Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed contract is signed on a Breaker Bay rental property, all Healthy Homes compliance items have to be completed inside of 90 days.

From the 1st of July in 2021, once a new, renewed or varied Tenancy is signed for the Breaker Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards by the end of the anticipated timeframe could result in penalties of up to $7200. Additionally, if a existing Healthy Homes Statement of Compliance is not included in the renewal, new or amended tenancy agreement there could be an additional penalty or infringement fee.

All information in the Compliance Statement requirements to be correct when the tenancy agreement is signed, and ideally it should be kept updated throughout the duration of the tenancy when any necessary work related to it’s finished.

It is also crucial to be aware that a landlord who manage multiple rental properties may receive additional fines for non-compliance. The harshest penalties are given for the most serious breaches. Landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 for hearing claims.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory throughout Breaker Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to the Healthy Homes Standards that apply or will be applied throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Property managers and private landlords have to make sure their rental properties conform with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All homes that are rented out through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Heating Breaker Bay

Breaker Bay rental properties require a reliable source of heating that can warm the principal or the biggest living space to at least 18degC, even on the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements for it to be permanent (i.e., not portable) and at minimum 1.5 kW of heating capacity and have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool may be used to determine whether the fix heater(s) are adequate or whether you will need to "top-up" with a new heater. Fires that are open and unflued heaters, such as portable LPG bottle heaters are not considered to be acceptable heating options for The Healthy Homes Standard.

If the heating that you provide is an electric heater (or heat pump), it must have the thermostat. This makes the heating more consistent and effective. For most houses, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in certain instances such as small apartments the smaller fixed electric heater may be sufficient.

If your main living space already has a central heating source such as heat pumps, it might require a top up in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the standard as they are either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Breaker Bay

All landlords and property managers should make sure that the insulation is in line with the new quality.
