Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Glenside rental property, all Healthy Homes compliance items have to be finished within 90 days.

Since the 1st July of 2021, if a new or renewed Tenancy is signed for a Glenside rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or amended tenancy agreement there may be an additional fine or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the property manager is unable to supply the required information within 21 days of having received the inquiry, they may receive an infringement letter and be fined upto $750.

In addition, there’s also a fine of up to $900 for landlords and property managers who provide a false or false Healthy Homes Statement of Compliance or information. The person who is liable for this fine is the person who is identified on the tenancy agreement as the one who is renting the property which could be the name of the landlord as well as the property management company.

All information in the Compliance Statement requirements to be correct when the tenancy agreement is signed, and ideally it must be updated throughout the tenancy as any related work is completed.

It is crucial to be aware that a landlord who own several rental properties can face more severe penalties for not complying. When do I require to be in compliance with The Healthy Homes Standards?

Glenside Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory for all Glenside and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords must keep records that prove compliance with the Healthy Homes Standards that apply or will be applicable during the tenancy of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords should make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a renewal, new or a change in tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Glenside

Draughts may lead to dropping temperatures within households. A draughty home is more expensive to heat, resulting in wasted money and energy.

If a draught can be noticed from gaps that are not adequate or holes the area requirements to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or an unobstructed draught coming from a crack or a gap, then it is probably a gap or hole which requirements sealing in the way you can. Cracks or gaps with large gaps must be fixed permanently. The gaps that exceed 3mm that allow air to enter or exit from the house require seals. In the case of an open fireplace isn’t being used, it may cause draughts and should be sealed from. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed in the maximum extent possible.

There is no need to cover up gaps or holes in the building. For example, tiny gaps around doors and windows may be required to allow for the movement of the structure as the home gets warmer and cooler, to allow them to be shut and opened, rather than securing. Proper heating is crucial to ensure healthy houses

Heating Glenside

Glenside rental properties must have a fixed source of heating that can warm the principal or the biggest living space to a minimum of 18degC, even during the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating needs that it be permanently fixed (i.e. not portable) with at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to determine whether the existing fixed heater(s) are sufficient or if you’ll need to "top up" with an additional heater. Open fires and unflued combustion heaters such as small portable LPG bottle heaters aren’t considered to be suitable heating options for the Healthy Homes Standard.

If the heating that you provide is electric heating (or heat pump), it requirements to include the thermostat. This will make the heating more consistent and efficient. For most homes, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in some cases like small apartments, a smaller fixed electric heater may be sufficient.

If the living area already has a permanent heating source like an air conditioner, it might just need some additional energy to ensure it meets the requirements. Some types of heaters can’t be used to meet the quality as they are either expensive, inefficient or are unsafe to operate.

Ventilation Glenside

Every living space in a rental property must have at least one opening window or exterior door to provide natural airflow. Additionally, areas with high moisture areas like kitchens and bathrooms need to have an venting fan outside to take moisture away.

This ventilation standard is all about acknowledging the fact that dry air is much easier to heat and a property that is well ventilated is less likely to develop damp and mould.

Bedrooms, living rooms dining rooms, and kitchens are considered liveable spaces. Connecting spaces such as the hallways are not liveable and do not require an opening window or door.

Every window, door or skylight needs for them to be in a position of opening to the outside and remain closed to allow to circulate fresh air as well as ventilation.

Bathrooms, kitchens, and every other room of your house that houses a bath, shower or cooktop, or any other humidity-generating items will need appropriate extractor fans that can be vented towards the outside. Insulation Glenside

Insulation for underfloor and ceilings is a requirement on all rental homes since July 1, 2019. All landlords and property managers should make sure that the insulation is in line with this new quality. In some cases, existing ceiling insulation or insulation in the sub floor space may need to be topped up or replaced.

A well-insulated property can reduce condensation and reduce the chances of mould and damp, and it will make much easier for the house to keep the heat.

The "R" stands for thermal resistance and is a measure of how well insulation resists heat flow. The more high the R-value, better the insulation.

  • Zone 1 Zone 1 Auckland & Northland Ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – The rest of the North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3
