Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed contract is signed on a Highbury rental property, all Healthy Homes compliance tasks need to be done within 90 days.

As of 1st July 2021, when a new, renewed or varied Tenancy is signed for the Highbury rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement, there could be additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the home they are living in. If the property manager is unable to provide the necessary information within 21 days of getting the notice, the tenant will receive an infringement letter and could be fined up to $750.

In addition, there’s also a penalty as much as $900 for landlords and property managers that provide false or false Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the one who is named on the lease contract as the person who is letting the property which could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be correct before the tenancy agreement can be signed, and ideally it should be maintained during the entire tenancy, as relevant work gets completed.

It is important to note that landlords who own multiple rental properties could face even higher fines for non-compliance. The harshest penalties are handed down for severe violations. Those who have six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement throughout Highbury and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the conformance to all Healthy Homes Standard that apply or will be applied during the tenure of your rental home.

From 1 July 2021

  • Property managers and private landlords must make sure their rental properties conform according to Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the date when the tenancy started.
