Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance work need to be taken care of by the end of 90 days.

Since the 1st July of 2021, when a brand new or renewed lease is entered into on a Breaker Bay rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet any of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance isn’t included in a new, renewed or amended tenancy agreement there could be an additional fine or violation fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the property they live in. If the property manager does not supply the necessary information within 21 days from having received the inquiry, they will receive an infringement letter and could be fined up to $750.

Furthermore, there’s also a penalty as much as $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is whoever is named on the lease agreement as the person who is who is letting the property which could be the name of the landlord as well as the property management company.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory for all Breaker Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate conformance with any Healthy Homes Standard that apply or will apply during the tenancy of the rental property.

From July 1st 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All households rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

What are the most unreasonable gaps or holes?

If you can feel external air entering or a clear draught from a hole or gap, then it is likely a crack or hole that needs sealing in some way. Cracks or gaps with large gaps must be fixed permanently. Cracks that are greater than 3mm and allow air in or out of the house need sealing. In the case of an open fireplace isn’t in use it could cause draughts, and should be blocked off. Property managers and landlords are responsible for making sure such draughts are eliminated in the maximum extent imaginable.

There is no need to block up intentional gaps or holes in the building. For instance, small gaps around windows and doors may be required to allow for movement within the structure as the home heats and cools, so that they can still be closed and opened rather than securing. Heating Breaker Bay

Breaker Bay rental properties must have a fixed source of heating which can warm the principal or the biggest living space to at least 18degC even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements that it be permanently fixed (i.e. not portable) that is, at minimum 1.5 kW of heating capacity and have the minimum requirement for heat capacity in the living area. A Heating Assessment Tool could be used to determine whether the current installed heater(s) are sufficient or if you’ll require to "top-up" by adding a second heater. If the heating that you offer is electric heating or heat pump, it must be equipped with a thermostat. This will make your heating more consistent and effective. For most properties, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in certain instances like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

If your living space already has a permanent heating source such as an air conditioner, it may need an update in order to comply with the standards. Certain kinds of heaters aren’t able to be used to achieve the quality because they’re inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Breaker Bay
