Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Kingsley Heights rental property, all Healthy Homes compliance work have to be taken care of inside of 90 days.

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on a Kingsley Heights rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy contract, there may be an additional penalty or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager fails to provide the required information within 21 days of having received the inquiry, they may be issued an infringement notice and be fined as high as $750.

Additionally, there is also a fine of approximately $900 for landlords and property managers who offer a false or false Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is identified on the tenancy agreement as the person who is letting the property out It could also be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be accurate when the tenancy agreement is executed, and it should be kept updated through the tenancy period as related work is completed.

It’s also important to remember that landlords who have multiple rental properties could face greater penalties for non-compliance. The harshest penalties are reserved for severe violations. Those who have at least six rental properties could be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is a requirement for all Kingsley Heights and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the conformance to the Healthy Homes Standard that apply or will be applicable throughout the tenancy period of their rental properties.

From July 1st 2021

  • Private landlords and property managers must make sure their rental properties comply with the Healthy Homes Standard within 90 days of any renewal, new or a change in tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Proper heating is important for well-being homes

Heating Kingsley Heights

Kingsley Heights rental properties should have a permanent heating source that can heat the largest or main living space to at least 18degC even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs to be fixed (i.e. not portable) with at least 1.5 kW of heating capacity, and must meet the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to determine if your current installed heater(s) are adequate or if you’ll require to "top-up" with a new heater. Fires that are open and unflued heaters such as portable LPG bottle heaters are not considered to be suitable heating options in The Healthy Homes Standard.

If the heating that you offer is an electric heater or heat pump, it needs to have a thermostat. This will help make the heating more reliable and efficient. In most homes, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in certain instances like small apartment buildings an electric, fixed heater may be sufficient.

If the main living room already has a fixed heating source like a heat pump, then it could need some additional energy in order to comply with the standards. Certain kinds of heaters cannot be used to comply with the quality since they’re either expensive, inefficient and/or unsafe to run.

Ventilation Kingsley Heights

Insulation Kingsley Heights

Underfloor and ceiling insulation is required on all rental houses since July 1, 2019. All landlords and property managers have to ensure that the insulation is up to this new standard. In some cases, an existing insulation on the ceiling or in the sub floor space may need to be topped up or replaced.

A well-insulated property will reduce the risk of condensation and lessen the likelihood of mould and damp, and also makes more easy for the home to hold the heat.

The "R" stands for thermal resistance and it is a measurement of how well the insulation resists heat flow. The more R-value is higher, the higher the quality of insulation.
