorrect Healthy Homes Compliance Statement or information. The person who is responsible to pay this fine is the one who is named on the lease agreement as the one who is who is letting the property which could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance needs to be accurate when the tenancy contract is signed, and ideally it should be maintained through the tenancy period as necessary work related to it is finished.

It is also important to remember that landlords who have several rental properties can face more severe penalties for not complying. The most severe penalties are handed down for the most serious breaches. Landlords with six or more properties can be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Papakowhai Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory to all Papakowhai and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate the compliance with any Healthy Homes Standards that apply or will be in force during the tenure of an apartment rental.

From 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

If you are able to feel external air coming in or an unobstructed draught coming from a gap or hole or crack, then it is probably a gap or an opening that requirements sealing in any way. Heating Papakowhai

Papakowhai rental properties must have a fixed source of heat which can warm the main or largest living room to at least 18degC even on the coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating needs for it to be permanent (i.e. not portable) and at least 1.5 Kilowatts in heating capacity and have the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to determine if the current fixed heater(s) are sufficient or if you’ll need to ‘top up’ with an additional heater. Open fires and unflued combustion heaters such as the portable LPG bottle heaters are not considered acceptable heating options in those following the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump, it must have the thermostat. This will help make the heating more consistent and effective. For the majority of homes, bigger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are required. In some instances, like small apartments small apartments, a smaller electric fixed heater could be enough.

If your living space already has a central heating source like the heat pump, it might just need an upgrade to meet the standards. Certain kinds of heaters cannot be used to meet the quality as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Papakowhai

Ceiling and underfloor insulation has been compulsory in all rental houses since 1 July 2019. Property managers and landlords must make sure that the insulation meets the new standard. In some instances, old ceiling insulation as well as insulation within the sub floor space may need to be added or replaced.
