Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on a Camborne rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Since the 1st July of 2021, if a new, renewed or varied lease is entered into on the Camborne rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the period of time expected can lead to penalties of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t incorporated within an updated, renewed, or revised tenancy contract, there could be an additional fine or infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager fails to supply the information requested within 21 days from being informed of the request, they can receive an infringement notification and be fined upto $750.

Additionally, there is also a penalty of up to $900 for landlords and property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is liable to pay this fine is the one who is named on the lease agreement as the person who is leasing the property out and it could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be accurate when the tenancy agreement is signed. It should be kept updated during the entire tenancy, as related work is completed.

It is also crucial to be aware that a landlord with multiple rental properties could face greater penalties for non-compliance. The harshest penalties are given for serious violations, and landlords who own more than six properties could be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.

Camborne Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is required to all Camborne and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate compliance with each Healthy Homes Standards that apply or will be in force during the tenancy of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a newly renewed, extended or changed tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Heating Camborne

Camborne rental properties must have a fixed heating source which can warm the largest or main living space to at least 18degC, even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating requirements to remain fixed (i.e. not portable), at minimum 1.5 Kilowatts in heating capacity, and meet the minimum required heating capacity for the main living room. For most houses, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in certain instances like small apartment buildings, a smaller fixed electric heater may suffice.

If your living space is already equipped with a fixed heating source like heat pumps, it may need a top up to ensure it meets the requirements. Some types of heaters can’t be used to meet the standard as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Camborne

Each liveable space in a rental house must contain at minimum one open door or window to offer natural ventilation. In addition, high moisture areas such as kitchens or bathrooms must have a suitable venting fan outside to take moisture away.
