Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Highbury rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied Tenancy is signed for a Highbury rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet one of the Healthy Homes Standards within the anticipated timeframe could result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement there may be additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they are living in. If the landlord or property manager does not supply the information requested within 21 days of getting the notice, the tenant can receive an infringement notice and be fined upto $750.

Additionally, there is also a penalty of approximately $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person liable for this fine is the one who is named on the lease agreement as being the person who is letting the property It could also be the name of the landlord, or the property management company.

All information in the Statement of Compliance requirements to be correct before the tenancy agreement can be signed. It must be updated during the entire tenancy, as related work is completed.

It’s crucial to be aware that landlords with multiple rental properties could face more severe penalties for not complying. The most severe penalties are handed down for serious violations. Those who have more than six properties could receive fines of up to $50,000 and as high as $100,000 in hearings.

Highbury Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required for all Highbury and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the compliance with the Healthy Homes Standards that apply or will be in force during the tenure of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply to the Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

You don’t require to block off gaps or holes which are part of the building. For instance, small gaps around doors and windows may be required to allow for movement of the structure when the house gets warmer and cooler, to allow them to be closed and opened instead of instead of being stuck. Heating Highbury

Rental properties in Highbury need to have a stable source of heating that can warm the principal or the biggest living space to at least 18degC, even during the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements to remain fixed (i.e., not portable) and at least 1.5 kW in heating capacity and have the minimum required heating capacity in the living area.
