Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? The landlords are now required to ensure their Maupuia rental properties meet the minimum Healthy Homes Standards within 90 days of a renewal or new tenancy and all private rental properties must be fully in compliance by July 1st 2024.

Fines for Failing to Comply

The person who is liable for this fine is whoever is identified on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement requirements to be current before the tenancy agreement can be executed, and it should be kept updated throughout the tenancy as any associated work has been completed.

It is also crucial to note that a landlord who own multiple rental properties may face additional fines for non-compliance. The most severe penalties are given only for serious violations, and landlords who own more than six properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Maupuia Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is required to all Maupuia and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate conformance with the Healthy Homes Standards that apply or will apply throughout the tenancy period of the rental property.

Starting 1 July 2021

  • Private landlords and property managers have to make sure their rental properties conform to the Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

If you are able to feel external air flowing in or an unobstructed draught coming from a gap or hole that is, it is most likely a gap or hole which needs sealing in any way. Large gaps and cracks should be permanently stopped. Any gaps greater than 3mm that allow air in or out of your home need sealing. For example, if the open fireplace isn’t being used, it could cause draughts, and should be sealed from. Landlords and property managers are accountable for ensuring that these draughts are stopped as much as possible.

Heating Maupuia

Rental properties in Maupuia should have a permanent source of heating that is able to heat the principal or the biggest living space to a minimum of 18degC, even during the coldest days of the year.
