Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed for a Fairfield rental property, all Healthy Homes compliance work need to be taken care of by the end of 90 days.

The person responsible for this fine is whoever is identified on the tenancy agreement as the one who is leasing the property out, so it could be the name of the landlord as well as the property management company.

All the information on the Compliance Statement needs to be up-to-date before the tenancy agreement can be signed, and ideally it should be kept updated throughout the duration of the tenancy when any relevant work gets completed.

Tenancies established between 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is required for all Fairfield and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or varied tenancy agreement.

Starting 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy began.
