Fines for Failing to Comply
Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed on an Ebdentown rental property, all Healthy Homes compliance items must be completed within 90 days.
As of 1st July 2021, once a new or renewed lease is entered into on the Ebdentown rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.
Failure to adhere to each of Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not included within an updated, renewed, or amended tenancy agreement there could be an additional penalty or infringement fee.
Any tenant may request details about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager is unable to supply the required information within 21 days of being informed of the request, they can be issued an infringement notice and could be fined up to $750.
In addition, there’s also a fine of up to $900 for landlords and property managers providing a false or inaccurate Healthy Homes Compliance Statement or other information. The person responsible for this fine is the one who is listed on the tenancy agreement as the one who is letting the property out and it could be the name of the landlord, or the property management company.
All the information on the Compliance Statement requirements to be correct before the tenancy agreement can be signed. It must be updated through the tenancy period as necessary work related to it is finished.
It is important to be aware that a landlord who have several rental properties can face greater penalties for non-compliance. The most severe penalties are given for the most serious breaches, and landlords with more than six properties could be penalised up to $50,000, and as much as $100,000 in hearings.
