Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed contract is signed on a Grenada Village rental property, all Healthy Homes compliance tasks must be finished within 90 days.

From the 1st of July in 2021, if a new or renewed contract is signed on a Grenada Village rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement, it could result in an additional fine or violation fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager does not supply the required information within 21 days from receiving the request, they will receive an infringement letter and be fined up to $750.

Furthermore, there’s also a penalty approximately $900 for property owners or property managers providing a false or incorrect Healthy Homes Compliance Statement or other information. The person who is liable to pay this fine is the one who is named on the tenancy agreement as being the person letting the property out It could also be the landlord’s name or the company that manages the property.

All information in the Compliance Statement requirements to be correct when the tenancy contract is completed, and must be updated throughout the tenancy as any necessary work related to it’s finished.

It’s also crucial to note that a landlord who own multiple rental properties could face greater penalties for non-compliance. The most severe penalties are handed down for the most serious breaches, and landlords with six or more properties could be fined as high as $50,000 and as high as $100,000 for hearing claims.

Grenada Village Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is required throughout Grenada Village and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate compliance with each Healthy Homes Standard that apply or will be in force throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any new, renewed , or altered lease.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.

Rental properties in Grenada Village require a reliable source of heat that can warm the principal or the biggest living area to at minimum 18 degrees Celsius, even on the winter coldest days. In some instances, like apartments with small spaces an electric, fixed heater may be sufficient.

If your main living space already has a central heating source like the heat pump, it may need some additional energy to be able to meet the standards. Certain types of heaters cannot be used to meet the standard as they are either not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Grenada Village
