Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on a Karaka Bays rental property, all Healthy Homes compliance items need to be completed inside of 90 days.

From the 1st of July in 2021, if a new, renewed or varied lease is entered into on a Karaka Bays rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

If the landlord or property manager does not supply the information requested within 21 days of receiving the request, they may be issued an infringement notice and be fined as high as $750.

Additionally, there is also a penalty up to $900 for landlords or property managers who offer a false or misleading Healthy Homes Statement of Compliance or information. The person who is liable for this fine is whoever is identified on the tenancy agreement as the person who is leasing the property out which could be the name of the landlord as well as the company that manages the property.

All information in the Compliance Statement needs to be current before the tenancy agreement can be executed, and it should be kept updated through the tenancy period as associated work has been completed.

It is also important to note that a landlord who have several rental properties can face greater penalties for non-compliance. The most severe penalties are handed down for serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in hearings.

Tenancies signed in the period between July 1st 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement throughout Karaka Bays and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate the compliance with all Healthy Homes Standards that apply or will be applicable throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply to the Healthy Homes Standard within 90 days of any new, renewed or varied tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

For instance, small gaps around windows and doors could be required to allow for movement of the structure as the house is heated and cools so that they are able to be shut and opened, rather than sticking. Heating Karaka Bays

Rental properties in Karaka Bays should have a permanent heating source which can warm the largest or main living room to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental outlook.

In some instances, like small apartment buildings, a smaller fixed electric heater might be enough.

If the main living room already has a fixed heating source like an air conditioner, it may need an update to make sure it meets the requirements. Some types of heaters can’t be utilised to meet the quality because they’re inefficient, unaffordable to operate or unsafe to operate.
