Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Haywards rental property, all Healthy Homes compliance work have to be taken care of within 90 days.

Since the 1st July of 2021, if a new or renewed lease is entered into on a Haywards rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy contract, it could result in additional penalties or an infringement fee.

Haywards Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is mandatory in all Haywards and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with any Healthy Homes Standards that apply or will be applied during the tenure of your rental home.

From 1 July 2021

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
