Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied contract is signed on a Grenada Village rental property, all Healthy Homes compliance work need to be taken care of within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied Tenancy is signed for a Grenada Village rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with all of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance is not included in an updated, renewed, or amended tenancy agreement there may be additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or the property manager doesn’t supply the information requested within 21 days from getting the notice, the tenant may receive an infringement letter and be fined upto $750.

In addition, there is also a fine of up to $900 for property owners or property managers providing a false or false Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is listed on the tenancy agreement as the one who is letting the property out, so it could be the name of the landlord or the company that manages the property.

Grenada Village Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory to all Grenada Village and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate compliance with all Healthy Homes Standards that apply or will be applied during the tenure of the rental property.

Starting 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed , or altered tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
