Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Johnsonville rental property, all Healthy Homes compliance items must be finished inside of 90 days.

From the 1st of July in 2021, when a new or renewed contract is signed on the Johnsonville rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with any of the Healthy Homes Standards inside of the deadlines can result in penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy agreement there may be an additional penalty or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to provide the necessary information within 21 days of having received the inquiry, they may receive an infringement notification and be fined up to $750.

In addition, there is also a fine of as much as $900 for property owners or property managers providing a false or false Healthy Homes Compliance Statement or information. The person responsible to pay this fine is the one who is listed on the tenancy agreement as the person who is renting the property It could also be the name of the landlord as well as the company that manages the property.

All the information on the Statement of Compliance needs to be correct at the time that the tenancy agreement is signed, and ideally it is updated through the tenancy period as associated work has been completed.

It is important to note that a landlord who own multiple rental properties may face greater penalties for non-compliance. The most severe penalties are given for severe breaches, and landlords with six or more properties can be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

In the end, a failure to meet requirements of Healthy Homes requirements can hit your pocket hard, and result in huge fines, in addition to having to continue to comply. Do not risk your rental property, contact us today and arrange to have a house assessment done on your rental property.

Healthy homes are important

What are the reasons why Healthy Homes Compliance So Important?

One in three households rent in New Zealand and Johnsonville, and research has shown that these rental houses are likely to be older, colder, are not as effective heating, and generally are of lower quality than owner occupied properties.

Damp, mouldy and cold houses can have negative health results, specifically for diseases like colds and influenza, asthma, and cardiovascular diseases. Additionally, those who have reported at least four key issues with their housing often have poor life satisfaction and lower well-being.

Improve the standard of Johnsonville rental property can help tenants enjoy better physical and mental health, and lessen the disruptions to their work, education and living due to health issues. Your investment is also better protected from mildew, mould and damp damage, meaning less maintenance costs in the long run.

Unreasonable Gaps & Holes

Draught Stopping Johnsonville

Draughts increase the likelihood of dropping temperatures within households. A humid house costs more to heat, which means wasting energy and resulting in higher bills.

If a draught could be perceived as a result of gaps or holes that it requirements to be sealed.

What are unjustifiable gaps or holes?

If you are able to feel external air getting in, or see a clear draught from a gap or hole and you are able to feel it, it’s most likely a gap or hole which needs sealing in some way. Cracks or gaps with large gaps must be fixed permanently. The gaps that exceed 3mm that allow air to enter or exit into your home need the sealing. For instance, if an open fireplace isn’t used it could cause draughts, and must be sealed from. Property managers and landlords are accountable for making sure that these draughts are stopped in the maximum extent imaginable.

There is no need to block holes or gaps that are part of the building. For instance, small gaps around doors and windows could be required to allow for movement within the structure when the household is heated and cools to allow them to be opened and closed rather than being stuck. We will examine every window and door in your Healthy Homes assessment of your rental property.

A good heating system is important for healthy houses

Heating Johnsonville

Johnsonville rental properties need to have a stable source of heat which can warm the principal or the biggest living space to a minimum of 18degC even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating requirements for it to be permanent (i.e. not portable) and at minimum 1.5 kW of heating capacity, and meet the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool can be used to determine whether the permanent heater(s) are sufficient or if you’ll need to ‘top up’ with an additional heater. Open fires and unflued combustion heaters such as small portable LPG bottle heaters are not considered to be safe heating options in those following the Healthy Homes Standard.

If the heating system you offer is electric heating (or heat pump), it needs to have the thermostat. This will make the heating more consistent and efficient. For most houses, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases such as small apartments the smaller fixed electric heater may suffice.

If your main living space already has a permanent heating source, like heat pumps, it may need an update to make sure it meets the requirements. Certain kinds of heaters aren’t able to be used to achieve the quality since they’re either costly, not affordable to run, or are unsafe to operate.

Ventilation Johnsonville

Each living space within a rental property has to contain at minimum one open doors or windows to provide natural ventilation. In addition, humid areas such as kitchens or bathrooms should have an externally vented extractor fan to take moisture away.

A ventilation quality is all about acknowledging it is that the dry atmosphere is more easy to heat and that the property that is properly ventilated is less likely to be a victim of damp and mould.

Living rooms, bedrooms, kitchens and dining rooms are considered liveable spaces. Connecting spaces like the hallways are not liveable and therefore don’t need an opening door or window.

Each window, door , or skylight needs to be able to open to the outside, and stay at an open angle to allow to circulate fresh air as well as ventilation.

The bathrooms in all kitchens and any other area in your home that has shower, bath and cooktop or another moisture-producing item will require suitable extractor fans that can be vented to the outside. This Healthy Homes Assessment service will verify that there is enough ventilation in every living space, including suitable extractor fans in areas with high moisture.

Insulation Johnsonville

Underfloor and ceiling insulation is a requirement in all rental homes since July 1, 2019. Property managers and landlords should ensure that the insulation is up to current standard. In some instances, current ceiling insulation, or the insulation of the subfloor space may require to be filled with or replaced.

A properly insulated home will help to control condensation and lessen the likelihood of mould and dampness as well as making more easy to the house to hold warmth.

Insulation requirements to meet the R-values of your area.

The "R" stands for thermal resistance, and is a gauge of how well the insulation can withstand heat flow. The greater the R-value, the more effective the insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 in the underfloor, 1.3
  • Zone 2 – all area of North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3, underfloor R 1.3

Johnsonville Moisture Ingress & Drainage

Keeping your rental property safe from moisture isn’t just about the inside of the building It’s about having to make sure there is somewhere to allow surface, rain or ground water, and also stop it from getting into the building. When it is damp and moisture, it’s frequently the concerns you don’t notice that can cause a lot of trouble, causing damage to your investment and harming the tenant’s well-being.

Rental properties need to have efficient drainage for the removal of rainwater, storm water, and ground water. This includes the proper outfall or runoff. Making sure that the water has a place to go and that it can’t linger underneath the buildings is a vital aspect of keeping your property dry.

Alongside a drainage system to avoid water ingress, if the apartment has an enclosed gap between your flooring and surface, a ground moisture barrier must be put in place when it’s reasonably practicable to install it.

Ground moisture barriers are usually a polythene sheet laid over the ground, to block any moisture from the ground from entering the home. It also helps to prevent moisture damage to the underfloor insulation.
