Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for a Melling rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied lease is entered into on the Melling rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to adhere to all of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included in the new, renewed or amended tenancy agreement there may be an additional fine or violation fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager does not supply the required information within 21 days of getting the notice, the tenant may be issued an infringement notice and could be fined up to $750.

In addition, there is also a penalty of approximately $900 for landlords or property managers that provide false or false Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the person who is named on the tenancy contract as the person leasing the property out and it could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be current when the tenancy agreement is completed, and must be updated throughout the tenancy as any relevant work gets completed.

It is crucial to remember that a landlord with multiple rental properties may receive additional fines for non-compliance. The most severe penalties are handed down for severe breaches, and landlords with at least six rental properties could receive fines of up to $50,000 and as high as $100,000 for hearing claims.

Melling Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement throughout Melling and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.

Heating Melling

Rental properties in Melling must have a fixed source of heat that can warm the principal or the biggest living room to at least 18degC, even during the coldest days of the year. Insulation Melling

All landlords and property managers must ensure that the insulation is up to standards that are in line with the latest standard.
