Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Karaka Bays rental property, all Healthy Homes compliance items need to be done by the end of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on the Karaka Bays rental property, all Healthy Homes compliance work must be done by the end of 90 days.

The person responsible for this fine is the person who is identified on the tenancy agreement as the one who is renting the property, so it could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement requirements to be correct at the time that the tenancy agreement is completed, and should be kept updated through the tenancy period as relevant work gets completed.

It’s also important to note that landlords who manage multiple rental properties may face greater penalties for non-compliance. The harshest penalties are given for the most serious breaches. Landlords with more than six properties could be fined up to $50,000 and as high as $100,000 in the case of hearing claims.

Karaka Bays Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory for all Karaka Bays and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with all Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

From July 1st 2021

  • Property managers and private landlords must ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All homes let through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Heating Karaka Bays
