Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Khandallah rental property, all Healthy Homes compliance tasks need to be done inside of 90 days.

From the 1st of July in 2021, if a new, renewed or varied lease is entered into on a Khandallah rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy contract, there may be additional penalties or an infringement fee.

If the landlord or property manager is unable to supply the necessary information within 21 days of being informed of the request, they could receive an infringement letter and be fined upto $750.

In addition, there’s an additional fine of as much as $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. The person responsible for this fine is the one who is identified on the tenancy agreement as the person who is who is letting the property, so it could be the name of the landlord as well as the company that manages the property.

Khandallah Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory to all Khandallah and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate conformance with each Healthy Homes Standards that apply or will be applicable during the tenancy of your rental home.

Starting 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply with the Healthy Homes Standards within 90 days of any renewal, new or a change in tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Heating Khandallah

Khandallah rental properties should have a permanent heating source which can warm the principal or the biggest living space to a minimum of 18degC, even on the winter coldest days.
