Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed for a Glenside rental property, all Healthy Homes compliance items must be completed by the end of 90 days.

Since the 1st July of 2021, if a new or renewed lease is entered into on the Glenside rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy contract, it could result in additional penalties or an infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the the property manager doesn’t supply the information requested within 21 days from having received the inquiry, they may receive an infringement letter and could be fined up to $750.

In addition, there’s also a penalty up to $900 for landlords or property managers that provide false or inaccurate Healthy Homes Statement of Compliance or information. The person liable for this fine is the person who is identified on the tenancy contract as the person who is letting the property, so it could be the landlord’s name or the property management company.

The information contained in the Statement of Compliance needs to be correct before the tenancy agreement can be signed. It must be updated throughout the duration of the tenancy when any relevant work gets completed.

It is important to keep in mind that a landlord who have multiple rental properties may face more severe penalties for not complying. The most severe penalties are handed down only for serious violations. Those who have at least six rental properties could be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

Glenside Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is compulsory to all Glenside and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records that prove compliance with the Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Draught Stopping Glenside

Heating Glenside

Rental properties in Glenside must have a fixed heating source that can heat the largest or main living space to at least 18degC, even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental well-being.

However, in some cases like apartments with small spaces the smaller fixed electric heater might be enough.

If your living space is already equipped with a fixed heating source, like an air conditioner, it could need an upgrade to make sure it meets the requirements. Certain kinds of heaters cannot be used to meet the standard since they’re either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Glenside

Insulation Glenside

The insulation of the ceiling and underfloor has been compulsory on all rental houses since July 1, 2019. Property managers and landlords must ensure the insulation meets this new standard.
