Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for an Ebdentown rental property, all Healthy Homes compliance tasks have to be taken care of by the end of 90 days.

As of 1st July 2021, if a new, renewed or varied contract is signed on the Ebdentown rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to each of Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy agreement it could result in additional penalties or an infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or the property manager doesn’t supply the necessary information within 21 days from being informed of the request, they can receive an infringement notification and could be fined up to $750.

In addition, there is also a penalty up to $900 for property owners or property managers who have provided a false or misleading Healthy Homes Compliance Statement or other information. The person liable for this fine is the person who is named on the lease agreement as the person who is leasing the property out which could be the name of the landlord or the property management company.

All the information on the Compliance Statement needs to be current at the time that the tenancy agreement is executed, and it is updated throughout the duration of the tenancy when any associated work has been completed.

It is important to remember that landlords who have several rental properties can face more severe penalties for not complying. The most severe penalties are handed down for serious violations, and landlords who own six or more properties could be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.

It is clear that failure to comply with compliance with Healthy Homes requirements can hit your bank account resulting in huge fines, in addition to having to continue to comply. Unreasonable Gaps & Holes

Draught Stopping Ebdentown

Draughts may lead to low temperatures inside homes. A draughty home is more expensive to heat, which completed jobs in wasting energy and resulting in higher bills.

If a draught can be noticed from gaps that are not adequate or holes the area needs to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air entering or a clear draught out of a hole or gap, then it’s probably a gap or crack that needs sealing in some way. Cracks and gaps that are large should be fixed permanently. Gaps greater than 3mm that allow air in or out of the home need sealing. In the case of an open fireplace is not in use, it may cause draughts and should be blocked from. Landlords and property managers are accountable for ensuring that these draughts are stopped in the maximum extent imaginable.

You don’t require to block up intentional holes or gaps which are part of the building. For example, tiny gaps around windows and doors may be required to allow for movement within the structure as the household warms and cools in order to let them be closed and opened instead of than sticking. We will check all windows and doors as part of your Healthy Homes assessment of your rental property.

Heating Ebdentown

Ebdentown rental properties must have a fixed source of heating which can warm the main or largest living area to at minimum 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating needs to remain fixed (i.e., not portable) that is, at least 1.5 horsepower in capacity, and must meet the minimum capacity for heating required in the living area. A Heating Assessment Tool may be used to determine if the installed heater(s) are sufficient or if you’ll need to "top-up" with an additional heater. Unflued combustion and open fire heaters like portable LPG bottle heaters are not considered to be suitable heating options for the Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), then it must include the thermostat. This makes the heating more uniform and efficient. For most properties, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In certain situations, like small apartment buildings the smaller fixed electric heater may be sufficient.

If the living area is already equipped with a fixed heating source like an air conditioner, it might just need an upgrade to be able to meet the standards. Certain kinds of heaters aren’t able to be used to achieve the standard because they’re not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Ebdentown

Every living space of a rental property has to have at least one openable door or window to provide natural ventilation. Furthermore, moist areas such as kitchens and bathrooms must have a suitable externally vented extractor to remove moisture.

This ventilation quality is all about recognising how the dry atmosphere is less difficult to heat, and that a property that is well ventilated will be less prone to developing mould and damp.

Living rooms, bedrooms, dining rooms, and kitchens are considered to be liveable spaces. Spaces that connect, such as the hallway aren’t liveable and are not need an opening door or window.

Every window, door or skylight needs at least to open to the outside and remain set in an opening position in order to allow to circulate fresh air as well as ventilation.

The bathrooms in all kitchens and any other room in your home with shower, bath, cooktop or other high humidity-generating items will require suitable extractor fans that can be vented to the outside. Our Healthy Homes Assessment service will ensure that there is sufficient air circulation in every living space that includes extractor fans that are suitable for areas that are high in moisture.

Insulation Ebdentown

Ceiling and underfloor insulation is mandatory to all rental homes from 1 July 2019. All landlords and property managers must ensure that the insulation is in line with the new quality. In some cases, existing ceiling insulation or insulation in the sub floor space might need to be added or replaced.

A house that is well-insulated will reduce the risk of condensation, and decrease the risk of mould and damp, and will also make more easy to allow the house to retain the heat.

Insulation requirements to be in compliance with the R-values that are appropriate for your region.

The "R" stands for thermal resistance and it is a measurement of how well the insulation is able to resist heat flow. The greater the R-value, the higher the quality of insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – all area of North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 (underfloor R 1.3

Ebdentown Moisture Ingress & Drainage

Making sure your rental property is protected from moisture isn’t just about the inside but you must make sure there is somewhere for surface, rain or ground water and stop it from coming inside. When it is damp and moisture, it’s frequently the things you don’t notice that could be a huge problem and cause the property to suffer and harming your tenant’s health.

Rental properties need to have effective drainage to remove floodwaters, surface water and groundwater, with an appropriate runoff or outfall. Making sure that water has a location to go, and that it doesn’t sit beneath buildings is an essential part of keeping your property dry.

Alongside a drainage system to prevent moisture ingress, if your apartment has an enclosed gap between floorboards and the soil, a ground-water barrier must be constructed if it’s reasonably practicable to install it.

A ground moisture barrier is generally a sheet of polythene that is placed over the ground, in order to block any moisture in the ground from accumulating into the structure. It also assists in preventing water damage to the floor insulation.
