Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed for a Highbury rental property, all Healthy Homes compliance tasks need to be taken care of by the end of 90 days.

As of 1st July 2021, once a new, renewed or varied lease is entered into on the Highbury rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they reside in. If the property manager is unable to supply the necessary information within 21 days from being informed of the request, they could receive an infringement letter and be fined as high as $750.

Furthermore, there’s also a fine of as much as $900 for landlords and property managers who offer a false or incorrect Healthy Homes Compliance Statement or any other information. The person responsible for this fine is the person who is named on the lease agreement as being the person leasing the property out, so it could be the name of the landlord, or the company that manages the property.

The information contained in the Compliance Statement needs to be accurate at the time that the tenancy agreement is executed, and it is updated through the tenancy period as related work is completed.

It’s crucial to be aware that a landlord with multiple rental properties may face additional fines for non-compliance. The highest penalties are handed down for serious violations, and landlords who own six or more properties can be penalised up to $50,000, or as high as $100,000 in hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement to all Highbury and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with each Healthy Homes Standard that apply or will be applied to the rental property.

From July 1st 2021

  • Private landlords and property managers must make sure their rental properties comply to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.

For example, if an open fireplace isn’t being used, it could cause draughts, and should be blocked off. You don’t need to block holes or gaps in the building. For instance, small gaps around windows and doors could be necessary to allow for movement within the structure as the house gets warmer and cooler, so that they are able to be closed and opened instead of than sticking. Heating Highbury

Highbury rental properties need to have a stable source of heat that can warm the largest or main living space to at least 18degC even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs that it be permanently fixed (i.e. not portable), at least 1.5 horsepower in capacity, and it must have the minimum heating capacity needed in the living area. If the heating system you provide is electric heating or heat pump, then it must be equipped with the thermostat. This will make the heating more uniform and efficient. For most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in some cases like apartments with small spaces, a smaller fixed electric heater could be enough.

If the living area already has a fixed heating source like a heat pump, then it may require an upgrade to be able to meet the standards. Some types of heaters can’t be used to comply with the quality as they are either not efficient, cost prohibitive to operate or are unsafe to operate.
