Fines for Failing to Comply

Failure to comply with all of the Healthy Homes Standards by the end of the period of time expected can lead to a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or amended tenancy agreement it could result in an additional fine or infringement fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager is unable to provide the required information within 21 days of having received the inquiry, they will receive an infringement notification and be fined as high as $750.
In addition, there’s an additional fine of up to $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or any other information. The person responsible for this fine is whoever is named on the lease agreement as the one who is letting the property out which could be the name of the landlord or the company that manages the property.
All the information on the Statement of Compliance requirements to be current at the time that the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any associated work has been completed.
It is crucial to be aware that landlords who have several rental properties can face more severe penalties for not complying. The highest penalties are reserved for the most serious breaches. Landlords with six or more properties could receive fines of up to $50,000, and as much as $100,000 in hearing claims.
