Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.

As of 1st July 2021, when a brand new or renewed tenancy is signed on the Breaker Bay rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to comply with each of Healthy Homes Standards within the anticipated timeframe could result in a fine of up to $7200. In addition, if the current Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

The person responsible to pay this fine is the one who is named on the lease contract as the person letting the property out, so it could be the landlord’s name or the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any relevant work gets completed.

It is also important to remember that landlords who have multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are reserved only for serious violations. Those who have more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is required for all Breaker Bay and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their the conformance to all Healthy Homes Standards that apply or will be in force throughout the tenancy period of your rental home.

Starting 1 July 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any new, renewed or varied Tenancy.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All houses that are rented out to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts can lead to low temperatures inside houses. A cold house will cost more to heat, resulting in wasted energy and resulting in higher bills.
