Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed contract is signed on a Highbury rental property, all Healthy Homes compliance work must be done inside of 90 days.

As of 1st July 2021, if a new, renewed or varied contract is signed on a Highbury rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to adhere to any of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the property manager does not provide the necessary information within 21 days of receiving the request, they may receive an infringement notification and be fined as high as $750.

Furthermore, there’s also a penalty up to $900 for landlords and property managers who have provided a false or false Healthy Homes Compliance Statement or information. The person liable for this fine is the one who is listed on the tenancy agreement as being the person renting the property, so it could be the name of the landlord as well as the property management company.

All the information on the Compliance Statement needs to be up-to-date when the tenancy contract is signed. It should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s important to keep in mind that a landlord who manage multiple rental properties may face even higher fines for non-compliance. The most severe penalties are reserved for the most serious violations. Those who have six or more properties can receive fines of up to $50,000 and as high as $100,000 in the case of hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement to all Highbury and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate the compliance with any Healthy Homes Standards that apply or will be applicable throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder household tenancies) must adhere to the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
