Did you have any idea that the Healthy Homes Standards came into effect on the 1st July 2021? The landlords are now required to make sure their Papakowhai rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rental properties are required to be completely certified by 1 July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed contract is signed on a Papakowhai rental property, all Healthy Homes compliance tasks need to be completed by the end of 90 days.

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on the Papakowhai rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to adhere to any of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or amended tenancy agreement there may be an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they are related to the house they live in. If the property manager does not provide the required information within 21 days from being informed of the request, they may be issued an infringement notice and be fined as high as $750.

Furthermore, there’s also a penalty as much as $900 for property owners or property managers providing a false or false Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the one who is named on the tenancy agreement as being the person letting the property out, so it could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance needs to be current at the time that the tenancy agreement is completed, and should be maintained during the entire tenancy, as associated work has been completed.

It is also crucial to remember that a landlord who manage multiple rental properties could face even higher fines for non-compliance. The highest penalties are reserved for the most serious violations. Those who have at least six rental properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.

Papakowhai Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is mandatory for all Papakowhai and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standard that apply or will be applied during the tenure of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform according to Healthy Homes Standards within 90 days of any new, renewed , or altered lease.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must adhere to the Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts are a major cause of less temperature in households. A cold home will cost more to heat, meaning wasting money and energy.

If a draught is noticed from gaps that are not adequate or holes or holes, it needs to be closed.

Proper heating is crucial to ensure healthy homes

Heating Papakowhai

Rental properties in Papakowhai should have a permanent source of heating that can warm the main or largest living room to at least 18degC, even during the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs that it be permanently fixed (i.e., not portable) that is, at least 1.5 Kilowatts in heating capacity, and must meet the minimum capacity for heating required to heat the living space in general. Every living space in a rental home must have at least one opening windows or an exterior door to offer natural ventilation. Additionally, areas with high moisture areas like kitchens and bathrooms should be equipped with an externally vented extractor to get rid of moisture.

Underfloor and ceiling insulation is mandatory for all rent houses since 1 July 2019. Property managers and landlords should ensure that the insulation is in line with the new standard. In some cases, old ceiling insulation as well as insulation within the subfloor space may need to be filled with or replaced.
