Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Kingsley Heights rental property, all Healthy Homes compliance items have to be finished inside of 90 days.

From the 1st of July in 2021, when a brand new or renewed contract is signed on a Kingsley Heights rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to any of the Healthy Homes Standards inside of the expected timeframe can result in an amount of $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement it could result in an additional fine or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the the property manager doesn’t supply the required information within 21 days of having received the inquiry, they could receive an infringement notification and be fined upto $750.

Furthermore, there’s also a fine of up to $900 for property owners or property managers who have provided a false or misleading Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is the one who is identified on the tenancy agreement as being the person renting the property which could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is signed. It should be kept updated throughout the tenancy as any necessary work related to it’s finished.

It’s also important to be aware that a landlord who own multiple rental properties may face even higher fines for non-compliance. The most severe penalties are handed down for severe violations. Those who have six or more properties can receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is required to all Kingsley Heights and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be applicable to their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must make sure their rental properties comply to the Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Kingsley Heights

Kingsley Heights rental properties must have a fixed source of heat that can heat the largest or main living room to at least 18degC even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.
