Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed on a Khandallah rental property, all Healthy Homes compliance tasks need to be taken care of within 90 days.

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Khandallah rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not incorporated within the renewal, new or amended tenancy agreement there could be an additional fine or infringement fee.

If the property manager fails to provide the required information within 21 days of receiving the request, they will receive an infringement notification and could be fined up to $750.

In addition, there is an additional fine of as much as $900 for landlords and property managers that provide false or incorrect Healthy Homes Statement of Compliance or other information. The person who is responsible to pay this fine is the one who is named on the lease agreement as being the person leasing the property out, so it could be the name of the landlord or the company that manages the property.

All the information on the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is signed. It is updated through the tenancy period as necessary work related to it’s finished.

It is also crucial to remember that a landlord with multiple rental properties could face additional fines for non-compliance. The most severe penalties are handed down for the most serious violations, and landlords who own more than six properties could receive fines of up to $50,000, and as much as $100,000 in the case of hearing claims.

Khandallah Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement throughout Khandallah and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records of their the conformance to all Healthy Homes Standard that apply or will be applicable during the tenure of the rental property.

Starting 1 July 2021

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy first began.
