Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed on a Johnsonville rental property, all Healthy Homes compliance tasks need to be completed inside of 90 days.

Since the 1st July of 2021, when a brand new or renewed lease is entered into on a Johnsonville rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to meet all of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or revised tenancy agreement there could be an additional fine or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the building they live in. If the property manager fails to provide the required information within 21 days of receiving the request, they will receive an infringement letter and could be fined up to $750.

Furthermore, there’s an additional fine of approximately $900 for property owners or property managers providing a false or false Healthy Homes Compliance Statement or information. The person responsible for this fine is the one who is identified on the tenancy agreement as the person who is letting the property out, so it could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be current before the tenancy agreement can be executed, and it should be maintained through the tenancy period as relevant work gets completed.

It is important to remember that landlords who own multiple rental properties may receive even higher fines for non-compliance. The highest penalties are handed down for serious breaches, and landlords with at least six rental properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

If you fail to adhere to the Healthy Homes requirements can hit your bank account hard, with significant fines and having to continue to comply. Don’t take a chance with your rental property, contact us today and ask us to conduct a home inspection performed on your rental property.

Unreasonable Gaps & Holes

Draught Stopping Johnsonville

Draughts may lead to less temperature in households. A damp home is more expensive to heat, which means wasting money and energy.

If a draught can be noticed from gaps that are not adequate or holes the area requirements to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or a clear draught from a hole or gap, then it is probably a gap or an opening that requirements sealing in somehow. Cracks and gaps that are large should be fixed permanently. Any gaps greater than 3mm that allow air in or out within the house require seals. For example, if an open fireplace is not in use, it may cause draughts and must be sealed from. Property managers and landlords are accountable for ensuring that draughts from the fireplace are removed in the maximum extent possible.

There is no require to block off holes or gaps in the construction. For instance, small gaps around doors and windows might be necessary to allow for movement of the building as the house warms and cools to allow them to be closed and opened instead of than sticking. We will examine all windows and doors in your Healthy Homes assessment of your rental property.

Adequate heaters are important to ensure healthy houses

Heating Johnsonville

Johnsonville rental properties need to have a stable source of heating which can warm the main or largest living area to at minimum 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating needs that it be permanently fixed (i.e., not portable) that is, at least 1.5 horsepower in capacity, and must meet the minimum required heating capacity for the main living space. A Heating Assessment Tool can be used to determine if the current fix heater(s) are sufficient or if you’ll need to top up with a new heater. Open fires as well as unflued combustion heaters, such as the portable LPG bottle heaters aren’t considered to be acceptable heating options for Healthy Homes Standard. Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump, it must be equipped with an thermostat. This will make the heating more reliable and effective. In most houses, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in certain instances like apartments with small spaces the smaller fixed electric heater could be enough.

If your main living space is already equipped with a fixed heating source, like an air conditioner, it might just require some additional energy to meet the standards. Certain types of heaters cannot be used to achieve the standard because they’re costly, not affordable to run, and/or unsafe to run.

Ventilation Johnsonville

Each liveable space in the rental property should have at least one opening door or window to offer natural airflow. In addition, humid spaces like kitchens and bathrooms need to have an externally vented extractor to remove moisture.

The ventilation quality is all about recognising how dry air will be less difficult to heat and that the property that is properly ventilated is less likely to develop mould and damp.

Bedrooms, living rooms dining rooms, and kitchens are all considered living spaces. Connecting spaces like the hallways are not liveable , and thus are not need an opening door or window.

Each window, door or the skylight requirements at least to open to the outside, but remain set in an opening position in order to allow ventilation and fresh air ventilation.

All kitchens and bathrooms, and every other room of your property with shower, bath or cooktop, or any other moisture generating item will require suitable extractor fans which are vented to the outdoors. The Healthy Homes Assessment service will check that there is adequate ventilation in every living space and will also check for the proper extractor fans for areas that are high in moisture.

Insulation Johnsonville

Underfloor and ceiling insulation is a requirement to all rental homes since July 1, 2019. All landlords and property managers must make sure that the insulation is in line with the new standard. In some cases, current ceiling insulation, or the insulation of the sub floor space might require to be filled with or replaced.

A properly insulated home will help to control condensation and lower the chance of mould and dampness, and will also make much easier for the household to hold warmth.

Insulation needs to be in compliance with the R-values for your area

The "R" is a symbol for thermal resistance and it is a measurement of how well the insulation can withstand heat flow. The greater the R-value, the higher the quality of insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – The rest area of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 and underfloor R 1.3

Johnsonville Moisture Ingress & Drainage

Protecting your rental property from water damage isn’t only about the interior of the building it’s also about the outside. You must make sure there is somewhere for rain, surface and ground water to go, and stop it from coming inside. When it is damp and moisture, it’s often those concerns that you aren’t aware of that could be a huge problem that can cause the property to suffer and affecting the tenant’s well-being.

Rental properties require to have effective drainage to remove storm water, surface water, and groundwater, with an appropriate outfall or runoff. Making sure that water is able to go, and it doesn’t get sucked into buildings is an essential part of keeping your property dry.

In addition to the drainage system that will prevent moisture ingress, if your apartment has an enclosed gap between your flooring and ground, a ground moisture barrier must be constructed if it’s reasonably practicable to install it.

Ground moisture barriers are generally a polythene sheet laid over the ground to stop any moisture that is present in the ground from entering the home. It also helps in preventing water damage to the floor insulation.
