Fines for Failing to Comply
Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Maupuia rental property, all Healthy Homes compliance items need to be finished within 90 days.
Since the 1st July of 2021, once a new, renewed or varied contract is signed on the Maupuia rental property, all Healthy Homes compliance work must be done by the end of 90 days.
Failure to adhere to all of the Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy contract, there may be an additional fine or violation fee.
Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to supply the necessary information within 21 days of receiving the request, they could receive an infringement notification and be fined up to $750.
Furthermore, there’s also a fine of approximately $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as the one who is leasing the property out, so it could be the landlord’s name or the company that manages the property.
The information contained in the Compliance Statement requirements to be accurate at the time that the tenancy agreement is executed, and it is updated during the entire tenancy, as associated work has been completed.
It’s important to keep in mind that landlords with several rental properties can face greater penalties for non-compliance. The highest penalties are reserved for the most serious breaches, and landlords with six or more properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.
