Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on a Khandallah rental property, all Healthy Homes compliance work need to be finished by the end of 90 days.

The harshest penalties are reserved for the most serious breaches, and landlords with more than six properties could be fined as high as $50,000, or as high as $100,000 in hearings.

Tenancies commenced beginning on 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement to all Khandallah and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records of their the conformance to any Healthy Homes Standard that apply or will be applied to their rental properties.

From 1 July 2021

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Adequate heaters are important to ensure healthy homes

Heating Khandallah

Rental properties in Khandallah need to have a stable source of heat that can warm the largest or main living area to at minimum 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs for it to be permanent (i.e. not portable), at least 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed for the main living space. A Heating Assessment Tool could be used to check if the existing permanent heater(s) are sufficient or whether you will need to ‘top up’ by adding a second heater. Unflued combustion and open fire heaters like mobile LPG bottle heaters aren’t considered to be acceptable heating options in the Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump, it must be equipped with the thermostat. This will help make your heating more consistent and efficient. For most homes, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in some cases like small apartment buildings an electric, fixed heater could be enough.

If your main living space already has a fixed heating source, like an air conditioner, it may need an update in order to comply with the standards. Certain types of heaters cannot be utilised to meet the standard because they’re inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Khandallah
