Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on a Kaiwharawhara rental property, all Healthy Homes compliance work have to be finished by the end of 90 days.

From the 1st of July in 2021, when a new or renewed Tenancy is signed for a Kaiwharawhara rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement, it could result in an additional fine or infringement fee.

Kaiwharawhara Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory to all Kaiwharawhara and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate the compliance with the Healthy Homes Standards that apply or will be in force during the tenancy of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any new, renewed , or altered tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.

Heating Kaiwharawhara

Kaiwharawhara rental properties require a reliable source of heat that is able to heat the largest or main living space to a minimum of 18degC, even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements for it to be permanent (i.e., not portable), at minimum 1.5 kW in heating capacity and have the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool may be used to determine whether the current fixed heater(s) are sufficient or if you’ll require to "top up" with an additional heater. Fires that are open and unflued heaters such as small portable LPG bottle heaters aren’t considered to be suitable heating options under the Healthy Homes Standard.

If the heating that you offer is an electric heater or heat source, it must have the thermostat. This will help make the heating more reliable and efficient. For most properties, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in certain instances like small apartments an electric, fixed heater may be sufficient.

If the main living room is already equipped with a fixed heating source like the heat pump, it might just require some additional energy in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Kaiwharawhara
