Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for a Fairfield rental property, all Healthy Homes compliance items need to be finished within 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on a Fairfield rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with any of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy contract, it could result in additional penalties or an infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the home they are living in. If the property manager is unable to provide the information requested within 21 days from receiving the request, they may receive an infringement notification and be fined upto $750.

In addition, there is also a penalty approximately $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the person who is named on the lease agreement as the person who is renting the property It could also be the landlord’s name or the company that manages the property.

All information in the Compliance Statement needs to be accurate at the time that the tenancy agreement is executed, and it should be kept updated throughout the duration of the tenancy when any necessary work related to it is finished.

It is crucial to remember that landlords with several rental properties can face even higher fines for non-compliance. The harshest penalties are reserved only for serious violations, and landlords who own six or more properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.

Clearly, failure to comply with your Healthy Homes requirements can hit your bank account resulting in massive fines as well as still being required to adhere to the regulations. Don’t take a chance with your rental property, contact us today and make arrangements to have an house assessment done for your rental property.

Healthy homes are important

What are the reasons why Healthy Homes Compliance so Important?

Around 1 in 3 households rent from New Zealand and Fairfield, and research shows us that these rental houses are likely to be colder, older and are not as effective heating, and generally are of lower standard than those owned by owners.

Cold, damp and mouldy houses are associated with negative well-being outcomes, particularly for illnesses such as colds and influenza, asthma, and heart diseases. In addition, people who experience at least four major issues with their housing often have less satisfaction in their lives and lower well-being.

Enhancing the standard of Fairfield rental property can allow tenants to experience better physical and mental health and minimise the disruptions to their work, education and daily life due to illnesses. Your investment will be safeguarded from mildew, mould and damp-related damage, which completed jobs in less costs of maintenance over the long term.

The Healthy Homes Standards are a set of specific and minimal standards for heating, insulation Ventilation, Moisture ingress and Drainage, as well as Draught stopping on Fairfield rental properties.

Unreasonable Gaps & Holes

Draught Stopping Fairfield

Draughts are a major cause of dropping temperatures within houses. A draughty house will cost more to heat, which means wasting money and energy.

If a draught can be noticed from gaps that are not adequate or holes that it requirements to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air coming in or a clear draught out of a hole or gap, then it is likely a crack or hole which needs sealing in some way. Cracks or gaps with large gaps must be stopped permanently. The gaps that exceed 3mm that let air in or out into the home require to be sealed. For instance, if an open fireplace isn’t in use it can cause draughts and should be blocked from. Property managers and landlords are accountable for making sure that these draughts are stopped whenever possible.

You don’t require to block holes or gaps which are part of the building. For instance, small gaps around doors and windows could be required to allow movement of the structure when the house is heated and cools so that they can still be opened and closed rather instead of being stuck. We will examine all windows and doors during your Healthy Homes assessment of your rental property.

Heating Fairfield

Fairfield rental properties should have a permanent source of heat that is able to heat the largest or main living room to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat requirements that it be permanently fixed (i.e., not portable) with at least 1.5 kW of heating capacity and have the minimum capacity for heating required in the living area. The Heating Assessment Tool can be used to check if your current fix heater(s) are adequate or whether you will require to top up by adding a second heater. Open fires as well as unflued combustion heaters like the portable LPG bottle heaters aren’t considered to be suitable heating options in those following the Healthy Homes Standard.

If the heating system you offer is electric heating or heat source, it needs to be equipped with an thermostat. This will help make the heating more uniform and efficient. For the majority of houses, bigger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in certain instances like apartments with small spaces the smaller fixed electric heater could be enough.

If the main living room already has a central heating source, such as the heat pump, it may require some additional energy to be able to meet the standards. Certain kinds of heaters aren’t able to be utilised to meet the quality as they are either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Fairfield

Each liveable space in a rental property has to have at least one openable door or window to offer natural airflow. Furthermore, moist areas such as kitchens and bathrooms need to have an externally vented extractor fan that can get rid of moisture.

The ventilation quality is all about recognising that dry air will be more easy to heat and a property that is well ventilated is less likely to grow mould and damp.

Bedrooms, living rooms kitchens, and dining rooms are considered to be liveable spaces. Connecting spaces like the hallway aren’t liveable , and thus do not need an opening window or door.

Every window, door or Skylight needs for them to be in a position open to the outside while remaining at an open angle in order to allow for fresh air circulation and ventilation.

The bathrooms in all kitchens and any other area in your home that has shower, bath, cooktop or other high humidity-generating items will need adequate extractor fans that can be vented to the outdoors. This Healthy Homes Assessment service will verify that there is enough ventilation throughout the living spaces, including suitable extractor fans in high moisture areas.

Insulation Fairfield

Underfloor and ceiling insulation is mandatory in all rental houses as of July 1st, 2019. All landlords and property managers should ensure that the insulation is up to current standard. In certain situations, the existing ceiling insulation or insulation in the subfloor space may require to be filled with or replaced.

A well-insulated property will reduce the risk of condensation and lessen the likelihood of mould and dampness and will also make an easier task for the home to retain heat.

Insulation needs to meet the R-values that are appropriate for your region.

The "R" refers to thermal resistance, and it is a measurement of how well the insulation withstands heat flow. The higher the R-value, the more effective the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9 in the underfloor, 1.3
  • Zone 2 – the rest area of North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 (underfloor R 1.3

Fairfield Moisture Ingress & Drainage

Keeping your rental property safe from dampness isn’t just about what’s inside the building it’s also about the outside. You must make sure there is somewhere to allow surface, rain and underground water to flow, and also stop it from getting into the building. When it is damp and moisture, it is frequently what you don’t see that could become a major issue that can cause damage to your investment as well as affecting your tenant’s well-being.

Properties that are rented must be equipped with effective drainage to get rid of the stormwater and surface waters and groundwater, with the proper outfall or runoff. Making sure that the water is able to go and that it isn’t allowed to remain beneath buildings is a vital aspect of keeping your property dry.

In addition to a drainage system to avoid the ingress of moisture, if your apartment has an enclosed gap between your floor and the soil, a ground-water barrier must be put in place when it’s reasonably practicable to install it.

A ground moisture barrier is generally made of polythene and is laid on top of the ground, in order to block any moisture in the ground from getting into the home. It also helps prevent water damage to the floor insulation.
