Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed on a Highbury rental property, all Healthy Homes compliance tasks must be completed within 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on the Highbury rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to adhere to all of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within a new, renewed or amended tenancy agreement there may be an additional fine or violation fee.

If the landlord or property manager does not supply the information requested within 21 days from having received the inquiry, they will receive an infringement letter and be fined as high as $750.

Highbury Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory in all Highbury and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that prove conformance with each Healthy Homes Standard that apply or will be applicable during the tenure of their rental properties.

From 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Highbury

Rental properties in Highbury should have a permanent source of heat that is able to heat the living space to at least 18degC, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs for it to be permanent (i.e. not portable) with at minimum 1.5 horsepower in capacity, and must meet the minimum heating capacity needed for the main living room. In some instances, such as small apartments the smaller fixed electric heater might be enough.

If your main living space is already equipped with a fixed heating source such as an air conditioner, it may require some additional energy in order to comply with the standards. Certain types of heaters cannot be used to achieve the quality as they are either not effective, cost prohibitive to operate or unsafe to operate.
