Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Karaka Bays rental property, all Healthy Homes compliance work must be completed inside of 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on a Karaka Bays rental property, all Healthy Homes compliance work must be completed within 90 days.

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory in all Karaka Bays and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that demonstrate compliance with the Healthy Homes Standard that apply or will be applied during the tenancy of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

You don’t need to cover up holes or gaps that are part of the construction. For instance, small gaps around windows and doors could be required to allow movement of the building when the house gets warmer and cooler, in order to let them be closed and opened instead of than securing. Heating Karaka Bays

Karaka Bays rental properties need to have a stable source of heating that can warm the main or largest living room to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat needs for it to be permanent (i.e., not portable), at least 1.5 horsepower in capacity, and it must have the minimum required heating capacity for the main living space. If the living area already has a central heating source like the heat pump, it could require some additional energy in order to comply with the standards. Some types of heaters can’t be used to comply with the quality as they are either costly, not cost-effective to run, or are unsafe to operate.

Ventilation Karaka Bays

Each living space within a rental house must include at least one open door or window to offer natural ventilation. Furthermore, moist areas like kitchens and bathrooms must have a suitable externally vented extractor fan to take moisture away.

The ventilation standard is all about recognising how dried air can be less difficult to heat and that a well ventilated rental property is less likely to develop mould and damp.

Living rooms, bedrooms, kitchens, and dining rooms are considered liveable areas. Connecting spaces such as the hallway aren’t considered living spaces and therefore don’t need an opening window or door.
