Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Linden rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

The person responsible to pay this fine is the one who is named on the lease agreement as being the person leasing the property out which could be the name of the landlord or the company that manages the property.

All the information on the Statement of Compliance needs to be current when the tenancy contract is completed, and is updated through the tenancy period as relevant work gets completed.

It is also crucial to note that a landlord who have several rental properties can face additional fines for non-compliance. The harshest penalties are given only for serious breaches, and landlords with six or more properties can be penalised up to $50,000, and as much as $100,000 for hearing claims.

Linden Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement for all Linden and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that prove conformance with the Healthy Homes Standards that apply or will apply throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Draughts can lead to less temperature in houses. A draughty house will cost more to heat, resulting in wasted money and energy.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or a clear draught from a hole or gap, then it’s most likely a gap or hole which needs sealing in some way. Cracks and gaps that are large should be sealed permanently. Any gaps greater than 3mm that allow air to enter or exit of your home require sealing. For instance, if an open fireplace isn’t used it may cause draughts and should be blocked from. Property managers and landlords are accountable for ensuring that draughts from the fireplace are removed as much as possible.

There is no need to block holes or gaps which are part of the building. For instance, small gaps around doors and windows may be required to allow for movement within the building when the house heats and cools, so that they are able to be closed and opened instead of instead of being stuck. Heating Linden

Rental properties in Linden need to have a stable heating source that can heat the largest or main living area to at minimum 18degC even on the coldest winter days. If your main living space is already equipped with a fixed heating source like an air conditioner, it could require an upgrade in order to comply with the standards. Certain types of heaters cannot be used to achieve the standard because they’re costly, not affordable to run, or are unsafe to operate.

Ventilation Linden
