Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed for a Kenepuru rental property, all Healthy Homes compliance items have to be finished within 90 days.

From the 1st of July in 2021, when a new, renewed or varied lease is entered into on a Kenepuru rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. The information contained in the Compliance Statement needs to be current when the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any related work is completed.

It’s crucial to keep in mind that a landlord who own multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are reserved for serious breaches, and landlords with six or more properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory throughout Kenepuru and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate compliance with all Healthy Homes Standards that apply or will be applied to your rental home.

From 1 July 2021

  • Private landlords and property managers have to make sure their rental properties comply according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of when the tenancy began.
