Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed for a Melling rental property, all Healthy Homes compliance items have to be taken care of by the end of 90 days.

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Melling rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy agreement, it could result in an additional fine or infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the building they are living in. If the property manager fails to provide the necessary information within 21 days of receiving the request, they could be issued an infringement notice and be fined upto $750.

In addition, there’s also a penalty up to $900 for landlords and property managers who have provided a false or false Healthy Homes Compliance Statement or any other information. The person responsible for this fine is the person who is named on the tenancy contract as the person letting the property out, so it could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance needs to be up-to-date before the tenancy agreement can be executed, and it must be updated throughout the duration of the tenancy when any related work is completed.

It is important to keep in mind that a landlord with multiple rental properties could face greater penalties for non-compliance. The most severe penalties are reserved for the most serious violations, and landlords who own more than six properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.

In the end, a failure to adhere to the Healthy Homes requirements can hit your wallet hard, with huge fines, in addition to continuing to be required to comply with the requirements. Healthy homes matter

What are the reasons why Healthy Homes Compliance so Important?

One in three households from New Zealand and Melling, and research has shown that these rental homes are more likely to be older, colder, are not as effective heating and tend to be lower quality than owner occupied properties.

The damp, cold and mouldy homes are associated with negative well-being results, specifically for ailments like colds and asthma, as well as heart diseases. In addition, people who experience at least four major house quality problems often experience poor life satisfaction and lower psychological well-being.

The improvement in the quality of Melling rental property can allow tenants to experience better physical and mental health, and lessen the disturbance to learning, work and daily life due to diseases. Your investment is also better protected from mildew, mould and damp-related damage, which results in lower maintenance costs in the long-term.

Unreasonable Gaps & Holes

Draught Stopping Melling

Draughts may lead to low temperatures inside houses. A damp house costs more to heat, which means wasting energy and resulting in higher bills.

If a draft can be noticed from gaps that are not adequate or holes the area requirements to be closed.

What are unreasonable gaps and holes?

If you can feel external air getting in, or see an unobstructed draught coming from a crack or a gap or crack, then it’s likely a crack or an opening that needs sealing in the way you can. Cracks or gaps with large gaps must be sealed permanently. The gaps that exceed 3mm that allow air in or out into your house require to be sealed. For example, if an open fireplace isn’t in use it may cause draughts and should be blocked from. Property managers and landlords are responsible for ensuring that such draughts are squelched whenever possible.

There is no need to block gaps or holes in the construction. For example, tiny gaps around windows and doors could be necessary to allow for the movement of the structure when the house warms and cools so that they are able to be opened and closed rather than securing. We will check all doors and windows in your Healthy Homes assessment of your rental property.

Adequate heaters are important to ensure well-being homes

Heating Melling

Melling rental properties need to have a stable source of heating that can heat the principal or the biggest living area to at minimum 18degC, even during the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs to be fixed (i.e., not portable) and at least 1.5 kW of heating capacity and have the minimum heating capacity needed in the living area. A Heating Assessment Tool may be used to check if the fix heater(s) are sufficient or whether you will need to "top up" with an additional heater. Fires that are open and unflued heaters, such as portable LPG bottle heaters are not considered to be safe heating options under those following the Healthy Homes Standard.

If the heating that you provide is an electric heater or heat pump, it needs to be equipped with a thermostat. This will make the heating more reliable and efficient. In most homes, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. In some instances, such as small apartments small apartments, a smaller electric fixed heater may be sufficient.

If your main living space already has a permanent heating source, like an air conditioner, it might just require a top up in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the quality because they’re expensive, inefficient and/or unsafe to run.

Ventilation Melling

Each liveable space in a rental property must contain at minimum one open windows or an exterior door to offer natural airflow. In addition, humid spaces like kitchens and bathrooms should have an externally vented extractor to take moisture away.

It is the ventilation quality is all about acknowledging the fact that dry air will be much easier to heat, and that the property that is properly ventilated will be less prone to developing damp and mould.

Living rooms, bedrooms, dining rooms, and kitchens are considered liveable areas. Spaces that connect, such as the hallway are not considered liveable and don’t require an opening window or door.

Each window, door , or the skylight requirements for them to be in a position open to the outside, but remain at an open angle in order to allow to circulate fresh air as well as air flow.

The bathrooms in all kitchens and any other area in your home that has a bath, shower and cooktop or another water-generating appliance will need proper extractor fan systems that are vented out to the outside. This Healthy Homes Assessment service will ensure that there is sufficient ventilation in each livable space and will also check for the proper extractor fans in high moisture areas.

Insulation Melling

Ceiling and underfloor insulation is mandatory in all rental houses from 1 July 2019. Property managers and landlords are required to ensure that the insulation meets current quality. In some instances, old ceiling insulation as well as insulation within the sub floor space might require to be topped up or replaced.

A well-insulated property will help to control condensation, and decrease the risk of mould and dampness and it will make an easier task to the house to keep the heat.

Insulation requirements to be in compliance with the R-values that are appropriate for your region.

The "R" refers to thermal resistance, and is a measure of how well insulation can withstand heat flow. The greater the R-value, the higher the standard of insulation.

  • Zone 1 Zone 1 Auckland & Northland - ceiling R 2.9, underfloor R 1.3
  • Zone 2 – the remainder area of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3, underfloor R 1.3

Melling Moisture Ingress & Drainage

The security of your rental home from the effects of moisture isn’t just a matter of what’s inside the building; you have to ensure there is somewhere for surface, rain and ground water to go and also stop it from getting into the building. When it is about damp and water, it’s usually not apparent that it could be a huge problem and end up causing the property to suffer and affecting the tenant’s well-being.

Rental properties must have effective drainage for the removal of rainwater, storm water, and ground water. This includes the proper outfall or runoff. Making sure the water has a location to go and that it doesn’t get sucked into buildings is an essential part of maintaining your property’s dry.

In addition to a drainage system to prevent moisture ingress, if your rental is enclosed between floorboards and soil, a ground-water barrier must be installed if it’s reasonably practicable to do so.

A ground moisture barrier is generally a sheet of polythene that is placed over the ground, to block any moisture from the ground from rising into the property. It also assists in preventing any damage to your underfloor insulation.
