Did you know that the Healthy Homes Standards came into effect on the 1st of July 2021? The landlords are now required to make sure that their Karaka Bays rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rental properties are required to be fully in compliance by July 1st 2024.

Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed tenancy is signed for a Karaka Bays rental property, all Healthy Homes compliance items have to be completed within 90 days.

From the 1st of July in 2021, once a new or renewed Tenancy is signed for a Karaka Bays rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet one of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement there may be an additional penalty or infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or the property manager doesn’t supply the necessary information within 21 days from being informed of the request, they may receive an infringement letter and be fined upto $750.

In addition, there’s an additional fine of up to $900 for property owners or property managers that provide false or incorrect Healthy Homes Statement of Compliance or information. The person liable for this fine is the one who is named on the tenancy agreement as the one who is letting the property out which could be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is signed. It is updated through the tenancy period as necessary work related to it’s finished.

It is also crucial to note that landlords who own multiple rental properties may face greater penalties for non-compliance. The harshest penalties are reserved for serious violations. Those who have six or more properties can be penalised up to $50,000, and even as high as $100,000 in hearings.

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is compulsory throughout Karaka Bays and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records of their compliance with each Healthy Homes Standard that apply or will be in force during the tenure of an apartment rental.

From July 1st 2021

  • Private landlords and property managers must ensure their rental properties conform with the Healthy Homes Standard within 90 days of a new, renewed , or altered Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.

Draughts are a major cause of dropping temperatures within houses. A humid home is more expensive to heat, meaning wasting money and energy.

What are the most unreasonable gaps or holes?

If you can feel external air getting in, or see an unobstructed draught coming from a gap or hole, then it’s likely a crack or hole that needs sealing in any way. Cracks or gaps with large gaps must be stopped permanently. The gaps that exceed 3mm that let air in or out within your home require sealing. In the case of an open fireplace isn’t in use it can cause draughts and must be sealed from. Property managers and landlords are responsible for making sure that these draughts are stopped as far as imaginable.

Heating Karaka Bays

Karaka Bays rental properties require a reliable heating source that can heat the principal or the biggest living space to at least 18degC, even during the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat needs to be fixed (i.e. not portable) and at least 1.5 kW of heating capacity, and meet the minimum requirement for heat capacity in the living area. The Heating Assessment Tool can be used to determine whether the existing permanent heater(s) are sufficient or whether you will require to ‘top up’ with a new heater. Open fires and unflued combustion heaters like the portable LPG bottle heaters are not considered to be safe heating options in those following the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, it needs to have a thermostat. This will help make your heating more consistent and efficient. For the majority of homes, bigger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in some cases like small apartments, a smaller fixed electric heater may suffice.

If the living area already has a fixed heating source such as heat pumps, it might just need a top up in order to comply with the standards. Certain kinds of heaters cannot be utilised to meet the quality since they’re either expensive, inefficient or are unsafe to operate.

Insulation Karaka Bays

Ceiling and underfloor insulation is required for all rent homes since 1 July 2019. Property managers and landlords are required to ensure the insulation meets standards that are in line with the latest quality.
