Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed for a Ngauranga rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

As of 1st July 2021, when a new or renewed tenancy is signed on a Ngauranga rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to each of Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. The highest penalties are handed down for the most serious breaches, and landlords with at least six rental properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Ngauranga Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory in all Ngauranga and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records of their the compliance with each Healthy Homes Standard that apply or will apply during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts may lead to less temperature in homes. A cold house costs more to heat, resulting in wasted money and energy.

If a draft can be felt from unreasonable gaps or holes, it needs to be sealed.

What are unreasonable gaps and holes?

If you can feel external air flowing in or the air is clear from a crack or a gap that is, it’s likely a crack or an opening that needs sealing in somehow. Large cracks and gaps should be stopped permanently. Any gaps greater than 3mm that let air in or out within the home require the sealing. In the case of an open fireplace isn’t in use it could cause draughts, and must be sealed off. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed as much as imaginable.

You don’t require to cover up gaps or holes that are part of the building. For instance, small gaps around doors and windows may be required to allow for movement within the structure when the home heats and cools, so that they can still be shut and opened, rather than being stuck. Heating Ngauranga

Rental properties in Ngauranga should have a permanent heating source that can heat the main or largest living space to at least 18degC even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs to remain fixed (i.e. not portable), at minimum 1.5 kW of heating capacity, and it must have the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool could be used to determine whether the permanent heater(s) are adequate or whether you will need to "top up" by adding a second heater. If the heating system you provide is an electric heater or heat pump it needs to have a thermostat. This will make the heating more consistent and efficient. For most properties, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in some cases like small apartment buildings the smaller fixed electric heater may suffice.

If the main living room already has a central heating source, like a heat pump, then it may need some additional energy to make sure it meets the requirements. Some types of heaters can’t be used to achieve the quality since they’re either not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Ngauranga

Underfloor and ceiling insulation is mandatory to all rental homes since July 1, 2019. Property managers and landlords have to make sure that the insulation is up to current standard. In some instances, current ceiling insulation, or the insulation of the subfloor space may require to be replaced or replaced.
