Fines for Failing to Comply
Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed on a Heretaunga rental property, all Healthy Homes compliance work have to be taken care of inside of 90 days.
As of 1st July 2021, once a new or renewed tenancy is signed on a Heretaunga rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Failure to meet any of the Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy agreement there may be additional penalties or an infringement fee.
Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager fails to supply the information requested within 21 days of having received the inquiry, they can be issued an infringement notice and be fined as high as $750.
In addition, there is an additional fine of as much as $900 for landlords and property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or information. The person responsible for this fine is the one who is named on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord as well as the property management company.
The information contained in the Compliance Statement requirements to be correct at the time that the tenancy agreement is signed. It must be updated throughout the tenancy as any related work is completed.
It is also crucial to be aware that landlords who manage multiple rental properties may receive more severe penalties for not complying. The most severe penalties are given for the most serious breaches. Landlords with more than six properties could be fined up to $50,000, or as high as $100,000 in hearings.
