Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Maupuia rental property, all Healthy Homes compliance work need to be completed inside of 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or amended tenancy agreement there could be an additional penalty or infringement fee.

Anyone can request details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager fails to supply the necessary information within 21 days from being informed of the request, they could be issued an infringement notice and be fined as high as $750.

Additionally, there is an additional fine of approximately $900 for landlords and property managers that provide false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is the person who is identified on the tenancy agreement as being the person leasing the property out, so it could be the name of the landlord as well as the company that manages the property.

Maupuia Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is required for all Maupuia and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that prove compliance with the Healthy Homes Standards that apply or will be applied during the tenancy of an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Maupuia rental properties need to have a stable source of heat which can warm the main or largest living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heat needs that it be permanently fixed (i.e. not portable) that is, at least 1.5 horsepower in capacity, and it must have the minimum required heating capacity for the main living room. A Heating Assessment Tool may be used to check if your current permanent heater(s) are adequate or if you’ll need to ‘top up’ with a new heater. Unflued combustion and open fire heaters such as the portable LPG bottle heaters aren’t considered to be suitable heating options for those following the Healthy Homes Standard.

If the heating system you provide is electric heating (or heat pump), then it must be equipped with the thermostat. This makes the heating more uniform and efficient. For most properties, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are required. In some instances, like small apartments an electric, fixed heater may be sufficient.

If the main living room already has a central heating source such as a heat pump, then it might just require some additional energy to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the standard as they are either not effective, cost prohibitive to operate and/or unsafe to run.

Ventilation Maupuia
