Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied contract is signed on a Kaiwharawhara rental property, all Healthy Homes compliance items have to be taken care of by the end of 90 days.

Since the 1st July of 2021, when a new or renewed lease is entered into on the Kaiwharawhara rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to meet all of the Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement, it could result in an additional penalty or infringement fee.

If the property manager fails to supply the information requested within 21 days of receiving the request, they will receive an infringement notice and be fined as high as $750.

The person who is responsible to pay this fine is the one who is named on the lease agreement as the person who is leasing the property out which could be the name of the landlord or the company that manages the property.

It is also important to remember that landlords who own multiple rental properties may receive greater penalties for non-compliance. The highest penalties are given for serious breaches, and landlords with six or more properties can be fined up to $50,000, or as high as $100,000 for hearing claims.

Kaiwharawhara Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory for all Kaiwharawhara and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records of their compliance with each Healthy Homes Standards that apply or will be applied to your rental home.

From 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Draughts may lead to low temperatures inside houses. A humid home will cost more to heat, meaning wasting energy and incurring higher costs.

Heating Kaiwharawhara

Rental properties in Kaiwharawhara should have a permanent source of heating that can heat the main or largest living room to at least 18degC even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to remain fixed (i.e., not portable) that is, at minimum 1.5 horsepower in capacity and have the minimum capacity for heating required to heat the living space in general. Open fires and unflued combustion heaters, such as the portable LPG bottle heaters aren’t considered acceptable heating options in the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump, then it must include a thermostat. This will help make your heating more consistent and effective. For the majority of homes, bigger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are needed. In certain situations, like small apartments small apartments, a smaller electric fixed heater may suffice.

If the main living room already has a permanent heating source such as heat pumps, it might just require an upgrade to meet the standards. Certain types of heaters cannot be used to achieve the standard because they’re costly, not cost-effective to run, and/or unhealthy to run.

Ventilation Kaiwharawhara
