Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Manor Park rental property, all Healthy Homes compliance items need to be taken care of by the end of 90 days.

Furthermore, there’s also a fine of up to $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. The person liable for this fine is whoever is named on the lease contract as the person leasing the property out which could be the landlord’s name or the property management company.

All information in the Compliance Statement requirements to be correct at the time that the tenancy agreement is executed, and it is updated throughout the tenancy as any relevant work gets completed.

It is crucial to note that landlords who have multiple rental properties may face even higher fines for non-compliance. The most severe penalties are reserved for severe violations. Those who have six or more properties could be fined as high as $50,000 and as high as $100,000 in hearing claims.

Manor Park Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement for all Manor Park and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with the Healthy Homes Standards that apply or will be applicable to your rental home.

Starting 1 July 2021

  • Property managers and private landlords should make sure their rental properties comply according to Healthy Homes Standards within 90 days of a renewal, new or a change in tenant.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of when the tenancy first began.
