Did you know that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords now have to make sure that their Breaker Bay rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rental properties are required to be completely conforming by the 1st July 2024.

Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on a Breaker Bay rental property, all Healthy Homes compliance tasks must be done by the end of 90 days.

Since the 1st July of 2021, when a new or renewed contract is signed on a Breaker Bay rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet each of Healthy Homes Standards inside of the period of time expected can lead to an amount of $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy agreement there could be an additional penalty or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or the property manager doesn’t provide the information requested within 21 days from receiving the request, they may be issued an infringement notice and be fined up to $750.

The person responsible for this fine is whoever is listed on the tenancy contract as the person renting the property It could also be the landlord’s name or the property management company.

Breaker Bay Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is required for all Breaker Bay and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records of their conformance with each Healthy Homes Standards that apply or will be applied during the tenancy of their rental properties.

From July 1st 2021

  • Property managers and private landlords must ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draughts are a major cause of less temperature in houses. A cold home will cost more to heat, which results in wasting energy and increased bills.

Heating Breaker Bay

Breaker Bay rental properties must have a fixed source of heating which can warm the main or largest living space to a minimum of 18degC even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat needs for it to be permanent (i.e., not portable) that is, at least 1.5 Kilowatts in heating capacity and have the minimum capacity for heating required in the living area. A Heating Assessment Tool may be used to determine if the existing installed heater(s) are sufficient or whether you will require to ‘top up’ by adding a second heater. Open fires and unflued combustion heaters such as mobile LPG bottle heaters aren’t considered to be safe heating options in the Healthy Homes Standard.

If the heating you provide is electric heating or heat pump it needs to include an thermostat. This will make the heating more consistent and efficient. For most properties, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are required. In certain situations, like small apartments small apartments, a smaller electric fixed heater may suffice.

If your main living space already has a fixed heating source, like an air conditioner, it might just require an upgrade to ensure it meets the requirements. Certain kinds of heaters cannot be used to meet the quality as they are either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Breaker Bay

Insulation Breaker Bay

The insulation of the ceiling and underfloor is mandatory on all rental homes since 1 July 2019. Property managers and landlords have to make sure that the insulation meets standards that are in line with the latest quality.
