Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed contract is signed on a Mount Victoria rental property, all Healthy Homes compliance tasks need to be taken care of by the end of 90 days.

Since the 1st July of 2021, once a new or renewed tenancy is signed on a Mount Victoria rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy agreement, it could result in an additional fine or violation fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager is unable to provide the information requested within 21 days from receiving the request, they will receive an infringement notice and be fined up to $750.

In addition, there is also a penalty of as much as $900 for landlords and property managers who have provided a false or misleading Healthy Homes Compliance Statement or information. The person responsible for this fine is whoever is named on the tenancy agreement as the one who is leasing the property out It could also be the name of the landlord, or the company that manages the property.

All the information on the Statement of Compliance needs to be accurate before the tenancy agreement can be executed, and it should be kept updated through the tenancy period as related work is completed.

It is crucial to note that a landlord who manage multiple rental properties could face additional fines for non-compliance. The highest penalties are handed down for the most serious violations, and landlords who own more than six properties could be penalised up to $50,000 and as high as $100,000 in hearing claims.

Mount Victoria Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory in all Mount Victoria and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or varied tenancy agreement.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.

The source of heating needs to be fixed (i.e. not portable), at minimum 1.5 horsepower in capacity, and meet the minimum capacity for heating required for the main living room. Fires that are open and unflued heaters like mobile LPG bottle heaters are not considered to be suitable heating options in The Healthy Homes Standard.

If the heating system you offer is electric heating (or heat pump), it must have an thermostat. This will make your heating more consistent and effective. For most homes, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in certain instances like small apartments, a smaller fixed electric heater may be sufficient.
