Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Houghton Bay rental property, all Healthy Homes compliance tasks have to be completed inside of 90 days.

Furthermore, there’s an additional fine of as much as $900 for landlords and property managers who offer a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is named on the tenancy agreement as being the person who is letting the property and it could be the name of the landlord as well as the property management company.

Houghton Bay Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory for all Houghton Bay and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords must keep records of their the compliance with each Healthy Homes Standards that apply or will be applied during the tenure of the rental property.

Starting 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in Tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All households which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Houghton Bay

Rental properties in Houghton Bay need to have a stable source of heating which can warm the principal or the biggest living room to at least 18degC even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements to be fixed (i.e., not portable), at least 1.5 horsepower in capacity, and it must have the minimum required heating capacity for the main living room. For the majority of houses, bigger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, like small apartment buildings the smaller fixed electric heater could be enough.

If your living space already has a central heating source, such as the heat pump, it might need an upgrade to ensure it meets the requirements. Certain types of heaters cannot be used to meet the standard since they’re either costly, not cost-effective to run, and/or unsafe to run.
