Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Highbury rental property, all Healthy Homes compliance tasks must be taken care of by the end of 90 days.

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Highbury rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet one of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy agreement there could be additional penalties or an infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the property manager fails to provide the necessary information within 21 days from being informed of the request, they could be issued an infringement notice and be fined upto $750.

In addition, there’s also a fine of up to $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or information. The person responsible for this fine is whoever is named on the tenancy agreement as being the person letting the property out which could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any associated work has been completed.

It’s important to remember that landlords who manage multiple rental properties may face even higher fines for non-compliance. The most severe penalties are handed down for severe violations, and landlords who own at least six rental properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement throughout Highbury and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with any Healthy Homes Standard that apply or will be applicable to the rental property.

From 1 July 2021

  • Property managers and private landlords must ensure their rental properties conform according to Healthy Homes Standard within 90 days of a renewal, new or a change in tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts may lead to less temperature in houses. A humid home costs more to heat, which means wasting money and energy.

If a draught can be noticed from gaps that are not adequate or holes, it needs to be closed.

What are unreasonable gaps or holes?

If you can feel external air flowing in or a clear draught out of a hole or gap or crack, then it’s probably a gap or crack that needs sealing in any way. Large cracks and gaps should be stopped permanently. Any gaps greater than 3mm that let air in or out into the house require to be sealed. For example, if the open fireplace isn’t used it can cause draughts and should be sealed off. Landlords and property managers are responsible for making sure that draughts from the fireplace are removed as much as imaginable.

There is no need to block up intentional gaps or holes which are part of the construction. For example, tiny gaps around doors and windows might be necessary to allow for movement within the building when the house is heated and cools to allow them to be shut and opened, rather instead of being stuck. A good heating system is important to ensure healthy homes

Heating Highbury

Rental properties in Highbury should have a permanent source of heating that can warm the largest or main living space to a minimum of 18degC, even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements to remain fixed (i.e. not portable) that is, at minimum 1.5 kW of heating capacity and have the minimum required heating capacity in the living area. If the heating you provide is an electric heater or heat pump it must have the thermostat. This will make your heating more consistent and effective. For most homes, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in some cases like small apartments an electric, fixed heater may suffice.

If the living area already has a fixed heating source such as an air conditioner, it might just need an upgrade to make sure it meets the requirements. Some types of heaters can’t be used to comply with the quality as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Highbury

Each living space within a rental property must have at least one openable door or window to provide natural airflow. In addition, high moisture spaces like kitchens and bathrooms should have an externally vented extractor fan to take moisture away.

This ventilation quality is all about recognising it is that dry air is much easier to heat and a well ventilated rental property is less likely to be a victim of damp and mould.

Bedrooms, living spaces, kitchens, and dining areas are all considered living spaces. Connecting spaces like the hallway aren’t liveable and don’t need an opening window or door.

Each window, door , or the skylight needs at least of opening to the outside while remaining closed, allowing ventilation and fresh air ventilation.

All bathrooms and kitchens and any other room in your home with shower, bath cooker or any other moisture generating item will need appropriate extractor fans that are vented out to the outside. The insulation of the ceiling and underfloor has been compulsory in all rental houses as of July 1st, 2019. Property managers and landlords are required to make sure that the insulation is in line with the new standard. In some cases, an existing insulation on the ceiling or in the subfloor space may need to be replaced or replaced.
