Fines for Failing to Comply
As of 1st July 2021, once a new or renewed tenancy is signed for a Papakowhai rental property, all Healthy Homes compliance work have to be completed within 90 days.
As of 1st July 2021, when a new, renewed or varied contract is signed on a Papakowhai rental property, all Healthy Homes compliance work must be taken care of within 90 days.
Failure to meet any of the Healthy Homes Standards inside of the deadlines can result in a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement there could be an additional fine or infringement fee.
Every tenant is entitled to request details regarding the Healthy Homes Standard and how they are related to the house they are living in. If the property manager does not provide the information requested within 21 days of being informed of the request, they could receive an infringement notice and be fined up to $750.
Additionally, there is an additional fine of as much as $900 for landlords or property managers providing a false or incorrect Healthy Homes Statement of Compliance or information. The person liable for this fine is whoever is named on the lease contract as the person leasing the property out, so it could be the landlord’s name or the property management company.
The information contained in the Compliance Statement needs to be current at the time that the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any necessary work related to it is finished.
It’s also important to remember that a landlord with multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are reserved only for serious violations. Those who have more than six properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.
