Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into effect on the 1st of July 2021? The landlords are now required to ensure their Melling rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rental properties are required to be fully certified by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Melling rental property, all Healthy Homes compliance items must be finished within 90 days.

Since the 1st July of 2021, when a new or renewed Tenancy is signed for the Melling rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated in the new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager is unable to provide the information requested within 21 days of having received the inquiry, they may be issued an infringement notice and be fined upto $750.

Additionally, there is also a penalty as much as $900 for landlords and property managers who offer a false or incorrect Healthy Homes Statement of Compliance or information. The person liable to pay this fine is the one who is identified on the tenancy agreement as the person who is renting the property and it could be the name of the landlord, or the company that manages the property.

All information in the Compliance Statement requirements to be current when the tenancy agreement is signed. It should be kept updated during the entire tenancy, as relevant work gets completed.

It’s important to note that landlords who manage several rental properties can face even higher fines for non-compliance. The highest penalties are given only for serious violations, and landlords who own six or more properties can be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

When should I need to be in compliance with The Healthy Homes Standards?

Melling Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is required in all Melling and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove compliance with the Healthy Homes Standard that apply or will be applicable to your rental home.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform according to Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenant.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Melling

Draughts may lead to low temperatures inside homes. A damp home costs more to heat, resulting in wasted energy and incurring higher costs.

If a draught can be felt from unreasonable gaps or holes the area needs to be sealed.

What are unreasonable gaps or holes?

If you can feel external air entering or the air is clear from a crack or a gap and you are able to feel it, it is probably a gap or hole that requirements sealing in somehow. Large cracks and gaps should be fixed permanently. Gaps greater than 3mm that allow air to enter or exit within the home need seals. In the case of an open fireplace isn’t being used, it can create draughts. This should be sealed from. Property managers and landlords are accountable for ensuring that such draughts are squelched in the maximum extent possible.

There is no need to block off holes or gaps which are part of the construction. For example, tiny gaps around windows and doors could be required to allow movement of the structure as the household heats and cools, to allow them to be opened and closed rather than securing. A good heating system is important for well-being houses

Heating Melling

Rental properties in Melling must have a fixed heating source that can warm the living area to at minimum 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements to remain fixed (i.e., not portable) that is, at least 1.5 kW in heating capacity, and it must have the minimum required heating capacity for the main living space. The Heating Assessment Tool can be used to determine whether the fix heater(s) are sufficient or whether you will require to top up with a new heater. Open fires and unflued combustion heaters like mobile LPG bottle heaters are not considered acceptable heating options for The Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump it requirements to be equipped with the thermostat. This makes the heating more reliable and effective. For the majority of houses, bigger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in certain instances like small apartment buildings, a smaller fixed electric heater might be enough.

If the living area is already equipped with a fixed heating source like a heat pump, then it might just need a top up to meet the standards. Certain types of heaters cannot be used to comply with the standard as they are either not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Melling

Each living space within a rental home must contain at minimum one open window or exterior door to offer natural ventilation. In addition, high moisture spaces like kitchens and bathrooms need to have an externally vented extractor fan to take moisture away.

This ventilation quality is all about recognising that dry air is easier to heat and heat, and the property that is properly ventilated will be less prone to developing mould and damp.

Bedrooms, living rooms, kitchens, and dining areas are considered to be liveable spaces. Connecting spaces like the hallways are not liveable and don’t need an opening window or door.

Each window, door , or the skylight requirements for them to be in a position to open up to the outside while remaining fixed in an open position to allow the circulation of fresh air and ventilation.

All bathrooms and kitchens and any other area in your house that houses shower, bath, cooktop or other high moisture generating item will require adequate extractor fans that are vented out to the outside. Insulation Melling

Insulation for underfloor and ceilings is a requirement for all rent houses from 1 July 2019. Property managers and landlords must make sure that the insulation meets this new standard. In some cases, current ceiling insulation, or the insulation of the sub floor space may require to be topped up or replaced.

A well-insulated property will reduce the risk of condensation and reduce the chances of dampness and mould, and will also make much easier for the house to keep heat.

Insulation needs to meet the R-values of your area.

The "R" refers to thermal resistance and it is a measurement of how well the insulation is able to resist heat flow. The greater the R-value, the better the insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – The rest part of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 and underfloor R 1.3

Melling Moisture Ingress & Drainage

Making sure your rental property is protected from the effects of moisture isn’t just a matter of the inside it’s also about the outside. You must make sure there is somewhere to allow surface, rain and ground water to go and prevent it from getting into the building. When it concerns damp and moisture it’s often not apparent that it could be a huge problem, causing the property to suffer and affecting your tenant’s health.

Properties that are rented must have effective drainage to eliminate floodwaters, surface water and ground water. This includes an appropriate outfall or runoff. Making sure the water is able to go, and that it doesn’t sit beneath buildings is an essential part of maintaining your property’s dry.

In addition to a drainage system to prevent water ingress, if the rental has an enclosed gap between your flooring and the ground, a ground moisture barrier should be put in place if it’s reasonably practicable to do so.

Ground moisture barriers are usually a sheet of polythene that is placed over the ground to prevent any moisture present in the ground from getting into the property. It also helps in preventing moisture damage to the underfloor insulation.
