Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed on a Glenside rental property, all Healthy Homes compliance items need to be completed within 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on a Glenside rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. The highest penalties are given only for serious breaches, and landlords with six or more properties can receive fines of up to $50,000, and as much as $100,000 in the case of hearing claims.

Tenancies commenced beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement throughout Glenside and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or altered tenancy contract.

From July 1st 2021

  • Property managers and private landlords have to make sure their rental properties conform according to Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.
