Fines for Failing to Comply

Tenancies that were signed beginning on 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory to all Mount Victoria and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standards that apply or will be applied during the tenure of an apartment rental.

From 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties comply to the Healthy Homes Standards within 90 days of a renewal, new or a change in Tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All households which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Heating Mount Victoria

Rental properties in Mount Victoria need to have a stable source of heat which can warm the principal or the biggest living space to a minimum of 18degC even on the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements to remain fixed (i.e. not portable) that is, at minimum 1.5 kW of heating capacity, and it must have the minimum requirement for heat capacity for the main living room. For most properties, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in certain instances like small apartment buildings small apartments, a smaller electric fixed heater may suffice.

If your living space is already equipped with a fixed heating source, such as the heat pump, it could require some additional energy in order to comply with the standards. Some types of heaters can’t be utilised to meet the standard because they’re costly, not cost-effective to run, or are unsafe to operate.
