Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Mount Victoria rental property, all Healthy Homes compliance tasks need to be taken care of inside of 90 days.

Since the 1st July of 2021, once a new or renewed Tenancy is signed for a Mount Victoria rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory in all Mount Victoria and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with any Healthy Homes Standard that apply or will be in force to an apartment rental.

From July 1st 2021

  • Private landlords and property managers should ensure their rental properties comply according to Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Rental properties in Mount Victoria should have a permanent heating source that is able to heat the principal or the biggest living space to a minimum of 18degC, even during the most coldest days of the year.
