Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords are now required to make sure that their Mount Victoria rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rental properties are required to be completely compliant by 1 July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed on a Mount Victoria rental property, all Healthy Homes compliance tasks have to be done by the end of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied lease is entered into on a Mount Victoria rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to each of Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy contract, there could be an additional penalty or infringement fee.

If the landlord or property manager fails to provide the required information within 21 days of being informed of the request, they may be issued an infringement notice and could be fined up to $750.

In addition, there’s also a penalty up to $900 for landlords or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or other information. The person responsible for this fine is whoever is named on the tenancy contract as the person who is letting the property and it could be the name of the landlord or the company that manages the property.

All the information on the Statement of Compliance requirements to be correct when the tenancy contract is signed, and ideally it should be kept updated throughout the duration of the tenancy when any necessary work related to it is finished.

It’s crucial to be aware that a landlord who manage several rental properties can face greater penalties for non-compliance. The most severe penalties are given for severe violations. Those who have at least six rental properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Mount Victoria Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement throughout Mount Victoria and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records of their compliance with each Healthy Homes Standard that apply or will be applicable throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Landlords and property managers are responsible for ensuring that draughts from the fireplace are removed as much as possible.

Mount Victoria rental properties need to have a stable heating source that can warm the largest or main living space to a minimum of 18degC, even on the winter coldest days.
