Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed on a Karaka Bays rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

Since the 1st July of 2021, when a new or renewed lease is entered into on the Karaka Bays rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with one of the Healthy Homes Standards within the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy agreement there may be an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not provide the necessary information within 21 days of getting the notice, the tenant could receive an infringement letter and could be fined up to $750.

Furthermore, there’s an additional fine of approximately $900 for property owners or property managers that provide false or false Healthy Homes Compliance Statement or other information. The person responsible for this fine is the person who is identified on the tenancy agreement as the one who is renting the property and it could be the landlord’s name or the property management company.

It is crucial to note that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are handed down only for serious breaches, and landlords with at least six rental properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required throughout Karaka Bays and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records of their compliance with any Healthy Homes Standard that apply or will be in force during the tenancy of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply to the Healthy Homes Standards within 90 days of any renewal, new or a change in lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts can lead to low temperatures inside houses. A damp house will cost more to heat, which completed jobs in wasting energy and incurring higher costs.

There is no need to block off holes or gaps that are part of the construction. For instance, small gaps around windows and doors could be required to allow movement of the structure as the house heats and cools, to allow them to be shut and opened, rather than securing. Heating Karaka Bays

Rental properties in Karaka Bays require a reliable source of heat which can warm the largest or main living space to a minimum of 18degC even on the coldest winter days.
