Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Breaker Bay rental property, all Healthy Homes compliance work must be taken care of within 90 days.

As of 1st July 2021, if a new, renewed or varied tenancy is signed on the Breaker Bay rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to adhere to all of the Healthy Homes Standards by the end of the expected timeframe can result in an amount of $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the property they are living in. If the property manager does not provide the information requested within 21 days of receiving the request, they could receive an infringement notification and could be fined up to $750.

In addition, there’s also a penalty as much as $900 for property owners or property managers who provide a false or misleading Healthy Homes Compliance Statement or any other information. The person responsible for this fine is the one who is named on the lease agreement as the one who is letting the property out It could also be the landlord’s name or the company that manages the property.

It is important to note that a landlord with multiple rental properties may receive additional fines for non-compliance. The most severe penalties are handed down for serious violations, and landlords who own at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

Tenancies signed from 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement throughout Breaker Bay and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to each Healthy Homes Standard that apply or will be applied during the tenancy of your rental home.

From July 1st 2021

  • Private landlords and property managers must ensure their rental properties comply to the Healthy Homes Standards within 90 days of any new, renewed , or altered lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must adhere to the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Draughts may lead to lower temperatures in homes. A cold home costs more to heat, meaning wasting energy and increased bills.

If a draught can be noticed from gaps that are not adequate or holes that it requirements to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or an unobstructed draught coming out of a hole or gap or crack, then it is most likely a gap or an opening that requirements sealing in any way. Cracks and gaps that are large should be sealed permanently. Any gaps greater than 3mm that let air in or out from the home need to be sealed. For instance, if an open fireplace is not in use, it can create draughts. This should be blocked from. Rental properties in Breaker Bay should have a permanent source of heat that is able to heat the principal or the biggest living room to at least 18degC even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating needs to be fixed (i.e. not portable) that is, at minimum 1.5 kW of heating capacity, and must meet the minimum heating capacity needed for the main living room. A Heating Assessment Tool could be used to check if your current installed heater(s) are sufficient or if you’ll require to ‘top up’ with an additional heater. If the heating system you provide is electric heating or heat pump it needs to be equipped with the thermostat. This will make the heating more uniform and efficient. For the majority of houses, bigger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. In some instances, like small apartment buildings the smaller fixed electric heater could be enough.

If your main living space already has a permanent heating source, such as a heat pump, then it may require an update to be able to meet the standards. Some types of heaters can’t be used to meet the standard as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Breaker Bay

Insulation Breaker Bay

Insulation for underfloor and ceilings is mandatory on all rental homes from 1 July 2019. Property managers and landlords should make sure that the insulation meets current standard. In certain situations, the an existing insulation on the ceiling or in the sub floor space may require to be replaced or replaced.
