Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied contract is signed on a Kilbirnie rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

It’s important to be aware that landlords who have multiple rental properties may face greater penalties for non-compliance. The highest penalties are handed down only for serious violations. Those who have more than six properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Tenancies established from 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is required throughout Kilbirnie and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate conformance with all Healthy Homes Standards that apply or will be applied to their rental properties.

From 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied lease.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy began.

Heating Kilbirnie

Kilbirnie rental properties should have a permanent source of heat that can heat the largest or main living space to at least 18degC, even during the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

In some instances, like small apartment buildings the smaller fixed electric heater may suffice.

If your main living space already has a permanent heating source, such as a heat pump, then it could need a top up in order to comply with the standards. Certain types of heaters cannot be used to comply with the quality as they are either not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Kilbirnie
