Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed for a Kenepuru rental property, all Healthy Homes compliance work must be done inside of 90 days.

Beginning on July 1st, 2021, when a new, renewed or varied lease is entered into on a Kenepuru rental property, all Healthy Homes compliance work must be finished within 90 days.

Inability to adhere to all of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement, there could be additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the home they live in. If the property manager does not provide the required information within 21 days from receiving the request, they may receive an infringement notification and be fined as high as $750.

Furthermore, there’s an additional fine of as much as $900 for landlords and property managers providing a false or misleading Healthy Homes Statement of Compliance or other information. The person who is liable to pay this fine is the one who is named on the lease agreement as being the person who is letting the property, so it could be the name of the landlord as well as the company that manages the property.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is compulsory to all Kenepuru and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records that prove compliance with any Healthy Homes Standard that apply or will be in force during the tenancy of your rental home.

From 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Heating Kenepuru

Kenepuru rental properties should have a permanent heating source that is able to heat the principal or the biggest living space to a minimum of 18degC, even on the winter coldest days. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in certain instances like small apartment buildings, a smaller fixed electric heater might be enough.

If the living area is already equipped with a fixed heating source like the heat pump, it might just need an upgrade in order to comply with the standards. Some types of heaters can’t be used to meet the standard because they’re not efficient, cost prohibitive to operate or unsafe to operate.
