Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed for a Manor Park rental property, all Healthy Homes compliance items must be done by the end of 90 days.

Since the 1st July of 2021, once a new or renewed Tenancy is signed for a Manor Park rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the expected timeframe can result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement there may be an additional penalty or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they are living in. If the property manager does not supply the information requested within 21 days of having received the inquiry, they will receive an infringement notification and be fined up to $750.

In addition, there is also a penalty of approximately $900 for landlords and property managers that provide false or false Healthy Homes Compliance Statement or other information. The person who is responsible to pay this fine is the one who is named on the tenancy contract as the person who is letting the property and it could be the name of the landlord or the company that manages the property.

All the information on the Statement of Compliance needs to be accurate before the tenancy agreement can be signed. It must be updated through the tenancy period as related work is completed.

It’s crucial to note that landlords who manage multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are given for severe breaches, and landlords with six or more properties can be fined as high as $50,000, or as high as $100,000 for hearing claims.

Manor Park Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement in all Manor Park and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with any Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All houses rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

For example, if an open fireplace isn’t in use it may cause draughts and must be sealed from. Landlords and property managers are responsible for ensuring such draughts are eliminated in the maximum extent possible.

You don’t require to block gaps or holes which are part of the building. For instance, small gaps around doors and windows could be required to allow movement of the building as the household warms and cools so that they can still be opened and closed rather than sticking. Heating Manor Park

Manor Park rental properties must have a fixed source of heating that can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat needs that it be permanently fixed (i.e. not portable) and at least 1.5 horsepower in capacity, and must meet the minimum heating capacity needed in the living area. A Heating Assessment Tool could be used to check if the existing fixed heater(s) are sufficient or if you’ll need to "top-up" by adding a second heater. Open fires and unflued combustion heaters, such as mobile LPG bottle heaters aren’t considered acceptable heating options in those following the Healthy Homes Standard.

If the heating system you offer is electric heating or heat source, it needs to include an thermostat. This will make your heating more consistent and effective. For most homes, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are needed.
