Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords are now required to ensure that their Mount Victoria rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any renewal or new tenancy and all private rental properties are required to be completely in compliance by July 1st 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed for a Mount Victoria rental property, all Healthy Homes compliance items must be completed within 90 days.

As of 1st July 2021, once a new or renewed tenancy is signed on a Mount Victoria rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet all of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement it could result in an additional fine or violation fee.

If the property manager fails to supply the information requested within 21 days from being informed of the request, they can receive an infringement notification and be fined upto $750.

Additionally, there is also a penalty of up to $900 for landlords and property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is whoever is listed on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord as well as the property management company.

The information contained in the Compliance Statement needs to be correct when the tenancy agreement is signed. It should be kept updated during the entire tenancy, as necessary work related to it’s finished.

It’s important to remember that landlords with multiple rental properties may face greater penalties for non-compliance. The harshest penalties are given for serious violations. Those who have six or more properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.

Mount Victoria Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory for all Mount Victoria and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with any Healthy Homes Standard that apply or will be applicable during the tenancy of their rental properties.

From July 1st 2021

  • Private landlords and property managers are required to ensure their rental properties conform to the Healthy Homes Standards within 90 days of a new, renewed , or altered Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Draughts may lead to less temperature in homes. A cold house is more expensive to heat, which results in wasting energy and incurring higher costs.

What are unreasonable gaps or holes?

If you are able to feel external air entering or the air is clear from a hole or gap that is, it’s probably a gap or crack that needs sealing in the way you can. Large cracks and gaps should be fixed permanently. The gaps that exceed 3mm that let air into or out into the home require to be sealed. In the case of an open fireplace isn’t used it can create draughts. This should be shut from. Landlords and property managers are responsible for making sure that these draughts are stopped as far as possible.

You don’t require to block up intentional gaps or holes in the construction. For example, tiny gaps around doors and windows may be required to allow for movement of the structure as the house warms and cools so that they can still be closed and opened rather instead of being stuck. Adequate heaters are crucial to ensure healthy homes

Heating Mount Victoria

Rental properties in Mount Victoria need to have a stable source of heating that can heat the living space to at least 18degC even on the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating needs to be fixed (i.e. not portable), at least 1.5 kW in heating capacity, and must meet the minimum required heating capacity in the living area. The Heating Assessment Tool can be used to check if your current permanent heater(s) are sufficient or whether you will need to top up with a new heater. Open fires as well as unflued combustion heaters such as portable LPG bottle heaters aren’t considered to be acceptable heating options under the Healthy Homes Standard.
