Fines for Failing to Comply
As of 1st July 2021, when a new or renewed contract is signed on a Kaiwharawhara rental property, all Healthy Homes compliance work have to be taken care of within 90 days.

Failure to comply with all of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement there could be additional penalties or an infringement fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager fails to provide the necessary information within 21 days of having received the inquiry, they will receive an infringement notice and be fined as high as $750.
In addition, there is an additional fine of approximately $900 for landlords and property managers who have provided a false or misleading Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the one who is named on the lease agreement as the person who is leasing the property out which could be the name of the landlord as well as the property management company.
The information contained in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is signed, and ideally it should be maintained throughout the duration of the tenancy when any associated work has been completed.
It is also important to remember that a landlord who manage multiple rental properties may face even higher fines for non-compliance. The highest penalties are reserved for serious breaches, and landlords with at least six rental properties could be fined as high as $50,000, and as much as $100,000 for hearing claims.
