Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Normandale rental property, all Healthy Homes compliance tasks must be completed by the end of 90 days.

From the 1st of July in 2021, when a brand new or renewed lease is entered into on a Normandale rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not incorporated in the renewal, new or amended tenancy agreement there may be additional penalties or an infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager does not provide the required information within 21 days of getting the notice, the tenant will receive an infringement notification and be fined as high as $750.

In addition, there’s an additional fine of as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is responsible to pay this fine is the one who is named on the tenancy agreement as the person who is leasing the property out and it could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be correct when the tenancy agreement is signed, and ideally it should be kept updated throughout the tenancy as any related work is completed.

It’s also important to keep in mind that a landlord who own several rental properties can face greater penalties for non-compliance. The harshest penalties are given for severe violations. Those who have more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

Normandale Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • Underfloor and ceiling insulation is compulsory for all Normandale and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate conformance with all Healthy Homes Standards that apply or will apply to their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed Tenancy.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Heating Normandale

Rental properties in Normandale must have a fixed source of heat that can warm the largest or main living space to a minimum of 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source requirements for it to be permanent (i.e. not portable), at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity for the main living room. In most homes, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in certain instances like small apartment buildings, a smaller fixed electric heater may suffice.

If the living area already has a permanent heating source such as an air conditioner, it may require a top up to make sure it meets the requirements. Some types of heaters can’t be used to comply with the quality because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Normandale
