Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Grenada Village rental property, all Healthy Homes compliance work need to be done inside of 90 days.

Beginning on July 1st, 2021, once a new or renewed Tenancy is signed for a Grenada Village rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet all of the Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement, it could result in additional penalties or an infringement fee.

If the landlord or property manager fails to provide the necessary information within 21 days from being informed of the request, they could receive an infringement notification and be fined as high as $750.

Additionally, there is an additional fine of up to $900 for property owners or property managers who offer a false or misleading Healthy Homes Compliance Statement or other information. The person who is responsible to pay this fine is the one who is named on the lease agreement as the person who is leasing the property out which could be the landlord’s name or the property management company.

All information in the Statement of Compliance requirements to be current at the time that the tenancy agreement is signed. It should be maintained during the entire tenancy, as related work is completed.

It is also important to remember that a landlord who manage multiple rental properties may face additional fines for non-compliance. The highest penalties are handed down only for serious breaches. Landlords with more than six properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Grenada Village Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement to all Grenada Village and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records of their conformance with the Healthy Homes Standards that apply or will be applied throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must adhere to the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All houses let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

For example, if an open fireplace isn’t in use it may cause draughts and must be sealed off. Adequate heaters are important to ensure well-being houses

Heating Grenada Village

Grenada Village rental properties require a reliable source of heating that is able to heat the largest or main living room to at least 18degC, even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating needs for it to be permanent (i.e., not portable) with at minimum 1.5 Kilowatts in heating capacity, and meet the minimum required heating capacity for the main living space. A Heating Assessment Tool can be used to determine if the fixed heater(s) are adequate or whether you will need to "top up" with a new heater. Unflued combustion and open fire heaters such as mobile LPG bottle heaters are not considered to be acceptable heating options for the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump, it needs to be equipped with an thermostat. This will make the heating more uniform and efficient. For most properties, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. In certain situations, such as small apartments, a smaller fixed electric heater might be enough.

If your main living space already has a central heating source like a heat pump, then it may require an update to meet the standards. Some types of heaters can’t be used to meet the standard because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Grenada Village

Every living space in the rental property should have at least one openable window or exterior door to offer natural airflow. Additionally, areas with high moisture areas such as kitchens or bathrooms need to have an externally vented extractor fan that can take moisture away.

Insulation Grenada Village

The insulation of the ceiling and underfloor has been compulsory in all rental homes as of July 1st, 2019. All landlords and property managers are required to ensure the insulation meets current quality. In some instances, old ceiling insulation as well as insulation within the sub floor space may need to be replaced or replaced.
