Did you know that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords are now required to make sure that their Maupuia rental properties meet the minimum Healthy Homes Standards within 90 days of a new or renewed tenancy and all private rentals are required to be fully certified by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Maupuia rental property, all Healthy Homes compliance items must be completed inside of 90 days.

Beginning on July 1st, 2021, when a new, renewed or varied lease is entered into on a Maupuia rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet each of Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement there may be an additional fine or violation fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager does not provide the required information within 21 days from being informed of the request, they may receive an infringement notification and be fined upto $750.

Additionally, there is an additional fine of approximately $900 for landlords and property managers providing a false or misleading Healthy Homes Statement of Compliance or any other information. The person liable to pay this fine is the one who is named on the tenancy agreement as the person who is leasing the property out and it could be the landlord’s name or the property management company.

The information contained in the Compliance Statement needs to be current when the tenancy contract is executed, and it must be updated during the entire tenancy, as associated work has been completed.

It is important to note that landlords who have multiple rental properties may face greater penalties for non-compliance. The harshest penalties are reserved for serious violations, and landlords who own six or more properties can be penalised up to $50,000, and as much as $100,000 for hearing claims.

Maupuia Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is required for all Maupuia and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with each Healthy Homes Standards that apply or will apply to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers must make sure their rental properties conform to the Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts are a major cause of less temperature in homes. A cold house is more expensive to heat, meaning wasting energy and increased bills.

If a draft can be perceived as a result of gaps or holes or holes, it needs to be closed.

Heating Maupuia

Rental properties in Maupuia must have a fixed heating source which can warm the principal or the biggest living area to at minimum 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements for it to be permanent (i.e. not portable) that is, at least 1.5 horsepower in capacity, and meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to determine whether the fix heater(s) are adequate or whether you will need to "top up" by adding a second heater. Open fires as well as unflued combustion heaters such as small portable LPG bottle heaters aren’t considered to be safe heating options for those following the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump, then it must include the thermostat. This will make your heating more consistent and efficient. In most homes, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are required. In certain situations, such as small apartments, a smaller fixed electric heater may be sufficient.

If the living area already has a fixed heating source like a heat pump, then it could need an update in order to comply with the standards. Certain kinds of heaters cannot be used to comply with the quality as they are either not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Maupuia
