Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed for a Kelburn rental property, all Healthy Homes compliance tasks have to be completed inside of 90 days.

It is also crucial to be aware that a landlord with multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved for the most serious violations, and landlords who own at least six rental properties could be penalised up to $50,000, or as high as $100,000 for hearing claims.

Kelburn Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is required in all Kelburn and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records that prove conformance with each Healthy Homes Standards that apply or will be in force during the tenancy of the rental property.

Starting 1 July 2021

  • Property managers and private landlords must make sure their rental properties comply to the Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Kelburn

Draughts may lead to low temperatures inside homes. A humid home is more expensive to heat, which means wasting money and energy.

Heating Kelburn

Rental properties in Kelburn must have a fixed heating source which can warm the largest or main living area to at minimum 18degC even on the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

Ventilation Kelburn
