Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Ngauranga rental property, all Healthy Homes compliance items have to be taken care of by the end of 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on the Ngauranga rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to meet all of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if a existing Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy contract, it could result in an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the building they reside in. If the property manager fails to provide the information requested within 21 days of getting the notice, the tenant could receive an infringement letter and be fined up to $750.

Furthermore, there’s also a fine of up to $900 for landlords or property managers providing a false or incorrect Healthy Homes Statement of Compliance or information. The person liable for this fine is whoever is named on the tenancy contract as the person leasing the property out and it could be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance needs to be up-to-date when the tenancy agreement is completed, and must be updated through the tenancy period as associated work has been completed.

It is important to keep in mind that a landlord who own multiple rental properties could face additional fines for non-compliance. The highest penalties are given for severe violations, and landlords who own six or more properties can be fined as high as $50,000 and as high as $100,000 for hearing claims.

It is clear that failure to adhere to compliance with Healthy Homes requirements can hit your wallet with massive fines as well as still being required to comply with the regulations. Do not risk your rental property, contact us today and make arrangements to have a house assessment done for your rental property.

Healthy homes matter

Why is Healthy Homes Compliance important?

A majority of households rent from New Zealand and Ngauranga, and research shows us that these rental homes tend to be colder, older and are not as effective heating and tend to be of poorer quality than owner occupied properties.

Cold, damp and mouldy homes can have negative well-being outcomes, especially for ailments like colds and asthma, as well as cardiovascular diseases. In addition, people who experience at least four major home quality issues often suffer from less satisfaction in their lives and lower well-being.

The improvement in the quality of Ngauranga rental property will allow tenants to enjoy improved physical and mental health and minimise the disturbance to learning, work and daily life due to illnesses. Your investment is also better protected from mildew, mould and damp-related damage, which completed jobs in lower maintenance costs in the long-term.

The Healthy Homes Standards are a list of the specific and minimum standards for heating, insulation, Ventilation, Moisture Ingress and Drainage, as well as Draught-stopping within Ngauranga rental properties.

Unreasonable Gaps & Holes

Draught Stopping Ngauranga

Draughts can lead to dropping temperatures within houses. A draughty home will cost more to heat, resulting in wasted energy and resulting in higher bills.

If a draught can be perceived as a result of gaps or holes that it requirements to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air coming in or the sound of a clear draught emanating from a gap or hole or crack, then it’s likely to be a gap or an opening that needs sealing in some way. Cracks or gaps with large gaps must be permanently stopped. Gaps greater than 3mm that let air in or out from the home require to be sealed. For example, if an open fireplace isn’t in use it can create draughts. This should be blocked from. Landlords and property managers are responsible for making sure that draughts from the fireplace are removed as far as imaginable.

You don’t require to block up intentional holes or gaps that are part of the construction. For instance, small gaps around doors and windows could be required to allow for the movement of the structure when the house warms and cools in order to let them be shut and opened, rather than being stuck. We will inspect all windows and doors during the Healthy Homes assessment of your rental property.

Heating Ngauranga

Ngauranga rental properties must have a fixed heating source that can warm the living room to at least 18degC, even during the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements to remain fixed (i.e., not portable), at least 1.5 kW of heating capacity, and it must have the minimum heating capacity needed for the main living room. A Heating Assessment Tool can be used to determine if the existing permanent heater(s) are adequate or if you’ll require to "top-up" by adding a second heater. Fires that are open and unflued heaters, such as mobile LPG bottle heaters aren’t considered acceptable heating options under those following the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump it requirements to be equipped with a thermostat. This makes the heating more consistent and effective. For most houses, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances such as small apartments an electric, fixed heater might be enough.

If the main living room already has a fixed heating source like an air conditioner, it may require an update to ensure it meets the requirements. Certain kinds of heaters aren’t able to be used to achieve the standard since they’re either not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Ngauranga

Each liveable space in a rental home must have at least one openable window or exterior door to offer natural airflow. Furthermore, moist spaces like kitchens and bathrooms must have a suitable externally vented extractor fan to get rid of moisture.

A ventilation standard is about recognising it is that dry air is much easier to heat and that a well ventilated rental property is less likely to grow damp and mould.

Bedrooms, living rooms kitchens, and dining rooms are all considered living spaces. Connecting spaces such as the hallway are not considered liveable and therefore don’t require an opening window or door.

Each window, door , or the skylight requirements to have the ability open to the outside, and stay closed in order to allow ventilation and fresh air ventilation.

The bathrooms in all kitchens and any other room in your home with shower, bath and cooktop or another moisture-producing item will need suitable extractor fans that vent out to the outside. Our Healthy Homes Assessment service will make sure there is sufficient ventilation in each livable space, including suitable extractor fans in high moisture areas.

Insulation Ngauranga

Ceiling and underfloor insulation is a requirement on all rental homes since July 1, 2019. All landlords and property managers must make sure that the insulation is in line with standards that are in line with the latest standard. In certain situations, the existing ceiling insulation or insulation in the sub floor space may require to be replaced or replaced.

A well-insulated house can reduce condensation and reduce the chances of mould and dampness and also makes an easier task for the household to keep the heat.

Insulation needs to meet the R-values of your area.

The "R" signifies thermal resistance and it is a measurement of how well the insulation can withstand heat flow. The greater the R-value, the higher the standard of insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9 Underfloor R 1.3
  • Zone 2 – all of the North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 below floor R 1.3

Ngauranga Moisture Ingress & Drainage

Making sure your rental property is protected from water damage isn’t only about the interior of the building It’s about having to make sure there is somewhere to allow surface, rain as well as groundwater to move, and also stop it from getting inside. When it concerns damp and moisture it is frequently those things that you aren’t aware of that can cause a lot of trouble and end up causing the property to suffer and affecting your tenant’s health.

Rental properties should have effective drainage to eliminate floodwaters, surface water and groundwater, with an appropriate outfall or runoff. Making sure that the water has a place to go, and it doesn’t sit beneath buildings is a vital aspect of keeping your property dry.

Alongside a drainage system to avoid the ingress of moisture, if your property has an enclosed space between your flooring and surface, a ground moisture barrier must be put in place when it is reasonably practicable to install it.

Ground moisture barriers are usually a polythene sheet laid over the ground, in order to block any moisture present in the ground from getting into the home. It also assists in preventing any damage to your underfloor insulation.
