Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for a Highbury rental property, all Healthy Homes compliance items must be finished inside of 90 days.

Since the 1st July of 2021, when a new, renewed or varied Tenancy is signed for the Highbury rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement it could result in an additional penalty or infringement fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager fails to supply the required information within 21 days from having received the inquiry, they may receive an infringement letter and be fined upto $750.

Additionally, there is an additional fine of as much as $900 for landlords and property managers that provide false or incorrect Healthy Homes Statement of Compliance or any other information. The person liable for this fine is whoever is named on the tenancy agreement as the one who is renting the property, so it could be the landlord’s name or the property management company.

All information in the Compliance Statement needs to be accurate when the tenancy contract is signed, and ideally it should be kept updated throughout the tenancy as any relevant work gets completed.

It is crucial to keep in mind that landlords with multiple rental properties may receive additional fines for non-compliance. The harshest penalties are reserved for serious breaches, and landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Highbury Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory to all Highbury and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standard that apply or will be applicable throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Property managers and private landlords have to make sure their rental properties conform to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of when the tenancy first began.

Proper heating is crucial for healthy homes

Heating Highbury

Rental properties in Highbury should have a permanent source of heating which can warm the largest or main living area to at minimum 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat needs that it be permanently fixed (i.e. not portable) that is, at minimum 1.5 kW of heating capacity, and meet the minimum required heating capacity for the main living room. For most properties, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. In some instances, such as small apartments small apartments, a smaller electric fixed heater could be enough.

If your main living space is already equipped with a fixed heating source, like heat pumps, it could require a top up to make sure it meets the requirements. Certain kinds of heaters cannot be used to achieve the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.
