Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Highbury rental property, all Healthy Homes compliance work must be finished inside of 90 days.

When Do I need to be in compliance with requirements of the Healthy Homes Standards?

Highbury Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory to all Highbury and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with any Healthy Homes Standards that apply or will apply to an apartment rental.

From July 1st 2021

  • Private landlords and property managers must make sure their rental properties conform with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
