Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed contract is signed on a Linden rental property, all Healthy Homes compliance work must be taken care of within 90 days.

As of 1st July 2021, when a brand new or renewed tenancy is signed on the Linden rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement there may be an additional fine or violation fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the property they are living in. If the property manager does not provide the required information within 21 days from being informed of the request, they may receive an infringement letter and be fined as high as $750.

In addition, there’s also a penalty of up to $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is named on the lease agreement as the person who is renting the property, so it could be the name of the landlord as well as the property management company.

All information in the Compliance Statement requirements to be up-to-date at the time that the tenancy agreement is signed, and ideally it should be kept updated during the entire tenancy, as necessary work related to it is finished.

It is also crucial to note that landlords with several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved for serious breaches, and landlords with at least six rental properties could be fined up to $50,000 and as high as $100,000 for hearing claims.

Linden Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory throughout Linden and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with any Healthy Homes Standards that apply or will be in force during the tenancy of an apartment rental.

From 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any new, renewed , or altered Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Linden

Rental properties in Linden should have a permanent source of heat that can warm the living area to at minimum 18degC, even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.
