Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Linden rental property, all Healthy Homes compliance work have to be done within 90 days.

From the 1st of July in 2021, when a brand new or renewed contract is signed on a Linden rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Additionally, there is also a penalty approximately $900 for landlords or property managers that provide false or false Healthy Homes Statement of Compliance or information. The person who is liable for this fine is the person who is named on the lease contract as the person letting the property out and it could be the name of the landlord as well as the company that manages the property.

Linden Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement throughout Linden and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records of their compliance with the Healthy Homes Standard that apply or will be applied during the tenure of your rental home.

From July 1st 2021

  • Private landlords and property managers are required to ensure their rental properties conform to the Healthy Homes Standards within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

If your living space is already equipped with a fixed heating source, like heat pumps, it might just need some additional energy in order to comply with the standards. Certain types of heaters cannot be used to meet the standard because they’re expensive, inefficient and/or unhealthy to run.
