Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Glenside rental property, all Healthy Homes compliance tasks have to be taken care of within 90 days.

Furthermore, there’s also a fine of as much as $900 for landlords or property managers who offer a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the person who is identified on the tenancy agreement as the one who is who is letting the property It could also be the name of the landlord as well as the property management company.

All the information on the Compliance Statement needs to be current when the tenancy contract is completed, and must be updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It is also important to keep in mind that a landlord who own several rental properties can face additional fines for non-compliance. The harshest penalties are handed down for severe violations, and landlords who own at least six rental properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Glenside Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is required in all Glenside and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate conformance with all Healthy Homes Standards that apply or will be applied throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties comply with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All houses which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

For most properties, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in some cases like small apartments the smaller fixed electric heater may be sufficient.

If the main living room already has a central heating source like the heat pump, it may need an upgrade to meet the standards. Certain kinds of heaters aren’t able to be used to achieve the quality since they’re either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Glenside
