Fines for Failing to Comply
Since the 1st July of 2021, if a new or renewed tenancy is signed on a Berhampore rental property, all Healthy Homes compliance items need to be taken care of by the end of 90 days.
Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on the Berhampore rental property, all Healthy Homes compliance work must be completed within 90 days.
Failure to meet each of Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy contract, there may be additional penalties or an infringement fee.
Any tenant can ask for details about the Healthy Homes Standard and how they are related to the house they are living in. If the property manager fails to supply the required information within 21 days of receiving the request, they can receive an infringement notification and could be fined up to $750.
Additionally, there is an additional fine of up to $900 for property owners or property managers who have provided a false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is whoever is named on the tenancy agreement as the one who is who is letting the property which could be the landlord’s name or the company that manages the property.
The information contained in the Compliance Statement needs to be correct when the tenancy agreement is signed, and ideally it must be updated during the entire tenancy, as associated work has been completed.
It is important to note that a landlord who manage multiple rental properties could face greater penalties for non-compliance. The most severe penalties are handed down for serious breaches. Landlords with six or more properties can be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.
