Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed for a Kaiwharawhara rental property, all Healthy Homes compliance work need to be finished within 90 days.

Beginning on July 1st, 2021, when a brand new or renewed Tenancy is signed for the Kaiwharawhara rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet all of the Healthy Homes Standards within the deadlines can result in the possibility of a fine up to $7200. Kaiwharawhara Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory in all Kaiwharawhara and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the conformance to each Healthy Homes Standards that apply or will be applied during the tenancy of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform according to Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.

Unreasonable Gaps & Holes

For most houses, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in some cases such as small apartments an electric, fixed heater may suffice.
