Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on a Papakowhai rental property, all Healthy Homes compliance items must be taken care of by the end of 90 days.

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on the Papakowhai rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy contract, it could result in an additional penalty or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they reside in. If the property manager fails to supply the information requested within 21 days from being informed of the request, they can receive an infringement notice and could be fined up to $750.

Additionally, there is also a fine of approximately $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is whoever is named on the lease agreement as being the person letting the property out It could also be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance needs to be accurate when the tenancy contract is signed. It is updated during the entire tenancy, as associated work has been completed.

It is important to note that landlords with multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved only for serious violations. Those who have six or more properties could receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Healthy homes are important

What is the reason Healthy Homes Compliance important?

Around 1 in 3 households rent in New Zealand and Papakowhai, and research suggests that rental homes are more likely to be colder, older and are not as efficient heating, and generally tend to be lower quality than owner occupied properties.

Moldy, damp and cold homes can have negative health results, specifically for illnesses like colds, asthma, as well as cardiovascular diseases. In addition, people who report at least four major housing quality problems frequently have lower levels of satisfaction with life and a decrease in well-being.

The improvement in the quality of Papakowhai rental property can allow tenants to experience better physical and mental health as well as lessen disturbance to learning, work and daily life due to health issues. Your investment will also be better protected from mildew, mould and damp damage, meaning less maintenance costs in the long-term.

The Healthy Homes Standards are a set of specific and minimal standards for Heating, Insulation Ventilation and Ventilation and Drainage, and Draught stopping on Papakowhai rental properties.

Unreasonable Gaps & Holes

Draught Stopping Papakowhai

Draughts may lead to lower temperatures in homes. A cold home costs more to heat, which means wasting energy and incurring higher costs.

If a draught is noticed from gaps that are not adequate or holes that it needs to be sealed.

What are unreasonable gaps and holes?

If you can feel external air coming in or the air is clear from a hole or gap or crack, then it is most likely a gap or hole that needs sealing in some way. Large cracks and gaps should be permanently stopped. Cracks that are greater than 3mm and allow air in or out from your house require the sealing. For example, if an open fireplace is not in use, it may cause draughts and should be shut off. Landlords and property managers are accountable for making sure that draughts from the fireplace are removed as far as imaginable.

You don’t need to block off gaps or holes that are part of the construction. For instance, small gaps around doors and windows might be necessary to allow movement of the structure when the house gets warmer and cooler, to allow them to be opened and closed rather than securing. We will inspect the windows and doors as part of the Healthy Homes assessment of your rental property.

A good heating system is crucial for well-being houses

Heating Papakowhai

Rental properties in Papakowhai require a reliable source of heating that can warm the main or largest living room to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements that it be permanently fixed (i.e., not portable) with at minimum 1.5 kW in heating capacity and have the minimum capacity for heating required in the living area. A Heating Assessment Tool may be used to determine if the fixed heater(s) are sufficient or if you’ll require to "top up" with an additional heater. Fires that are open and unflued heaters such as portable LPG bottle heaters aren’t considered to be acceptable heating options in the Healthy Homes Standard.

If the heating you offer is an electric heater (or heat pump), it must have the thermostat. This will make your heating more consistent and efficient. For most houses, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are required. However, in certain instances like apartments with small spaces an electric, fixed heater may suffice.

If your living space already has a central heating source like the heat pump, it might require an upgrade to be able to meet the standards. Some types of heaters can’t be used to meet the quality as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Papakowhai

Every living space of a rental property must have at least one opening windows or an exterior door to provide natural airflow. Additionally, areas with high moisture areas like kitchens and bathrooms should have an externally vented extractor fan that can take moisture away.

This ventilation quality is about recognising that dried air can be more easy to heat and that the property that is properly ventilated will be less prone to developing damp and mould.

Bedrooms, living rooms, kitchens, and dining areas are considered liveable areas. Connecting spaces like the hallways are not liveable and do not require an opening window or door.

Each window, door , or Skylight requirements to have the ability open to the outside, but remain closed, allowing ventilation and fresh air air flow.

All kitchens and bathrooms, and every other room of your home that has shower, bath, cooktop or other high humidity-generating items will need suitable extractor fans that vent towards the outside. We offer a Healthy Homes Assessment service will ensure that there is sufficient ventilation throughout the living spaces with the right extractor fan in areas with high moisture.

Insulation Papakowhai

The insulation of the ceiling and underfloor is mandatory for all rent houses from 1 July 2019. Property managers and landlords should ensure that the insulation is up to standards that are in line with the latest quality. In some cases, an existing insulation on the ceiling or in the sub floor space may need to be replaced or replaced.

A properly insulated home can reduce condensation, and decrease the risk of mould and dampness and also makes more easy to allow the home to hold warmth.

Insulation requirements to meet the R-values of your area.

The "R" signifies thermal resistance and is a gauge of how well the insulation is able to resist heat flow. The higher the R-value, the better the insulation.

  • Zone 1 Zone 1 Auckland & Northland - ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – The rest part of North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3

Papakowhai Moisture Ingress & Drainage

Keeping your rental property safe from dampness isn’t just about the inside but you must ensure there is somewhere to allow surface, rain or ground water, and also stop it from getting inside. When it concerns damp and moisture it’s frequently those concerns that you aren’t aware of that can become a big problem that can cause damage to your investment and affecting the tenant’s well-being.

Rental properties need to be equipped with effective drainage to get rid of storm water, surface water and ground water, which includes an appropriate runoff or outfall. Making sure that the water is able to go, and that it doesn’t get sucked into structures is an crucial aspect of maintaining your property’s dry.

Alongside an irrigation system to stop moisture ingress, if your apartment has an enclosed gap between your floor and ground, a ground moisture barrier should be put in place if it’s reasonably practicable to install it.

The ground-moisture barrier generally a sheet of polythene that is placed over the ground, in order to block any moisture present in the ground from getting into the property. It also assists in preventing from causing damage to the flooring insulation.
