Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed contract is signed on a Ngauranga rental property, all Healthy Homes compliance items must be finished by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on the Ngauranga rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

When should I require to be in compliance with The Healthy Homes Standards?

Ngauranga Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement to all Ngauranga and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove the conformance to each Healthy Homes Standard that apply or will be in force during the tenure of their rental properties.

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Ngauranga

Ngauranga rental properties should have a permanent source of heat that can heat the largest or main living space to a minimum of 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs to remain fixed (i.e., not portable) and at minimum 1.5 kW of heating capacity, and meet the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to determine if the existing fix heater(s) are sufficient or if you’ll need to "top-up" with an additional heater. Unflued combustion and open fire heaters such as the portable LPG bottle heaters aren’t considered to be safe heating options in The Healthy Homes Standard.

If the heating you provide is an electric heater (or heat pump), then it must include a thermostat. This will help make the heating more consistent and efficient. In most homes, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. In certain situations, like apartments with small spaces the smaller fixed electric heater could be enough.

If your living space already has a fixed heating source such as the heat pump, it could require an update to make sure it meets the requirements. The insulation of the ceiling and underfloor is mandatory to all rental houses since July 1, 2019. Property managers and landlords should make sure that the insulation is up to current standard.
