Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for a Camborne rental property, all Healthy Homes compliance tasks need to be taken care of by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for the Camborne rental property, all Healthy Homes compliance work must be done within 90 days.

In addition, there is also a penalty of up to $900 for landlords and property managers that provide false or incorrect Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is whoever is identified on the tenancy agreement as being the person who is letting the property which could be the landlord’s name or the property management company.

All the information on the Compliance Statement needs to be accurate before the tenancy agreement can be signed, and ideally it should be kept updated during the entire tenancy, as associated work has been completed.

It is also important to remember that landlords with several rental properties can face more severe penalties for not complying. The harshest penalties are given only for serious violations. Those who have six or more properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory in all Camborne and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with each Healthy Homes Standards that apply or will apply throughout the tenancy period of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers must make sure their rental properties conform to the Healthy Homes Standard within 90 days of a new, renewed or varied Tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.
