Fines for Failing to Comply

Failure to adhere to one of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated within the new, renewed or revised tenancy agreement, there could be an additional penalty or infringement fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they are living in. If the property manager fails to supply the necessary information within 21 days of having received the inquiry, they could receive an infringement letter and be fined up to $750.
Furthermore, there’s an additional fine of approximately $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the one who is identified on the tenancy agreement as the one who is renting the property and it could be the name of the landlord or the company that manages the property.
All information in the Statement of Compliance requirements to be correct when the tenancy agreement is completed, and should be kept updated throughout the tenancy as any associated work has been completed.
It is also crucial to keep in mind that landlords with multiple rental properties may receive more severe penalties for not complying. The highest penalties are given for severe violations. Those who have six or more properties can receive fines of up to $50,000, or as high as $100,000 for hearing claims.
