Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on a Kenepuru rental property, all Healthy Homes compliance items need to be completed inside of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied lease is entered into on the Kenepuru rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet one of the Healthy Homes Standards within the anticipated timeframe could result in a fine of up to $7200. When do I require to be in compliance with The Healthy Homes Standards?

Kenepuru Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required for all Kenepuru and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their compliance with all Healthy Homes Standard that apply or will be applied during the tenure of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed , or altered Tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.
