Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on a Normandale rental property, all Healthy Homes compliance items must be done within 90 days.

Beginning on July 1st, 2021, if a new or renewed Tenancy is signed for the Normandale rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy contract, it could result in additional penalties or an infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the building they are living in. If the the property manager doesn’t provide the required information within 21 days from being informed of the request, they will receive an infringement letter and be fined upto $750.

Furthermore, there’s an additional fine of up to $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the person who is named on the tenancy contract as the person renting the property and it could be the name of the landlord as well as the property management company.

All information in the Compliance Statement needs to be up-to-date before the tenancy agreement can be completed, and should be kept updated during the entire tenancy, as associated work has been completed.

It is important to remember that a landlord who manage multiple rental properties may receive additional fines for non-compliance. The highest penalties are given only for serious violations. Those who have six or more properties can be fined as high as $50,000 and as high as $100,000 in hearing claims.

Normandale Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement for all Normandale and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the conformance to any Healthy Homes Standards that apply or will apply throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords have to make sure their rental properties conform with the Healthy Homes Standard within 90 days of any new, renewed , or altered Tenancy.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Proper heating is crucial for healthy homes

Heating Normandale

Rental properties in Normandale must have a fixed heating source that can heat the largest or main living room to at least 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.
