Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Papakowhai rental property, all Healthy Homes compliance work need to be finished inside of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied lease is entered into on the Papakowhai rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy agreement there may be an additional penalty or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager fails to supply the information requested within 21 days from being informed of the request, they may receive an infringement notification and be fined up to $750.

Additionally, there is also a fine of as much as $900 for landlords and property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or information. The person liable to pay this fine is the one who is named on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord, or the property management company.

All information in the Statement of Compliance requirements to be current before the tenancy agreement can be signed, and ideally it is updated throughout the duration of the tenancy when any necessary work related to it is finished.

It is also important to keep in mind that landlords who manage multiple rental properties may face additional fines for non-compliance. The highest penalties are reserved only for serious breaches. Landlords with six or more properties can be penalised up to $50,000, or as high as $100,000 in hearing claims.

Papakowhai Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory throughout Papakowhai and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords are required to keep records to demonstrate conformance with each Healthy Homes Standards that apply or will be applicable throughout the tenancy period of the rental property.

From 1 July 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a new, renewed , or altered lease.
