Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed for a Churton Park rental property, all Healthy Homes compliance items need to be finished within 90 days.

From the 1st of July in 2021, when a new, renewed or varied Tenancy is signed for the Churton Park rental property, all Healthy Homes compliance work must be finished inside of 90 days.

The person responsible for this fine is whoever is named on the tenancy agreement as being the person renting the property and it could be the name of the landlord, or the company that manages the property.

All information in the Compliance Statement needs to be current when the tenancy contract is signed, and ideally it should be maintained during the entire tenancy, as relevant work gets completed.

It’s important to keep in mind that landlords who have multiple rental properties may face even higher fines for non-compliance. The harshest penalties are handed down for severe breaches, and landlords with more than six properties could be penalised up to $50,000, and as much as $100,000 in hearing claims.

Tenancies that were signed from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is required in all Churton Park and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with any Healthy Homes Standard that apply or will be in force during the tenancy of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Rental properties in Churton Park need to have a stable heating source which can warm the living space to a minimum of 18 degrees Celsius, even on the winter coldest days. If your living space is already equipped with a fixed heating source, such as an air conditioner, it could need an update in order to comply with the standards. Certain types of heaters cannot be used to meet the quality because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Churton Park

Every living space in a rental house must contain at minimum one open windows or an exterior door to offer natural airflow. In addition, high moisture areas like kitchens and bathrooms must have a suitable externally vented extractor fan to take moisture away.
