Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance items must be completed within 90 days.

Since the 1st July of 2021, if a new, renewed or varied contract is signed on the Breaker Bay rental property, all Healthy Homes compliance work must be finished within 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy agreement there could be an additional penalty or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they are related to the house they live in. If the the property manager doesn’t provide the information requested within 21 days of getting the notice, the tenant can receive an infringement notification and could be fined up to $750.

In addition, there’s an additional fine of up to $900 for landlords or property managers that provide false or misleading Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the person who is listed on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement needs to be current before the tenancy agreement can be executed, and it must be updated during the entire tenancy, as relevant work gets completed.

It is important to keep in mind that landlords who have several rental properties can face even higher fines for non-compliance. The most severe penalties are given for serious violations, and landlords who own six or more properties could be fined up to $50,000, or as high as $100,000 in hearing claims.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory throughout Breaker Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.

  • All rental houses are required to comply with Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Heating Breaker Bay

Breaker Bay rental properties require a reliable source of heat which can warm the living area to at minimum 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

If your living space is already equipped with a fixed heating source, like a heat pump, then it may require some additional energy in order to comply with the standards. Certain kinds of heaters cannot be used to meet the quality since they’re either expensive, inefficient or unsafe to operate.

Ventilation Breaker Bay

Insulation Breaker Bay

Underfloor and ceiling insulation is a requirement on all rental houses from 1 July 2019. All landlords and property managers have to ensure the insulation meets this new quality. In some instances, existing ceiling insulation or insulation in the sub floor space may need to be topped up or replaced.

A well-insulated property can help control condensation and reduce the chances of mould and damp, and also makes it easier to allow the household to hold the heat.
