Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Houghton Bay rental property, all Healthy Homes compliance items must be taken care of inside of 90 days.

Beginning on July 1st, 2021, if a new or renewed contract is signed on the Houghton Bay rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to meet all of the Healthy Homes Standards inside of the expected timeframe can result in an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy contract, there could be an additional penalty or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager fails to provide the necessary information within 21 days from being informed of the request, they will receive an infringement notice and be fined up to $750.

In addition, there is also a penalty of up to $900 for landlords and property managers that provide false or false Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the one who is identified on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement needs to be correct when the tenancy agreement is signed, and ideally it should be maintained during the entire tenancy, as necessary work related to it is finished.

It is also important to note that a landlord who manage several rental properties can face more severe penalties for not complying. The harshest penalties are handed down for serious breaches, and landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

Unreasonable Gaps & Holes

Draughts increase the likelihood of low temperatures inside homes. A damp home will cost more to heat, meaning wasting energy and resulting in higher bills.

If a draft can be felt through gaps that are too large or holes or holes, it requirements to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air entering or the air is clear out of a hole or gap and you are able to feel it, it is most likely a gap or an opening that requirements sealing in the way you can. Cracks and gaps that are large should be fixed permanently. The gaps that exceed 3mm that let air in or out of the house require seals. For instance, if an open fireplace isn’t being used, it can create draughts. This should be blocked from. Property managers and landlords are accountable for ensuring that these draughts are stopped as much as imaginable.

There is no need to cover up gaps or holes that are part of the building. For example, tiny gaps around windows and doors may be required to allow for movement of the structure as the home is heated and cools so that they can still be shut and opened, rather than being stuck. We will examine all doors and windows during our Healthy Homes assessment of your rental property.

Heating Houghton Bay

Houghton Bay rental properties should have a permanent source of heating that is able to heat the principal or the biggest living space to a minimum of 18degC, even during the most coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating requirements to be fixed (i.e., not portable) and at least 1.5 horsepower in capacity and have the minimum requirement for heat capacity for the main living space. The Heating Assessment Tool can be used to determine if the existing fix heater(s) are adequate or if you’ll need to ‘top up’ with a new heater. Fires that are open and unflued heaters like the portable LPG bottle heaters aren’t considered to be suitable heating options under the Healthy Homes Standard.

If the heating that you provide is an electric heater (or heat pump), it requirements to include a thermostat. This will make your heating more consistent and effective. In most houses, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in some cases like small apartment buildings, a smaller fixed electric heater might be enough.

If your living space already has a central heating source, like a heat pump, then it may need a top up to meet the standards. Certain types of heaters cannot be used to comply with the quality as they are either expensive, inefficient or unsafe to operate.

Houghton Bay Moisture Ingress & Drainage

The security of your rental home from moisture isn’t just about the interior of the building but you must make sure there is somewhere for surface and underground water to flow and prevent it from getting inside. When it is damp and moisture, it is often the things you don’t notice that can become a big problem and cause damage to your investment as well as harming your tenant’s well-being.

Rental properties need to have effective drainage to eliminate rainwater, storm water and ground water, including an appropriate runoff or outfall. Making sure the water has a location to go and that it isn’t allowed to remain beneath structures is a crucial aspect of making sure your property is dry.

Alongside the drainage system that will prevent the ingress of moisture, if your rental has an enclosed gap between your floor and the surface, a ground moisture barrier must be installed if it is reasonably practicable to install it.

An underground moisture barrier typically a polythene sheet laid over the ground to stop any moisture present in the ground from accumulating into the building. It also helps in preventing from causing damage to the flooring insulation.
