Did you not know that Healthy Homes Standards came into effect on the 1st of July 2021? Landlords are now required to ensure their Breaker Bay rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rentals are required to be completely conforming by the 1st July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance items must be completed within 90 days.

As of 1st July 2021, once a new or renewed Tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy contract, there could be an additional fine or infringement fee.

It is important to note that a landlord who manage multiple rental properties could face greater penalties for non-compliance. The most severe penalties are handed down for serious violations. When will I need to be in compliance with requirements of the Healthy Homes Standards?

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement to all Breaker Bay and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that prove the compliance with each Healthy Homes Standards that apply or will be applicable to their rental properties.

Starting 1 July 2021

  • Private landlords and property managers have to ensure their rental properties conform to the Healthy Homes Standards within 90 days of a new, renewed or varied lease.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households let through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts are a major cause of dropping temperatures within homes. A cold house will cost more to heat, which means wasting energy and resulting in higher bills.

If a draft can be perceived as a result of gaps or holes or holes, it needs to be closed.

Heating Breaker Bay

Rental properties in Breaker Bay require a reliable source of heat that is able to heat the main or largest living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs for it to be permanent (i.e. not portable), at minimum 1.5 kW in heating capacity and have the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool can be used to check if the fix heater(s) are adequate or if you’ll need to "top-up" by adding a second heater. If the heating you offer is electric heating or heat source, it must be equipped with a thermostat. This will make the heating more reliable and effective. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. In certain situations, like small apartments small apartments, a smaller electric fixed heater may suffice.

If your living space already has a permanent heating source such as an air conditioner, it could require some additional energy in order to comply with the standards. Certain types of heaters cannot be utilised to meet the standard because they’re inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Breaker Bay

Underfloor and ceiling insulation is mandatory in all rental homes since July 1, 2019. Property managers and landlords must ensure the insulation meets current quality. In certain situations, the current ceiling insulation, or the insulation of the subfloor space might need to be filled with or replaced.
