Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed for a Kingsley Heights rental property, all Healthy Homes compliance work need to be finished within 90 days.

As of 1st July 2021, if a new or renewed Tenancy is signed for the Kingsley Heights rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. In addition, if the present Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy contract, there could be an additional penalty or infringement fee.

It is important to remember that landlords with multiple rental properties may receive additional fines for non-compliance. The highest penalties are given for the most serious breaches, and landlords with six or more properties can be penalised up to $50,000, or as high as $100,000 for hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is required throughout Kingsley Heights and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with all Healthy Homes Standards that apply or will be in force throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any new, renewed or varied lease.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All homes let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

However, in certain instances such as small apartments the smaller fixed electric heater may be sufficient.

If the living area is already equipped with a fixed heating source, like the heat pump, it might require an update to meet the standards. Certain types of heaters cannot be used to meet the standard since they’re either expensive, inefficient or unsafe to operate.
