Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed for a Khandallah rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on the Khandallah rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy agreement, there may be an additional penalty or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager is unable to supply the required information within 21 days from getting the notice, the tenant will receive an infringement letter and be fined up to $750.

In addition, there’s an additional fine of as much as $900 for property owners or property managers that provide false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is whoever is named on the lease agreement as the person who is renting the property which could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be correct when the tenancy agreement is executed, and it should be kept updated through the tenancy period as associated work has been completed.

It’s also important to note that a landlord who manage multiple rental properties could face greater penalties for non-compliance. The most severe penalties are reserved for severe breaches. Landlords with more than six properties could be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory for all Khandallah and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records that prove the compliance with the Healthy Homes Standard that apply or will be applicable throughout the tenancy period of your rental home.

From 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any renewal, new or a change in Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Heating Khandallah

Khandallah rental properties require a reliable source of heating which can warm the living space to a minimum of 18degC even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs to remain fixed (i.e. not portable) and at least 1.5 horsepower in capacity and have the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool can be used to determine whether your current permanent heater(s) are sufficient or if you’ll need to "top-up" with an additional heater. Unflued combustion and open fire heaters such as mobile LPG bottle heaters are not considered to be suitable heating options under those following the Healthy Homes Standard.

If the heating you provide is electric heating (or heat pump), then it must be equipped with the thermostat. This will make the heating more consistent and effective. For the majority of homes, bigger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in certain instances like apartments with small spaces the smaller fixed electric heater could be enough.

If the living area already has a central heating source, such as a heat pump, then it could require a top up to meet the standards. Certain kinds of heaters cannot be utilised to meet the standard as they are either inefficient, unaffordable to operate and/or unhealthy to run.
