Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed for a Manor Park rental property, all Healthy Homes compliance tasks must be done by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied lease is entered into on the Manor Park rental property, all Healthy Homes compliance work must be completed within 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy agreement, there could be an additional fine or violation fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager fails to supply the necessary information within 21 days from being informed of the request, they will receive an infringement notice and be fined upto $750.

In addition, there is also a penalty as much as $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or information. The person responsible for this fine is the person who is identified on the tenancy agreement as being the person letting the property out which could be the name of the landlord as well as the property management company.

All information in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is executed, and it should be kept updated through the tenancy period as necessary work related to it is finished.

It’s also crucial to note that landlords who own multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved for the most serious breaches. Landlords with more than six properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Manor Park Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory for all Manor Park and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate compliance with all Healthy Homes Standard that apply or will apply to the rental property.

Beginning 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform with the Healthy Homes Standards within 90 days of a renewal, new or a change in lease.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Heating Manor Park

Rental properties in Manor Park require a reliable source of heat which can warm the principal or the biggest living area to at minimum 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat needs to be fixed (i.e. not portable) and at least 1.5 kW in heating capacity, and it must have the minimum capacity for heating required in the living area. For the majority of homes, bigger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In certain situations, like small apartment buildings the smaller fixed electric heater may be sufficient.

If your main living space already has a permanent heating source like an air conditioner, it could require a top up in order to comply with the standards. Some types of heaters can’t be used to comply with the standard since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Manor Park

Each living space within a rental property must contain at minimum one open windows or an exterior door to provide natural airflow. Furthermore, moist areas such as kitchens and bathrooms need to have an venting fan outside to eliminate moisture.
