Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed on a Clouston Park rental property, all Healthy Homes compliance tasks must be done by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Clouston Park rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet one of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy contract, there may be an additional fine or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the building they are living in. If the the property manager doesn’t supply the required information within 21 days of being informed of the request, they could receive an infringement letter and be fined upto $750.

In addition, there’s also a fine of approximately $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the one who is listed on the tenancy contract as the person who is letting the property and it could be the name of the landlord as well as the property management company.

All the information on the Statement of Compliance needs to be current at the time that the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any necessary work related to it is finished.

It’s also important to be aware that landlords with multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down only for serious breaches, and landlords with six or more properties can be fined up to $50,000, or as high as $100,000 in the case of hearing claims.

Healthy homes matter

What are the reasons why Healthy Homes Compliance important?

One in three households rent from New Zealand and Clouston Park, and research suggests that rental homes are most likely to be colder, older, have less efficient heating, and generally tend to be of poorer quality than the houses of owners.

The damp, cold and mouldy houses are associated with negative well-being results, specifically for illnesses like colds, asthma, as well as heart diseases. In addition, people who report four or more major housing quality problems frequently have lower levels of satisfaction with life and a decrease in well-being.

The improvement in the quality of Clouston Park rental property will help tenants experience improved mental and physical health and minimise the disruptions to their work, education and living due to health issues. Your investment is also better safeguarded from mildew, mould and damp-related damage, which completed jobs in lower maintenance costs in the long run.

Unreasonable Gaps & Holes

Draught Stopping Clouston Park

Draughts increase the likelihood of dropping temperatures within households. A damp home costs more to heat, which means wasting energy and incurring higher costs.

If a draught is felt through gaps that are too large or holes the area requirements to be sealed.

What are unreasonable gaps and holes?

If you are able to feel external air getting in, or see the air is clear from a gap or hole or crack, then it is probably a gap or hole that needs sealing in any way. Cracks or gaps with large gaps must be stopped permanently. Gaps greater than 3mm that let air in or out from your house need to be sealed. For instance, if an open fireplace isn’t used it may cause draughts and should be sealed from. Property managers and landlords are accountable for making sure that these draughts are stopped as far as imaginable.

You don’t need to cover up gaps or holes that are part of the building. For instance, small gaps around doors and windows might be necessary to allow for the movement of the building when the home heats and cools, in order to let them be shut and opened, rather than sticking. We will test all doors and windows as part of the Healthy Homes assessment of your rental property.

Adequate heaters are important for well-being homes

Heating Clouston Park

Clouston Park rental properties should have a permanent heating source that can heat the living space to at least 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs for it to be permanent (i.e., not portable) that is, at least 1.5 horsepower in capacity and have the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool could be used to determine whether the existing installed heater(s) are adequate or whether you will require to ‘top up’ by adding a second heater. Open fires and unflued combustion heaters, such as mobile LPG bottle heaters are not considered to be suitable heating options for the Healthy Homes Standard.

If the heating you offer is electric heating or heat pump it should have an thermostat. This will help make your heating more consistent and effective. In most houses, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters are required. However, in some cases such as small apartments, a smaller fixed electric heater might be enough.

If the main living room already has a permanent heating source, like heat pumps, it could require an update to be able to meet the standards. Certain types of heaters cannot be used to comply with the standard as they are either costly, not cost-effective to run, or are unsafe to operate.

Ventilation Clouston Park

Every living space of the rental property should have at least one opening window or exterior door to provide natural airflow. In addition, humid spaces like kitchens and bathrooms should be equipped with an externally vented extractor fan to get rid of moisture.

It is the ventilation standard is all about understanding the fact that the dry atmosphere is less difficult to heat and a well ventilated rental property is less likely to grow mould and damp.

Bedrooms, living rooms, kitchens, and dining areas are considered to be liveable spaces. Connecting spaces such as the hallway are not considered liveable and therefore do not require an opening window or door.

Each door, window or the skylight requirements for them to be in a position to open to the outside while remaining closed, allowing to circulate fresh air as well as air flow.

All kitchens and bathrooms, and every other room of your house that houses shower, bath or cooktop, or any other humidity-generating items will need proper extractor fan systems that can be vented towards the outside. We offer a Healthy Homes Assessment service will ensure that there is sufficient ventilation in each livable space that includes extractor fans that are suitable in high moisture areas.

Insulation Clouston Park

Underfloor and ceiling insulation is mandatory for all rent houses since July 1, 2019. Property managers and landlords should make sure the insulation meets current standard. In some cases, an existing insulation on the ceiling or in the subfloor space might require to be replaced or replaced.

A house that is well-insulated will help to control condensation and lower the chance of mould and dampness as well as making more easy for the household to retain warmth.

Insulation requirements to be in compliance with the R-values of your area.

The "R" refers to thermal resistance and is a measure of how well the insulation is able to resist heat flow. The greater the R-value, the better the insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – the remainder part of North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3, underfloor R 1.3

Clouston Park Moisture Ingress & Drainage

Making sure your rental property is protected from moisture isn’t just about the interior of the building; you have to ensure there is somewhere for rain, surface or ground water and stop it from coming inside. When it is damp and moisture, it is often what you don’t see that can become a big problem and end up causing the property to suffer and harming the tenant’s health.

Rental properties should be equipped with efficient drainage to remove storm water, surface water, and ground water. This includes the proper outfall or runoff. Making sure that the water has a location to go, and that it can’t linger underneath the structures is a crucial aspect of keeping your property dry.

Alongside a drainage system to prevent the ingress of moisture, if your rental is enclosed between floorboards and the soil, a ground-water barrier should be put in place if it’s reasonably practicable to do so.

The ground-moisture barrier generally a polythene sheet laid over the ground, in order to block any moisture in the ground from getting into the property. It also helps in preventing from causing damage to the flooring insulation.
