Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Linden rental property, all Healthy Homes compliance work need to be taken care of within 90 days.

From the 1st of July in 2021, when a new or renewed Tenancy is signed for the Linden rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to any of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement, it could result in an additional fine or violation fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager fails to provide the required information within 21 days from being informed of the request, they could receive an infringement letter and be fined upto $750.

In addition, there is also a fine of as much as $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Compliance Statement or information. The person responsible for this fine is the person who is identified on the tenancy agreement as the person who is renting the property which could be the landlord’s name or the company that manages the property.

All information in the Compliance Statement requirements to be correct when the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any relevant work gets completed.

It is also crucial to remember that a landlord with several rental properties can face even higher fines for non-compliance. The highest penalties are handed down for severe breaches. Landlords with six or more properties can be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

When do I require to be in compliance with my Healthy Homes Standards?

Linden Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory for all Linden and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate the compliance with each Healthy Homes Standards that apply or will be applied throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Private landlords and property managers have to ensure their rental properties conform with the Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Insulation for underfloor and ceilings is required for all rent homes since 1 July 2019. All landlords and property managers should ensure that the insulation is in line with this new standard.
