Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed for a Melling rental property, all Healthy Homes compliance tasks need to be completed inside of 90 days.

All the information on the Statement of Compliance needs to be current at the time that the tenancy agreement is completed, and should be maintained during the entire tenancy, as associated work has been completed.

It is important to be aware that a landlord who own several rental properties can face even higher fines for non-compliance. The harshest penalties are reserved for severe violations, and landlords who own more than six properties could be fined as high as $50,000, or as high as $100,000 in hearing claims.

Melling Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory for all Melling and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records of their the conformance to all Healthy Homes Standard that apply or will be in force during the tenure of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

  • All rental houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

For most homes, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in some cases such as small apartments an electric, fixed heater could be enough.

If the living area is already equipped with a fixed heating source such as a heat pump, then it could need an update in order to comply with the standards. Certain kinds of heaters aren’t able to be used to achieve the standard because they’re not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Melling

Insulation Melling

The insulation of the ceiling and underfloor is required on all rental houses since July 1, 2019. All landlords and property managers should ensure the insulation meets the new quality.
