Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Melling rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

Tenancies established between 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is required throughout Melling and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records that prove compliance with any Healthy Homes Standard that apply or will apply to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Melling

Rental properties in Melling must have a fixed heating source that can heat the living space to at least 18degC even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs for it to be permanent (i.e. not portable) and at least 1.5 kW of heating capacity, and must meet the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool may be used to determine whether the existing permanent heater(s) are sufficient or if you’ll require to "top up" with an additional heater. Fires that are open and unflued heaters such as portable LPG bottle heaters are not considered to be acceptable heating options in The Healthy Homes Standard.

If the heating system you provide is an electric heater (or heat pump), then it must be equipped with a thermostat. This will make the heating more consistent and effective. In most houses, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. In certain situations, like apartments with small spaces an electric, fixed heater may suffice.

If your living space is already equipped with a fixed heating source, such as a heat pump, then it could need an upgrade to ensure it meets the requirements. Some types of heaters can’t be utilised to meet the quality since they’re either expensive, inefficient and/or unsafe to run.

Ventilation Melling

Insulation Melling

Insulation for underfloor and ceilings is mandatory on all rental houses from 1 July 2019. All landlords and property managers must ensure that the insulation is up to current standard. In certain situations, the existing ceiling insulation or insulation in the sub floor space might need to be topped up or replaced.
