Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Fairfield rental property, all Healthy Homes compliance work need to be completed inside of 90 days.

From the 1st of July in 2021, once a new or renewed contract is signed on the Fairfield rental property, all Healthy Homes compliance work must be done by the end of 90 days.

It’s important to keep in mind that landlords who have multiple rental properties may receive more severe penalties for not complying. The harshest penalties are handed down for severe violations, and landlords who own six or more properties can be fined as high as $50,000, and as much as $100,000 for hearing claims.

Fairfield Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is a requirement in all Fairfield and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that prove compliance with the Healthy Homes Standard that apply or will be applicable during the tenure of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers must ensure their rental properties comply according to Healthy Homes Standards within 90 days of a new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must adhere to the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of when the tenancy began.

In some instances, like apartments with small spaces small apartments, a smaller electric fixed heater might be enough.

If the living area is already equipped with a fixed heating source such as a heat pump, then it may need some additional energy to meet the standards. Some types of heaters can’t be used to comply with the quality since they’re either expensive, inefficient or unsafe to operate.

Ventilation Fairfield

Insulation Fairfield

Insulation for underfloor and ceilings is a requirement on all rental homes as of July 1st, 2019. All landlords and property managers must ensure that the insulation is in line with the new quality.
