Since the 1st July of 2021, if a new or renewed Tenancy is signed for the Karaka Bays rental property, all Healthy Homes compliance work must be done inside of 90 days.
Failure to adhere to each of Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy contract, there could be additional penalties or an infringement fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they reside in. If the property manager does not supply the necessary information within 21 days from being informed of the request, they can receive an infringement notification and be fined upto $750.
In addition, there’s also a fine of as much as $900 for landlords and property managers providing a false or incorrect Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the one who is identified on the tenancy contract as the person letting the property out which could be the name of the landlord, or the property management company.
All information in the Compliance Statement needs to be up-to-date when the tenancy contract is signed, and ideally it should be kept updated through the tenancy period as relevant work gets completed.
It is crucial to keep in mind that landlords with multiple rental properties could face greater penalties for non-compliance. The harshest penalties are given for the most serious violations, and landlords who own more than six properties could receive fines of up to $50,000, or as high as $100,000 in hearing claims.
It is clear that failure to meet the Healthy Homes requirements can hit your bank account hard, and result in significant fines and continuing to be required to comply with the requirements.
