Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed for a Manor Park rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

The person who is liable for this fine is whoever is named on the lease agreement as being the person leasing the property out which could be the name of the landlord or the property management company.

All information in the Compliance Statement needs to be up-to-date when the tenancy agreement is completed, and must be updated during the entire tenancy, as associated work has been completed.

It is also important to keep in mind that a landlord with multiple rental properties could face even higher fines for non-compliance. The harshest penalties are reserved for severe breaches. Landlords with six or more properties could be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Manor Park Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory throughout Manor Park and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove conformance with any Healthy Homes Standard that apply or will be applied during the tenure of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform according to Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Manor Park rental properties should have a permanent source of heat that can warm the largest or main living area to at minimum 18degC, even on the coldest days of the year.
