Fines for Failing to Comply

All the information on the Compliance Statement needs to be accurate before the tenancy agreement can be signed, and ideally it is updated through the tenancy period as associated work has been completed.

It’s crucial to note that landlords who manage multiple rental properties may face additional fines for non-compliance. The highest penalties are reserved only for serious violations. Those who have six or more properties can receive fines of up to $50,000, and as much as $100,000 in hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement throughout Kingsley Heights and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to each Healthy Homes Standards that apply or will be in force throughout the tenancy period of the rental property.

From 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed lease.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.
