Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied contract is signed on a Crofton Downs rental property, all Healthy Homes compliance tasks have to be done within 90 days.

The person who is responsible to pay this fine is the one who is listed on the tenancy agreement as the person who is renting the property which could be the name of the landlord or the company that manages the property.

All the information on the Statement of Compliance needs to be current before the tenancy agreement can be completed, and should be kept updated throughout the tenancy as any related work is completed.

It is also important to note that a landlord with multiple rental properties may face even higher fines for non-compliance. The most severe penalties are handed down only for serious violations, and landlords who own more than six properties could be fined as high as $50,000, and as much as $100,000 in hearings.

Tenancies signed from 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement to all Crofton Downs and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records of their the compliance with all Healthy Homes Standard that apply or will be applied during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply according to Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.

Heating Crofton Downs

Crofton Downs rental properties need to have a stable heating source that can warm the living room to at least 18degC, even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs that it be permanently fixed (i.e. not portable) and at minimum 1.5 kW in heating capacity, and it must have the minimum requirement for heat capacity for the main living space. However, in certain instances like small apartments small apartments, a smaller electric fixed heater may suffice.

If the main living room already has a central heating source, like a heat pump, then it may need some additional energy to be able to meet the standards. Certain kinds of heaters cannot be utilised to meet the standard because they’re costly, not affordable to run, and/or unhealthy to run.
