Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on a Clouston Park rental property, all Healthy Homes compliance tasks must be taken care of within 90 days.

As of 1st July 2021, if a new or renewed contract is signed on a Clouston Park rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Inability to adhere to all of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager fails to supply the necessary information within 21 days from receiving the request, they may be issued an infringement notice and could be fined up to $750.

In addition, there’s an additional fine of approximately $900 for property owners or property managers that provide false or incorrect Healthy Homes Statement of Compliance or any other information. The person liable to pay this fine is the one who is named on the tenancy agreement as being the person letting the property out and it could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy agreement is completed, and is updated through the tenancy period as necessary work related to it is finished.

It is important to keep in mind that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are handed down for serious breaches. Landlords with six or more properties could be fined up to $50,000 and as high as $100,000 in hearing claims.

Clouston Park Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is compulsory to all Clouston Park and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate conformance with each Healthy Homes Standards that apply or will be applied throughout the tenancy period of the rental property.

From 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of a renewal, new or a change in tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All homes that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

Draughts are a major cause of lower temperatures in homes. A damp home costs more to heat, resulting in wasted money and energy.

What are the most unreasonable gaps or holes?

If you are able to feel external air getting in, or see a clear draught out of a hole or gap, then it’s most likely a gap or hole which needs sealing in somehow. Cracks or gaps with large gaps must be fixed permanently. Any gaps greater than 3mm that allow air in or out within the home require seals. Heating Clouston Park

Clouston Park rental properties need to have a stable source of heat that can heat the living space to a minimum of 18degC, even on the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source requirements to be fixed (i.e., not portable) that is, at least 1.5 kW of heating capacity, and it must have the minimum required heating capacity for the main living room. A Heating Assessment Tool can be used to determine whether the permanent heater(s) are adequate or if you’ll require to top up with a new heater. Open fires and unflued combustion heaters like portable LPG bottle heaters aren’t considered to be suitable heating options under the Healthy Homes Standard.

If the heating system you provide is an electric heater or heat pump, it should include a thermostat. This makes the heating more reliable and effective. For the majority of homes, bigger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in certain instances such as small apartments an electric, fixed heater may be sufficient.

If your main living space already has a fixed heating source, such as a heat pump, then it might just need an upgrade to make sure it meets the requirements. Insulation Clouston Park

Ceiling and underfloor insulation is a requirement on all rental homes from 1 July 2019. Property managers and landlords have to make sure that the insulation is in line with current standard.
