Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed for a Heretaunga rental property, all Healthy Homes compliance tasks have to be done within 90 days.

From the 1st of July in 2021, when a new, renewed or varied contract is signed on the Heretaunga rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the period of time expected can lead to an amount of $7200. Heretaunga Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory in all Heretaunga and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records of their conformance with the Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Draughts may lead to low temperatures inside houses. A draughty house is more expensive to heat, resulting in wasted energy and incurring higher costs.

If a draught can be felt from unreasonable gaps or holes or holes, it requirements to be closed.

Heating Heretaunga

Heretaunga rental properties need to have a stable source of heat which can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

The source of heat needs for it to be permanent (i.e. not portable) with at least 1.5 Kilowatts in heating capacity and have the minimum required heating capacity for the main living room. A Heating Assessment Tool could be used to determine if your current fixed heater(s) are adequate or whether you will need to "top up" with a new heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters aren’t considered to be suitable heating options in The Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump, it requirements to include the thermostat. This will help make the heating more reliable and effective. For most houses, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. In some instances, like small apartment buildings, a smaller fixed electric heater may be sufficient.

If the main living room already has a central heating source, such as heat pumps, it might require a top up in order to comply with the standards. Certain kinds of heaters aren’t able to be utilised to meet the quality as they are either costly, not affordable to run, and/or unhealthy to run.
