Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed for a Kaiwharawhara rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.

When Do I need to be in compliance with the Healthy Homes Standards?

Kaiwharawhara Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory for all Kaiwharawhara and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords must keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be in force during the tenancy of the rental property.

From 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed or varied lease.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.
