Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Kenepuru rental property, all Healthy Homes compliance tasks have to be taken care of inside of 90 days.

Since the 1st July of 2021, when a brand new or renewed lease is entered into on a Kenepuru rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with each of Healthy Homes Standards within the period of time expected can lead to an amount of $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy contract, there could be an additional fine or violation fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the building they live in. If the property manager does not supply the information requested within 21 days from having received the inquiry, they may receive an infringement notification and be fined as high as $750.

In addition, there is also a fine of approximately $900 for landlords and property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the person who is named on the lease agreement as the one who is who is letting the property, so it could be the name of the landlord as well as the property management company.

All the information on the Compliance Statement requirements to be current before the tenancy agreement can be completed, and must be updated throughout the tenancy as any associated work has been completed.

It’s crucial to remember that a landlord with multiple rental properties may receive additional fines for non-compliance. The highest penalties are given for severe violations, and landlords who own at least six rental properties could be fined up to $50,000 and as high as $100,000 for hearing claims.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required throughout Kenepuru and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with the Healthy Homes Standards that apply or will be in force to their rental properties.

From 1 July 2021

  • Property managers and private landlords must make sure their rental properties conform according to Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Kenepuru

Rental properties in Kenepuru need to have a stable heating source that can warm the living space to a minimum of 18degC, even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements that it be permanently fixed (i.e. not portable) with at least 1.5 Kilowatts in heating capacity, and must meet the minimum capacity for heating required for the main living space. In some instances, like apartments with small spaces an electric, fixed heater might be enough.

Insulation for underfloor and ceilings is required in all rental homes since 1 July 2019. All landlords and property managers have to ensure that the insulation meets current quality. In some instances, current ceiling insulation, or the insulation of the subfloor space may require to be topped up or replaced.
