Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Grenada Village rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

Since the 1st July of 2021, if a new or renewed Tenancy is signed for a Grenada Village rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to adhere to all of the Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if a current Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement there could be additional penalties or an infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the building they reside in. If the property manager is unable to supply the information requested within 21 days of receiving the request, they will receive an infringement letter and could be fined up to $750.

In addition, there is also a fine of approximately $900 for property owners or property managers that provide false or incorrect Healthy Homes Statement of Compliance or other information. The person responsible to pay this fine is the one who is named on the tenancy agreement as the one who is letting the property out, so it could be the name of the landlord as well as the property management company.

All the information on the Statement of Compliance needs to be up-to-date when the tenancy contract is completed, and should be kept updated throughout the duration of the tenancy when any related work is completed.

It’s crucial to remember that landlords who manage multiple rental properties may receive more severe penalties for not complying. The harshest penalties are given for the most serious breaches, and landlords with at least six rental properties could be penalised up to $50,000 and as high as $100,000 in hearings.

Grenada Village Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory to all Grenada Village and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate conformance with all Healthy Homes Standard that apply or will be applicable to an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must adhere to the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

What are unjustifiable gaps or holes?

If you are able to feel external air coming in or a clear draught from a crack or a gap, then it’s most likely a gap or crack that needs sealing in any way. Cracks and gaps that are large should be stopped permanently. Any gaps greater than 3mm that let air into or out into your home need to be sealed. In the case of an open fireplace isn’t being used, it may cause draughts and must be sealed off. Property managers and landlords are accountable for ensuring that draughts from the fireplace are removed in the maximum extent possible.

You don’t need to block holes or gaps which are part of the building. For instance, small gaps around windows and doors could be necessary to allow for the movement of the structure as the home gets warmer and cooler, so that they are able to be opened and closed rather than being stuck. Heating Grenada Village

Rental properties in Grenada Village need to have a stable source of heat which can warm the principal or the biggest living space to at least 18degC, even on the coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs that it be permanently fixed (i.e., not portable) that is, at least 1.5 kW in heating capacity, and must meet the minimum heating capacity needed for the main living room. The Heating Assessment Tool can be used to check if the installed heater(s) are adequate or if you’ll need to top up by adding a second heater. Open fires and unflued combustion heaters, such as the portable LPG bottle heaters are not considered to be safe heating options for those following the Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), it requirements to be equipped with the thermostat. This will make the heating more reliable and efficient. In most houses, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters are required. In certain situations, such as small apartments an electric, fixed heater may suffice.

If the living area already has a permanent heating source, such as a heat pump, then it could require an update in order to comply with the standards. Certain kinds of heaters cannot be used to meet the quality as they are either costly, not cost-effective to run, or are unsafe to operate.

Ventilation Grenada Village

Each living space within the rental property should contain at minimum one open window or exterior door to offer natural ventilation. In addition, humid areas such as kitchens or bathrooms must have a suitable externally vented extractor fan to get rid of moisture.

This ventilation standard is about recognising that dried air can be easier to heat and that the property that is properly ventilated will be less prone to developing damp and mould.

Living rooms, bedrooms, kitchens, and dining areas are considered liveable areas. Spaces that connect, such as the hallway aren’t living spaces and therefore do not need an opening window or door.

Insulation Grenada Village

Underfloor and ceiling insulation is mandatory on all rental houses as of July 1st, 2019. Property managers and landlords should ensure the insulation meets current standard. In some instances, existing ceiling insulation or insulation in the subfloor space may require to be filled with or replaced.
