Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Houghton Bay rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

As of 1st July 2021, when a brand new or renewed Tenancy is signed for a Houghton Bay rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

The person liable for this fine is whoever is identified on the tenancy agreement as the one who is renting the property which could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be up-to-date when the tenancy contract is signed, and ideally it should be maintained throughout the tenancy as any relevant work gets completed.

It’s also crucial to keep in mind that a landlord with multiple rental properties may face more severe penalties for not complying. The highest penalties are given for the most serious breaches. Landlords with at least six rental properties could receive fines of up to $50,000, and as much as $100,000 in hearings.

Houghton Bay Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is mandatory throughout Houghton Bay and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with any Healthy Homes Standards that apply or will be applicable to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform according to Healthy Homes Standards within 90 days of a new, renewed , or altered Tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
