Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed contract is signed on a Churton Park rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

From the 1st of July in 2021, when a new, renewed or varied Tenancy is signed for the Churton Park rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Inability to adhere to any of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement, it could result in additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager does not supply the required information within 21 days of having received the inquiry, they may receive an infringement letter and could be fined up to $750.

In addition, there is also a penalty of approximately $900 for property owners or property managers that provide false or misleading Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the person who is named on the lease agreement as the person who is who is letting the property It could also be the name of the landlord, or the property management company.

All information in the Statement of Compliance requirements to be correct when the tenancy contract is completed, and should be maintained through the tenancy period as relevant work gets completed.

It’s important to remember that a landlord who have multiple rental properties may receive additional fines for non-compliance. The most severe penalties are given for the most serious breaches. Landlords with six or more properties can be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory in all Churton Park and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.

Heating Churton Park

Churton Park rental properties should have a permanent heating source that is able to heat the principal or the biggest living space to a minimum of 18degC, even on the winter coldest days.
