Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into effect on the 1st of July 2021? The landlords are now required to make sure their Melling rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rental properties are required to be fully conforming by the 1st July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed contract is signed on a Melling rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.

From the 1st of July in 2021, if a new or renewed Tenancy is signed for the Melling rental property, all Healthy Homes compliance work must be done within 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the deadlines can result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within the new, renewed or amended tenancy agreement there may be an additional fine or violation fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the home they live in. If the property manager fails to supply the necessary information within 21 days from receiving the request, they may be issued an infringement notice and could be fined up to $750.

Additionally, there is an additional fine of up to $900 for landlords or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is whoever is named on the tenancy contract as the person leasing the property out It could also be the name of the landlord as well as the property management company.

All information in the Compliance Statement requirements to be up-to-date when the tenancy agreement is completed, and is updated throughout the tenancy as any related work is completed.

It’s also important to keep in mind that a landlord who own multiple rental properties could face greater penalties for non-compliance. The harshest penalties are reserved for the most serious violations, and landlords who own at least six rental properties could be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

Melling Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory for all Melling and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the compliance with all Healthy Homes Standards that apply or will be in force throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply to the Healthy Homes Standards within 90 days of any new, renewed or varied Tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Melling

Draughts are a major cause of dropping temperatures within houses. A humid home costs more to heat, resulting in wasted energy and increased bills.

If a draught can be perceived as a result of gaps or holes, it needs to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air entering or the sound of a clear draught emanating out of a hole or gap, then it is likely to be a gap or crack that needs sealing in somehow. Large cracks and gaps should be stopped permanently. Cracks that are greater than 3mm and allow air to enter or exit within the house require to be sealed. For example, if the open fireplace isn’t being used, it could cause draughts, and should be sealed off. Landlords and property managers are responsible for ensuring such draughts are eliminated in the maximum extent possible.

You don’t require to block off holes or gaps that are part of the building. For example, tiny gaps around doors and windows could be required to allow for the movement of the building as the house heats and cools, so that they are able to be opened and closed rather instead of being stuck. Proper heating is important for healthy houses

Heating Melling

Rental properties in Melling require a reliable source of heating that can heat the living room to at least 18degC, even on the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs for it to be permanent (i.e. not portable) with at least 1.5 kW of heating capacity and have the minimum capacity for heating required for the main living room. A Heating Assessment Tool may be used to determine if your current fix heater(s) are adequate or whether you will require to "top up" with an additional heater. Fires that are open and unflued heaters such as the portable LPG bottle heaters aren’t considered to be safe heating options under The Healthy Homes Standard.

If the heating you offer is electric heating or heat pump it should include a thermostat. This makes the heating more consistent and effective. For most properties, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In certain situations, like small apartments small apartments, a smaller electric fixed heater may be sufficient.

If the main living room already has a central heating source such as the heat pump, it may need an upgrade to be able to meet the standards. Certain types of heaters cannot be used to achieve the standard because they’re expensive, inefficient and/or unhealthy to run.

Ventilation Melling

Each living space within a rental property has to have at least one openable door or window to offer natural ventilation. Furthermore, moist areas like kitchens and bathrooms should have an externally vented extractor fan that can eliminate moisture.

Insulation Melling

Ceiling and underfloor insulation is mandatory to all rental houses as of July 1st, 2019. All landlords and property managers are required to make sure that the insulation meets standards that are in line with the latest standard. In certain situations, the current ceiling insulation, or the insulation of the sub floor space may require to be topped up or replaced.

A house that is well-insulated will reduce the risk of condensation, and decrease the risk of mould and dampness and will also make much easier to allow the house to retain the heat.
