Fines for Failing to Comply
Beginning on July 1st, 2021, if a new, renewed or varied tenancy is signed on a Birchville rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.
From the 1st of July in 2021, when a brand new or renewed Tenancy is signed for the Birchville rental property, all Healthy Homes compliance work must be done by the end of 90 days.
Inability to adhere to any of the Healthy Homes Standards inside of the expected timeframe can result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included in the new, renewed or amended tenancy agreement there could be an additional fine or infringement fee.
Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager is unable to provide the information requested within 21 days from being informed of the request, they can receive an infringement notification and be fined upto $750.
In addition, there’s also a penalty approximately $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. The person who is liable for this fine is whoever is identified on the tenancy agreement as the one who is leasing the property out which could be the name of the landlord or the property management company.
The information contained in the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed. It should be kept updated through the tenancy period as associated work has been completed.
It is also crucial to note that landlords with multiple rental properties may face even higher fines for non-compliance. The harshest penalties are reserved only for serious breaches, and landlords with six or more properties can be fined up to $50,000 and as high as $100,000 in hearings.
