Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Clouston Park rental property, all Healthy Homes compliance items have to be done within 90 days.

Landlords with six or more properties can be fined as high as $50,000 and as high as $100,000 for hearing claims.

Tenancies commenced from 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is required for all Clouston Park and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records of their compliance with any Healthy Homes Standards that apply or will apply during the tenancy of your rental home.

Beginning 1 July 2021

  • Property managers and private landlords have to ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any new, renewed , or altered Tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
