Fines for Failing to Comply

All information in the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is signed, and ideally it must be updated through the tenancy period as relevant work gets completed.

It’s crucial to note that landlords with several rental properties can face more severe penalties for not complying. The harshest penalties are reserved for severe violations, and landlords who own more than six properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Tenancies commenced beginning on 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is a requirement in all Khandallah and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with any Healthy Homes Standard that apply or will be applicable during the tenancy of an apartment rental.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy began.

Heating Khandallah

Khandallah rental properties require a reliable source of heat that is able to heat the main or largest living room to at least 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to be fixed (i.e. not portable) and at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum required heating capacity for the main living space.
