Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied lease is entered into on a Breaker Bay rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet all of the Healthy Homes Standards inside of the anticipated timeframe could result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or revised tenancy contract, there may be an additional fine or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the home they live in. If the property manager does not supply the necessary information within 21 days of being informed of the request, they may receive an infringement notification and be fined up to $750.

Furthermore, there’s an additional fine of up to $900 for landlords or property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the person who is identified on the tenancy contract as the person renting the property and it could be the landlord’s name or the property management company.

All information in the Compliance Statement requirements to be up-to-date when the tenancy contract is signed. It should be maintained during the entire tenancy, as associated work has been completed.

It’s important to be aware that landlords who have multiple rental properties could face additional fines for non-compliance. The highest penalties are handed down for severe breaches. Landlords with six or more properties can be fined as high as $50,000, or as high as $100,000 for hearing claims.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement for all Breaker Bay and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to the Healthy Homes Standard that apply or will be applied throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Adequate heaters are crucial for well-being homes

Heating Breaker Bay

Rental properties in Breaker Bay should have a permanent heating source that is able to heat the largest or main living room to at least 18degC even on the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating requirements for it to be permanent (i.e., not portable) and at minimum 1.5 kW in heating capacity, and it must have the minimum heating capacity needed in the living area. A Heating Assessment Tool can be used to determine if the existing permanent heater(s) are adequate or whether you will require to "top-up" with a new heater. Open fires and unflued combustion heaters like mobile LPG bottle heaters aren’t considered to be acceptable heating options for the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump, it should include the thermostat. This will make your heating more consistent and efficient. In most houses, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are necessary. However, in certain instances like small apartment buildings an electric, fixed heater may suffice.

If the living area is already equipped with a fixed heating source, such as heat pumps, it could need an update in order to comply with the standards. Certain types of heaters cannot be used to meet the quality because they’re expensive, inefficient and/or unsafe to run.

Ventilation Breaker Bay

Every living space in a rental home must have at least one openable door or window to provide natural airflow. Additionally, areas with high moisture areas such as kitchens or bathrooms need to have an externally vented extractor fan to remove moisture.

A ventilation standard is all about recognising that dry air is much easier to heat and heat, and a well ventilated rental property is less likely to be a victim of damp and mould.

Insulation Breaker Bay

Underfloor and ceiling insulation is required for all rent houses from 1 July 2019. Property managers and landlords must make sure that the insulation is up to standards that are in line with the latest standard. In some instances, current ceiling insulation, or the insulation of the subfloor space may require to be filled with or replaced.
