Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on a Clouston Park rental property, all Healthy Homes compliance tasks must be taken care of inside of 90 days.

The information contained in the Compliance Statement requirements to be up-to-date before the tenancy agreement can be completed, and should be kept updated through the tenancy period as relevant work gets completed.

It is also important to note that landlords who own multiple rental properties may face more severe penalties for not complying. The most severe penalties are given only for serious breaches, and landlords with more than six properties could be fined up to $50,000, and even as high as $100,000 in hearings.

Clouston Park Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory to all Clouston Park and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records of their compliance with each Healthy Homes Standard that apply or will apply during the tenure of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform in accordance with Healthy Homes Standards within 90 days of a new, renewed , or altered tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standards regardless of the time of the first day of tenancy.
