Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Highbury rental property, all Healthy Homes compliance work have to be finished inside of 90 days.

The person who is responsible for this fine is whoever is named on the lease agreement as being the person who is letting the property which could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be current before the tenancy agreement can be completed, and should be kept updated during the entire tenancy, as necessary work related to it’s finished.

It is also important to keep in mind that landlords who own multiple rental properties may face greater penalties for non-compliance. The highest penalties are reserved only for serious breaches, and landlords with at least six rental properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is required to all Highbury and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
