Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Kelburn rental property, all Healthy Homes compliance items need to be taken care of inside of 90 days.

As of 1st July 2021, when a new, renewed or varied lease is entered into on the Kelburn rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet all of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy agreement there may be an additional fine or infringement fee.

The person liable to pay this fine is the one who is named on the lease agreement as the person who is leasing the property out which could be the landlord’s name or the property management company.

All the information on the Statement of Compliance needs to be correct when the tenancy contract is signed. It should be kept updated through the tenancy period as associated work has been completed.

It’s also important to be aware that a landlord with several rental properties can face additional fines for non-compliance. The most severe penalties are given for the most serious violations, and landlords who own six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearings.

Kelburn Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory to all Kelburn and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate the compliance with any Healthy Homes Standards that apply or will apply to the rental property.

Beginning 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties conform according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Kelburn

Draughts may lead to low temperatures inside households. A cold house is more expensive to heat, which results in wasting energy and incurring higher costs.

What are unreasonable gaps or holes?

If you are able to feel external air coming in or the air is clear from a gap or hole and you can feel it, it is likely a crack or hole which needs sealing in any way. Cracks or gaps with large gaps must be fixed permanently. Cracks that are greater than 3mm and let air into or out within the home need seals. For example, if an open fireplace isn’t being used, it may cause draughts and must be sealed off. Landlords and property managers are responsible for ensuring such draughts are eliminated as much as possible.

There is no require to block up intentional holes or gaps that are part of the construction. For instance, small gaps around windows and doors may be required to allow for movement within the building as the home gets warmer and cooler, to allow them to be closed and opened rather instead of being stuck. Adequate heaters are important to ensure well-being houses

Heating Kelburn

Rental properties in Kelburn must have a fixed source of heating that can heat the living space to a minimum of 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements to remain fixed (i.e. not portable), at minimum 1.5 horsepower in capacity, and meet the minimum heating capacity needed for the main living room. A Heating Assessment Tool can be used to determine whether your current installed heater(s) are sufficient or if you’ll require to "top up" with an additional heater. Fires that are open and unflued heaters such as mobile LPG bottle heaters aren’t considered to be suitable heating options under The Healthy Homes Standard.

If the heating you offer is electric heating or heat source, it needs to be equipped with the thermostat. This will make your heating more consistent and effective. For the majority of homes, bigger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in some cases such as small apartments the smaller fixed electric heater might be enough.

If your living space already has a permanent heating source like a heat pump, then it might just require an upgrade to ensure it meets the requirements. Certain types of heaters cannot be utilised to meet the standard since they’re either expensive, inefficient and/or unsafe to run.

Ventilation Kelburn

Insulation Kelburn

The insulation of the ceiling and underfloor is mandatory for all rent homes since 1 July 2019. All landlords and property managers should make sure the insulation meets this new standard. In some instances, old ceiling insulation as well as insulation within the subfloor space may need to be filled with or replaced.
