Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed on a Kenepuru rental property, all Healthy Homes compliance items must be done by the end of 90 days.

Since the 1st July of 2021, if a new or renewed Tenancy is signed for the Kenepuru rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to meet any of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated in a new, renewed or amended tenancy agreement there may be additional penalties or an infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager is unable to supply the information requested within 21 days from receiving the request, they can be issued an infringement notice and be fined upto $750.

In addition, there’s also a fine of as much as $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is named on the tenancy agreement as the one who is leasing the property out It could also be the landlord’s name or the property management company.

All the information on the Compliance Statement needs to be current when the tenancy contract is signed. It should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It is important to keep in mind that a landlord who own multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are reserved for the most serious breaches, and landlords with more than six properties could receive fines of up to $50,000, and as much as $100,000 in the case of hearing claims.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is required in all Kenepuru and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records that prove the compliance with all Healthy Homes Standards that apply or will apply during the tenancy of their rental properties.

From July 1st 2021

  • Private landlords and property managers have to ensure their rental properties conform according to Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts increase the likelihood of less temperature in homes. A draughty home will cost more to heat, resulting in wasted money and energy.

If a draught is felt through gaps that are too large or holes, it needs to be sealed.

What are unreasonable gaps or holes?

If you can feel external air getting in, or see a clear draught from a gap or hole that is, it is likely a crack or hole which requirements sealing in somehow. Cracks and gaps that are large should be sealed permanently. Cracks that are greater than 3mm and allow air in or out from the home require seals. For example, if an open fireplace isn’t in use it could cause draughts, and should be shut from. Property managers and landlords are accountable for making sure such draughts are eliminated in the maximum extent imaginable.

There is no need to block off gaps or holes that are part of the building. For example, tiny gaps around doors and windows may be required to allow movement of the building as the house gets warmer and cooler, to allow them to be closed and opened instead of instead of being stuck. Heating Kenepuru

Kenepuru rental properties should have a permanent heating source that can warm the principal or the biggest living room to at least 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements that it be permanently fixed (i.e. not portable) and at least 1.5 kW of heating capacity, and meet the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool could be used to determine if your current fixed heater(s) are adequate or if you’ll need to top up with a new heater. If the heating that you offer is an electric heater or heat pump, then it must include the thermostat. This makes your heating more consistent and effective. For most houses, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are required. In certain situations, like apartments with small spaces, a smaller fixed electric heater may be sufficient.

If the main living room already has a permanent heating source such as the heat pump, it may need some additional energy to make sure it meets the requirements. Certain types of heaters cannot be used to comply with the quality because they’re inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Kenepuru

Every living space of a rental home must have at least one openable windows or an exterior door to offer natural ventilation. In addition, high moisture areas such as kitchens and bathrooms need to have an venting fan outside to get rid of moisture.

Underfloor and ceiling insulation has been compulsory on all rental houses from 1 July 2019. Property managers and landlords must ensure that the insulation is in line with current standard.
