Fines for Failing to Comply

The person who is liable to pay this fine is the one who is listed on the tenancy agreement as being the person renting the property, so it could be the name of the landlord or the property management company.

All the information on the Compliance Statement needs to be accurate when the tenancy contract is signed, and ideally it is updated throughout the duration of the tenancy when any associated work has been completed.

It’s crucial to note that landlords who have several rental properties can face even higher fines for non-compliance. The most severe penalties are given only for serious violations. Those who have six or more properties can receive fines of up to $50,000, and as much as $100,000 in hearing claims.

Khandallah Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory to all Khandallah and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.

Heating Khandallah

Khandallah rental properties require a reliable source of heating that is able to heat the principal or the biggest living area to at minimum 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs to be fixed (i.e., not portable) and at minimum 1.5 kW in heating capacity, and must meet the minimum heating capacity needed to heat the living space in general. For the majority of homes, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, such as small apartments an electric, fixed heater may suffice.

If your main living space already has a fixed heating source such as the heat pump, it may need an upgrade in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the standard as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Khandallah
