Fines for Failing to Comply
Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Houghton Bay rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.
From the 1st of July in 2021, once a new, renewed or varied contract is signed on the Houghton Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Failure to adhere to each of Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not included within a new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.
Every tenant is entitled to request details regarding the Healthy Homes Standard and how they are related to the house they are living in. If the property manager fails to provide the information requested within 21 days from having received the inquiry, they will be issued an infringement notice and be fined up to $750.
In addition, there is also a penalty of approximately $900 for landlords or property managers providing a false or false Healthy Homes Statement of Compliance or other information. The person who is responsible to pay this fine is the one who is named on the tenancy contract as the person letting the property out, so it could be the name of the landlord or the company that manages the property.
All information in the Statement of Compliance requirements to be current before the tenancy agreement can be signed, and ideally it must be updated throughout the duration of the tenancy when any associated work has been completed.
It is also crucial to remember that landlords who manage multiple rental properties may receive additional fines for non-compliance. The most severe penalties are reserved only for serious violations, and landlords who own at least six rental properties could be fined up to $50,000, and as much as $100,000 for hearing claims.
