Fines for Failing to Comply

As of 1st July 2021, if a new or renewed tenancy is signed for a Highbury rental property, all Healthy Homes compliance work need to be done inside of 90 days.

Failure to adhere to all of the Healthy Homes Standards within the deadlines can result in an amount of $7200. In addition, if the present Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy agreement it could result in additional penalties or an infringement fee.

The person responsible for this fine is the one who is named on the lease agreement as being the person renting the property, so it could be the name of the landlord or the property management company.

All information in the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be completed, and must be updated through the tenancy period as related work is completed.

It’s also important to note that landlords who manage multiple rental properties may receive more severe penalties for not complying. The highest penalties are handed down for serious violations. Those who have six or more properties can be penalised up to $50,000, or as high as $100,000 for hearing claims.

When will I need to meet The Healthy Homes Standards?

Highbury Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory for all Highbury and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the compliance with the Healthy Homes Standards that apply or will be applicable to your rental home.

Starting 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed or varied tenant.

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.

If your living space already has a fixed heating source, such as a heat pump, then it might just require some additional energy to meet the standards. Some types of heaters can’t be utilised to meet the quality because they’re costly, not cost-effective to run, or are unsafe to operate.
