Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed contract is signed on a Fairfield rental property, all Healthy Homes compliance work have to be finished within 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on the Fairfield rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards within the anticipated timeframe could result in a fine of up to $7200. If the landlord or the property manager doesn’t provide the required information within 21 days from being informed of the request, they can receive an infringement notice and be fined upto $750.

Furthermore, there’s also a penalty of approximately $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the one who is named on the tenancy contract as the person renting the property which could be the name of the landlord as well as the company that manages the property.

The information contained in the Compliance Statement requirements to be current when the tenancy contract is executed, and it must be updated throughout the duration of the tenancy when any relevant work gets completed.

It is important to keep in mind that landlords who own multiple rental properties may face even higher fines for non-compliance. Fairfield Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory in all Fairfield and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records of their conformance with each Healthy Homes Standards that apply or will be in force throughout the tenancy period of their rental properties.

From 1 July 2021

  • Private landlords and property managers have to ensure their rental properties conform with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Heating Fairfield

Fairfield rental properties require a reliable source of heating that is able to heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest winter days. All landlords and property managers are required to ensure that the insulation is in line with current standard.
