Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

When do I require to be in compliance with The Healthy Homes Standards?

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is a requirement for all Breaker Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate the conformance to each Healthy Homes Standard that apply or will be applied to an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords must ensure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a renewal, new or a change in Tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All homes rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental houses have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

Draughts are a major cause of less temperature in houses. A draughty home is more expensive to heat, meaning wasting energy and incurring higher costs.

If a draught can be noticed from gaps that are not adequate or holes or holes, it needs to be sealed.

Heating Breaker Bay

Breaker Bay rental properties need to have a stable heating source that can heat the principal or the biggest living room to at least 18degC even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

If your main living space is already equipped with a fixed heating source such as an air conditioner, it might just require a top up to make sure it meets the requirements. Certain types of heaters cannot be used to meet the standard because they’re not effective, cost prohibitive to operate or unsafe to operate.

Insulation for underfloor and ceilings is a requirement to all rental houses since July 1, 2019. All landlords and property managers must ensure that the insulation is up to this new standard.
