Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied contract is signed on a Manor Park rental property, all Healthy Homes compliance tasks need to be done within 90 days.

Since the 1st July of 2021, when a new, renewed or varied Tenancy is signed for the Manor Park rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to one of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy agreement it could result in an additional fine or violation fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager does not supply the necessary information within 21 days from receiving the request, they could receive an infringement notification and be fined as high as $750.

Furthermore, there’s also a penalty up to $900 for property owners or property managers providing a false or false Healthy Homes Compliance Statement or information. The person responsible for this fine is the one who is named on the tenancy agreement as the person who is renting the property, so it could be the name of the landlord, or the property management company.

All information in the Compliance Statement needs to be correct when the tenancy agreement is signed. It is updated throughout the tenancy as any relevant work gets completed.

It’s important to note that a landlord with multiple rental properties may face more severe penalties for not complying. The harshest penalties are given for serious breaches. Landlords with six or more properties could be penalised up to $50,000, or as high as $100,000 in hearings.

In the end, a failure to comply with the Healthy Homes requirements can hit your pocket hard, and result in large fines in addition to still having to meet compliance. Don’t risk your rental property, contact us today and request a home inspection performed on the rental property you are renting.

Unreasonable Gaps & Holes

Draught Stopping Manor Park

Draughts may lead to dropping temperatures within homes. A draughty home is more expensive to heat, meaning wasting energy and resulting in higher bills.

If a draft can be felt through gaps that are too large or holes, it requirements to be closed.

What are unreasonable gaps and holes?

If you are able to feel external air coming in or the air is clear from a hole or gap or crack, then it is likely a crack or an opening that needs sealing in somehow. Large cracks and gaps should be fixed permanently. The gaps that exceed 3mm that let air into or out within your house need sealing. For example, if an open fireplace is not in use, it may cause draughts and should be blocked off. Property managers and landlords are accountable for ensuring that such draughts are squelched as far as possible.

There is no need to cover up holes or gaps in the building. For example, tiny gaps around windows and doors could be necessary to allow for movement of the structure when the house gets warmer and cooler, so that they are able to be closed and opened instead of than securing. We will test every window and door in an Healthy Homes assessment of your rental property.

A good heating system is important to ensure healthy homes

Heating Manor Park

Manor Park rental properties must have a fixed heating source that is able to heat the main or largest living space to at least 18degC even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs to be fixed (i.e. not portable) with at least 1.5 kW in heating capacity, and meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool can be used to determine if the existing fixed heater(s) are adequate or if you’ll need to "top up" by adding a second heater. Unflued combustion and open fire heaters, such as portable LPG bottle heaters aren’t considered acceptable heating options in the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat source, it should include a thermostat. This makes the heating more reliable and effective. In most homes, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in certain instances such as small apartments the smaller fixed electric heater might be enough.

If your main living space already has a fixed heating source such as heat pumps, it might require a top up to be able to meet the standards. Certain kinds of heaters cannot be used to meet the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Manor Park

Every living space of a rental property has to contain at minimum one open doors or windows to provide natural ventilation. In addition, high moisture areas such as kitchens or bathrooms should have an externally vented extractor fan that can eliminate moisture.

The ventilation standard is about recognising how dried air can be more easy to heat and a well ventilated rental property is less likely to develop mould and damp.

Bedrooms, living spaces, kitchens, and dining areas are considered liveable spaces. Connecting spaces like the hallway aren’t considered liveable , and thus do not require an opening window or door.

Each window, door or the skylight requirements to have the ability of opening to the outside, and stay set in an opening position to allow the circulation of fresh air and air flow.

Bathrooms, kitchens, as well as any other space in your home with shower, bath, cooktop or other high moisture-producing item will need appropriate extractor fans that vent towards the outside. The Healthy Homes Assessment service will make sure there is sufficient ventilation throughout the living spaces and will also check for the proper extractor fans in areas with high moisture.

Insulation Manor Park

Underfloor and ceiling insulation is a requirement on all rental homes since July 1, 2019. All landlords and property managers have to make sure the insulation meets standards that are in line with the latest standard. In some cases, current ceiling insulation, or the insulation of the subfloor space might need to be replaced or replaced.

A properly insulated home will reduce the risk of condensation and lower the chance of mould and dampness and will also make it easier to the house to keep warmth.

Insulation requirements to meet the R-values that are appropriate for your region.

The "R" refers to thermal resistance, and is a gauge of how well the insulation withstands heat flow. The higher the R-value, the more effective the insulation.

  • Zone 2 – all of North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3

Manor Park Moisture Ingress & Drainage

Protecting your rental property from dampness isn’t just about what’s inside the building; you have to ensure there is somewhere to allow surface, rain and ground water to go and to prevent it from getting into the building. When it concerns damp and moisture it is frequently the concerns you don’t notice that can become a big problem and cause damage to your investment and harming the tenant’s health.

Rental properties must be equipped with effective drainage to get rid of rainwater, storm water and groundwater, with an appropriate runoff or outfall. Making sure that the water has a location to go and that it can’t linger underneath the structures is a crucial aspect of keeping your property dry.

Alongside an irrigation system to stop water ingress, if the apartment has an enclosed gap between the floor and the ground, a ground moisture barrier must be installed if it’s reasonably practicable to do so.

An underground moisture barrier usually an insulating sheet of polythene laid over the ground to prevent any moisture present in the ground from rising into the building. It also assists in preventing any damage to your underfloor insulation.
