Fines for Failing to Comply

From the 1st of July in 2021, when a new or renewed tenancy is signed for a Churton Park rental property, all Healthy Homes compliance tasks need to be done by the end of 90 days.

Since the 1st July of 2021, if a new or renewed lease is entered into on a Churton Park rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet each of Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy agreement, there may be an additional penalty or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the landlord or property manager fails to provide the required information within 21 days from getting the notice, the tenant can receive an infringement notice and could be fined up to $750.

Additionally, there is also a penalty approximately $900 for landlords or property managers providing a false or misleading Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is the one who is identified on the tenancy contract as the person renting the property and it could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement needs to be correct when the tenancy agreement is executed, and it should be kept updated through the tenancy period as necessary work related to it is finished.

It’s important to note that a landlord with multiple rental properties may face greater penalties for non-compliance. The highest penalties are reserved for serious violations, and landlords who own more than six properties could receive fines of up to $50,000, or as high as $100,000 in hearing claims.

When do I require to be in compliance with The Healthy Homes Standards?

Churton Park Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is required throughout Churton Park and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove conformance with each Healthy Homes Standards that apply or will be applied throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must make sure their rental properties comply in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed lease.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Rental properties in Churton Park require a reliable source of heat that is able to heat the largest or main living space to a minimum of 18degC, even on the coldest days of the year.
