Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed for an Epuni rental property, all Healthy Homes compliance work need to be completed within 90 days.

As of 1st July 2021, when a new, renewed or varied lease is entered into on an Epuni rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy contract, it could result in an additional fine or violation fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the property manager does not supply the necessary information within 21 days of receiving the request, they can receive an infringement letter and be fined up to $750.

It is also crucial to note that landlords with multiple rental properties may face greater penalties for non-compliance. The highest penalties are reserved only for serious breaches, and landlords with at least six rental properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

Epuni Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is required to all Epuni and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to any Healthy Homes Standards that apply or will be applicable during the tenancy of their rental properties.

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.
