Did you be aware that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords now have to ensure that their Breaker Bay rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rental properties are required to be fully compliant by 1 July 2024.

Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Breaker Bay rental property, all Healthy Homes compliance work need to be done inside of 90 days.

From the 1st of July in 2021, if a new or renewed Tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy agreement there may be additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the property they are living in. If the property manager fails to provide the required information within 21 days from being informed of the request, they could receive an infringement notification and could be fined up to $750.

In addition, there’s also a penalty of approximately $900 for landlords or property managers who offer a false or false Healthy Homes Statement of Compliance or other information. The person liable for this fine is the one who is named on the tenancy contract as the person who is letting the property, so it could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement requirements to be up-to-date at the time that the tenancy agreement is completed, and is updated through the tenancy period as necessary work related to it is finished.

It’s important to note that landlords with multiple rental properties could face even higher fines for non-compliance. The harshest penalties are reserved for serious breaches. Landlords with six or more properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

When do I need to be in compliance with the Healthy Homes Standards?

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory for all Breaker Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their the conformance to the Healthy Homes Standards that apply or will be in force during the tenure of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Breaker Bay

Breaker Bay rental properties must have a fixed source of heating that can warm the main or largest living area to at minimum 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source requirements to be fixed (i.e., not portable), at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity for the main living space. A Heating Assessment Tool could be used to determine if the current permanent heater(s) are adequate or whether you will need to ‘top up’ with a new heater. Open fires and unflued combustion heaters such as small portable LPG bottle heaters are not considered acceptable heating options for those following the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump, it needs to have a thermostat. This will make your heating more consistent and effective. In most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. In certain situations, like small apartment buildings an electric, fixed heater may be sufficient.

If the main living room already has a central heating source, like a heat pump, then it might just need a top up to be able to meet the standards. Some types of heaters can’t be used to achieve the quality as they are either not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Breaker Bay

Each door, window or skylight needs at least to open to the outside, and stay at an open angle to allow ventilation and fresh air air flow.

Bathrooms, kitchens, and any other area in your home with shower, bath cooker or any other moisture generating item will need suitable extractor fans that are vented towards the outside. Insulation Breaker Bay

Underfloor and ceiling insulation is a requirement in all rental houses from 1 July 2019. All landlords and property managers are required to ensure that the insulation is in line with current standard. In some cases, old ceiling insulation as well as insulation within the subfloor space might need to be filled with or replaced.
