Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Kelburn rental property, all Healthy Homes compliance tasks need to be done within 90 days.

From the 1st of July in 2021, once a new, renewed or varied Tenancy is signed for a Kelburn rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy contract, there could be an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager fails to provide the required information within 21 days of having received the inquiry, they will be issued an infringement notice and be fined as high as $750.

In addition, there’s an additional fine of as much as $900 for landlords and property managers that provide false or incorrect Healthy Homes Statement of Compliance or other information. The person who is liable to pay this fine is the one who is named on the lease agreement as the one who is leasing the property out, so it could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be up-to-date before the tenancy agreement can be signed, and ideally it is updated throughout the duration of the tenancy when any relevant work gets completed.

It’s also important to remember that a landlord who have multiple rental properties may face even higher fines for non-compliance. The highest penalties are handed down for severe violations, and landlords who own six or more properties can be fined as high as $50,000 and as high as $100,000 in hearing claims.

Tenancies signed between 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory to all Kelburn and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with the Healthy Homes Standards that apply or will be applicable during the tenancy of your rental home.

From 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform with the Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Kelburn

Kelburn rental properties require a reliable source of heating that can warm the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs to be fixed (i.e. not portable) that is, at minimum 1.5 horsepower in capacity, and must meet the minimum heating capacity needed to heat the living space in general. Fires that are open and unflued heaters such as portable LPG bottle heaters aren’t considered to be suitable heating options for those following the Healthy Homes Standard.

If the heating that you offer is an electric heater (or heat pump), then it must be equipped with a thermostat. This makes the heating more reliable and efficient. For most homes, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases like small apartments, a smaller fixed electric heater might be enough.

If the living area is already equipped with a fixed heating source, like heat pumps, it could need an update to be able to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the standard as they are either inefficient, unaffordable to operate and/or unsafe to run.
