Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Papakowhai rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

From the 1st of July in 2021, if a new, renewed or varied Tenancy is signed for the Papakowhai rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet each of Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the property manager does not provide the information requested within 21 days of receiving the request, they can receive an infringement notice and be fined up to $750.

Additionally, there is an additional fine of as much as $900 for property owners or property managers that provide false or false Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the one who is named on the lease agreement as the person who is leasing the property out It could also be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be accurate when the tenancy contract is signed. It must be updated throughout the duration of the tenancy when any related work is completed.

It is important to note that a landlord who manage multiple rental properties could face greater penalties for non-compliance. The highest penalties are handed down only for serious breaches, and landlords with six or more properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Papakowhai Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory in all Papakowhai and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records to demonstrate conformance with any Healthy Homes Standard that apply or will be applied throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply with the Healthy Homes Standard within 90 days of any new, renewed , or altered tenant.

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts increase the likelihood of less temperature in houses. A cold house is more expensive to heat, meaning wasting energy and resulting in higher bills.

If a draught is noticed from gaps that are not adequate or holes, it needs to be sealed.

What are unjustifiable gaps or holes?

If you can feel external air getting in, or see an unobstructed draught coming from a hole or gap that is, it’s probably a gap or hole which needs sealing in any way. Large gaps and cracks should be fixed permanently. Any gaps greater than 3mm that allow air to enter or exit into the home need to be sealed. For example, if an open fireplace isn’t being used, it can cause draughts and should be blocked from. Landlords and property managers are accountable for ensuring that such draughts are squelched as far as imaginable.

There is no need to block off gaps or holes in the construction. For example, tiny gaps around windows and doors could be necessary to allow for movement of the structure as the household gets warmer and cooler, to allow them to be closed and opened rather than securing. Adequate heaters are important to ensure healthy houses

Heating Papakowhai

Papakowhai rental properties should have a permanent source of heat that can warm the largest or main living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat needs to be fixed (i.e. not portable) that is, at minimum 1.5 horsepower in capacity, and must meet the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to check if the fix heater(s) are adequate or if you’ll require to top up with an additional heater. Fires that are open and unflued heaters such as portable LPG bottle heaters aren’t considered to be acceptable heating options under the Healthy Homes Standard.

If the heating that you provide is an electric heater or heat pump, then it must have the thermostat. This makes the heating more consistent and effective. For most houses, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are needed. In certain situations, like small apartment buildings small apartments, a smaller electric fixed heater might be enough.

If your main living space already has a permanent heating source such as heat pumps, it could need an upgrade to ensure it meets the requirements. Some types of heaters can’t be used to achieve the quality because they’re expensive, inefficient and/or unsafe to run.

Ventilation Papakowhai

Property managers and landlords have to ensure the insulation meets standards that are in line with the latest quality.
