Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for a Kingsley Heights rental property, all Healthy Homes compliance items must be finished inside of 90 days.

As of 1st July 2021, if a new, renewed or varied Tenancy is signed for the Kingsley Heights rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with each of Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated in a new, renewed or revised tenancy contract, there may be an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager fails to provide the information requested within 21 days of having received the inquiry, they will receive an infringement notification and be fined upto $750.

In addition, there’s an additional fine of approximately $900 for landlords or property managers who offer a false or misleading Healthy Homes Compliance Statement or any other information. The person liable for this fine is the one who is named on the tenancy agreement as the person who is who is letting the property which could be the name of the landlord or the property management company.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory throughout Kingsley Heights and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove conformance with the Healthy Homes Standards that apply or will be in force during the tenure of an apartment rental.

From July 1st 2021

  • Private landlords and property managers are required to make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

Beginning 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.
