Fines for Failing to Comply

Those who have more than six properties could receive fines of up to $50,000, and as much as $100,000 in hearings.

Tenancies signed between 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory throughout Kaiwharawhara and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with any Healthy Homes Standards that apply or will be applied during the tenure of the rental property.

From 1 July 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Kaiwharawhara rental properties must have a fixed source of heating that can warm the main or largest living area to at minimum 18degC, even on the winter coldest days.
