Fines for Failing to Comply

The person responsible to pay this fine is the one who is named on the tenancy agreement as the person who is leasing the property out It could also be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement needs to be accurate before the tenancy agreement can be completed, and is updated throughout the tenancy as any associated work has been completed.

It is also crucial to remember that landlords who manage multiple rental properties may receive additional fines for non-compliance. The harshest penalties are handed down only for serious violations. Those who have more than six properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory throughout Kingsley Heights and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate conformance with the Healthy Homes Standard that apply or will be applicable during the tenancy of your rental home.

From July 1st 2021
