Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed on a Kingsley Heights rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Kingsley Heights rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement there may be an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they reside in. If the property manager does not supply the information requested within 21 days of receiving the request, they can be issued an infringement notice and could be fined up to $750.

Additionally, there is also a penalty up to $900 for landlords or property managers providing a false or false Healthy Homes Statement of Compliance or other information. The person responsible to pay this fine is the one who is named on the lease agreement as being the person renting the property, so it could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance needs to be current when the tenancy contract is signed, and ideally it is updated through the tenancy period as related work is completed.

It is crucial to keep in mind that landlords who manage several rental properties can face even higher fines for non-compliance. The most severe penalties are handed down for severe breaches. Landlords with more than six properties could receive fines of up to $50,000 and as high as $100,000 in the case of hearing claims.

When Do I need to be in compliance with my Healthy Homes Standards?

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory throughout Kingsley Heights and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their compliance with each Healthy Homes Standard that apply or will be applicable throughout the tenancy period of their rental properties.

From July 1st 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any new, renewed or varied tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts may lead to lower temperatures in homes. A draughty house will cost more to heat, which completed jobs in wasting energy and increased bills.

If a draft can be felt from unreasonable gaps or holes or holes, it needs to be closed.

What are unreasonable gaps and holes?

If you are able to feel external air getting in, or see an unobstructed draught coming from a hole or gap, then it is likely a crack or an opening that needs sealing in any way. Proper heating is crucial to ensure healthy homes

Heating Kingsley Heights

Rental properties in Kingsley Heights need to have a stable heating source that can warm the principal or the biggest living area to at minimum 18degC even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating requirements to remain fixed (i.e., not portable) with at least 1.5 horsepower in capacity and have the minimum required heating capacity in the living area. However, in some cases like apartments with small spaces an electric, fixed heater may be sufficient.

If the living area already has a central heating source such as heat pumps, it might require an update to meet the standards. Some types of heaters can’t be used to achieve the standard since they’re either not effective, cost prohibitive to operate and/or unsafe to run.

Ventilation Kingsley Heights

Each living space within a rental property has to have at least one opening windows or an exterior door to offer natural airflow. Additionally, areas with high moisture areas such as kitchens or bathrooms should be equipped with an externally vented extractor fan to take moisture away.

Insulation Kingsley Heights

The insulation of the ceiling and underfloor is required on all rental houses since July 1, 2019. Property managers and landlords have to ensure that the insulation is in line with the new standard. In some cases, old ceiling insulation as well as insulation within the sub floor space may require to be added or replaced.
