Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed on a Khandallah rental property, all Healthy Homes compliance tasks need to be finished by the end of 90 days.

From the 1st of July in 2021, if a new, renewed or varied Tenancy is signed for the Khandallah rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with each of Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or amended tenancy agreement there may be an additional fine or violation fee.

If the landlord or the property manager doesn’t provide the information requested within 21 days from being informed of the request, they may be issued an infringement notice and be fined upto $750.

The information contained in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be completed, and is updated throughout the tenancy as any necessary work related to it’s finished.

It is important to be aware that landlords who have multiple rental properties may face greater penalties for non-compliance. The highest penalties are handed down only for serious breaches. Landlords with six or more properties can be fined as high as $50,000, and as much as $100,000 in hearings.

Khandallah Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory for all Khandallah and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standards that apply or will be applicable to an apartment rental.

From July 1st 2021

  • Private landlords and property managers should ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Adequate heaters are important for well-being houses

Heating Khandallah

Rental properties in Khandallah need to have a stable heating source that can heat the principal or the biggest living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements for it to be permanent (i.e. not portable) and at minimum 1.5 kW in heating capacity, and it must have the minimum heating capacity needed in the living area.
