Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed for a Mount Victoria rental property, all Healthy Homes compliance items need to be completed inside of 90 days.

As of 1st July 2021, once a new or renewed contract is signed on the Mount Victoria rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with all of the Healthy Homes Standards within the period of time expected can lead to an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy contract, there may be an additional fine or infringement fee.

Tenancies signed in the period between July 1st 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is required for all Mount Victoria and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with each Healthy Homes Standards that apply or will be in force during the tenancy of your rental home.

Heating Mount Victoria

Rental properties in Mount Victoria require a reliable source of heating that can warm the main or largest living area to at minimum 18 degrees Celsius, even on the winter coldest days.
