Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Normandale rental property, all Healthy Homes compliance work need to be done by the end of 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on the Normandale rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with each of Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the home they reside in. If the property manager is unable to provide the necessary information within 21 days from receiving the request, they could receive an infringement notice and be fined upto $750.

Furthermore, there’s also a fine of up to $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is whoever is listed on the tenancy agreement as the person who is renting the property which could be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance needs to be current at the time that the tenancy agreement is signed, and ideally it should be kept updated throughout the duration of the tenancy when any relevant work gets completed.

It is also crucial to note that a landlord who own multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are handed down for severe violations, and landlords who own at least six rental properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Normandale Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory to all Normandale and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with all Healthy Homes Standard that apply or will be applied throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Normandale

Draughts increase the likelihood of low temperatures inside homes. A draughty home costs more to heat, which means wasting energy and incurring higher costs.

If a draft can be felt through gaps that are too large or holes the area needs to be sealed.

What are unreasonable gaps and holes?

If you are able to feel external air getting in, or see an unobstructed draught coming from a hole or gap that is, it’s probably a gap or hole that requirements sealing in somehow. Cracks or gaps with large gaps must be permanently stopped. The gaps that exceed 3mm that let air in or out into your house need sealing. For instance, if an open fireplace is not in use, it could cause draughts, and should be shut from. Landlords and property managers are responsible for making sure such draughts are eliminated in the maximum extent possible.

There is no need to block off gaps or holes which are part of the construction. For instance, small gaps around windows and doors might be necessary to allow for movement within the building when the household warms and cools in order to let them be closed and opened rather than being stuck. Heating Normandale

Normandale rental properties should have a permanent source of heating which can warm the living area to at minimum 18degC even on the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat requirements for it to be permanent (i.e. not portable), at least 1.5 kW of heating capacity, and it must have the minimum required heating capacity for the main living space. A Heating Assessment Tool can be used to determine if the existing fix heater(s) are sufficient or if you’ll need to ‘top up’ with an additional heater. Open fires as well as unflued combustion heaters like portable LPG bottle heaters are not considered to be suitable heating options under the Healthy Homes Standard.

If the heating you offer is electric heating (or heat pump), then it must include the thermostat. This makes the heating more uniform and effective. For most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters will be required. In certain situations, such as small apartments an electric, fixed heater might be enough.

If the living area already has a permanent heating source like the heat pump, it may need some additional energy to meet the standards. Some types of heaters can’t be used to meet the standard since they’re either expensive, inefficient and/or unsafe to run.

Ventilation Normandale

Insulation Normandale

Insulation for underfloor and ceilings is required in all rental houses from 1 July 2019. Property managers and landlords are required to make sure that the insulation is in line with this new standard. In some cases, an existing insulation on the ceiling or in the sub floor space might need to be topped up or replaced.
