Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed for a Glenside rental property, all Healthy Homes compliance tasks have to be taken care of by the end of 90 days.

All the information on the Statement of Compliance needs to be correct at the time that the tenancy agreement is completed, and should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It’s crucial to be aware that a landlord who have multiple rental properties may face greater penalties for non-compliance. The highest penalties are handed down only for serious violations, and landlords who own six or more properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Glenside Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory to all Glenside and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove the conformance to any Healthy Homes Standard that apply or will be in force throughout the tenancy period of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords must make sure their rental properties comply to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy began.

What are unjustifiable gaps or holes?

If you are able to feel external air entering or a clear draught from a crack or a gap and you can feel it, it’s likely to be a gap or an opening that requirements sealing in any way. Cracks and gaps that are large should be sealed permanently. Any gaps greater than 3mm that let air into or out within the home need seals. For instance, if an open fireplace is not in use, it may cause draughts and should be blocked off. Property managers and landlords are accountable for making sure such draughts are eliminated as far as possible.

There is no need to block off gaps or holes which are part of the building. For example, tiny gaps around doors and windows could be required to allow for movement within the structure when the home is heated and cools so that they are able to be closed and opened rather than sticking. Adequate heaters are crucial for well-being homes

Heating Glenside

Rental properties in Glenside should have a permanent heating source that can warm the principal or the biggest living area to at minimum 18degC, even during the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs to remain fixed (i.e. not portable) with at minimum 1.5 kW in heating capacity and have the minimum capacity for heating required for the main living room. In some instances, like small apartment buildings small apartments, a smaller electric fixed heater may be sufficient.

If your main living space already has a central heating source like a heat pump, then it may need an update in order to comply with the standards. Some types of heaters can’t be used to meet the standard because they’re inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Glenside

Each living space within a rental property has to contain at minimum one open door or window to offer natural airflow. In addition, humid areas such as kitchens or bathrooms should be equipped with an externally vented extractor to take moisture away.
