Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on an Ebdentown rental property, all Healthy Homes compliance items need to be done inside of 90 days.

The harshest penalties are handed down for the most serious violations, and landlords who own six or more properties can be fined as high as $50,000, or as high as $100,000 in hearings.

Ebdentown Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required throughout Ebdentown and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records that demonstrate the conformance to the Healthy Homes Standards that apply or will be applicable to an apartment rental.

From 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Adequate heaters are important to ensure healthy homes
