Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Manor Park rental property, all Healthy Homes compliance tasks must be done within 90 days.

Since the 1st July of 2021, when a new or renewed Tenancy is signed for the Manor Park rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with any of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. The person who is responsible for this fine is the person who is identified on the tenancy agreement as the one who is who is letting the property which could be the landlord’s name or the company that manages the property.

It is also important to keep in mind that landlords who manage multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are handed down for serious violations. Those who have six or more properties can be fined up to $50,000 and as high as $100,000 in hearing claims.

Manor Park Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Underfloor and ceiling insulation is required in all Manor Park and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records of their compliance with any Healthy Homes Standard that apply or will apply during the tenancy of their rental properties.

From 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Manor Park

Rental properties in Manor Park should have a permanent heating source that can heat the largest or main living space to at least 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

In certain situations, like small apartment buildings an electric, fixed heater could be enough.

If the living area is already equipped with a fixed heating source like the heat pump, it might require a top up in order to comply with the standards. Certain types of heaters cannot be used to comply with the standard as they are either costly, not cost-effective to run, or unsafe to operate.

Ventilation Manor Park

Insulation Manor Park

Ceiling and underfloor insulation is required for all rent homes as of July 1st, 2019. Property managers and landlords should ensure that the insulation meets the new quality.
