Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Glenside rental property, all Healthy Homes compliance work need to be done within 90 days.

As of 1st July 2021, if a new or renewed Tenancy is signed for the Glenside rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet each of Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy contract, there may be an additional fine or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager is unable to supply the necessary information within 21 days of being informed of the request, they will be issued an infringement notice and be fined upto $750.

In addition, there is an additional fine of approximately $900 for landlords and property managers who offer a false or misleading Healthy Homes Compliance Statement or other information. The person who is liable for this fine is whoever is named on the lease agreement as the one who is leasing the property out which could be the name of the landlord, or the property management company.

All information in the Compliance Statement requirements to be accurate when the tenancy contract is signed, and ideally it is updated during the entire tenancy, as related work is completed.

It is also crucial to be aware that a landlord who have multiple rental properties could face even higher fines for non-compliance. The most severe penalties are given for severe violations, and landlords who own at least six rental properties could be fined as high as $50,000 and as high as $100,000 for hearing claims.

Glenside Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory to all Glenside and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with each Healthy Homes Standards that apply or will apply throughout the tenancy period of your rental home.

From 1 July 2021

  • Private landlords and property managers must ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a new, renewed , or altered lease.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts may lead to low temperatures inside homes. A damp house will cost more to heat, meaning wasting energy and increased bills.

What are unjustifiable gaps or holes?

If you are able to feel external air getting in, or see the air is clear from a crack or a gap or crack, then it is most likely a gap or crack that requirements sealing in some way. Cracks or gaps with large gaps must be sealed permanently. Cracks that are greater than 3mm and allow air to enter or exit of the home need the sealing. For example, if an open fireplace isn’t being used, it may cause draughts and should be sealed from. Heating Glenside

Glenside rental properties should have a permanent source of heat that can heat the largest or main living space to at least 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs that it be permanently fixed (i.e., not portable), at least 1.5 horsepower in capacity and have the minimum requirement for heat capacity in the living area. A Heating Assessment Tool may be used to determine whether the current installed heater(s) are adequate or if you’ll need to top up by adding a second heater. Open fires and unflued combustion heaters, such as the portable LPG bottle heaters are not considered acceptable heating options under those following the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump it needs to be equipped with the thermostat. This makes the heating more reliable and efficient. For most homes, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in certain instances such as small apartments, a smaller fixed electric heater may suffice.

If your main living space already has a central heating source, such as an air conditioner, it could require an update to meet the standards. Certain types of heaters cannot be utilised to meet the quality because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Glenside
