Beginning on July 1st, 2021, when a new or renewed contract is signed on a Highbury rental property, all Healthy Homes compliance work have to be finished inside of 90 days.

Since the 1st July of 2021, when a new or renewed contract is signed on the Highbury rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement, it could result in additional penalties or an infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they are living in. If the property manager fails to supply the required information within 21 days from getting the notice, the tenant will receive an infringement notice and be fined up to $750.

In addition, there is also a penalty up to $900 for landlords or property managers who have provided a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is whoever is listed on the tenancy agreement as the one who is letting the property out which could be the name of the landlord or the company that manages the property.

It’s also crucial to remember that landlords who have multiple rental properties may receive greater penalties for non-compliance. The highest penalties are given only for serious breaches, and landlords with more than six properties could be fined up to $50,000, and as much as $100,000 in hearings.

Healthy homes matter

Why is Healthy Homes Compliance so important?

A majority of households rent in New Zealand and Highbury, and research shows us that these rental homes are likely to be older, colder, are not as efficient heating, and generally are of lower quality than the homes of owners.

Cold, damp and mouldy houses are associated with negative well-being outcomes, especially for diseases like colds and asthma, as well as cardiovascular conditions. In addition, people who experience at least four key home quality issues often suffer from poor life satisfaction and lower mental health.

Improve the standard of Highbury rental property can help tenants enjoy better physical and mental health and minimise the disruptions to their work, education and living due to illnesses. Your investment will be secured from mildew, mould and damp damage, meaning less maintenance costs in the long run.

The Healthy Homes Standard is a set of specific and minimal standards for Heating, Insulation Ventilation, Moisture Ingress and Drainage, as well as Draught-stopping on Highbury rental properties.

Unreasonable Gaps & Holes

Draught Stopping Highbury

Draughts can lead to low temperatures inside houses. A humid house costs more to heat, resulting in wasted energy and resulting in higher bills.

If a draft can be perceived as a result of gaps or holes that it needs to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or a clear draught from a gap or hole, then it’s probably a gap or crack that needs sealing in somehow. Cracks or gaps with large gaps must be stopped permanently. The gaps that exceed 3mm that let air in or out within the house need to be sealed. For example, if an open fireplace isn’t being used, it may cause draughts and should be sealed off. Property managers and landlords are accountable for making sure that these draughts are stopped as much as possible.

You don’t need to block gaps or holes in the construction. For example, tiny gaps around windows and doors might be necessary to allow for the movement of the structure as the home gets warmer and cooler, in order to let them be closed and opened instead of than securing. We will check the windows and doors during our Healthy Homes assessment of your rental property.

A good heating system is crucial for healthy houses

Heating Highbury

Highbury rental properties should have a permanent source of heat which can warm the living room to at least 18degC, even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs for it to be permanent (i.e., not portable) and at least 1.5 kW of heating capacity and have the minimum heating capacity needed for the main living room. The Heating Assessment Tool can be used to determine whether the fix heater(s) are adequate or if you’ll need to top up with a new heater. Open fires and unflued combustion heaters, such as mobile LPG bottle heaters are not considered to be safe heating options for Healthy Homes Standard. Healthy Homes Standard.

If the heating system you offer is electric heating (or heat pump), it must include an thermostat. This makes the heating more consistent and efficient. For most homes, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in some cases such as small apartments an electric, fixed heater might be enough.

If the living area already has a permanent heating source, like the heat pump, it may require some additional energy to meet the standards. Some types of heaters can’t be utilised to meet the quality since they’re either not effective, cost prohibitive to operate and/or unsafe to run.

Ventilation Highbury

Each liveable space in a rental home must have at least one opening door or window to provide natural airflow. In addition, high moisture areas like kitchens and bathrooms need to have an externally vented extractor fan to take moisture away.

A ventilation standard is all about recognising it is that dry air is easier to heat and that a property that is well ventilated is less likely to develop mould and damp.

Bedrooms, living spaces, dining rooms, and kitchens are considered to be liveable spaces. Connecting spaces such as the hallways are not liveable , and thus do not need an opening window or door.

Each window, door , or skylight needs to be able to open to the outside while remaining set in an opening position in order to allow to circulate fresh air as well as air flow.

Bathrooms, kitchens, and any other area in your property with shower, bath, cooktop or other high moisture-producing item will require adequate extractor fans that are vented towards the outside. This Healthy Homes Assessment service will check that there is adequate ventilation in each livable space, including suitable extractor fans for areas that are high in moisture.

Insulation Highbury

Underfloor and ceiling insulation is required in all rental homes from 1 July 2019. All landlords and property managers must make sure that the insulation is up to current standard. In some cases, existing ceiling insulation or insulation in the sub floor space may require to be replaced or replaced.

A well-insulated house can reduce condensation and lower the chance of mould and damp, as well as making an easier task to allow the home to hold warmth.

Insulation needs to be in compliance with the R-values that are appropriate for your region.

The "R" signifies thermal resistance, and is a measure of how well insulation withstands heat flow. The more R-value is higher, the more effective the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – the rest of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 (underfloor R 1.3

Highbury Moisture Ingress & Drainage

Protecting your rental property from water damage isn’t only about the inside of the building it is also about the outside. You must ensure there is somewhere to allow surface, rain and ground water to go and also stop it from getting inside. When it is about damp and water, it’s usually those concerns that you aren’t aware of that can cause a lot of trouble and end up causing damage to your investment as well as affecting the tenant’s well-being.

Rental properties should have efficient drainage to remove rainwater, storm water, and ground water, which includes an appropriate outfall or runoff. Making sure that the water has a place to go, and also that it isn’t allowed to remain beneath structures is an important aspect of keeping your property dry.

In addition to a drainage system to avoid moisture ingress, if your apartment has an enclosed gap between your floor and soil, a ground-water barrier should be put in place if it is reasonably practicable to install it.

A ground moisture barrier is usually a sheet of polythene that is placed over the ground, to block any moisture present in the ground from rising into the building. It also helps to prevent water damage to the floor insulation.
