Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Kilbirnie rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Kilbirnie rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

The person liable to pay this fine is the one who is identified on the tenancy agreement as the person who is who is letting the property which could be the name of the landlord as well as the property management company.

When Do I need to be in compliance with the Healthy Homes Standards?

Kilbirnie Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement to all Kilbirnie and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with all Healthy Homes Standard that apply or will be applicable to the rental property.

From 1 July 2021

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Rental properties in Kilbirnie must have a fixed source of heating that can warm the main or largest living space to at least 18degC, even during the coldest days of the year.
