Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed for a Linden rental property, all Healthy Homes compliance tasks need to be taken care of within 90 days.

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on the Linden rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet all of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated in the renewal, new or revised tenancy contract, there could be an additional penalty or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager fails to supply the required information within 21 days of being informed of the request, they will receive an infringement notice and be fined as high as $750.

Additionally, there is an additional fine of as much as $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or information. The person who is liable for this fine is the person who is named on the tenancy agreement as the person who is who is letting the property and it could be the name of the landlord or the property management company.

The information contained in the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed, and ideally it should be kept updated during the entire tenancy, as necessary work related to it is finished.

It’s also important to be aware that a landlord who manage several rental properties can face more severe penalties for not complying. The highest penalties are handed down for serious violations, and landlords who own six or more properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

When should I need to be in compliance with the Healthy Homes Standards?

Linden Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement to all Linden and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with all Healthy Homes Standards that apply or will be applied during the tenure of the rental property.

From 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Linden

Draughts may lead to low temperatures inside households. A cold house costs more to heat, meaning wasting energy and increased bills.

Heating Linden

Rental properties in Linden need to have a stable heating source that can warm the main or largest living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements to remain fixed (i.e. not portable), at least 1.5 horsepower in capacity, and meet the minimum required heating capacity for the main living room. Unflued combustion and open fire heaters such as mobile LPG bottle heaters are not considered acceptable heating options for the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump, it needs to have the thermostat. This will help make the heating more uniform and efficient. For most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are needed. In some instances, like small apartment buildings, a smaller fixed electric heater could be enough.

If your main living space is already equipped with a fixed heating source, like heat pumps, it might just require an update to meet the standards. Certain kinds of heaters cannot be used to achieve the standard as they are either expensive, inefficient or unsafe to operate.

Ventilation Linden

Each liveable space in a rental home must have at least one opening windows or an exterior door to provide natural airflow. Additionally, areas with high moisture areas such as kitchens or bathrooms should have an venting fan outside to remove moisture.

All landlords and property managers are required to ensure that the insulation is up to standards that are in line with the latest standard.
