Fines for Failing to Comply
As of 1st July 2021, when a new, renewed or varied tenancy is signed for a Papakowhai rental property, all Healthy Homes compliance work must be finished within 90 days.
Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Papakowhai rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Failure to comply with all of the Healthy Homes Standards inside of the anticipated timeframe could result in penalties of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated within the new, renewed or amended tenancy agreement there could be an additional fine or infringement fee.
Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager fails to supply the required information within 21 days from being informed of the request, they will receive an infringement letter and be fined as high as $750.
Furthermore, there’s also a penalty of up to $900 for landlords and property managers who have provided a false or false Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the person who is listed on the tenancy agreement as the one who is letting the property out which could be the name of the landlord as well as the company that manages the property.
All information in the Compliance Statement needs to be up-to-date when the tenancy contract is executed, and it is updated during the entire tenancy, as related work is completed.
It is also important to remember that a landlord who own several rental properties can face additional fines for non-compliance. The harshest penalties are handed down only for serious breaches. Landlords with more than six properties could be fined up to $50,000, and as much as $100,000 in hearings.
