Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied contract is signed on a Highbury rental property, all Healthy Homes compliance work have to be done inside of 90 days.

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Highbury rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to comply with all of the Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. If the landlord or property manager is unable to provide the information requested within 21 days of receiving the request, they can receive an infringement letter and could be fined up to $750.

In addition, there’s an additional fine of approximately $900 for property owners or property managers who provide a false or false Healthy Homes Statement of Compliance or information. The person who is liable for this fine is whoever is named on the tenancy agreement as being the person letting the property out and it could be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance needs to be up-to-date when the tenancy contract is completed, and should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It is also crucial to keep in mind that a landlord who own multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are reserved for severe breaches. Landlords with more than six properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required for all Highbury and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to the Healthy Homes Standard that apply or will be applied during the tenancy of an apartment rental.

From July 1st 2021

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
