Fines for Failing to Comply

From the 1st of July in 2021, if a new or renewed tenancy is signed on a Grenada Village rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

As of 1st July 2021, once a new, renewed or varied tenancy is signed on a Grenada Village rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to adhere to one of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy agreement, there may be an additional fine or violation fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they reside in. If the property manager fails to supply the required information within 21 days from getting the notice, the tenant can be issued an infringement notice and be fined as high as $750.

Additionally, there is also a penalty as much as $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. When Do I require to be in compliance with requirements of the Healthy Homes Standards?

Grenada Village Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory throughout Grenada Village and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that prove the conformance to each Healthy Homes Standards that apply or will apply throughout the tenancy period of your rental home.

From July 1st 2021

  • Property managers and private landlords are required to make sure their rental properties conform to the Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts increase the likelihood of dropping temperatures within homes. A draughty house costs more to heat, which means wasting energy and increased bills.

Heating Grenada Village

Rental properties in Grenada Village should have a permanent source of heating that can heat the largest or main living area to at minimum 18degC, even during the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements to be fixed (i.e., not portable) with at least 1.5 Kilowatts in heating capacity, and it must have the minimum required heating capacity for the main living space. The Heating Assessment Tool can be used to determine whether the permanent heater(s) are adequate or whether you will require to "top-up" with an additional heater. Fires that are open and unflued heaters, such as portable LPG bottle heaters aren’t considered to be suitable heating options under those following the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump, it should be equipped with the thermostat. This will make the heating more uniform and effective. For most houses, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are required. In certain situations, like apartments with small spaces small apartments, a smaller electric fixed heater could be enough.

If the living area already has a permanent heating source, like the heat pump, it could need a top up in order to comply with the standards. Some types of heaters can’t be used to meet the standard because they’re expensive, inefficient or are unsafe to operate.

Ventilation Grenada Village

Each living space within a rental house must have at least one opening windows or an exterior door to offer natural airflow. Additionally, areas with high moisture areas such as kitchens and bathrooms should be equipped with an venting fan outside to remove moisture.

Insulation Grenada Village

Insulation for underfloor and ceilings is a requirement in all rental homes since 1 July 2019. Property managers and landlords have to make sure the insulation meets this new standard. In certain situations, the current ceiling insulation, or the insulation of the sub floor space may need to be filled with or replaced.

A well-insulated house will reduce the risk of condensation and reduce the chances of mould and damp, and will also make more easy to the house to retain warmth.

The "R" signifies thermal resistance and it is a measurement of how well the insulation can withstand heat flow. The more R-value is higher, the more effective the insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9 in the underfloor, 1.3
  • Zone 2 – the rest of the North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3, underfloor R 1.3
