Did you know that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords must ensure that their Breaker Bay rental properties meet the minimum Healthy Homes Standards within 90 days of a renewed or new tenancy and all private rentals are required to be completely compliant by 1 July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Breaker Bay rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

Since the 1st July of 2021, once a new or renewed Tenancy is signed for the Breaker Bay rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with all of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy agreement it could result in additional penalties or an infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or the property manager doesn’t supply the information requested within 21 days of being informed of the request, they may be issued an infringement notice and could be fined up to $750.

In addition, there is also a penalty of approximately $900 for landlords and property managers that provide false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the one who is named on the lease contract as the person who is letting the property which could be the landlord’s name or the property management company.

All information in the Statement of Compliance needs to be up-to-date when the tenancy agreement is executed, and it is updated during the entire tenancy, as associated work has been completed.

It is also important to note that landlords who have multiple rental properties may face more severe penalties for not complying. The most severe penalties are given only for serious breaches, and landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearings.

When Do I need to meet The Healthy Homes Standards?

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is a requirement for all Breaker Bay and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records of their conformance with any Healthy Homes Standards that apply or will be applied to their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

A good heating system is important for healthy houses

Heating Breaker Bay

Breaker Bay rental properties should have a permanent heating source that can heat the largest or main living area to at minimum 18degC, even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heating needs to remain fixed (i.e. not portable) and at least 1.5 kW in heating capacity and have the minimum required heating capacity to heat the living space in general. A Heating Assessment Tool could be used to determine if the fix heater(s) are adequate or if you’ll require to top up with an additional heater. Fires that are open and unflued heaters like mobile LPG bottle heaters aren’t considered acceptable heating options in Healthy Homes Standard. Healthy Homes Standard.

If the heating you offer is electric heating or heat source, it should be equipped with a thermostat. This will help make the heating more uniform and effective. For the majority of houses, bigger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In certain situations, such as small apartments the smaller fixed electric heater may be sufficient.

If your main living space is already equipped with a fixed heating source, such as heat pumps, it might need an upgrade to meet the standards. Some types of heaters can’t be utilised to meet the standard as they are either costly, not affordable to run, or unsafe to operate.

Ventilation Breaker Bay
