Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on a Manor Park rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

The person liable for this fine is the person who is named on the lease agreement as the person who is renting the property It could also be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be accurate when the tenancy contract is completed, and is updated throughout the tenancy as any associated work has been completed.

It’s crucial to note that a landlord who manage multiple rental properties may face additional fines for non-compliance. The highest penalties are handed down for the most serious violations, and landlords who own six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearings.

When Do I require to be in compliance with The Healthy Homes Standards?

Manor Park Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement to all Manor Park and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.
