Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed for a Glenside rental property, all Healthy Homes compliance items must be taken care of within 90 days.

From the 1st of July in 2021, if a new or renewed lease is entered into on a Glenside rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet all of the Healthy Homes Standards within the period of time expected can lead to an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or revised tenancy contract, there may be an additional fine or violation fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they reside in. If the property manager does not provide the information requested within 21 days from receiving the request, they will receive an infringement notification and be fined as high as $750.

In addition, there is also a penalty approximately $900 for landlords and property managers providing a false or false Healthy Homes Compliance Statement or any other information. The person liable for this fine is the person who is listed on the tenancy agreement as being the person who is letting the property and it could be the landlord’s name or the company that manages the property.

All information in the Statement of Compliance needs to be accurate before the tenancy agreement can be completed, and should be maintained through the tenancy period as necessary work related to it is finished.

It is crucial to note that landlords who have multiple rental properties could face more severe penalties for not complying. The most severe penalties are given for severe violations, and landlords who own six or more properties can receive fines of up to $50,000, and as much as $100,000 in hearing claims.

Tenancies established between 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement to all Glenside and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate compliance with each Healthy Homes Standards that apply or will apply throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties comply with the Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Heating Glenside

Rental properties in Glenside must have a fixed source of heat which can warm the living space to a minimum of 18degC, even during the coldest days of the year.
