Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Normandale rental property, all Healthy Homes compliance items have to be finished within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied lease is entered into on a Normandale rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy contract, there could be an additional fine or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager fails to supply the information requested within 21 days of being informed of the request, they could be issued an infringement notice and could be fined up to $750.

Additionally, there is also a fine of as much as $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. The person responsible for this fine is the person who is identified on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord or the property management company.

All information in the Statement of Compliance requirements to be accurate when the tenancy agreement is signed, and ideally it should be kept updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It is important to note that a landlord with multiple rental properties may receive even higher fines for non-compliance. The highest penalties are given for the most serious violations, and landlords who own six or more properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.

Normandale Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement in all Normandale and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the compliance with each Healthy Homes Standard that apply or will apply during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply to the Healthy Homes Standard within 90 days of a renewal, new or a change in lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All homes let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts increase the likelihood of low temperatures inside households. A humid home costs more to heat, resulting in wasted money and energy.

If a draft can be felt through gaps that are too large or holes or holes, it needs to be sealed.

Heating Normandale

Normandale rental properties must have a fixed source of heat that can warm the main or largest living space to a minimum of 18degC even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat needs for it to be permanent (i.e. not portable), at minimum 1.5 kW in heating capacity, and meet the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool can be used to determine if your current permanent heater(s) are sufficient or if you’ll need to "top-up" with a new heater. Fires that are open and unflued heaters, such as mobile LPG bottle heaters aren’t considered to be acceptable heating options for the Healthy Homes Standard.

If the heating you offer is an electric heater or heat source, it should have the thermostat. This will make the heating more reliable and effective. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters will be required. In some instances, like apartments with small spaces the smaller fixed electric heater may suffice.

If the living area already has a central heating source, like an air conditioner, it might require some additional energy to be able to meet the standards. Certain kinds of heaters cannot be used to achieve the standard because they’re not effective, cost prohibitive to operate and/or unhealthy to run.

Ventilation Normandale

Insulation Normandale

Insulation for underfloor and ceilings is mandatory on all rental homes since July 1, 2019. Property managers and landlords are required to ensure that the insulation meets the new quality. In some instances, existing ceiling insulation or insulation in the sub floor space might need to be topped up or replaced.

A well-insulated house can reduce condensation and lower the chance of mould and damp, and will also make it easier to the house to hold heat.

The "R" refers to thermal resistance, and it is a measurement of how well insulation withstands heat flow. The higher the R-value, the more effective the insulation.
