Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on an Elderslea rental property, all Healthy Homes compliance work must be finished within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied Tenancy is signed for the Elderslea rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet any of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included within a new, renewed or revised tenancy agreement, there may be an additional fine or violation fee.

Any tenant can ask for details about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager is unable to supply the necessary information within 21 days from being informed of the request, they will receive an infringement notice and be fined upto $750.

Additionally, there is also a penalty up to $900 for landlords or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person liable for this fine is the person who is identified on the tenancy agreement as the person who is leasing the property out, so it could be the landlord’s name or the property management company.

All information in the Statement of Compliance needs to be current when the tenancy contract is signed. It is updated throughout the tenancy as any associated work has been completed.

It is also important to keep in mind that a landlord who own multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are reserved only for serious breaches. Landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

Elderslea Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is required to all Elderslea and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records of their the compliance with all Healthy Homes Standards that apply or will be applicable throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Property managers and private landlords have to make sure their rental properties comply to the Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Draughts are a major cause of lower temperatures in houses. A cold house is more expensive to heat, which means wasting energy and increased bills.

If a draft can be perceived as a result of gaps or holes the area needs to be sealed.

What are unjustifiable gaps or holes?

If you can feel external air coming in or the sound of a clear draught emanating from a gap or hole, then it is probably a gap or hole which requirements sealing in some way. Cracks and gaps that are large should be fixed permanently. Cracks that are greater than 3mm and let air into or out within the house need sealing. For instance, if an open fireplace is not in use, it can create draughts. This should be blocked off. Property managers and landlords are accountable for ensuring such draughts are eliminated whenever possible.

There is no need to block off gaps or holes in the building. For example, tiny gaps around doors and windows could be necessary to allow for movement within the structure when the house warms and cools to allow them to be opened and closed rather instead of being stuck. Heating Elderslea

Elderslea rental properties must have a fixed source of heat that can heat the main or largest living area to at minimum 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating requirements to be fixed (i.e., not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and meet the minimum capacity for heating required in the living area. A Heating Assessment Tool can be used to determine if the current permanent heater(s) are adequate or whether you will need to "top-up" with a new heater. Open fires and unflued combustion heaters such as small portable LPG bottle heaters aren’t considered to be safe heating options under those following the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump it needs to include the thermostat. This makes the heating more uniform and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters will be required. In certain situations, like apartments with small spaces the smaller fixed electric heater may suffice.

If your main living space already has a fixed heating source, such as an air conditioner, it may require some additional energy to make sure it meets the requirements. Some types of heaters can’t be used to achieve the quality because they’re not efficient, cost prohibitive to operate and/or unhealthy to run.

Insulation for underfloor and ceilings is a requirement on all rental homes since 1 July 2019. Property managers and landlords have to make sure that the insulation is up to current quality. In some cases, an existing insulation on the ceiling or in the sub floor space may require to be added or replaced.
