Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied contract is signed on a Kilbirnie rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

The person liable to pay this fine is the one who is named on the lease contract as the person who is letting the property, so it could be the name of the landlord or the property management company.

All information in the Statement of Compliance requirements to be up-to-date when the tenancy agreement is signed. It should be maintained throughout the tenancy as any associated work has been completed.

It is important to be aware that landlords who manage multiple rental properties could face greater penalties for non-compliance. The most severe penalties are given only for serious violations, and landlords who own six or more properties can be fined up to $50,000, and even as high as $100,000 in hearings.

Tenancies that were signed beginning on 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required in all Kilbirnie and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove compliance with all Healthy Homes Standards that apply or will be applicable to your rental home.

Beginning 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform to the Healthy Homes Standard within 90 days of any new, renewed , or altered lease.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All households rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Rental properties in Kilbirnie should have a permanent heating source that can heat the main or largest living space to a minimum of 18degC even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

Certain types of heaters cannot be used to meet the quality because they’re not efficient, cost prohibitive to operate and/or unhealthy to run.
