Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed on a Khandallah rental property, all Healthy Homes compliance items must be taken care of inside of 90 days.

As of 1st July 2021, when a brand new or renewed tenancy is signed on a Khandallah rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet each of Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement, there could be additional penalties or an infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the the property manager doesn’t provide the required information within 21 days of receiving the request, they could receive an infringement notification and be fined upto $750.

Additionally, there is also a penalty of up to $900 for landlords and property managers that provide false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is whoever is named on the lease agreement as being the person leasing the property out, so it could be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance requirements to be correct when the tenancy agreement is signed, and ideally it is updated during the entire tenancy, as relevant work gets completed.

It is important to note that landlords who own multiple rental properties may receive additional fines for non-compliance. The most severe penalties are handed down for severe breaches, and landlords with six or more properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

Khandallah Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory throughout Khandallah and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with each Healthy Homes Standards that apply or will be in force throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords have to make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed lease.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts are a major cause of low temperatures inside homes. A damp home is more expensive to heat, which means wasting energy and increased bills.

If a draft can be perceived as a result of gaps or holes or holes, it needs to be closed.

Heating Khandallah

Rental properties in Khandallah must have a fixed source of heat which can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs for it to be permanent (i.e., not portable) with at least 1.5 Kilowatts in heating capacity and have the minimum capacity for heating required for the main living space. A Heating Assessment Tool can be used to determine if the current permanent heater(s) are adequate or if you’ll require to top up with an additional heater. Fires that are open and unflued heaters like portable LPG bottle heaters aren’t considered to be acceptable heating options for those following the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump it needs to be equipped with the thermostat. This makes your heating more consistent and efficient. For most houses, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in some cases like small apartment buildings the smaller fixed electric heater may suffice.

If the living area already has a central heating source like an air conditioner, it might require a top up to meet the standards. Certain kinds of heaters cannot be used to comply with the quality since they’re either expensive, inefficient and/or unhealthy to run.

Ventilation Khandallah

Insulation Khandallah

Ceiling and underfloor insulation is mandatory for all rent houses from 1 July 2019. Property managers and landlords must ensure the insulation meets the new standard. In certain situations, the an existing insulation on the ceiling or in the subfloor space may require to be filled with or replaced.
