Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? The landlords are now required to ensure their Papakowhai rental properties meet the minimum Healthy Homes Standards within 90 days of a renewal or new tenancy and all private rentals must be fully compliant by 1 July 2024.

Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Papakowhai rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied lease is entered into on the Papakowhai rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.

Anyone can request details regarding the Healthy Homes Standard and how they are related to the house they reside in. If the the property manager doesn’t supply the necessary information within 21 days of having received the inquiry, they can receive an infringement notification and be fined upto $750.

Additionally, there is an additional fine of as much as $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is named on the lease agreement as the person who is renting the property which could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be current when the tenancy contract is signed. It must be updated throughout the tenancy as any associated work has been completed.

It’s also important to remember that a landlord who have multiple rental properties may face more severe penalties for not complying. The most severe penalties are given only for serious violations. Those who have six or more properties could receive fines of up to $50,000, and even as high as $100,000 in hearing claims.

Papakowhai Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory in all Papakowhai and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate conformance with all Healthy Homes Standards that apply or will apply throughout the tenancy period of your rental home.

From July 1st 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a new, renewed or varied lease.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must adhere to the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.

What are the most unreasonable gaps or holes?

If you are able to feel external air flowing in or an unobstructed draught coming from a gap or hole that is, it is most likely a gap or crack that needs sealing in the way you can. Cracks or gaps with large gaps must be stopped permanently. The gaps that exceed 3mm that allow air in or out within your home require sealing. For example, if an open fireplace isn’t in use it can cause draughts and should be shut off. Landlords and property managers are responsible for making sure such draughts are eliminated whenever possible.

You don’t need to block holes or gaps which are part of the construction. For example, tiny gaps around doors and windows could be necessary to allow for movement of the structure when the house is heated and cools in order to let them be closed and opened rather than being stuck. Heating Papakowhai

Papakowhai rental properties require a reliable source of heat which can warm the main or largest living area to at minimum 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat needs for it to be permanent (i.e. not portable) and at least 1.5 kW of heating capacity, and must meet the minimum capacity for heating required for the main living room. A Heating Assessment Tool may be used to determine whether the existing permanent heater(s) are sufficient or whether you will need to top up by adding a second heater. Fires that are open and unflued heaters like the portable LPG bottle heaters are not considered to be safe heating options in those following the Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), then it must include an thermostat. This will help make the heating more uniform and effective. In most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. In some instances, like small apartments the smaller fixed electric heater may suffice.

If your main living space is already equipped with a fixed heating source such as an air conditioner, it might need a top up to make sure it meets the requirements. Some types of heaters can’t be used to meet the standard because they’re inefficient, unaffordable to operate or unsafe to operate.

Ventilation Papakowhai

Every living space in a rental property must have at least one openable doors or windows to provide natural airflow. Furthermore, moist areas like kitchens and bathrooms must have a suitable externally vented extractor fan that can take moisture away.

A ventilation standard is all about recognising the fact that the dry atmosphere is more easy to heat and an apartment that is well-ventilated is less likely to be a victim of mould and damp.

Living rooms, bedrooms, kitchens and dining rooms are considered to be liveable spaces. Connecting spaces like the hallway aren’t considered living spaces and therefore are not need an opening door or window.

Every window, door or skylight needs to be able to open to the outside while remaining closed in order to allow ventilation and fresh air ventilation.

The bathrooms in all kitchens and any other room in your house that houses a bath, shower or cooktop, or any other moisture generating item will require appropriate extractor fans that vent to the outside. Insulation Papakowhai

The insulation of the ceiling and underfloor is a requirement on all rental homes since July 1, 2019. All landlords and property managers have to ensure that the insulation is in line with current standard. In some cases, an existing insulation on the ceiling or in the subfloor space may require to be topped up or replaced.
