Fines for Failing to Comply

Beginning on July 1st, 2021, when a new or renewed tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance work must be finished by the end of 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied Tenancy is signed for a Breaker Bay rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to each of Healthy Homes Standards within the deadlines can result in penalties of up to $7200. The person who is liable to pay this fine is the one who is listed on the tenancy agreement as the person who is leasing the property out which could be the landlord’s name or the company that manages the property.

All information in the Statement of Compliance needs to be correct at the time that the tenancy agreement is signed. It must be updated throughout the tenancy as any related work is completed.

It is also crucial to keep in mind that a landlord with several rental properties can face additional fines for non-compliance. The most severe penalties are reserved for serious violations, and landlords who own six or more properties can be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory in all Breaker Bay and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included with any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate compliance with any Healthy Homes Standards that apply or will be in force during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers should make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.

  • All homes which are rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Breaker Bay

Breaker Bay rental properties require a reliable heating source that can heat the largest or main living area to at minimum 18degC even on the winter coldest days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs for it to be permanent (i.e., not portable) and at minimum 1.5 horsepower in capacity, and it must have the minimum heating capacity needed for the main living space. The Heating Assessment Tool can be used to determine whether the existing permanent heater(s) are adequate or if you’ll need to top up with a new heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters aren’t considered to be acceptable heating options for those following the Healthy Homes Standard.

If the heating you provide is electric heating or heat source, it needs to be equipped with an thermostat. This will make the heating more consistent and efficient. In most houses, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. In some instances, like apartments with small spaces the smaller fixed electric heater may be sufficient.

If your main living space already has a fixed heating source, such as heat pumps, it might just need a top up to ensure it meets the requirements. Certain kinds of heaters cannot be used to comply with the quality as they are either not effective, cost prohibitive to operate or unsafe to operate.

Ventilation Breaker Bay

Insulation Breaker Bay

Insulation for underfloor and ceilings is a requirement to all rental homes since 1 July 2019. Property managers and landlords are required to ensure that the insulation is up to this new standard.
