Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed for a Days Bay rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

As of 1st July 2021, when a brand new, renewed or varied Tenancy is signed for a Days Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to one of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included within a new, renewed or amended tenancy agreement there could be additional penalties or an infringement fee.

It’s crucial to remember that landlords who have multiple rental properties may receive additional fines for non-compliance. The harshest penalties are reserved for serious violations, and landlords who own more than six properties could be fined up to $50,000, or as high as $100,000 for hearing claims.

Days Bay Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory in all Days Bay and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records that demonstrate the compliance with all Healthy Homes Standard that apply or will apply throughout the tenancy period of the rental property.

From July 1st 2021

  • Property managers and private landlords have to ensure their rental properties conform with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Days Bay

Rental properties in Days Bay need to have a stable heating source that is able to heat the largest or main living space to at least 18degC, even during the coldest winter days. Insulation Days Bay

Insulation for underfloor and ceilings is a requirement to all rental houses as of July 1st, 2019. All landlords and property managers are required to ensure that the insulation is in line with this new quality.
