Fines for Failing to Comply

As of 1st July 2021, if a new or renewed contract is signed on a Linden rental property, all Healthy Homes compliance work have to be completed within 90 days.

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Linden rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to meet all of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. It is also important to keep in mind that landlords who manage multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are given for the most serious breaches, and landlords with six or more properties could be fined as high as $50,000, or as high as $100,000 in hearings.

Linden Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement in all Linden and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate the compliance with any Healthy Homes Standard that apply or will be applied during the tenure of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Large cracks and gaps should be fixed permanently. Any gaps greater than 3mm that let air in or out into your house require the sealing. For instance, if an open fireplace isn’t being used, it can cause draughts and should be shut from. Landlords and property managers are accountable for ensuring that draughts from the fireplace are removed as much as imaginable.

You don’t require to block gaps or holes that are part of the construction. Heating Linden

Linden rental properties need to have a stable heating source that can heat the largest or main living space to at least 18degC, even during the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs to be fixed (i.e. not portable) with at least 1.5 kW in heating capacity, and it must have the minimum heating capacity needed for the main living space. If the heating you provide is electric heating or heat source, then it must have the thermostat. This will make your heating more consistent and effective. For most properties, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are required. In certain situations, like small apartment buildings the smaller fixed electric heater could be enough.

If your main living space already has a permanent heating source, such as an air conditioner, it might require a top up in order to comply with the standards. Some types of heaters can’t be used to comply with the quality because they’re costly, not cost-effective to run, and/or unsafe to run.

Ventilation Linden

Insulation Linden
