Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed for an Ebdentown rental property, all Healthy Homes compliance work need to be taken care of within 90 days.

Since the 1st July of 2021, if a new or renewed contract is signed on the Ebdentown rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement there could be an additional penalty or infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager fails to supply the necessary information within 21 days from getting the notice, the tenant may be issued an infringement notice and be fined as high as $750.

Additionally, there is an additional fine of approximately $900 for landlords and property managers that provide false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as the person who is renting the property It could also be the name of the landlord or the property management company.

All information in the Compliance Statement needs to be accurate before the tenancy agreement can be signed, and ideally it must be updated during the entire tenancy, as necessary work related to it is finished.

It’s also crucial to keep in mind that a landlord who manage multiple rental properties may face even higher fines for non-compliance. The most severe penalties are reserved for serious violations, and landlords who own more than six properties could be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

In the end, a failure to comply with your Healthy Homes requirements can hit your bank account hard, resulting in large fines in addition to still having to meet compliance. Do not risk your rental property call us now and arrange to have a home assessment performed on the rental property you are renting.

Healthy homes matter

Why is Healthy Homes Compliance So Important?

Unreasonable Gaps & Holes

Draught Stopping Ebdentown

Draughts may lead to dropping temperatures within homes. A humid home will cost more to heat, resulting in wasted energy and incurring higher costs.

If a draft can be felt from unreasonable gaps or holes the area needs to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air getting in, or see the sound of a clear draught emanating from a gap or hole or crack, then it is likely a crack or crack that needs sealing in somehow. Large cracks and gaps should be stopped permanently. The gaps that exceed 3mm that allow air in or out from the home need sealing. For example, if an open fireplace isn’t being used, it can create draughts. This should be shut from. Landlords and property managers are responsible for ensuring such draughts are eliminated as far as imaginable.

There is no need to block off holes or gaps that are part of the building. For example, tiny gaps around doors and windows could be necessary to allow for movement of the structure as the home gets warmer and cooler, so that they are able to be opened and closed rather than being stuck. We will inspect all windows and doors during an Healthy Homes assessment of your rental property.

The proper heating equipment is important to ensure well-being homes

Heating Ebdentown

Ebdentown rental properties should have a permanent source of heating which can warm the living space to at least 18degC, even during the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat needs to remain fixed (i.e., not portable) with at minimum 1.5 kW of heating capacity, and must meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool can be used to check if your current installed heater(s) are sufficient or whether you will require to "top up" with an additional heater. Unflued combustion and open fire heaters such as the portable LPG bottle heaters are not considered acceptable heating options under those following the Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump it should include a thermostat. This makes the heating more reliable and effective. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters will be required. In some instances, like small apartment buildings small apartments, a smaller electric fixed heater may be sufficient.

If your living space already has a permanent heating source, such as the heat pump, it might just require a top up to ensure it meets the requirements. Certain kinds of heaters aren’t able to be used to achieve the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Ebdentown

Every living space in a rental property has to include at least one open door or window to offer natural ventilation. Furthermore, moist areas such as kitchens and bathrooms must have a suitable externally vented extractor fan that can take moisture away.

A ventilation quality is about recognising it is that dry air is easier to heat and that the property that is properly ventilated will be less prone to developing mould and damp.

Bedrooms, living spaces, kitchens, and dining rooms are considered to be liveable spaces. Connecting spaces like the hallway aren’t liveable and therefore do not require an opening window or door.

Every window, door or the skylight needs to be able to open up to the outside, and stay closed in order to allow the circulation of fresh air and air flow.

Bathrooms, kitchens, and every other room of your house that houses shower, bath, cooktop or other high water-generating appliance will require suitable extractor fans which are vented to the outdoors. The Healthy Homes Assessment service will verify that there is enough ventilation in every living space with the right extractor fan in areas of high moisture.

Insulation Ebdentown

Underfloor and ceiling insulation is mandatory in all rental homes since July 1, 2019. All landlords and property managers are required to make sure that the insulation is up to standards that are in line with the latest quality. In some cases, old ceiling insulation as well as insulation within the subfloor space might need to be added or replaced.

A well-insulated house can help control condensation and reduce the chances of mould and dampness, and it will make it easier to allow the household to hold the heat.

Insulation needs to be in compliance with the R-values for your area

The "R" stands for thermal resistance and it is a measurement of how well insulation is able to resist heat flow. The more high the R-value, better the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9, underfloor R 1.3
  • Zone 2 – the remainder area of North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3, underfloor R 1.3

Ebdentown Moisture Ingress & Drainage

Keeping your rental property safe from the effects of moisture isn’t just a matter of the inside of the building; you have to ensure there is somewhere to allow surface, rain and underground water to flow and prevent it from getting into the building. When it concerns damp and moisture it is frequently those things that you aren’t aware of that could become a major issue and end up causing damages to your investment and affecting the tenant’s well-being.

Properties that are rented must have efficient drainage to eliminate floodwaters, surface water, and groundwater, with the proper outfall or runoff. Making sure that the water has a location to go, and it doesn’t get sucked into buildings is an essential part of keeping your property dry.

Alongside the drainage system that will prevent water ingress, if the rental is enclosed between your floor and ground, a ground water barrier should be put in place if it’s reasonably practicable to install it.

The ground-moisture barrier generally a polythene sheet laid over the ground to stop any moisture in the ground from rising into the home. It also helps prevent moisture damage to the underfloor insulation.
