Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed contract is signed on a Haywards rental property, all Healthy Homes compliance items need to be done inside of 90 days.

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on the Haywards rental property, all Healthy Homes compliance work must be done by the end of 90 days.

The information contained in the Statement of Compliance needs to be current when the tenancy agreement is signed. It should be kept updated during the entire tenancy, as related work is completed.

It’s important to remember that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The highest penalties are handed down for severe violations, and landlords who own six or more properties can be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Tenancies established beginning on 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory throughout Haywards and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate the conformance to each Healthy Homes Standard that apply or will be in force during the tenure of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords have to ensure their rental properties comply according to Healthy Homes Standard within 90 days of any new, renewed , or altered lease.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Heating Haywards

Haywards rental properties must have a fixed source of heating that can warm the main or largest living area to at minimum 18degC, even during the coldest days of the year.
