Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Linden rental property, all Healthy Homes compliance items need to be completed within 90 days.

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Linden rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy agreement, it could result in an additional fine or violation fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager does not supply the information requested within 21 days from getting the notice, the tenant may receive an infringement letter and be fined upto $750.

Additionally, there is an additional fine of approximately $900 for landlords and property managers that provide false or false Healthy Homes Compliance Statement or other information. The person responsible for this fine is the one who is listed on the tenancy contract as the person letting the property out It could also be the name of the landlord as well as the company that manages the property.

All the information on the Statement of Compliance requirements to be up-to-date when the tenancy contract is executed, and it must be updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It’s important to remember that a landlord who own multiple rental properties may face additional fines for non-compliance. The highest penalties are reserved only for serious violations. Those who have six or more properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.

Linden Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is a requirement to all Linden and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove the conformance to any Healthy Homes Standards that apply or will apply throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Linden

Draughts can lead to lower temperatures in houses. A cold home costs more to heat, meaning wasting energy and resulting in higher bills.

If a draught can be felt through gaps that are too large or holes, it requirements to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air coming in or the sound of a clear draught emanating out of a hole or gap or crack, then it is most likely a gap or an opening that needs sealing in somehow. Large gaps and cracks should be fixed permanently. Gaps greater than 3mm that let air into or out of your home require seals. In the case of an open fireplace is not in use, it could cause draughts, and should be shut off. Landlords and property managers are responsible for making sure such draughts are eliminated whenever possible.

There is no need to block off gaps or holes which are part of the construction. For instance, small gaps around windows and doors may be required to allow for movement within the building when the home heats and cools, so that they can still be shut and opened, rather than sticking. Proper heating is important to ensure healthy homes

Heating Linden

Rental properties in Linden require a reliable source of heat that can warm the principal or the biggest living room to at least 18degC, even during the most coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements that it be permanently fixed (i.e. not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool may be used to determine if the existing fix heater(s) are sufficient or whether you will need to "top-up" with an additional heater. If the heating that you provide is an electric heater or heat source, it should include an thermostat. This makes the heating more consistent and efficient. In most houses, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. In some instances, like small apartment buildings, a smaller fixed electric heater may suffice.

If your main living space already has a fixed heating source, like the heat pump, it may require an update to be able to meet the standards. Certain kinds of heaters cannot be used to meet the standard since they’re either expensive, inefficient and/or unsafe to run.

Ventilation Linden

Each liveable space in a rental home must contain at minimum one open door or window to offer natural airflow. Furthermore, moist areas such as kitchens and bathrooms should have an externally vented extractor to take moisture away.

Insulation Linden

Ceiling and underfloor insulation is a requirement in all rental houses from 1 July 2019. Property managers and landlords are required to ensure that the insulation is up to the new standard. In some instances, existing ceiling insulation or insulation in the sub floor space may require to be filled with or replaced.

A well-insulated property will help to control condensation, and decrease the risk of mould and dampness, and also makes much easier for the house to keep warmth.

The "R" stands for thermal resistance, and it is a measurement of how well the insulation is able to resist heat flow. The more R-value is higher, the higher the standard of insulation.

Linden Moisture Ingress & Drainage

The security of your rental home from the effects of moisture isn’t just a matter of the inside but you must make sure there is somewhere to allow surface, rain and ground water to go, and also stop it from getting inside.
