Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Days Bay rental property, all Healthy Homes compliance work have to be done inside of 90 days.

Since the 1st July of 2021, when a new, renewed or varied contract is signed on the Days Bay rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement, there may be an additional fine or violation fee.

Any tenant can ask for details about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager fails to supply the information requested within 21 days of getting the notice, the tenant can be issued an infringement notice and be fined as high as $750.

Additionally, there is also a penalty up to $900 for landlords or property managers that provide false or misleading Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is whoever is named on the tenancy contract as the person renting the property which could be the name of the landlord or the property management company.

It is important to remember that landlords with multiple rental properties may face greater penalties for non-compliance. The most severe penalties are handed down for the most serious violations, and landlords who own six or more properties can be penalised up to $50,000, and even as high as $100,000 in hearing claims.

Days Bay Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory to all Days Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to any Healthy Homes Standard that apply or will be in force to the rental property.

Starting 1 July 2021

  • Private landlords and property managers are required to ensure their rental properties comply to the Healthy Homes Standard within 90 days of a renewal, new or a change in tenant.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must meet the Healthy Homes Standards regardless of the time the tenancy began.

  • All homes let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.

For instance, if an open fireplace isn’t being used, it may cause draughts and should be blocked from. Property managers and landlords are accountable for making sure that such draughts are squelched in the maximum extent imaginable.

You don’t require to block up intentional holes or gaps in the building. Heating Days Bay

Rental properties in Days Bay require a reliable source of heat which can warm the main or largest living area to at minimum 18degC, even during the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs for it to be permanent (i.e., not portable) and at least 1.5 horsepower in capacity and have the minimum required heating capacity for the main living space. A Heating Assessment Tool could be used to determine whether the existing permanent heater(s) are adequate or if you’ll require to "top up" with an additional heater. Fires that are open and unflued heaters like portable LPG bottle heaters aren’t considered to be safe heating options in the Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump, it should include the thermostat. This will make the heating more reliable and effective. In most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In some instances, such as small apartments small apartments, a smaller electric fixed heater might be enough.

If the living area already has a central heating source, like a heat pump, then it might just require a top up to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the standard since they’re either not effective, cost prohibitive to operate or are unsafe to operate.

Ventilation Days Bay

Insulation Days Bay

Insulation for underfloor and ceilings is mandatory to all rental houses since 1 July 2019. All landlords and property managers are required to ensure that the insulation meets standards that are in line with the latest standard. In some cases, an existing insulation on the ceiling or in the subfloor space may require to be filled with or replaced.
