Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Kenepuru rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Kenepuru rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with one of the Healthy Homes Standards within the deadlines can result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy contract, it could result in an additional penalty or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager is unable to supply the required information within 21 days from receiving the request, they will receive an infringement notification and be fined as high as $750.

In addition, there is an additional fine of approximately $900 for property owners or property managers who have provided a false or misleading Healthy Homes Statement of Compliance or information. The person liable for this fine is the person who is named on the tenancy contract as the person who is letting the property It could also be the name of the landlord as well as the company that manages the property.

The information contained in the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is completed, and should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s also important to remember that a landlord who own multiple rental properties may face even higher fines for non-compliance. The harshest penalties are given for severe breaches, and landlords with six or more properties could be fined up to $50,000 and as high as $100,000 in the case of hearing claims.

Kenepuru Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is required in all Kenepuru and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the conformance to any Healthy Homes Standards that apply or will be in force during the tenancy of their rental properties.

From 1 July 2021

  • Private landlords and property managers are required to make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed or varied lease.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.

What are unreasonable gaps and holes?

If you can feel external air entering or a clear draught from a hole or gap or crack, then it is likely a crack or crack that requirements sealing in any way. Adequate heaters are important to ensure healthy houses

Heating Kenepuru

Rental properties in Kenepuru need to have a stable heating source that is able to heat the largest or main living space to a minimum of 18degC, even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

If your living space already has a permanent heating source such as a heat pump, then it may require an upgrade to ensure it meets the requirements. Certain kinds of heaters cannot be used to meet the quality because they’re costly, not cost-effective to run, or unsafe to operate.
