Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied contract is signed on a Camborne rental property, all Healthy Homes compliance work have to be taken care of within 90 days.

The most severe penalties are handed down only for serious breaches, and landlords with six or more properties can be penalised up to $50,000, or as high as $100,000 in the case of hearing claims.

Tenancies signed from 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is mandatory to all Camborne and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with any Healthy Homes Standard that apply or will be in force during the tenure of the rental property.

From 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any new, renewed , or altered tenant.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.
