Fines for Failing to Comply

It’s crucial to be aware that a landlord with multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are given for severe violations, and landlords who own more than six properties could be fined up to $50,000, and even as high as $100,000 for hearing claims.

Khandallah Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is required throughout Khandallah and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to each Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties conform to the Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Khandallah

Draughts are a major cause of low temperatures inside households. A cold home will cost more to heat, which means wasting energy and increased bills.

What are unreasonable gaps or holes?

If you are able to feel external air getting in, or see the air is clear out of a hole or gap that is, it is likely to be a gap or an opening that needs sealing in somehow. Cracks or gaps with large gaps must be stopped permanently. Cracks that are greater than 3mm and allow air in or out within the home require the sealing. In the case of an open fireplace isn’t used it can create draughts. This should be blocked off. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed in the maximum extent possible.

There is no need to block up intentional gaps or holes in the construction. For instance, small gaps around doors and windows could be required to allow movement of the structure when the house is heated and cools in order to let them be opened and closed rather than being stuck. Proper heating is important for well-being houses

Heating Khandallah

Khandallah rental properties must have a fixed heating source that is able to heat the living space to at least 18degC even on the coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat needs to remain fixed (i.e., not portable) and at minimum 1.5 Kilowatts in heating capacity and have the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool can be used to determine if the fix heater(s) are sufficient or if you’ll need to "top-up" with an additional heater. Open fires and unflued combustion heaters like the portable LPG bottle heaters are not considered acceptable heating options for The Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump it should have the thermostat. This will help make the heating more reliable and efficient. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. In some instances, like small apartments an electric, fixed heater could be enough.

If your living space already has a fixed heating source, like the heat pump, it might just need some additional energy to ensure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the quality as they are either not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Khandallah

Each liveable space in a rental property has to have at least one openable window or exterior door to offer natural airflow. Furthermore, moist spaces like kitchens and bathrooms should be equipped with an externally vented extractor to get rid of moisture.

Insulation Khandallah

Underfloor and ceiling insulation has been compulsory on all rental homes since 1 July 2019. Property managers and landlords must ensure that the insulation meets standards that are in line with the latest standard. In certain situations, the current ceiling insulation, or the insulation of the sub floor space may require to be replaced or replaced.
