Fines for Failing to Comply

As of 1st July 2021, when a new or renewed contract is signed on a Haywards rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on the Haywards rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Additionally, there is also a penalty of approximately $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is liable for this fine is whoever is named on the lease agreement as the person who is letting the property out and it could be the name of the landlord as well as the company that manages the property.

All information in the Compliance Statement requirements to be current at the time that the tenancy agreement is signed. It must be updated through the tenancy period as related work is completed.

Haywards Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is required throughout Haywards and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with each Healthy Homes Standards that apply or will be in force throughout the tenancy period of the rental property.

From 1 July 2021

  • Private landlords and property managers should make sure their rental properties conform according to Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must adhere to the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All houses rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Haywards

Rental properties in Haywards need to have a stable source of heating which can warm the largest or main living area to at minimum 18degC, even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

In certain situations, like small apartment buildings an electric, fixed heater may suffice.

If the living area is already equipped with a fixed heating source like an air conditioner, it could require a top up to be able to meet the standards. All landlords and property managers are required to ensure that the insulation is in line with the new quality.
