Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for a Fairfield rental property, all Healthy Homes compliance tasks have to be done within 90 days.

Since the 1st July of 2021, if a new or renewed Tenancy is signed for a Fairfield rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to comply with any of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement it could result in an additional fine or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager is unable to provide the required information within 21 days of being informed of the request, they may receive an infringement notice and be fined upto $750.

In addition, there’s an additional fine of approximately $900 for landlords and property managers providing a false or incorrect Healthy Homes Compliance Statement or information. The person who is liable for this fine is whoever is listed on the tenancy agreement as the person who is letting the property out, so it could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance needs to be up-to-date before the tenancy agreement can be completed, and must be updated during the entire tenancy, as associated work has been completed.

It is also important to note that a landlord who have multiple rental properties may face even higher fines for non-compliance. The highest penalties are given for serious breaches. Landlords with more than six properties could receive fines of up to $50,000 and as high as $100,000 in hearings.

When Do I require to be in compliance with The Healthy Homes Standards?

Fairfield Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory for all Fairfield and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any renewal, new or altered tenancy contract.

Beginning 1 July 2021

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
