Fines for Failing to Comply
As of 1st July 2021, if a new, renewed or varied contract is signed on a Mount Victoria rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement, there could be additional penalties or an infringement fee.
Any tenant can ask for details about the Healthy Homes Standard and how they are related to the house they are living in. If the the property manager doesn’t supply the information requested within 21 days of getting the notice, the tenant could receive an infringement notification and be fined as high as $750.
In addition, there’s an additional fine of as much as $900 for property owners or property managers who provide a false or incorrect Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is identified on the tenancy contract as the person who is letting the property which could be the name of the landlord, or the company that manages the property.
The information contained in the Compliance Statement requirements to be current at the time that the tenancy agreement is signed. It should be kept updated through the tenancy period as relevant work gets completed.
It’s also important to keep in mind that landlords who manage multiple rental properties may face more severe penalties for not complying. The highest penalties are handed down for serious breaches, and landlords with six or more properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.
