Did you be aware that the Healthy Homes Standards came into in force on July 1, 2021? Landlords must make sure their Heretaunga rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rental properties are required to be completely certified by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed for a Heretaunga rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

As of 1st July 2021, when a new or renewed tenancy is signed on a Heretaunga rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with all of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy agreement there may be additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager is unable to supply the required information within 21 days of getting the notice, the tenant will be issued an infringement notice and be fined as high as $750.

Furthermore, there’s also a penalty up to $900 for landlords or property managers who provide a false or incorrect Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is whoever is listed on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord as well as the property management company.

The information contained in the Statement of Compliance requirements to be accurate when the tenancy agreement is completed, and must be updated throughout the tenancy as any relevant work gets completed.

It’s also important to remember that landlords who manage multiple rental properties could face even higher fines for non-compliance. The most severe penalties are handed down only for serious breaches. Landlords with at least six rental properties could be fined up to $50,000, and as much as $100,000 in hearings.

Heretaunga Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory for all Heretaunga and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with all Healthy Homes Standard that apply or will apply during the tenancy of an apartment rental.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure their rental properties conform with the Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must adhere to the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

If you are able to feel external air coming in or the air is clear from a gap or hole that is, it’s most likely a gap or hole that needs sealing in any way. Cracks or gaps with large gaps must be sealed permanently. Gaps greater than 3mm that allow air in or out into the house need the sealing. For example, if the open fireplace isn’t in use it could cause draughts, and should be sealed from. Property managers and landlords are responsible for ensuring that such draughts are squelched as much as possible.

There is no need to block off gaps or holes which are part of the construction. For instance, small gaps around windows and doors may be required to allow movement of the structure when the household warms and cools to allow them to be closed and opened rather than being stuck. Heating Heretaunga

Heretaunga rental properties need to have a stable source of heat that can heat the principal or the biggest living space to at least 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements to be fixed (i.e., not portable) and at minimum 1.5 kW of heating capacity, and meet the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to determine whether your current fixed heater(s) are adequate or whether you will need to "top up" with a new heater. Fires that are open and unflued heaters, such as the portable LPG bottle heaters aren’t considered to be suitable heating options in those following the Healthy Homes Standard.

If the heating that you provide is electric heating or heat source, then it must have a thermostat. This makes your heating more consistent and effective. For most properties, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in certain instances like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

If the living area already has a permanent heating source like the heat pump, it could need an upgrade to ensure it meets the requirements. Certain kinds of heaters aren’t able to be used to meet the quality because they’re inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Heretaunga

The insulation of the ceiling and underfloor is a requirement to all rental homes since 1 July 2019. Property managers and landlords are required to make sure that the insulation is in line with the new standard. In some cases, existing ceiling insulation or insulation in the subfloor space may need to be topped up or replaced.

A well-insulated property will reduce the risk of condensation, and decrease the risk of dampness and mould, and also makes an easier task for the home to retain the heat.
