Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed on a Kaiwharawhara rental property, all Healthy Homes compliance items must be done by the end of 90 days.

From the 1st of July in 2021, when a new, renewed or varied lease is entered into on a Kaiwharawhara rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy agreement it could result in an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or property manager does not provide the necessary information within 21 days of having received the inquiry, they could receive an infringement notice and be fined up to $750.

Additionally, there is also a penalty of up to $900 for landlords or property managers that provide false or false Healthy Homes Compliance Statement or other information. The person who is liable to pay this fine is the one who is identified on the tenancy agreement as the person who is renting the property which could be the landlord’s name or the property management company.

All the information on the Statement of Compliance requirements to be current before the tenancy agreement can be executed, and it should be maintained through the tenancy period as necessary work related to it is finished.

It’s crucial to note that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The highest penalties are given for the most serious breaches, and landlords with six or more properties could be fined up to $50,000 and as high as $100,000 in the case of hearing claims.

What time Do I need to meet the Healthy Homes Standards?

Kaiwharawhara Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory in all Kaiwharawhara and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate the conformance to all Healthy Homes Standards that apply or will be in force during the tenure of an apartment rental.

From July 1st 2021

  • Private landlords and property managers are required to make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a new, renewed , or altered Tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts are a major cause of dropping temperatures within households. A cold home is more expensive to heat, which means wasting energy and resulting in higher bills.

If a draught can be felt from unreasonable gaps or holes, it requirements to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating out of a hole or gap and you are able to feel it, it’s likely to be a gap or an opening that requirements sealing in some way. Cracks and gaps that are large should be sealed permanently. Cracks that are greater than 3mm and let air into or out into the home need to be sealed. For example, if the open fireplace isn’t being used, it can create draughts. This must be sealed from. Landlords and property managers are accountable for ensuring that draughts from the fireplace are removed whenever possible.

There is no need to block gaps or holes in the construction. For instance, small gaps around windows and doors may be required to allow for movement of the building as the household heats and cools, so that they can still be opened and closed rather than being stuck. Adequate heaters are crucial for healthy homes

Heating Kaiwharawhara

Rental properties in Kaiwharawhara require a reliable source of heating that can heat the living space to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs to remain fixed (i.e. not portable) with at least 1.5 horsepower in capacity and have the minimum capacity for heating required in the living area. A Heating Assessment Tool can be used to determine whether the fixed heater(s) are sufficient or if you’ll need to ‘top up’ by adding a second heater. Insulation Kaiwharawhara

Ceiling and underfloor insulation is a requirement on all rental homes as of July 1st, 2019. Property managers and landlords must ensure that the insulation meets the new quality. In some cases, old ceiling insulation as well as insulation within the sub floor space may require to be topped up or replaced.
