Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed contract is signed on a Manor Park rental property, all Healthy Homes compliance items have to be done within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Manor Park rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.

Additionally, there is also a penalty approximately $900 for landlords and property managers providing a false or misleading Healthy Homes Compliance Statement or information. The person responsible for this fine is the one who is listed on the tenancy agreement as being the person who is letting the property and it could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement requirements to be up-to-date when the tenancy contract is executed, and it is updated throughout the tenancy as any related work is completed.

It’s also crucial to keep in mind that landlords who own multiple rental properties could face greater penalties for non-compliance. Manor Park Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement throughout Manor Park and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with any Healthy Homes Standards that apply or will be applicable throughout the tenancy period of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords have to make sure their rental properties conform with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All homes that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts can lead to dropping temperatures within homes. A humid home is more expensive to heat, which means wasting energy and resulting in higher bills.

Heating Manor Park

Rental properties in Manor Park should have a permanent source of heating that can warm the main or largest living space to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The heating source needs for it to be permanent (i.e. not portable), at least 1.5 kW of heating capacity, and it must have the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to determine if the existing installed heater(s) are sufficient or whether you will need to "top-up" with a new heater. Fires that are open and unflued heaters like portable LPG bottle heaters are not considered to be safe heating options in The Healthy Homes Standard.

If the heating you provide is electric heating or heat pump then it must include a thermostat. This will help make the heating more reliable and efficient. For the majority of houses, bigger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in some cases like small apartment buildings an electric, fixed heater may suffice.

If your main living space is already equipped with a fixed heating source like the heat pump, it may need some additional energy in order to comply with the standards. Some types of heaters can’t be utilised to meet the standard because they’re expensive, inefficient or unsafe to operate.

Ventilation Manor Park
