Fines for Failing to Comply

As of 1st July 2021, if a new or renewed contract is signed on a Melling rental property, all Healthy Homes compliance tasks have to be completed by the end of 90 days.

As of 1st July 2021, when a new, renewed or varied contract is signed on the Melling rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not incorporated in the renewal, new or revised tenancy contract, there could be an additional penalty or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the home they live in. If the property manager is unable to provide the information requested within 21 days of receiving the request, they may receive an infringement notice and be fined as high as $750.

Furthermore, there’s also a penalty of as much as $900 for property owners or property managers who offer a false or false Healthy Homes Statement of Compliance or other information. The person responsible for this fine is whoever is identified on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord as well as the property management company.

Melling Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement throughout Melling and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records of their compliance with all Healthy Homes Standard that apply or will be applied during the tenure of the rental property.

From 1 July 2021

  • Property managers and private landlords have to ensure their rental properties comply according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Melling

Draughts can lead to low temperatures inside homes. A draughty home will cost more to heat, which means wasting energy and increased bills.

If a draught is felt through gaps that are too large or holes the area needs to be closed.

What are unreasonable gaps and holes?

If you are able to feel external air coming in or the sound of a clear draught emanating from a gap or hole or crack, then it’s probably a gap or hole which requirements sealing in any way. Large cracks and gaps should be sealed permanently. Gaps greater than 3mm that let air in or out into your home need seals. For example, if an open fireplace isn’t used it can cause draughts and should be shut from. Property managers and landlords are accountable for making sure that these draughts are stopped as much as imaginable.

There is no need to block holes or gaps in the construction. For example, tiny gaps around windows and doors might be necessary to allow for movement within the building as the home gets warmer and cooler, so that they can still be closed and opened instead of instead of being stuck. A good heating system is crucial for healthy houses

Heating Melling

Melling rental properties should have a permanent source of heating that is able to heat the principal or the biggest living space to at least 18degC, even on the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating requirements for it to be permanent (i.e. not portable) with at least 1.5 kW in heating capacity, and meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool could be used to check if the permanent heater(s) are sufficient or whether you will need to ‘top up’ with a new heater. Open fires as well as unflued combustion heaters like the portable LPG bottle heaters aren’t considered to be safe heating options under The Healthy Homes Standard.

If the heating that you offer is electric heating (or heat pump), it must be equipped with a thermostat. This makes the heating more consistent and efficient. In most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. In certain situations, like apartments with small spaces the smaller fixed electric heater may be sufficient.

If the living area already has a fixed heating source, like a heat pump, then it might need a top up to be able to meet the standards. Certain kinds of heaters cannot be used to comply with the standard because they’re inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Melling

Insulation Melling

Underfloor and ceiling insulation is a requirement on all rental houses since 1 July 2019. All landlords and property managers are required to make sure that the insulation is up to this new standard. In certain situations, the old ceiling insulation as well as insulation within the sub floor space may need to be replaced or replaced.

Melling Moisture Ingress & Drainage

Making sure your rental property is protected from water damage isn’t only about the inside of the building; you have to ensure there is somewhere for surface and underground water to flow and prevent it from getting into the building. The ground-moisture barrier typically a sheet of polythene that is placed over the ground, to block any moisture that is present in the ground from rising into the home. It also helps in preventing moisture damage to the underfloor insulation.
