It is also important to be aware that landlords who have several rental properties can face even higher fines for non-compliance. The harshest penalties are given only for serious breaches, and landlords with at least six rental properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Tenancies commenced from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement to all Karaka Bays and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove compliance with the Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

From July 1st 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any renewal, new or a change in lease.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.
