Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Normandale rental property, all Healthy Homes compliance items have to be taken care of within 90 days.

Since the 1st July of 2021, when a new or renewed tenancy is signed on the Normandale rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. The person liable for this fine is the person who is named on the tenancy contract as the person renting the property which could be the name of the landlord as well as the company that manages the property.

The information contained in the Statement of Compliance needs to be current when the tenancy contract is signed, and ideally it must be updated through the tenancy period as associated work has been completed.

It’s crucial to be aware that landlords who own multiple rental properties could face greater penalties for non-compliance. The harshest penalties are handed down for severe breaches. Landlords with six or more properties could be fined up to $50,000, and as much as $100,000 in hearings.

Normandale Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required to all Normandale and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with all Healthy Homes Standards that apply or will apply throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords are required to make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any renewal, new or a change in lease.

If the main living room already has a fixed heating source, like heat pumps, it might need a top up in order to comply with the standards. Certain types of heaters cannot be used to achieve the standard because they’re not effective, cost prohibitive to operate and/or unsafe to run.
