Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied contract is signed on a Haywards rental property, all Healthy Homes compliance tasks have to be taken care of inside of 90 days.

All information in the Statement of Compliance requirements to be up-to-date at the time that the tenancy agreement is completed, and is updated throughout the duration of the tenancy when any related work is completed.

It is important to keep in mind that landlords who own several rental properties can face greater penalties for non-compliance. The most severe penalties are given for the most serious violations. Those who have more than six properties could be fined up to $50,000, and as much as $100,000 in hearing claims.

Tenancies established from 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory throughout Haywards and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with each Healthy Homes Standards that apply or will be in force during the tenancy of the rental property.
