Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Linden rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on the Linden rental property, all Healthy Homes compliance work must be done within 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. The person liable for this fine is the person who is named on the lease agreement as being the person letting the property out and it could be the name of the landlord, or the property management company.

All the information on the Compliance Statement needs to be up-to-date when the tenancy agreement is signed. It is updated during the entire tenancy, as associated work has been completed.

It is crucial to keep in mind that landlords with several rental properties can face more severe penalties for not complying. The highest penalties are given for serious violations. Those who have more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

Linden Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory to all Linden and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records to demonstrate compliance with the Healthy Homes Standards that apply or will be in force to an apartment rental.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Heating Linden

Rental properties in Linden need to have a stable source of heat that can heat the main or largest living area to at minimum 18degC, even on the winter coldest days. Ventilation Linden
