Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Mount Victoria rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

Since the 1st July of 2021, when a brand new or renewed Tenancy is signed for a Mount Victoria rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with one of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy agreement, it could result in additional penalties or an infringement fee.

The person who is liable for this fine is whoever is listed on the tenancy agreement as the person who is letting the property out It could also be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be accurate when the tenancy contract is signed. It is updated throughout the tenancy as any related work is completed.

It’s also important to remember that landlords with multiple rental properties could face additional fines for non-compliance. The highest penalties are given for serious breaches. Landlords with more than six properties could be fined as high as $50,000, or as high as $100,000 in hearing claims.

Mount Victoria Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is required throughout Mount Victoria and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to the Healthy Homes Standard that apply or will be applicable during the tenancy of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts may lead to low temperatures inside households. A draughty home costs more to heat, which means wasting energy and incurring higher costs.

Proper heating is crucial for healthy houses

Heating Mount Victoria

Rental properties in Mount Victoria should have a permanent heating source which can warm the main or largest living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source requirements for it to be permanent (i.e. not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and meet the minimum required heating capacity to heat the living space in general. The Heating Assessment Tool can be used to check if the existing fixed heater(s) are adequate or whether you will require to "top up" with a new heater. Open fires and unflued combustion heaters, such as mobile LPG bottle heaters aren’t considered to be suitable heating options for The Healthy Homes Standard.

If the heating system you provide is electric heating (or heat pump), it must include the thermostat. This will make the heating more consistent and efficient. For most properties, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are needed. In some instances, like apartments with small spaces the smaller fixed electric heater may be sufficient.

If the main living room already has a central heating source, such as the heat pump, it may need some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to meet the quality as they are either not effective, cost prohibitive to operate and/or unhealthy to run.

Ventilation Mount Victoria

Each liveable space in a rental property has to have at least one opening door or window to provide natural airflow. In addition, high moisture areas such as kitchens and bathrooms should have an externally vented extractor fan to eliminate moisture.

A ventilation standard is about recognising the fact that the dry atmosphere is much easier to heat and the property that is properly ventilated will be less prone to developing mould and damp.

Bedrooms, living rooms dining rooms, and kitchens are considered liveable areas. Connecting spaces such as the hallway aren’t considered liveable and therefore are not need an opening door or window.

Each door, window or skylight needs for them to be in a position to open to the outside, but remain at an open angle, allowing to circulate fresh air as well as ventilation.

Insulation Mount Victoria

The insulation of the ceiling and underfloor is required for all rent houses from 1 July 2019. Property managers and landlords should make sure the insulation meets standards that are in line with the latest quality. In some cases, existing ceiling insulation or insulation in the sub floor space may need to be added or replaced.

A well-insulated house will reduce the risk of condensation and reduce the chances of mould and dampness, and will also make it easier for the household to retain heat.
