Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed for a Melling rental property, all Healthy Homes compliance items need to be done inside of 90 days.

All the information on the Compliance Statement needs to be up-to-date when the tenancy contract is signed. It should be maintained throughout the duration of the tenancy when any related work is completed.

It’s also crucial to be aware that a landlord with multiple rental properties may receive additional fines for non-compliance. The harshest penalties are given for the most serious violations. Those who have at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Tenancies commenced from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement for all Melling and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords have to keep records of their compliance with any Healthy Homes Standard that apply or will be applicable throughout the tenancy period of the rental property.

From July 1st 2021

  • Property managers and private landlords should make sure their rental properties comply according to Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.
