Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance tasks must be done by the end of 90 days.

As of 1st July 2021, if a new or renewed contract is signed on the Breaker Bay rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy agreement, there may be an additional fine or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the building they are living in. If the property manager does not provide the necessary information within 21 days from being informed of the request, they could receive an infringement notice and could be fined up to $750.

Furthermore, there’s an additional fine of approximately $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person liable for this fine is the person who is named on the lease agreement as the one who is leasing the property out which could be the name of the landlord, or the property management company.

All the information on the Compliance Statement needs to be accurate when the tenancy contract is completed, and should be maintained throughout the duration of the tenancy when any related work is completed.

It is also crucial to remember that a landlord with multiple rental properties could face greater penalties for non-compliance. The highest penalties are handed down only for serious breaches. Landlords with at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is required throughout Breaker Bay and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with any Healthy Homes Standards that apply or will be in force to your rental home.

From 1 July 2021

  • Property managers and private landlords have to make sure their rental properties comply with the Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.

Heating Breaker Bay

Rental properties in Breaker Bay must have a fixed source of heating which can warm the largest or main living space to at least 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat needs for it to be permanent (i.e., not portable) and at least 1.5 Kilowatts in heating capacity, and it must have the minimum heating capacity needed to heat the living space in general. If the living area already has a central heating source, such as the heat pump, it might just need an upgrade to ensure it meets the requirements. Some types of heaters can’t be utilised to meet the standard as they are either expensive, inefficient and/or unhealthy to run.

Ventilation Breaker Bay

Underfloor and ceiling insulation is a requirement for all rent homes from 1 July 2019. All landlords and property managers must ensure the insulation meets standards that are in line with the latest standard.
