Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed on a Karaka Bays rental property, all Healthy Homes compliance work must be done by the end of 90 days.

All information in the Statement of Compliance needs to be current when the tenancy agreement is completed, and should be kept updated through the tenancy period as necessary work related to it’s finished.

It is important to keep in mind that landlords who have multiple rental properties may face even higher fines for non-compliance. The most severe penalties are given for the most serious violations. Those who have six or more properties could be fined as high as $50,000, and as much as $100,000 for hearing claims.

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is required throughout Karaka Bays and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records of their conformance with the Healthy Homes Standards that apply or will apply during the tenancy of their rental properties.

From 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy first began.

Heating Karaka Bays

Rental properties in Karaka Bays need to have a stable source of heat that can warm the principal or the biggest living room to at least 18 degrees Celsius, even on the most coldest days of the year.
