Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Kingsley Heights rental property, all Healthy Homes compliance items have to be completed by the end of 90 days.

All information in the Statement of Compliance requirements to be accurate when the tenancy contract is signed, and ideally it should be maintained throughout the duration of the tenancy when any related work is completed.

It’s also important to remember that landlords who own multiple rental properties could face more severe penalties for not complying. The harshest penalties are reserved only for serious violations, and landlords who own at least six rental properties could be penalised up to $50,000, and even as high as $100,000 in the case of hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory for all Kingsley Heights and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove compliance with the Healthy Homes Standard that apply or will be applicable during the tenancy of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform with the Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
