Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Clouston Park rental property, all Healthy Homes compliance tasks need to be completed inside of 90 days.

As of 1st July 2021, when a brand new or renewed tenancy is signed on the Clouston Park rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement there could be an additional penalty or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they are related to the house they are living in. If the property manager does not provide the information requested within 21 days from receiving the request, they will receive an infringement letter and be fined as high as $750.

It’s also important to note that a landlord who have multiple rental properties could face additional fines for non-compliance. The harshest penalties are given for serious breaches, and landlords with more than six properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

When Do I require to be in compliance with requirements of the Healthy Homes Standards?

Clouston Park Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required throughout Clouston Park and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove compliance with each Healthy Homes Standard that apply or will be in force during the tenure of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed lease.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarder household tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Clouston Park

Rental properties in Clouston Park need to have a stable source of heating that can warm the largest or main living room to at least 18 degrees Celsius, even on the coldest days of the year.
