Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied contract is signed on a Linden rental property, all Healthy Homes compliance work have to be finished by the end of 90 days.

From the 1st of July in 2021, if a new or renewed Tenancy is signed for the Linden rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated in the new, renewed or amended tenancy agreement there could be an additional fine or violation fee.

Any tenant can ask for information about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or the property manager doesn’t provide the information requested within 21 days of receiving the request, they will receive an infringement notification and be fined as high as $750.

Furthermore, there’s an additional fine of approximately $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person liable for this fine is whoever is identified on the tenancy agreement as being the person who is letting the property and it could be the name of the landlord as well as the property management company.

The information contained in the Compliance Statement needs to be current at the time that the tenancy agreement is executed, and it must be updated through the tenancy period as associated work has been completed.

It is important to note that a landlord who have multiple rental properties may receive more severe penalties for not complying. The highest penalties are given for severe breaches. Landlords with six or more properties can receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Linden Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is required for all Linden and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate conformance with all Healthy Homes Standards that apply or will be applicable during the tenancy of their rental properties.

From July 1st 2021

  • Property managers and private landlords are required to ensure their rental properties conform with the Healthy Homes Standards within 90 days of any new, renewed , or altered lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Linden

Draughts are a major cause of less temperature in households. A damp house will cost more to heat, meaning wasting money and energy.

If a draught is felt through gaps that are too large or holes, it needs to be closed.

What are unreasonable gaps or holes?

If you can feel external air entering or a clear draught from a crack or a gap or crack, then it is likely a crack or hole that requirements sealing in some way. Large cracks and gaps should be permanently stopped. Gaps greater than 3mm that allow air to enter or exit of your home need the sealing. Proper heating is crucial for healthy houses

Heating Linden

Linden rental properties must have a fixed source of heating that is able to heat the largest or main living space to at least 18 degrees Celsius, even on the coldest days of the year.
