Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for an Ebdentown rental property, all Healthy Homes compliance tasks need to be finished within 90 days.

The information contained in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is completed, and should be kept updated through the tenancy period as relevant work gets completed.

It is also crucial to be aware that a landlord with several rental properties can face even higher fines for non-compliance. The highest penalties are given only for serious breaches, and landlords with more than six properties could receive fines of up to $50,000, and as much as $100,000 for hearing claims.

Ebdentown Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is required in all Ebdentown and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate conformance with each Healthy Homes Standard that apply or will be applied throughout the tenancy period of their rental properties.

Starting 1 July 2021

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Ebdentown

Ebdentown rental properties must have a fixed source of heating that can heat the largest or main living space to a minimum of 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating needs that it be permanently fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and meet the minimum capacity for heating required for the main living space. In some instances, like apartments with small spaces an electric, fixed heater may be sufficient.

If the main living room already has a permanent heating source such as a heat pump, then it might just need a top up in order to comply with the standards. Some types of heaters can’t be utilised to meet the standard since they’re either inefficient, unaffordable to operate or unsafe to operate.
