Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed for a Mount Victoria rental property, all Healthy Homes compliance items have to be done within 90 days.

As of 1st July 2021, when a new, renewed or varied contract is signed on a Mount Victoria rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet all of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. It is important to remember that a landlord who have multiple rental properties could face even higher fines for non-compliance. The most severe penalties are handed down for the most serious violations. Those who have six or more properties can be fined up to $50,000, or as high as $100,000 in the case of hearing claims.

Mount Victoria Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory to all Mount Victoria and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.

From 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Mount Victoria rental properties should have a permanent source of heat that can warm the main or largest living room to at least 18degC, even during the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs that it be permanently fixed (i.e., not portable) that is, at minimum 1.5 kW of heating capacity, and it must have the minimum requirement for heat capacity in the living area. The Heating Assessment Tool can be used to check if the existing installed heater(s) are adequate or whether you will need to "top up" by adding a second heater. Fires that are open and unflued heaters, such as the portable LPG bottle heaters are not considered to be suitable heating options for those following the Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump, it must include the thermostat. This makes the heating more reliable and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are required. In certain situations, such as small apartments small apartments, a smaller electric fixed heater may be sufficient.

If the living area already has a permanent heating source like heat pumps, it could require an upgrade to be able to meet the standards. Certain kinds of heaters cannot be utilised to meet the standard as they are either not effective, cost prohibitive to operate and/or unhealthy to run.

All landlords and property managers are required to make sure that the insulation is up to this new quality.
