Fines for Failing to Comply
Since the 1st July of 2021, when a brand new or renewed tenancy is signed for a Khandallah rental property, all Healthy Homes compliance tasks need to be done by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement there could be additional penalties or an infringement fee.
Anyone can request details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to provide the necessary information within 21 days of having received the inquiry, they could receive an infringement notice and be fined up to $750.
In addition, there’s an additional fine of as much as $900 for landlords or property managers who offer a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is liable to pay this fine is the one who is named on the tenancy agreement as being the person leasing the property out, so it could be the landlord’s name or the company that manages the property.
The information contained in the Compliance Statement requirements to be up-to-date when the tenancy agreement is signed. It must be updated through the tenancy period as associated work has been completed.
It is important to keep in mind that landlords who manage several rental properties can face additional fines for non-compliance. The most severe penalties are handed down only for serious breaches. Landlords with at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in the case of hearing claims.
